K-1 Fiance(e) Visa Process & Proceduresk1 visa over stay visa waiver hardship
We used a lawyer and it wasn't necessary and I don't recommend them to most people.

However, in your case, you need to consult a lawyer. Call several immigration lawyers in your area and based on the initial impression from the phone calls, meet with a couple of them and them pick one to help you.

Expect the process to take a while. You may need to file waivers, which take time and money. Also, the border issue from Canada where they detained you will probably cause you to undergo more security checks with USCIS. Your NOA2 approval time will be long (most likely).

Best of luck.

Can anyone help with question 2 on the I-134 Form asking how long my fiance has resided in the US? He is american but is in the air force and came back from being stationed in England in June 2008....is that the date we put or do we put his birth date? He has moved around the world alot with his job?

Thanks

I was born in the US, but have lived overseas at times...I still put my birth date as the start of my time in the US, meaning I had been in the US for my entire life.

QUOTE (ACGeiger @ Jun 29 2009, 01:29 PM) <{POST_SNAPBACK}>
Just out of curiosity, what did you all find was the hardest part of this whole process? Was it being away from your loved one, dealing with the government, or was it anything else that you found difficult?

Just wondering... best of luck to all

In our case, being forced apart for the 7.5 months of the process.

We had previously lived together for years and my fiance was denied entry as a tourist while the K-1 was being processed. I guess for others already apart, the paperwork might be worse.

QUOTE (allenr @ May 11 2009, 04:29 PM) <{POST_SNAPBACK}>
I have a question. I petitioned for my fiance from the Philippines on a fiance visa. We arrived here in Texas on April 15, 2008, and were married April 18, 2008. By the 1st year anniversary, she decided to leave me because we would have arguements. She has left and is with her oldest sister in Arizona. Right now her case is in Adjustment of Status. It was in deportation court because we traveled to California to see other family members in the summer. We were detained at the Border Patrol in El Paso due to not having filed a Conditional Resident Application, which Catholic Services didn’t advise us we had to do. We just recently (January) got out of the deportation proceedings. And the judge transferred the case back to Adjustment of Status court. My question is: WHAT HAPPENS IF I WITHDRAW MY SPONSORSHIP? I don’t what she is doing, and she hardly answers the phone when I call her. Can you please help me. Please email me at txheartbreaker2000@hotmail.com also if you can. Thanks.

You should really start a new thread and not hijack this one.

Thanks guys,, We are going to go by the rules in the book. Get married within the 90 days of the K1 visa (Lets hope it will go smooth). I'm also going to be hiring a lawyer who can help me throughout the process. Make sure I don't make any mistakes. I'd rather pay the money for someone who is experienced and save time, than trying to figure this out myself. We want her over here ASAP. I know it'll be a long and "infernal" process. but we are both commited to doing so.

You probably don't need a lawyer.

Sydney will be nice to deal with. Most people on these forums will be extremely conservative with their advice, but keep in mind most of these people have fiances from non English speaking less developed countries. Most of the Visa-waiver countries are very easy to deal with, because there is very little visa fraud from them.

Let me clarify something......

Couldn't the OP apply now for the I-129F (since they wont care at NOA2 stage if they have met 1 time or 2000) and just make sure he gets another visit in before the interview?

That way they don't have to wait? I'm not saying waiting is not a good idea though, I think it's a GREAT idea...just wondering.

You have to have meet IN PERSON once within the two years PRIOR to filling the I-129F.

The family relationship comes up often when I see visa's denied here on VJ. In fact, that is one of the big ones. I suggest you do all you can to mitigate that.

Maybe not get engaged right away, and continue a relationship for a while first. Just my two cents. If your girlfriend/fiance is only 17/18 years old, why the rush to marry. Just enjoy things and build up a solid relationship first.

I am interested to know which airports are the easiest for a new K-1 arrival. I was planning on bringing my fiance in thru Las Vegas but was told it is a hard airport for new arrivals. Has anyone experienced this? I can have her come thru Seattle or Las Angels if needed. I am just trying to make her arrival as easy as possible for her. Thanks for your time and consideration.

San Francisco is the best of the main airports that service trans-Pacific flights. My family and I pay more to fly to/from New Zealand via SFO instead of LAX.

Seattle and Portland are both friendly and nice, but both have a very limited amount of trans-Pacific flights (I think you can go to/from Tokyo), not enough to really be viable. I don't think you can come directly into Las Vegas from across the Pacific (but I could be wrong). If you will fly via Japan and can go to PDX or SEA, I recommend them more than anywhere else, but as I said, there are a limited amount of flights from Asia into these two airports.

