K-1 Fiance(e) Visa Process & ProceduresAffadavit of Support
Hello! We have our interview at the Vancouver, BC consulate in a few weeks. I am sponsoring my fiance to come to the US but have been living here in Canada for almost a year. I am about to move back to the US, a few weeks before he goes to the interview. I have no income because I will be just arriving in the States. My fiance does not have a job lined up in the US but has savings that will support us for several months after we move. I have a cosponsor (my parents) and am curious if the number of people that their income needs to support includes myself (since I am not working). Would the household size be 3 (my fiance, my mom, my stepdad), or 4 (myself, my fiance, my mom, my stepdad)? I am confused...my mom is just barely over the 125% for 3 people...really hoping I am not included in this! Anyone have any advice for the interview?

The directions on the I-134 said that for self-employed people you just need to include the last tax return...ahhh I'm so sick of all this conflicting information!

Thanks! I am worried to include more than one tax return because the amount is not over the required amount in the previous years. How much money is expected to be in the bank account when you show this?

Anyone?? Could really use some help! Do I need to find a second cosponsor who makes more than a tiny bit over the 125% limit?

K-1 Fiance(e) Visa Process & ProceduresWorried about Interview
Hello! Thanks in advance for reading this, and for all the help I've gotten on here..it really helps. I am very worried about my fiance's interview at the Vancouver, BC embassy. It is in about a month...I think we have all our bases covered, but I have no idea what to expect. I have been living here in Canada for the past year but I am moving back to Oregon next week. I will be staying with a friend and looking for our own place before the interview date, so I will either have a letter from the friend stating that we will be staying with her, the cost of rent etc, or I will have both of our names on a lease. I will most likely be attending school and receiving financial aid for tuition and living expenses...if I'm lucky I can find some kind of job and get a letter stating this before the interview. I have a cosponsor who is just barely over the 125% line for 3 people (herself, husband, and my fiance). Do I need to include my finances and tax returns when I have a cosponsor? I am getting some conflicting info about it. I have not been making much/any money the past few years, I was a full time student and received food stamps and unemployment the last couple years I was in Oregon. I worked a bit here in Canada but then my work permit renewal was denied. So basically, I have been on food stamps in the past, have made basically no money, and am just moving back to Oregon. The way I understand it is that I just need to prove domicile in Oregon (letter from friend or lease, plus either school registration or job letter) and then have a cosponsor since I don't make anything. My fiance has a good amount of savings to support both of us until we are settled and he can work. His parents will also write a letter saying they will help. Could they deny us due to me not being able to support him? I thought that the cosponsor took care of this problem. THANKS!

Oh, forgot to mention..my cosponsor sent me the I-134 and 2010 tax return (she is self-employed). Is this sufficient?

Um no they are not combined at all..both make over the amount required. I got 2 just to be safe.

What I really need to know is what I need from the cosponsor..everywhere I look it says something different.

K-1 Fiance(e) Visa Process & ProceduresCosponsor Questions
Hello! I am so confused about what I need to ask for from my cosponsors. I have two family cosponsor's and they have both sent me 1) Original signed I-134 2)Previous 3 years tax returns (copies) 3) One of them has sent a bank statement. Do the I-134's need to be notarized? Do they need to send employer letters (one if self-employed), W2's, or anything else?? The directions on the I-134 just say to fill out the form and send the previous year's tax return. Everywhere I look, there seems to be another thing that is required. The interview is next week, I really want to make sure I have everything I need since I have no income and will def. need the cosponsors! Thanks for your help!! Also, does anyone know if I can physically be with my fiance at the time of his point of entry into the US? This is sooo confusing, last time I went through the border the guy said I might have to physically be in the US already when he comes down.

K-1 Fiance(e) Visa Process & ProceduresVisiting the US while awaiting NOA2 arrival

Well....you have no sympathy from me....sorry. My wife couldn't leave and maybe wouldn't have been granted a visa anyway and we had already decided that I should save the money and vacation time for when they came here......so we Skyped every day and made the best of it. It was a litle over 9 months between when we last met and when se came through the doors at POE.

