Ok, we're at the end of the road here! Interview's in a few weeks and I was double checking things and suddenly realized something. I heard that ALL documents have to be translated but... The police certificate is in Japanese but it also says not to open it before the interview. So I'm assuming that's ok to not have translated?

Also, my fiance is working on translated his birth certificate himself but I'm worried whether or not they'll accept it if he's the translator. Do we need to hire someone? Thanks :)

So we finally got approved! He's got his plane ticket to come out here in December and we plan to have our wedding in February. Honestly, I hadn't even thought that there was much else we needed to do till then. But looking over the flowchart it says that he can't work till the AOS?

My question is..on average, how long does it take to be able to legally work once you get to the country? I saw people mentioning applying for a work permit? I'm just generally confused about this step of the process.

I was going to say the same thing. Personally, I think it would be a disadvantage. I am 7 months into the process and am STILL at USCIS through no fault of my own. That means that once, when I do get approved, its going to be at least another 3-5 months for my interview.

There are only about 5 instances that qualify for an expedite, and I know many people who did qualify for an expedite that have been waiting over 6 months for their applications to be approved.

My boyfriend and I have been together for a year. We've had short visits in the past, but I am now staying with him temporarily (I'm from Canada, he's in Oregon).

I've been here for almost 2 months now. I know that the maximum amount of time you can be in the US (on a simple visit without any kind of visa) is 6 months. If we want to start the process of paperwork, marriage, etc, how long would we have to be apart? What I mean is, can the process only start once I'm home, because it would involve him applying for me to get a Fiancée Visa? So we're looking at up to 5 months of having to be apart while we wait for the K-1 visa?

If we got married here, would getting some kind of Spousal Visa keep us apart for less time than waiting for a Fiancee Visa?

My fiance and I met last year, visited each other twice during 2010, and then in December I went to stay with him for a few months. So I've been in the US for 3 months now and am planning to leave before the 6 months are up (as a Canadian, I can be in the US for 6 months out of a year with no visa. They don't give you an I-94 either).

In our declaration, I described both short visits and explained my current visit. It ends with:
"It is now March 5th, 2011. Since [cananner], as a Canadian visitor, can only be in the United States for 6 months out of a year, she will be returning to Montreal before May, so that she does not overstay her US visit."

I guess I'm just paranoid that whoever reviews our case will read that and be like "NO RETURN TICKET?!" even though we've stated that I'm fully aware that I can't just hang out in the US for an unlimited time. Is what I've written okay?

I'm from Canada, which I assume is pretty low-fraud, so I want to think that the proof of meeting we're including is enough. We chose the time my boyfriend came from the US to visit me, since his passport was stamped upon entering Canada (seems like the best proof). However, we don't have boarding passes. What we have is:
-flight confirmation/itinerary from Delta, printed from his email
-hotel reservation confirmation, printed from his email
-transaction history from his bank account online, showing purchases with an ISA (international charge)
-passport stamp
-photos

Should this be enough? I get that a flight confirmation isn't proof that you did in fact FLY, but with the passport stamp, should it prove itself?

Sure, to those of us going through the process it seems silly that they wouldn't just believe the nonUSC fiances that they will leave the country. But, the officers at the borders don't know that you have applied for the visa. If you enter the country and say "I'm here to visit my fiance" that will send a red flag to the guard that you might not be leaving because you'll want to stay with your fiance. If you don't have any evidence of ties to home, then they could very well turn you away and you will have to return home without stepping foot in the US. People can easily buy a return plane ticket and not use it, so that is not very strong evidence. However, if you bring a copy of the i-129f and the NOA1, this will show proof that you are going through the process legally. Also, letters from an employer or showing proof of a mortgage or something like that will further reinforce your intentions.

I've read stories from people who have had no trouble at all entering the US and they didn't even need their evidence. But I have also heard stories of people who were made to return to their home countries. It all depends on the officers at your entrypoint.

Overall, the whole situation sucks. I don't think there is anyone on this site who would disagree with me... But we still have to play by the rules and it will help us more to be overprepared than underprepared.

Yes, I think the US CBP exactly think that. I think the US CBP have had MANY people misuse tourist, fiance and other non-immigrant visas so now they are very strict

Remember, there used to be a time when you married a USC then you were also automatically a USC, there is a reason why that changed. And that same reason is why the border is so strict now

Most border guards know NOTHING at all of the process. They are not properly educated on it, and most of the time they give 100% wrong answers about it.

When I crossed with my K-1 my POE only 1 of 15 border guards (that were working at the time) had done a K-1 and it was so many years ago they couldn't remember how to do it.


Oh! I'd just assumed knowing about visas and processes was part of their job. I guess so many people come through each day that they can't be expected to know about every single type of process.

So I've read all about how you have to bring sufficient ties to home when trying to visit the US during the visa process, but I don't really understand it. I'm not saying I don't think people should follow those guidelines or lie, I'm simply curious as to why it works that way.

If someone's reason for visiting the US was to see their fiance(e) and they weren't undergoing any visa process, I get that it could look bad, in the sense that they might be planning to just stay there. But if you're entering the US with a round-trip ticket and proof of your K1 process, how is that not enough? If the border guards know how the process works, wouldn't they know that it entails the foreign fiance(e) having to be back in their home country to send paperwork to the consulate and go to the interview? Does the US think that people might apply for a K1 just to use their NOA1/copy of I129F to cross the border, like "hey guys, I'm just a poor little engaged person trying to visit my fiance(e) who I tooootally promise I'm gonna marry!"?

I'm just confused as to why showing proof that you're essentially paying to wait for the US government to communicate with you in your own country isn't enough. :huh:

My fiancee is from Scotland and we have known each other online since 2008. We've grown so close over the last three years. He proposed, I have accepted and am looking forward to visiting him in Scotland. My question is about the proof of evidence. We rarely email or text, as we are on voice chat every evening for at least 2 hours, and my 12 year old often participates (and gets homework help lol). I do have phone records, and some older chat logs prior to when we got serious about our relationship, but how do you prove relationship when you've been voicing/video calling for over a year?


As the other reply states, what you need for the K1 application is proof that you've met in person. Whether you visit him or he visits you, the person doing the traveling should hang on to their boarding passes, and it's even better if they get a stamp in their passport. Also, the traveler will be able to show receipts and/or credit/debit card history showing that they made purchases abroad. You'll probably take some photos together that you'll send, but those are considered secondary evidence.

Phone records and chat logs would come in handy at the interview (the very end of the K1 process), to show proof of a continuing relationship. Since you haven't met in person yet or sent out the forms, you have lots of time to get into the habit of emailing occasionally or sending letters here and there, which would help prove the ongoing relationship.

I'm a Montrealer waiting for my K1, which will take me to the west coast. However, I have family in New York who I don't often get to see. Do you know if it's possible to fly to New York (which would have been my POE anyay) with my visa, spend a few days with my family, and then continue on to my fiance's place? Would the border guards accept this (a ticket to NY and a ticket to my fiance) or do they absolutely want you to make your journey all in one day?
I would assume it would be okay, since even if you fly directly to your new home, it's still up to you to complete all the subsequent steps like applying for a SSN and getting married. But I'm aware that my logic isn't always their logic <_<

Our petition has been approved smile.png my finances awaiting his interview in New Zealand.

I have been traveling and working abroad for the last 3 years so I have no us Income (currently seeking employment). My mum wants to be co sponsor and she makes $80k per year well above poverty line,

The problem is she only finished university a few months ago and so has only been doing her job for a few months with no tax slips from previous years as a student. Can we still use her or should we ask someone else?

It says in the instructions that your mom can get a letter from her employer and a letter from her bank showing her income. You should be fine.

Hi gang, we still are waiting for the NOA2 on the K-1 visa process, but, in thinking ahead to the proof of support, I had a question.

My current job is permanent and pays well over the required income for support - $55,000, but it started July, 2012, so it is fairly new. Will the fact that it is only a year old present a problem? (Prior to this, I still made over the income requirement every year with my previous employer (but one year it was only $25,000) if that makes any difference).

I think OP already sent the visa package in though. So now all there is to do is to wait for an approval, or a denial or a possible RFE. I'm not sure one can meet one's fiancee in person after the petition has been sent in. Worst case, you'll get denied and then you'll just have to re file.

that's true I just think there are ways around it. she can show if she has assets that can be liquidated within one year she can sponsor him that way. the government only cares that he can prove that he will not use public services.

Ok but still, I don't think it's that serious. Everyone stresses about this money part. Before my husband and I decided to marry, I had never had a full time "real" job in my life and I still sponsored him on my own. I just had started my own business as a sole proprieter that january 1 of 2012 and I petitioned for him that april. on that 1-134 form I literally just put 0 in savings and I think 1000 or so dollars in the amount that I had in my account. I sent them bank statements and paypal statements and that was it. when it came time to file taxes for 2012 I did so and made just a smidgen above the poverty line. I did not submit my last three years taxes either. Just that one. The IO did not even bat one single eyelash. I can only speak for myself but I found it easy.

It seems you have a good handle on what the requirements are. the USCIS looks at current income. Let's say hypothetically you get a job tomorrow and you are able to prove that you can sponsor your fiancee. I am assuming you do not have any dependent children. You are required to submit your most recent years tax return and also you may submit your last 3 years tax returns if you think it will help you, but if you did not make above the poverty line the last 3 years i would advise against doing so. Unfortunately the time to file taxes for 2013 calendar year has passed so if you did not make above the poverty line last year i would recommend getting a job and filing your taxes for 2014 and waiting to file until january next year. This is just my opinion. You could also prove your income using assets, as in if you have any savings or any assets that can be liquidated into cash within one calendar year. It's all in the paperwork I highly suggest reading through all of it before you proceed. Government paperwork is very literal, follow the instructions to the T and you will be OK.

I suggest having a look at the example forms. You will need to include a copy of your passport and also i recommend sending a cover letter. Your fiancee can stay until May 23 if she wants. it's not a problem. The letter of intent is a simple letter saying I Eoghan (last name) intend to marry (fiancee's first and last name) within 90 days of her entry in the united states on her k-1 visa" then you sign your name in blue or black ink. She sends the same letter in the package but obviously with names and gender reversed. no additional fee for the g forms.

I got my RFE notice last week, and the hard copy yesterday. They need my ENTIRE divorce papers, not just the divorce certificate that I got from the county. I sent it off today, and hope to get our NOA2 SOON!

It was such a long week from April 1st when we got the e-mail notice until the hardcopy came, telling us what we needed. Pure torture. Good luck. And like the others said, hopefully it is something simple and you can get your NOA2 soon.

Following on from the RFE we received, the necessary information was sent to Vermont and we now have a RESPONSE REVIEW,where it is stated this can take up to another 60 days before we receive a decision. It is now almost 7 months since our NOA1, are we really looking at the possibility of another 2 months of waiting.



I got an RFE, and received my NOA2 exactly one week after mailing my paperwork back to them. It depends on what your RFE was, but they are USUALLY pretty quick once they get back what they requested. Good luck. I'm betting you will have it within a week.

It took one full week for my hard copy RFE to reach me by mail. BY far one of the longest weeks of my life. Luckily though, once I sent everything back, I had my NOA2 within a week of them receiving the info. I'm sure you'll have yours in the next day or so.
