Tried to get a license here in Oregon... and failed miserably this past Friday. Turns out they need my EAD to even CONSIDER giving me a license, let alone an Oregon ID. On top of that, after being a driver for over 10 years in Canada, they're telling me that I have to re-take a written AND actual driver test AFTER I get my EAD/Green Card. ASLDJALSDJALSDKAJD!!!!!!!!!!LASDLAS!@@#Uq)($)#(*$1!!! Needless to say, I'm not happy, but I guess I have no other choice.

I really was hoping for my case to get transferred to California, but after reading what people have said on here, I'm feeling more relieved (well, just a bit) for my interview on May 17. It feels like it's going to take forever since there hasn't been any touches on the AP or EAD either. Hopefully something will happen soon!

After waiting for what seemed like forever (no touch/e-mail -- nothing!) , I received an interview letter this morning! FINALLY! I'm scheduled for the third week in May.

*whew*

Now time to get all my stuff together... and hopefully get an EAD/AP in the mail? Eeeeeep.

I went in for my Biometrics on Wednesday -- it was quite painless. The staff at the Portland offices were really nice, and I was in and out of there within 15 minutes.

Still waiting to hear about my AP/EAD/AOS -- I really, really hope my file gets transferred to the CSC offices and that my AP/EAD gets to me soon.

Okay, quick question.

I posted this earlier on the AOS forum over there, but it's quite quiet so I thought maybe y'all can help me out! I'll basically copy + paste what I put. Basically...

My husband & I submitted my AOS while living with his parents. When we sent it in, both my husband along with my father-in-law both sponsored me. My husband filled out the Affidavit of Support (Form I-864) and my Father-in-Law filled out the Contract Between Sponsor and Household Member (Form I-864a).

However, I received a pink RFE -- it states that I have to submit ALL the information requested below at one tie, and to send it to US Department of Homeland Security in Lee's Summit, MO. This is what it says:

For the household member's income to be included in the household income, the household member's income must have been from a lawful source and earned while the household member was authorized to work in the United States.

Please submit evidence that the household member (my Father-in-Law's name) on Form I-863, Affidavit of Support, or Form I-864A Contract Between Sponsor and Household Member, was authorized to work in the United States. Examples include one of the following: (and then it lists it all).


My questions are:
a) Do I have to have my Father-in-Law fill out Form I-864 along WITH I-864a, or just have him fill out Form I-864A again?
b) Would the following in an envelope sent back to USCIS it would be okay to resend out? Would that be all that's required?
- Letter of RFE
- Form I-864A Signed
- Copy of his birth certificate
- Copy of the Certificate of Naturalization
- Copy of US Passport

Any help would be great since I intend to send this back out asap! Thanks so much

No extra fees :) Don't know if you already did the medical transcription, if not then a possibility that's what it is, but wait until you actually see it. They give you a good amount of time too to send it back in.

My RFE had to do with financial things, instead of my medical being transcribed. ( I hadn't done that when I sent in the AOS ) My case was transferred after sending back the RFE, and my GC was ordered a month later.

Don't worry yet!! I'm sure it's an easy peasy RFE.. :)


Aww. Thanks for your support! & Thanks to everyone else sending me their love. Turns out, it's actually just requesting more information on the household member (my Father-in-Law) who's helping support me. They just need a copy of his US passport/Certificate of Naturalization. Sending it in as of tomorrow!

On the bright side -- I also got my biometrics! So hopefully this will all work out & process quickly.

Well, I got an e-mail today that I'll be receiving a RFE in my file :( Sadness. No idea what for, but I'm hoping nothing big! Question about RFE -- when you get one, is there another fee to pay? & do you have to submit the same I-485 package as before?

Ugh. I literally cried to my husband about getting that e-mail. It's so frustrating!

Received both the text message & e-mail on the 24th, and then the letter on the 26th. Today it FINALLY let me track it online... which is about time! Now another round of waiting for my biometrics letter + interview.

(I can't wait to get my EAD & work already... not to mention my AP. I miss my family!)