Waiting three more months is not a big deal. VWP is probably your best bet but just be prepared if he is denied. That will not affect anything with the K-1.

I wasn't looking for sympathy, I was looking for people's experiences with this.

It's sad you haven't been able to physically see your fiancee .... I just keep this in mind and feel lucky that I've been able to be with mine for the last year and a half :)

Thanks for all the POSITIVE feedback from everyone!

K-1 Fiance(e) Visa Process & ProceduresVisiting the US while awaiting NOA2 arrival
Hi everyone!

Thank you all so much for the help you've given us since we joined the site. It's helped us tremendously.

Since you're all so rad, here's another question:

What would you do in our situation? Knowing that we will be waiting another 3 months in all likelihood for Paul's interview in London, we were wanting to travel back to the US for the holidays and to start preparing wedding details. I've done all the research into VWP vs. B2, and all the signs seem to give it the A-OK

Here's the rub!

All sources stressed the fact that Paul would need to prove to the Officer upon arrival that he has no intention of overstaying his visa, and plans to return to London. This would be fine, except, Paul sold his house and left his job over two years ago to travel the world (which is lucky for me, otherwise we wouldn't have met ;) ). He can not prove ties by employment or residence.

We are willing to chance it, but I was curious to see what everyone thought.

Aww, thanks Chazzie! We've calmed down a lot after finding this site, Igor's List, etc. It was just a heart sinking feeling when I saw that sad last touch date, and we didn't understand that it was normal.

Once yours gets going again, I'm sure it will be quick and painless. Good luck to you!

K-1 Fiance(e) Visa Process & ProceduresApplication hasn't been "touched" in 3 months

If you go to the K1 updates forum, you'll see a whole slew of threads of CSC's slowdown. Your profile says you filed at California Service Center... and your NoA1 date is July 15th? You're most likely in for at least another month of waiting. Our NoA1 is dated June 1st, and the we just got 2 touches this week after hearing nothing since a June 7th touch.
CSC's official processing time is 5 months, and lately, they've been around there.
You are most likely going to wait 5 months for your NoA2.
C'mon over to the other forum and join the wait! We're all supporting each other :)

Thank you guys so much for making us feel like we haven't been lost in the system! I'll definitely check out the forum, thanks.

K-1 Fiance(e) Visa Process & ProceduresApplication hasn't been "touched" in 3 months
Hello everyone,

My fiance and I have been travelling around Asia and Europe for the last year, and submitted our I-129F at the end of June. I used my mother's home address as my mailing address, so any information sent out would be received by her and immediately emailed to me.

We received our NOA1 on July 15th.

We have been waiting in the UK since then for further instructions as to when my fiance can go to the interview in London.

Because of help from the forum, I found the section of the USCIS site where you can see how often your application had been touched.

Imagine my surprise when it said the last time it had been touched was July 18th.

Has nothing been done to further our case in 3 months?!

Thanks in advance for any of your stories that can reassure us and/or point us in the correct direction!

K-1 Fiance(e) Visa Process & Proceduresstart a K1 visa abroad
Yes, you can definitely start the paperwork while being in another country.

My fiance and I haven't been in the States since January, and have done all of our I-129F paperwork while backpacking around. In fact, we sent the papers off while in France :)

If you have a mailing address that can stay the same during the entire process, that would help out a lot. I used my mother's address in the States, and when she received our NOA1 in the mail, she scanned it and emailed it to me. I'm not sure if it slows down the process if you have to update your mailing address, so we found this way to be the most reliable.

The only suggestion I would make is to anticipate the wait time to be longer than you expected. We continued travelling, naively assuming everything would take about 5 months, and went through our savings faster than if we had known better. Being on this site early on is a really great way to be able to plan better. However, it sounds like you two will have no problem continuing a "normal" life while in another country.

Have fun! and enjoy Ireland!