However, if you have a valid K-1, POE is not a big deal. What is a bigger deal, IMO, with regards to which airport, is which ones is better to spend time in and around. Most of the time transiting to/from the Pacific, I end up with lots of time to kill between domestic and trans-Pacific flights. I enjoy going into San Francisco MUCH more than going into LA. Public transport and people are much nicer in SF. SFO Airport is much nicer than LAX too.

so we aren't approved yet, but we are trying to get all the documents ready for my fiance in Australia for when we ARE approved, and we are finding it a little confusing (as usual lol) trying to understand EXACTLY everything he needs after I get the NOA2 in the mail, and at what point he needs each item..

The VJ guides list that the following be sent to my fiance for his interview:
QUOTE
"A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one)."

is this actually necessary? at what point is the entire package used/needed AGAIN?

QUOTE
"Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy."

same question... and what documentary proof is this referring to?

QUOTE
"I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all."

My fiance shows this form at the interview?

We no longer had a copy of the orignal I-129F and were fine. It may depend one which consulate you are going through. Check their requirements.

It's probably not needed. We didn't have a copy and I asked a similar question months ago before our consulate interview.

This is not a concern. It happens to a lot of people. As long as he was allowed to 'withdraw his admission application' to the US. (basically he was INA 214b), you will have no problems (other than possible longer NOA2 due to security checks - we went through this and others have too).

This is not a tax forum, but an immigration forum.

OP, you will be fine.

When you get to the consular stage, your mother will need to sign some paperwork. Depending on how much money you make when you file AOS next year, you may need your mother to help again.

As for being denied entry, it happens (to us actually too). You should be prepared for a little more scrutiny at USCIS, but you will be fine.

I've used FIOA for CBP records - took several months to get the info back.
My lawyer tells me the FIOA for USCIS takes even longer (like 1+ year).

Its not a 2 year visa you apply for, it is permanent residency (conditional, for 2 years)

Ideally you should apply before her I-94 expires. If not, then as soon as possible. You wife will become out of status as soon as the 90 days from the K-1 entry are up, until you file for AOS.

They only care about health problems that could become a public concern at the medical exam. Like some have said, usually medical and dental care is cheaper outside the US, so if this is something you are going to get fixed, you might want to do it in your home country.

In 2008, I started the process of the K1 for my fiance. We had gotten to the point of getting NOA1 and then...well long story short we broke up and I canceled the petition. Now we've managed to patch things up and are starting again the process. My question is...

On the I-129F Part A-11, it asks if I've ever filed for them before. The name of the 'alien, place and date of filing' are self explanitory but I'm unsure what the A# is and what to write for the 'result'. Should I just put something like petition canceled by petitioner for result? And do I need to go into depth about what happened in the section of explaining how we met?

Can you please post the Effective Date and Expiration Date of the I-129F form you are using.

I see the three options you describe and immediately below those three options are a check box Yes and a check box No.

My form is Rev. 7/30/07 and Expires 1/31/2010. There is a newer Revision now at USCIS but it is also the same. You do not see two check boxes below the three Bulleted items of question 2.

Thanks

Mine says Rev. 05/23/06. When you noted the date of yours I wondered how in the world I got an older version. Because I know I downloaded the forms from here and they all link to the USCIS page or at least list the rev date as the one you listed. What looks like happened was I used the form linked to as an 'example' via the K-1 Guide page and just replaced the example info with my own. Guess I didn't notice the dates were off. :\

K-1 Fiance(e) Visa Process & ProceduresRFE'd on Criminal History

Question 3 requires you to check all that apply, not Question 2. Question 2 requires you to check Yes or No. Very simple matter. If you check No for Question 2, skip Question 3. But you cannot leave Question 2 unchecked. It is a legitimate RFE for an important question.

Uhh no, I'm looking at it right now. Question 2 says "Have you ever been convicted by a court of law (civil or criminal) or court martialed by a military tribunal for any of the following crimes" And then it lists three options. Domestic violence etc, Homicide etc, or three or more convictions. There is no option for "Yes or No" There is no place to write N/A. It's just those three boxes. It's worded as such that you can either check one of the boxes or do nothing.

Since I have no criminal history there, I didn't check anything. And there were no text boxes or anything so I just left it as is. I just got sent an RFE for that. I called Customer Service and they said I should have attached a separate piece of paper explaining that I had no criminal convictions and as such that section didn't apply to me.