CanadaGoing Back to Canada to Visit...
I've been in the US for about seven months now and loving every bit of it; the married life & job life has been good to me. The husband and I have since filed taxes for last year (2010) and things are going great! Work has so nicely given me time off, so I'll be going back to visit my family back in Canada for three weeks. With that being said, I was wondering: on the Canadian Declaration Form, do I fill out that I'm (1) Part B: Visitor of Canada and how long I'll be staying or (2) Part C: Resident of Canada? Also, since my ticket was booked with my maiden name & I'll be crossing the border using my passport (still in my maiden name), should I also show the Canadian Border Agents my green card? Is it necessary?

Any help figuring this out would be great! :)

Canada2010 Tax thread - For Canada and the U.S.
I've looked through this whole thread & still need help with what to do.

I came & entered the States on December 30th, 2009. My whole income is Canadian based. From then, I haven't worked a day yet since I've been in the US. What I initially was going to do was file my residence as Manitoba (as that's where I'm from) where it says where is your place of residence on December 31, 2009 & then just e-file it with QuickTax since I have my NetFile code, as I've done in the past. But now that I've read this, I'm totally unsure. I have no clue how to file taxes via paper.

Would I be able to file online & netfile on QuickTax? Or would I have to mail in my information? & if I had to mail it in, where would I mail it to? Would I have to send the letter as well? SO CONFUSED! Help!

The five months you're looking at may be when the I129F is approved, not the actual visa. Again, depends on where he lives in Canada. Personally I think it's going to be touch and go given his proof and the time you'd like him to come visit. He has little ties to Canada to show the border officials. He can't lie...gosh...NEVER LIE! Going for vacation for a few weeks is a little different than saying he's coming in to visit for 5 or 6 months, and saying you're going to support him, and he has no job and lives with his Mom. Sorry, I'm just being honest. This has nothing to do with a K-1 application or not. We're not 100% sure they're even going to know about it, if it was being processed anyway when he crossed the border.

I'd say your best bet would be to gather as much evidence as he can, and if he can't get through the border, he'll be out a ticket. In the meantime, get your evidence of having met together and get your application in. It is nice of course if you can wait out the process while being together, but many, many don't have this option. I know it seems like a long time until you're together again, but truly, when it's all over and done you'll wonder where the time goes. In the meantime, you can visit him you know.

So he needs to be there for the I129F approval and that is when he will then go for the medical exam and interview? What they show on the center processing website with the 6 months for the California center just means when he will receive the K1 at that point after he passes the exam and interview? Not when he will receive the I129F approval? So you're saying they will send the I129F at probably around a month before those 6 months months as a total and the 6 months represents when the K1 visa will be approved based on him having gone for a medical exam and interview? Is the time when they approve the I129F usually around a month before the time they list as the whole K1 visa being approved on the site or does it vary? Yeah, we won't ever lie to them, which also brings up something someone else said in this post, "Before the process, it might be easier...if asked he could simply say he is visiting a friend...which technically isn't lying. Once the K1 is in process if he should try to visit and he is questioned at the POE, it is very likely he will be denied entry based on having no strong ties to Canada. Again, just MHO." It isn't technically lying but sort of leaving stuff out none the less, isn't that a bad idea? I wish there was a way to prove that he would go back for sure. Maybe we could tell them he'll check in with them when he's going back to Canada when he says he will, I guess it doesn't work like that though, lol. Why doesn't it, I guess they don't have enough time to do that for everyone, right? I wish there was another good way to prove it, a return ticket, him not taking much stuff and telling them that he has his cats and his stuff back at home wouldn't make a difference? I guess they don't take pets and belongings too seriously though, right? He would maybe also be seeing his mother and the rest of his family for the last time for a while, I'm not sure if they'd be coming to our wedding or not (or my family), we might have a simple and private one at the town hall, we'd probably be doing it right away when he came to the US with his K1 visa and also we're both really shy people with lots of anxiety issues. Would that be a bad idea to have a private wedding considering the fact that not only are we getting married but he's also immigrating and we'll need proof of relationship for this whole process? I'm guessing a private wedding could look bad to immigration? How likely will it be that my fiance would be able to visit me in the United States while the K1 application is being processed, has it worked for anyone? I would also like to know about how it would work if he was able to visit me during the K1 application being processed considering he would need to get back to Canada in time for the K1 visa (medical exam and interview I believe it is, right?) when it is approved. I read that to be able to visit me he should bring a ticket to return to Canada later (we're not sure when that should be either considering the K1's processing times can vary, we just know that the longest amount of time he could be with me there as a visitor is 6 months) when he is coming to the states to visit me, is this something that should definitely be done and how would we pick a return ticket date? What other things should be done to make his visit possible? Is it likely that he will be able to visit me, for 6 months or under, during the time that the K1 visa is being processed?