K-1 Fiance(e) Visa Process & ProceduresAdvice needed before visiting my fiance please!!
Sarah-

My British fiance and I are about to do the same thing! We're flying into the States on the 5th, so we can let you know what happens. His situation is pretty similar to yours - sold his house and quit his job to go travelling, however, he doesn't have a single family member. So as far as proving "strong ties" to the UK ... he really can't.

We just know that he has no intentions of staying, so we're bringing just about all the proof we can through bank statements, car registry, etc. I'm trying not to get too nervous since I know our intentions are good ;) But I understand how frustrating it is since everyone would like a clear cut answer.

K-1 Fiance(e) Visa Process & ProceduresI-129F payment abroad

I am having the same problem! I am living in Spain until August and we are trying to figure out how to pay. I'm glad to hear that I am not the only one struggling with this part. I have called every number they list and tried to talk to everyone possible in every office and they are all rude and can give you no help---Don't bother calling them. I even got yelled at today by some woman saying that I should call the people I have already called who gave me her number. WHATEVER. I think the best option is what was said above-- have someone from the US send you a check or money order to put in with your I-129f. But as others have warned you, look at all the information and be absolutely SURE that you are going about this is the correct way for your situation. You may end up stuck in the US and very frustrated.

Best of luck

My UKC fiance and I were travelling around as we were preparing our I-129F. What we did is shipped all of the documents to my mother in the States to have her put the packet together more neatly than we could have (there wasn't room in our backpacks for paperclips and such ;) ). She also wrote a check from her account, and later we reimbursed her through Paypal. The check being written by her was never a problem.

K-1 Fiance(e) Visa Process & ProceduresIs k-1 really the right visa for us?
Thanks all for the advice so far, it has given me more details to work with as I sort out our situation. I-130 seems like a better option for us, if we wanted to go that route eventually. I think I'm going to suggest to him just trying to visit the US in the next year, then I can go to Turkey and visit or try to find a teaching job there. Thanks again!

Why no green card? He will need one if he comes after the K1 process. I would finish school.

I should say he wouldn't MIND a green card I'm sure, but we aren't planning on living in the US immediately. I'm also worried if he did apply we would leave the US during the processing for one: is that okay?

Also, I'm finishing my school regardless of what happens, education first.

K-1 Fiance(e) Visa Process & ProceduresIs k-1 really the right visa for us?
I have been going back and forth over what my fiance and I should do for our situation. I want him to come to the United States a year from now, when I graduate college. Then we could get married and he could travel as my spouse while I teach abroad. I don't think our different citizenship will be a huge problem, but if all else fails I could find a job in Turkey (where he is from).
As for him, he just wants to come here as soon as possible AND be able to work (I've provided him with a huge eye-opener as to how difficult it is to get into the US) until I finish my degree. We were looking at the k-1 because it seemed like the safest option (ex; what if we can't leave the US right away?) but also somewhat pointless since he doesn't want a green card. Also, I'm worried once we get deep into the process, our case won't look very good since I'm a just a student. ANY sort of advice is welcome!

They just need your birth certificate, right now. Dont send hers.

They want your info not hers:

Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship.

Hers they will want later after NOA2 has been approved. Keep a translation you will needed it for AOS.

Good luck

Perfect. I will take out her Birth Certificate and translation. Thanks for all the great advice

Like everyone has said you need to do a lot of reading here with the 129f petition K1 guides. You don't send off 134 now you do that later and then send it to fiancee. You also send 129f to Dallas lock box not California. You need a letter of intent from both of you so you are not ready to send this off yet. Please read the guides.

