K-1 Fiance(e) Visa Process & ProceduresCertified Documents
Thanks, this was very helpful.

I read a lot of those guides but some of them I missed.

I would like to know if I should just go ahead and include all of her certified copies to the uscis for the I-129f, just to avoid any delays.
I hear some saying they don't need her Birth Certificate but since she changed her name I should probably include in right, as well as, the certified translations?

The thing I am mostly worried about is that her name change twice.

Thanks,

Austin

K-1 Fiance(e) Visa Process & ProceduresCertified Documents
This is my first thread, thanks for your help ahead of time.

So we are currently collecting all our documents for the I-129f.

Question 1: My fiancee has 2 records of changing her name.
1. When 15 changes last name from her fathers two her mothers.
2. When 29 changes first name

We have both documents, that prove her name change, do I need to include them in my I-129f? If so, should I provide a copy of her birth certificate, as well as, any other document that is different from her BC. Including, passport and resident ID.

Question 2: Though all her documents have been stamped and signed, she believes that she still needs to get her documents certified by the Ministry of Foreign Affairs. Is this true or is a stamp and signature from the office where the document was obtained sufficient.

Question 3: In regards to translated documents, do we need to translate, BC, Identity Card, passport, name change documents, and anything else in thai?

"13. Proof of Legal Name Change if either the US Citizen and/or foreign fiance(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order."

Question 4: Is the Certification from the certified translator sufficient enough or does it need to be certified some where else?

Question 5: In regards to her parents names, do use the name that is indicated on her BC?, because her father has changed his last name since she was born. He has not been her life for 15 years. What do we do?

If these questions get answered it will clarify a lot for me. I think we might be making it too complicated but the instructions almost seem too easy to be for real.

Also, with regards to the I-129f, it seems to be more about validating my status rather than hers so I was wondering how much of her info should I include.

Thank you so much,

Austin

K-1 Fiance(e) Visa Process & ProceduresBirth Records for Mother and Father
Having a bit of an issue with my fiancee's G G-325a form.

My fiancee's mother was born in a remote area of Thailand and she only has a birth year, there is no month or day indicated. How do we get around this? I wrote an addendum telling them uscis the situation but I am affraid to turn in the application because I am concerned I will get an RFE.

The situation for her father is the same she only has the birth year. Her father has not been in her life since her birth and there is no way to contact him.

For both her mother and father we have their birth year and where they were born.

Will this be enough with an addendum explaining the situation?

Thanks

Thank you for all for the support. I felt much better today. I had a great time chatting with my sweetie tonight, we laughed a ton. I am so lucky to have her and I am thankful. Just need to practice focusing on all the positive things that are happening right now.

K-1 Fiance(e) Visa Process & ProceduresTogether, Alone
I am sending my I-129F package today. I decided that I am not going to obsess about it anymore and just let go and hope everything is going to OK.

I am having a bit of difficulty though, with the distance apart. I miss her so much and I am finding it hard to be positive because my sadness some times takes over crying.gif . I want the times that we communicate fun and light but sometimes I wear the sadness on my face. When we video chat. I am 33 years old but now I feel like I am 5, because everything affects my mood. I am normally a very happy, joyful person and I want this feeling to go away.

It has been just over a month since I have seen her last. I am have hard time now and I fear of the long journey ahead. I just do not understand why it has to be such a long process.

One of my fiancee's friends married a man in the UK and it only took a week to process their application. A week.

Anyway, I feel that I could use some support right now and if anyone has any suggestions on how to make this time apart just as amazing as the times together, I would greatly appreciate your words of wisdom.

Thanks,

Austin

I had to go to jamaica my self and ask what was going on they said they could not find any record of my BC i had to bring all my paper work from the old one to let them see 2 days later they found it. so try to go in person and see what they need they will take forever if you dont.

Well...he has been to the office numerous time so I will advise him of your experience as well...he is soo frustrated now it's hard to even talk about it... :(

IR-1 / CR-1 Spouse Visa Process & ProceduresWaiting on a Birth Certificate

I can say with almost 100% certainty that they WILL NOT accept the old one. Did you order the new one through the Registrar General Dept? They will need to know the number on the old one in order to look it up. As long as your husband was "registered" at birth, it should be on file. I received my marriage license through them and they express delivered it to me for an extra charge. They have a phone number that you can call the office to check the status or send them an email. But you're definately going to need the new one. Good Luck!

Yes did order it through the RGD site Feb 21st....$55us...my mistake was to request it be sent to me in the states....

I agree they will not accept it.. The registrar office is the place to do it, but it is best in goes into the office in person again and express that he needs it right away. The number never works my husband had to go in just to give his father name. The called him and told him to call back but could never get through. And there is no way to track it....UUGGGGHHHHH!!! I know exactly how you feel!!!

Then March 21st I sent them an email asking if he could go into the local office in Mobay with the transaction# for proof of payment and pick it up there??? no reply....so he went into the office and they said they would request it be given to him instead of mailing it to me....he was told they will call him once they have it...after a week or so he went into the office and was told "come back in 3 days"....he did...NOTHING...

Jama, did you'll use the short bc to obtain the Marriage lic? He has a Passport already correct? Have they told him what's the hold up on his BC request? Does he have sibling, have they been able to obtain a copy of their BC? I am just trying to see if there is some type of pattern and if you maybe able to identify what could be the hold up.

But, the answer to your question is he will need the new version of the BC. :crying:

We did use the short bc for the Marriage Lic-no prob. Yes he has his passport. We finally decided to have him pay for another one last week and he was told 3 business days...which would have been yesterday. I told him to give them one more day and go in today....NO SUCH LUCK :( they told him to call in and keep checking (of course nobody answers the phone) and now he is so mad (myself also) that we don't know what to do. I sent an email to the RGD...(actually 2) telling them that if I don't hear from them by friday I am going to dispute the $55 charge with my bank as fraud...since I have never received what I paid for. Not sure if that is what I should have done since I DO NEED THEM but I am soooo pissed!!!

Thanks everyone for the advise....

Ok, sorry if this is not done correctly but I am new at posting a NEW TOPIC....

In Jamaica there are 2 types of Birth Certificates...the new one and the old one (simple enough right?) well, according to all reports you must have a NEW one to submit with your paperwork...so I ordered one...2 MONTHS AGO...then my husband went into the office and ordered it again....still nothing... Do you think if I sent all the paperwork in with a copy of the old BC and proof of payment for the new one will they allow it???

IR-1 / CR-1 Spouse Visa Process & ProceduresROUND TWO

Okay, here's the scoop...

My fiancé was denied his visa due to charges on his police record.
The embassy has stated that in order for him to be eligible for a waiver of these specific charges, we must be married.

Fine, no problem, woo hoo!! Posted Image

Next month, a year and 3 months after the K1 petition we will finally be married...

So then I have to file another petition (CR1) and wait all over again.
Not so fine, but whatever

I know I am going to have lots of questions.
I have read the CR1 guide, but our case is unique and I am broke
So, no lawyer for me
I hope that the good people of VJ will help again with ROUND TWO :help:

First question:

On the I-130 it asks for the Alien Registration number.

Should I put the A# he was given in the K1 NOA2?
Will this same number follow him throughout the immigration process?

Hey hun...you know I will be here with as much info as I can remember..... I left that space blank because Michael didn't have an Alien Reg #.... I would say yes to use the one he was issued since he was issued one.

I don't see how it is unfair though. You forgot the copy of your husband's passport, not them......

I do agree it is silly that they didn't bother to do it all at once, it would save everyone time.

No, I do accept the first RFE...it was my fault...but at that time they had a valid police record and only said I needed to send the missing copy of the passport....it is only now that they have changed the policy about police records and are requesting a 2nd record be PURCHASED although the previous one was already cleared.

Did you get RFE in email or through snail mail?

jamericanFemaleJamaica2010-08-14 02:33:00
IR-1 / CR-1 Spouse Visa Process & Procedures2nd RFE.....Are you kidding me????
Just when you think you've heard it all....

My case had been reviewed and I got a RFE because I forgot to send a copy of my husband's passport...According to NVC that was the ONLY thing that was wrong. So, I sent it and they put it on the bottom of the pile of cases to review so at 7 weeks they send me another RFE!!!! This time, it is because of the new ruling requiring a new police record if the previous record was dated prior to June 14th. YES, I was aware we were gonna need to get a new record and provide it at the interview but didn't realize that we would need to have it prior to getting an interview. REALLY????

I don't think that is fair. They already told me the file was good with the one exception....I think they should have advised me that at the interview I will be required to have a new police record but not hold up the process of getting an interview.

My question is....what keeps this from happening again....how many RFE's can one person get??? Is there an expedite I can request due to the length of time and the unfairness of the situation??? Anyone with this or a similar situation??? Multiple RFE's???

HELP!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresAverage Wait Time After Fixing RFE from NVC

Pacmatrx,, Sachinky is right..My RFE did take 11 days to be exact..

I beg to differ.....the new process is 6-8 weeks! It took my case exactly 7 weeks after they received the ONE document I forgot to include (copy of my husbands passport). I have been told by the NVC operators that they are looking at RFE info just as if it were a brand new case. In the meantime of my case being reviewed a second time...the requirements have changed and now I got a 2nd RFE for an updated police report. So, I guess they are correct in saying that the whole file is reviewed when they get the Requested evidence.

IR-1 / CR-1 Spouse Visa Process & ProceduresAssets not being counted???

You may have a problem, yes. Usually NVC will tell you your income doesn't qualify and suggest you "may want to" secure a joint sponsor but the Consular officer will make the determination. They'll send the same notice to anybody who doesn't qualify on income regardless of how much they show in liquid assets. Read the notice carefully. Unless they are specifically requesting something be sent to them, don't send NVC anything more.

However, the Consular officer WILL evaluate the assets and if there's no appraisal and mortgage statement, he won't be able to consider the home equity at all. So, make sure you provide a corrected affidavit with the appropriate supporting documentation.

MORE HOWEVERS, however....

The I-864 instructions state the following.

Assets may supplement income if the consular or immigration officer is convinced that the monetary value of the asset could reasonably be made available to support the sponsored immigrant and converted to cash within one year without undue harm to the sponsor or his or her family members.

You may not include an automobile unless you show that you own at least one working automobile that you have not included.

When using the family home as an asset, Consular officers tend to consider liquidating it as "undue harm to the sponsor and his or her family members" in the same way the consider selling the family's only car, an undue hardship.

If I were you, I would also submit an I-864 from a qualified joint sponsor, either to NVC if they actually request it or to the Consulate at the interview.

Pushbrk...you are totally correct. I called NVC again to get more details on this RFE that I still have yet to receive, the CSR was very helpfull(unlike the last one) and she too said that it was only a suggestion that I get a co-sponsor due to the actual consular officer may request it. What I did have an RFE for was forgetting to send a copy of my hubby's passport. This was not what I was told originally so of course I was a bit confused, frustrated and upset. It feels good to know that I won't hold up getting an interview while I obtain a co-sponsor. Thanks for all of your and everyones help.

IR-1 / CR-1 Spouse Visa Process & ProceduresAssets not being counted???

maybe ya missed something ? when using a house, must include recent appraisal, from licensed appraiser, with his/her signature and seal/chop. If you did that, already, then someone at NVC is a retard, being uber douchey about reading.

But maybe I was too fast, slinging words together.

Assets Addendum - yet another piece o paper to include with the I-864 (could be multiple pages, as well)

Reivew of assets addendum - clerk at NVC does an eyeball review of the 'assets addendum' included with the I-864, does some mathematical computations.

IMO, even with 300K in equity in a house, you SHOULD be able to liquidate in 20 days, acrruing 200K in cash, to go forth with 'assets computations' ...

BUT - what I'm saying, is that is possibility that NVC clerk NOT review the equity position in the house OR they denied it, in toto, without the appraiser's document.

If you included the appraiser's document, then it's time to get NVC to 'do something' - ie - review the frickin paperwork again.

If you did not include the appraiser's document - then, IMO, submit NEW I-864, with NEW stuff in it, to include the appraiser's document.

Good Luck !

Thank you sooo much Darnell....I have to admit, IT WAS ME...I didn't include (nor know about) this assets addendem so I guess I was the RETARD  You have given me a ray of sunshine...I will research this and get on top of it! ALTHOUGH...just looking at a previous post from another member going through the Jamaican Embassy...although they met the income they were still required to get a co-sponsor due to being laid off in 09...so, sounds like I may still be up against the co-sponsor problem

IR-1 / CR-1 Spouse Visa Process & ProceduresAssets not being counted???

What kind of assets ? If you used a house did you offset it by the amount owed and show a recent appraisal ? Did you show proof of any other assets you included ?

Assets are a House...I included the current county tax assesment and my current mortgage showing what is owed..... I didn't think I would need any other assets as I only owe $100k on a $400k assesed value home...

Darnell....what is this...review of assets addendum?? maybe that is the problem cause I just filled out the AOS and where it asks about assets I filled that out & included the proof. Did I miss something??
jamericanFemaleJamaica2010-06-15 13:49:00
IR-1 / CR-1 Spouse Visa Process & ProceduresAssets not being counted???
What to do???

I called NVC and found out that we got a RFE "didn't meet income guidelines"...ok, I knew that so I included assets to compensate. I am a student who up until a month ago wasn't working so I filled out the paperwork as "unemployed" but provided $300k in assets to make up the difference from my last tax return-which was $6000 short of the 125% poverty level. I thought that they x the difference by 5 or 10 years to come up with what is needed in assets? Am I wrong??? I haven't gotten the letter yet explaining in more detail the RFE-although I am not sure it will go into much more detail.....

I know the easy way to correct the situation is to get a co-sponsor BUT what if that isn't an option???

I am an independant contractor so that I suppose is another issue as far as having my employer write a letter too??? Ughhhhhhh :help:

I saw a few persons being told that they cannot be allowed even though they are the petitioners. Dont want to dampen your spirits but most persons got turned down because they were missing a document. I saw at least 3 persons got blue slips because they did not have the petitioner's employment letter. Another got turned down because they did not have the tax returns. Another person was given blue slip because they needed to interview his petitioner as well (strange because even if he brought his petitiner she would not be allowed inside). I tell you this, if you have all your documents together you'll feel more confident in your interview. I spent money printing pictures and photocopyning documents, getting phone records etc. They didn't ask me for any of these. However I am glad I got them because it made me feel a whole lot more confident and secure as if I am ready to conquer the interviewer. Later on I will do a list of all the documents I carried to the interview.

Please, please, please feel free to ask any questions pertaining to the interview. I want you all to be approved.

Congrats to everyone with interview dates! I on the other-hand have been stuck with complete idiots at NVC who have managed to lie and say they haven't received any of my emailed packages, but that I snail mailed them a package in February, which is completely untrue, I emailed my I-864 in February.

Anyways, I had a question. I was always under the impression that CR1/IR1 were the same thing. But they are different, right? IR1 is for marriages over 2 years, and CR1 for those less than 2 years and so the GC has conditions on it. I applied for the CR1, but my correspondence from NVC says "IR1". Is this normal?

Congrats to everyone that has received their interview dates!

Also, a word of advice for anyone doing Electronic Processing(@ Montreal), do NOT email any of your supporting documentation before you receive your opt-in confirmation from NVC. I waited 30 days and my documents had still not been reviewed and after speaking with a supervisor I was told that if you send your documents before you received the opt-in confirmation they will be confused and not have a case to match the documents to! I received 2 emails from the NVC this morning:

The first at 1:29 AM with subject "ACL UNIVERSAL":

Dear Sir/Madam,

The attached correspondence relates to an immigrant visa referenced on the subject line. This case is being processed by the National Visa Center. Please read the information carefully and follow the instructions.

Then the second email at 1:35 AM with subject "PAOSF I-130 UNIVERSAL":

Their emails, in my opinion are slightly confusing. I got those same two emails back to back on the 23rd. One has the Choice of Agent form attached, and one asks you to pay the AOS. You're getting closer!