Should he get his passport now regardless of when he will be visiting me during the K1 being processed even though we aren't sure when that will be yet? Thank you so much for your time!

Ok got my Oath letter in the mail, so a few weeks after the interview, so that was good to know. And I have the ceremony in 3 more weeks. Yay.

So question, it tells me to bring my Green Card (I knew that), but then also it says to bring my re-entry permits or refuge travel documents. I don't have either of those obviously. Just have the green card as they took my travel docs when I got the green card (along with the EAD).

So what should I bring instead? It also said bring all other INS documents I may have, well I don't think I have any really, other then the FP and reciepts I've gotten back from them.

Just curious what people have brought there with them.

I take it the next step after that is to go to SSN and get my number officially converted to state USC on it and then I guess I need to file for a passport...



Just bring your green card it'll be fine, they just take it from you there at the ceremony and send them to some place to be destroyed. At the ceremony they will give you the certificate of naturalization, with that you can go to the SS office and get your status changed, then you have to apply for a passport and you have to send them the original certificate of naturalization, so make a copy before, even though a copy isn't legal evidence that you are a citizen, it helps in case they lose your original in the mail.

I will be applying for citizenship in September, and now I am VERY worried!!!

Am I not going to be able to travel to Canada (weekends, vacations, visiting my sons, etc) after I file my naturalization application? I have never read that anywhere. I can understand not being able to live out of the U.S..... but not even travel for short periods outside the U.S.

Is this, in fact, true?



No that fact is false, I applied for citizenship in August 05 and travelled to Morocco in Nov 05 and March 06 all while my petition wasn't approved yet. When I had my swearing in ceremony they asked if I had left the country and I told them yes, so they just wrote down the dates of the trip and to where and proceeded with the swearing in. A visit is not a problem at all you just have to disclose it.

Hi everyone!

Our story in a nutshell is that we're expecting our first child on May 24th and then a few weeks after the baby is born, heading back to the UK for a quick visit with my mother and father. You know, show off the baby and say hello. This will be my first time back since I left with my K1 visa in hand. Since then, I've received my Temp Green Card and I'm excited to go home for a couple of weeks. My wife is American and I'm British.

We would like to apply for duel citizenship for our newborn. We already know we have to apply for a US passport as soon as the baby is born.
Does anyone know what the procedures are for applying for a UK passport for the newborn baby? What is the process? Do we all have to be in the UK for a certain amount of time and be present when applying for the UK passport. I really have absolutely no idea how these things work.

I'm German (well I was then anyway) and upon the birth of my daughter we applied for her German passport at the German Consulate, we didn't have to go to Germany, all the paperwork could be done from here. I suppose it's probably similar for the UK. Call your embassy or consulate they will hook you up.

Is there some schedule for periodic oath ceremonies for a given district office? I live in san diego and have my interview on 27th feb. my 5 year GC anniversay is 8th march and trying to fingure out when would be the oath.



They will either send you to the oath ceremony the same day, or they'll send you a notice telling you when your oath ceremony will be. They have several each month. Mine was at the federal court house and I got sent a notice, while my friend had hers the same day. Interview in the am and ceremony in the pm. That's in Portland, but I'm sure other places handle it similarly.

Congrats sweetgirl! You might have the oath ceremony on the same day after passing the interview. In that case you won't get a letter. The test is easy, just study the questions, they'll ask you 3 or 4 and tell you to read and write a sentence in english. Good Luck!