Thanks for the reply and the info on Dallas Lockbox, because I was about to send it to USCIS Laguna Niguel, CA. This forum is particularly rewarding. Thanks for your input

K-1 Fiance(e) Visa Process & ProceduresAlmost ready to send K-1 Visa Petition

It's Amy writing...Are you just now submitting the I-129F petition for a K-1 fiance(e) visa? If so, you don't need the affidavit of support until the petition is approved. You don't need those documents until her interview at the US Consulate in Argentina. You'll send those documents to her and she'll take them with her to her interview along with all other supporting documents. Also, I would greatly advise including prints of emails and chat logs; me and Victor submitted a sampling of them from different periods of time over our relationship (we had hundreds of pages worth of stuff so it would have been too much for the I-129f - you'll need everything later at her interview in the US Consulate in Argentina). Include scanned copies of letters you sent each other in the mail, and copies of any phone bills you each might have from calling each other. Me and Victor use Skype to call each other on the phone, and Skype saves a log of your calls. We also, just to be safe, made screen captures of the websites of our mobile phone companies after logging into our accounts to show these phone numbers belonged to us and were in our names so whoever reviewing our packet will see we were in fact calling each other. These things all fall into "proof of an ongoing relationship." I think it wouldn't be very advisable not to include this supporting proof of an ongoing relationship, even if you have photos. Also, you need a fiancee letter of intent from her as well. There needs to be a signed and dated letter of intent from each of you, not just from you. The photos should be good. How many photos did you include? Best of luck to you!

This topic has probably been posted many times before, but alas here it is again. I just need some input. My packet is ready to be sent to the California Service Center because I live in Oregon. My fiancee lives in Argentina and is ready for the next step. Included in my packet are:

Petition and payment
(1) Copy of my US Birth Certificate
(1) Copy of original and original translated copy with letter of accuracy of Fiance's Argentine Birth Certificate
(2) Biographics for myself and fiancee. Signed and dated
Affidavit of Support with all supporting documents: ie: pay stubs, tax records, 401K, bank account summaries, etc.
Passport Photos for Me and my fiance
Many photos with names, date, people written on back, boarding passes, bus tickets, Western Union receipts, all pages and stamps of my passport, copy of the information pages of my fiance's Argentine passport.
Fiance Letter of Intent from me dated and signed.

Any advise would be greatly appreciated. Thank-you

K-1 Fiance(e) Visa Process & ProceduresFiance letter of intent

They MUST be original. Read part 5B of the instructions closely:

5B: Provide original statements from you and your fiancé whom you plan to marry within 90 days of his or her admission, and copies of any evidence you wish to submit to establish your mutual intent; and…

Also read part 9 copies:

Copies: Unless specifically required that an original document be filed with the application or petition, and ordinary legible photocopy may be submitted. Original documents submitted when not required will remain a part of the record, even if the submission was not required

They ask for an ORIGINAL statement. Not a copy.

You also need an ORIGINAL G-325A from your fiancé.

Hope I could help. Let me know if there is anything else you need help with.

Thanks Bonnie. I will just have to get her to mail the original to me. Thanks for your help.

K-1 Fiance(e) Visa Process & ProceduresPicture Size - G-325A

Hello,

I've got a question about the size of the photo that we sent with the form G-325A. I have already sent my photos to my fiancee
And the size of my photos are 5x7 (I am the beneficiary)
This is the size of pictures that we (beneficiaries) must send along with Form G-325A, right?

How should the size of the photo of the petitioner?
How should the size of photos for the petitioner submit with the form G-325A? The same size? 5x5 or 5x7?

I'm having doubts about this information...

Thanks!

Way too big. They want a passport photo. 2x2 The exact size is on the USCIS homepage.

Mine hasnt reached the NVC yet either, we were apprvd on 4-02-08. What is the deal with the CSC?

We were approved too last April 2 & NVC still don't have our papers. I had high hopes that we will get out case number within this week. crying.gif

My fiance called CSC this morning, the lady told him to call back in the afternoon as their server is slow during Friday mornings. He called back later in the afternoon and the lady confirmed that CSC sent our papers to NVC only last April 15.

whistling.gif My bet is they waited until the crate is full then shipped it off to NVC. Yours is probably in that crate too.

Just wondering, Did they ever update your case online or does yours say still pending too?

They updated it on April 7 which was 5 days after NOA2 receipt date.
