Yep you would have to start over. That 130 and 129f approval was probably on a K3.

Im just curious....
will it jeopardize or in any way will affect our K1 application if we're planning to get married in the Phils by this coming July?
according to VJ, our NOA2 might be adjucted by July 15,2007.
we just want to have this simple wedding ceremony since both our families are in the Phils. For sure you know how happy it will be - to celebrate this love with close friends & family.

If you get married you're abandoning your K1 process and have to start over. K1 is a fiance visa to bring your fiance and marry in the US. If you're married you have to file for a different type of visa. The one you saw with the approvals for I129f and I130 probably was K3 and married.
My advice is to wait with the marriage...or you will have wasted time and money.

For your fiance not to be granted a visitors visa is pretty normal. He's an unemployed turkish male. I think the K1 is a good option for you. But you have to intend to marry him here within 90-days or he has to go back to Turkey. His income won't matter much to the consulate on the K-1, he doesn't have to prove ties to Turkey anymore, because he's intending to marry you within 90 days and remain in the US and you and your father have agreed to sponsor him.
What you will have to prove at the interview is the validity of your relationship. If he gets denied this time, it will be a long process, he can't just get another interview at will. The petition will be returned to the US and eventually expire, or it will be reviewed by the service center...depending where you file. So make sure, that you have everything in order when you do file for your K1. If I were you I would make some sort of wedding plans once he arrives, just so you can answer any questions they might have about your upcomming wedding, the plans don't have to be set in stone, really that's impossible anyway waiting for a visa and not knowing when it will be granted, but plan on marrying in the US and make sure that's what you both want. If you want to marry in Turkey, I would suggest your parents fly out to meet him there, then marry and file for K3/CR1.

Grr I called today, the woman on the phone was pretty helpful. She also gave me the July 16th processing date over at TSC. I asked her what I was supposed to do next. JUST.KEEP.WAITING?

She said to call back in a week. At least she didn't tell me to call back 180 days from my transfer notice, sheesh. :blink:

Hi,
I emailed TSC last week and i heard nothing, then last MOnday i emailed the main office of USCIS and they were very fast, they forward my letter at TCS saying " FOR RESOLUTION PLEASE. THANK YOU." then TCS answered me back because of the USCIS main email.
TCS told me that our petition is still pending and awaiting for final review. Don't if this is good or what. Last Nov TCS mailed that we are still on Initial review the last december my cousin's friend contacted a senator (which is their friend) from NY and inquire my case and we found out that our case " for further review". and now we are awaiting for final review. Oh God please enlighten me :)

So my congressman contacted USCIS @ TSC and they said they are processing the petitions 30-160 days from when they received them. They told the congressman's representative that they received my file on 11/18, which is weird, because it was transferred on 11/03/10. This means they are counting the days from 11/18, which I think is unfair, because that's not the date of my transfer notice. The congressional rep has to abide by those wait rules, so I guess it'll be up to another 60 days before anything can be done. She said at the least it's good that she inquired on the case because sometimes it gets them moving faster.

I sincerely hope that my application, along with ALL TSC filers are approved before their 60 day mark! :thumbs:

I need you guys' opinions: My 5 months mark is on 12/24 and I am planning on mailing out a letter to a senator on the 27th. Is that a good idea or should I wait a bit? I'm assuming I won't get a response from his office until a few weeks into January, anyway...

I emailed my senator 3 days before my 5 month mark and got a response from their office 2 days later. They have already contacted USCIS on my behalf and it takes 24-48 hours for USCIS to get back to them. I don't think it hurts contacting your senator now. Most have an online point of contact so it makes it very quick and easy. Good luck!

I think I am going to email him, over and over and over and over. Maybe that will get me somewhere? I'm not yet to the 5 month mark, I've got a week left, BUT I think I will email him now, make light of the fact June/July filers were transferred, NOT approved but August/Sept/Oct filers have been approved. :bonk:

Many people have had positive responses by contacting their congressman. I guess it just depends on who your congressman is.

I am in August filer the 14th to be exact. Do you think it would be smart to send a letter to my congresswoman in the middle of the month around my 4 month mark or do I have to wait until I'm at or rather close to my 5 month mark. I hope I'm not discouraging you as an August filer talking about this but we are all going through it!

I think you should wait until the 5 month mark, that's when the higher powers actually start to care, if at least a little bit. I am just over a week away from my 5 month mark and I will wait until that day to write my congressman. The USCIS says "5 months" on the site so there's no use contacting the congressman if you're still within the timeframe USCIS has given.

It seems though that August and September filers are getting approved before July filers, and July just ended up getting the short end of the stick. I bet you will be approved before your 5 month mark. But if it makes you feel better why not write the letter in case you need to send it on your 5 month date? I think I will do the same. :thumbs:

I think they just transferred certain clerks petitions for the month of July/August. I do not think they sent the problematic applications to TSC. I haven't had a "touch" since 7.26, but I'm not really worried about it, since they didn't even need to touch it to transfer it to TSC. I went over my application a few times and think I was pretty thorough. It just seems like there hasn't been any action whatsoever for July filers at TSC.

Here's to hoping we get some approvals over the next few weeks or USCIS is getting an earful! :bonk:

Hi all!

I sent an email to my Senator 3 days ago and received a response yesterday. The congressman's assistant was VERY helpful and ensured me she would get to the bottom of my USCIS issue. I emailed my congressman 3 days before my 5 month mark too, which is today. She asked for all of our info and is going to start by getting a case status update, then she said she could dive deeper and they have several different options.

It's looking pretty positive so far. I also told her how al us TSC July filers were stuck yet August/Sept/October filers that stayed at CSC were getting approvals. :unsure:

I am new here but i've been reading posts for quite sometime already. Would like to ask Lotto if he knows how long will it take for us to get a copy of tax return from IRS once we call them ( actually my husband has a copy of his tax returns but the one who made it was his accountant where he's paying every year just to compute his tax and i'm not sure if NVC will accept that or it should really be coming from IRS). Also i've been reading so many posts coming for Lotto even his EZGuideSpouse, if you don't mind if you can share or give me a sample copy of the "Bar Coded Coversheet of AOS and IV Packet"......

Wow! I've been away from the internet for a whole day and it seems like there's a lot of action here. It seems like a few people were transferred again, were you notified via email or just mail? I am in Canada until next week and can't check my email, the suspense is killing me!

Hmm I just looked at Igors list. If i am reading it correctly none of those July filers have been approved, yet August ones have been approved...Happy for them, sad for all us July filers that are coming up to 5 months in the next few weeks. :crying:
