My husband's conditional greencard expires in four days. We already filed the I-751 and received the NOA stating it is extended for a year but my question is this: He is currently looking for work and I am worried that an employer might not be comfortable hiring somebody with an expired green card...anybody have experience with this?

The letter is kind of vague...I thought it would say something like "this letter allows work and travel until...blah blah blah"

And what about traveling? I can just see the immigration people in Jamaica not letting him on the plane because his greencard is expired!

Don't worry. Things are a bit slow, to put it mildly, at the California Service Center (CSC) now. We submitted our petition to Nebraska on May 2. It was received on May 5 then forwarded to California. Our check was cashed by CSC on May 29....... i.e. 27 days after we submitted it. Still no NOA1 yet but it should come soon. If your check was cashed you can look on the endorsement section of the cashed check (the back side) for your case receipt number. It is a 13 character number that begins with 3 letters, usually the letters "WAC" for cases processed in California. You can then use your case receipt number to track the processing of your petition online with USCIS. USCIS Case Tracking You can also request email notifications of changes to your case status at the same website.

Good Luck...... and give it a bit more time (as painful as it sounds).

Not true. CSC is slow and becoming even slower as more Service Centers are forwarding their I-129F Alien Fiancee Petitions there for processing. It appears the only Service Center not currently forwarding all or part of their I-129F Petitions to CSC is the Vermont Service Center (VSC) which accounts for VSC's much faster processing times.


You're partially correct Buck. They have been forwarded from Texas and Nebraska since spring of 2006. There was some thought that it was originally just a "temporary" fix, but who knows. I guess on one hand if it was going to be a permanent change they would have made the mailing address change on the "new" forms when they were released in February, but they didn't.

The other issue is that the VJ timelines are still being tracked by service center. There is a difference in processing times between CSC/TSC/NSC as shown when you look at them. I know that there has been some thought that perhaps the NSC/TSC petitons may (and I say may) be getting processed by specific groups at CSC. In other words the forwarded petitions are being processed seperately from the CSC petitons. This would account with the disparity in the timelines. I would encourage ANYONE who has filed at TSC/NSC to keep that service center listed as their service center rather than change it to CSC for that reason. It will provide a more accurate reflection of the processing times if that is indeed the case.



Nice to see your posts Eric_and_Teresa and the rest of you. Thanks for the info. Here is another item for the rumor mill. A few couples (probably very few) are getting their NOA2's processed very quickly. According to our immigration attorney there is a rumor circulating among them that a few petitions are being pulled randomly from the middle of the pile by senior CSC processing agents in order to train new processing agents. Our immigration attorney has seen NOA2's issued in as little 2 or 3 weeks albeit he has only seen this happen a handful of times........ maybe 3 or 4 times for every 100 petitions or so in his case load. Of course, we fervently hope to be one of the "lucky ones" chosen to have our petitions pulled for training purposes.... but this probably a very slim hope...haha.

I want to start a thread of Nebraska Service Center filers (mailed my NOA1 May 24, received May 25). I'd like to see and compare the times of touches NOA's, etc. I'm looking at my checking acct. everyday waiting to see a cashed check!



The Nebraska Service Center forwards all I-129F K1 petitions to the California Service Center (CSC) for processing. Our petition was submitted to Nebraska on May 2, received by Nebraska on May 5 and then forwarded to California. However, no real contact since then. Our fee check was cashed by the CSC on May 29 (27 days after the petition was originally mailed). We are still waiting to recieve the actual NOA1 from CSC. We hope to receive it in the next few days so that we can confirm our case receipt number which will enable us to track the processing of our petition with USCIS online. The endorsement section of our fee check was actually stamped with our case receipt number (a 13 character number begining with 3 letters - WAC in our case - and 10 numbers). Unfortunately, the endorsement stamp was partially illegible so we still do not know our full case receipt number..... only part of it. We wish you much better luck.

This is my first post and we are new to the group. I am an Amerian attorney....... she is a Russian attorney....... and we have an immigration attorney helping us. However, I doubt our accumulated legal knowledge and experience will help us navigate the system quicker than any of you. I say this because we just received our NOA1 27 days after it was received by the Nebraska Service Center and then forwarded to the California Service Center..... about the same amount of time as it took Lewis & Clark to travel the same distance.

Despite our initial very slow start, we firmly believe that true love conquers all........ whether it be time, distance or bureaucratic lethargy.

As you have discovered, the 800 number is so useless as to be essentially worthless. In fact, USCIS would probably be doing all of us a favor if they removed the 800 number entirely rather than give people false hopes that they might actually be assisted on a timely basis.

In your case, there is probably little that Customer Service can do without you supplying them the Case Receipt Number....... which is what you need.

I know a method that might work but it is a long shot. Immigration attorneys in this situation will go to the local USCIS office and try to "back door" the information through their contacts there. This would cost you money for an attorney. However, you could try the same method yourself without an attorney. You would go to the local USCIS office in your city, take a number...... wait to be helped......... and then desperately hope that you get a helpful USCIS representative behind the counter that is willing to hack into the USCIS computer database to find your Case Receipt number on the basis of your photo ID and a copy of the fee check that USCIS cashed. (Of course, you should bring these).

I say again this is a long shot. One USCIS rep at the Customer Service 800 number told me that they can not look up pending cases by last name on their database. They need the Case Reciept Number. On the other hand, immigration attorneys are able to find their clients' Case Receipt Number so there must be some way of doing this in the system.

As others have suggested, waiting might not be a bad option since you know that your fee check was cashed. I know this sounds terrible and gives you and your fiancee no peace of mind. Trust me, many of us here know exactly how you feel.

I feel your pain. My file status never changed from it's original NOA1 date of May 29. Day after day I looked... many times...... no change....... then WHAMMO..... my petition was approved last week. However, when I return to the USCIS Case Status Online webpage it still says my petition was received on May 29 and the September 19 approval date is not reflected nor have I received an email from USCIS stating that my petition was approved. Indeed, I only knew my petition was approved because I received a hard copy in the mail.

Here are some observations based on comparing NOA2 approval times on the VisaJourney website and our own personal experience:

CSC APPROVAL PERIOD ABOUT 4 MONTHS FOR NOA2's:

The California Service Center (CSC) appears to be taking approximately 4 months or so to issue NOA2's. Upon reviewing the CSC timelines on VisaJourney, approval appears to be occuring about 125 - 145 days following the NOA1 date. The USCIS website says that CSC is taking up to "6 months" to process I-129F petitions but about 4 months (give or take a couple of weeks) appears to be more accurate at the moment. This is supported by the recent approvals of many May CSC filers.

MY DANG PETITION HAS NEVER BEEN "TOUCHED":

Your petition remains a virgin and has never been "touched"? Do not become overly depressed about this. Alas, this is rather common. For many of us (including myself), our petitions are first touched and approved on the same day. Thus, USCIS Case Status Online will frequently not show any touches prior to approval.

Hi,

I seem to be a bit outnumbered. Wanting to know if there are any Female Petitioners on here, marrying a Filipino? My fiance has a child. He was never married to the mother, but has had full custody of her since she was one (she is now almost 5). There is no custody agreement, but the mother will sign a letter stating it's ok for her to come to the US.

Are single fathers under more scrutiny regarding his paternal rights? Do you think they will question the child's paternity? He has her birth certificate listing him as the father, but it was only recently registered? What kind of back up documentation do you think they will request?

I'm just trying to get an idea so we can start collecting any needed documents now. We're very close to receiving our NOA2 (hopefully) as we are approaching the 5 month mark.

Thanks for any and all help/advise. Would especially love to hear from other female petitioners.

I think it all depends on who is manning the customs station. On my last trip, we had dried fish, and even told the customs agent. They scanned our bags, and sent us on our way....with our fish. The official rule is probably NO, but seems that some of us have gotten away with it (even while being up front with the customs agent).

I've heard conflicting information. Does the Manila Embassy require children who are a applying for a k2 to show up at the interview with the k1 applicant? I've heard definitely yes, no, and only if they are 14 years or older.

If they are required to show up, what types of questions might they be asked? My fiance's daughter is only 4 years old, but is SUPER SUPER shy, and will more than likely be hiding in the crook of his arm the entire time. Plus, she hardly speaks any English.

Anyone with young children at the interview, can you share how it went?

Hi All,

My fiance will be eligible to pay for his Visa soon (just waiting on NVC to send paperwork to Manila). From what I have read, a passport is needed to pay for the Visa. My fiance has his passport, however he is just now applying for a passport for his daughter.

Can he go ahead and pay for his visa fee, and thereby be able to schedule his interview appointment, and then just pay for his daughter's visa fee when she has her passport in hand? When you make the interview appointment does it just ask for the K1 applicants info, or does it also ask for any K2's.

It could take a couple of weeks to get his daughter's passport, and so I was just curious if he could speed things up a bit by just paying for his and getting scheduled for the interview, and then taking care of her visa payment when her passport comes.

Well, after being in AP/AR (whatever it is officially called) for 4 1/2 months, my fiance FINALLY received his Visa last week. He will be flying on March 4th!!!! It has been a VERY VERY long journey, and although it isn't quite complete (we will be bringing his daughter out in a few months), I'm so happy to have this stage over (the waiting was EXCRUTIATING).

I'm sure we are going to have a fight ahead of us to bring his daughter here, as that is why we were in AP/AR to begin with (discrepency with her birth certificate), but we will cross that bridge when we get there.

Come on March 4th....hurry up and get here!!!!!!

I'm a female petitioner!!!! Not filipina though. Yes, we are definitely in the minority.

We've received our NOA2, and now just need to pay for the Visa's and schedule the interview appointment. We would have this done now, but my fiance decided to wait until we got NOA2 before he applied for his and his daughters passport. Well, guess what? It is taking MONTHS to get a passport (he didn't realize this). SO, now we are in a big waiting game. It will take about two months to get the passports (we're trying to get them expedited), and then at least a month from that to get an interview appointment. I'm so disappointed. I was hoping they would be home this summer, but it is looking more like Sept/Oct. Oh well.

My fiance has a 5 year old daughter that will be coming with him, so it will be interesting to see how his interview goes at the embassy, when it's usually the mothers bringing their children.

Actually, they can waive the 3 year residency requirement if it is a step parent adoption. I don't know what the process entails beyond this, but you do not need to be a resident for three years to adopt your stepchild.

U.S. citizens residing in the Philippines who are interested in adopting a Filipino child through the Philippine Courts must meet the following conditions pursuant to Philippine adoption law:


•Be resident in the Philippines for at least three years prior to the filing of the adoption petition and maintain such residence until the adoption decree is entered by the Philippine court.
•Possess a certification of legal capacity to adopt issued by the appropriate government agency from your state of residence.

The Philippines government may waive these requirements in the following cases:


•A former Filipino citizen who seeks to adopt a relative within the fourth degree of consanguinity, as defined under Philippines law; or
•A person who seeks to adopt the legitimate son/daughter of his/her Filipino spouse

I have had really good response from e-mailing the embassy. I e-mail before I go to bed, and usually have a response the next morning. Granted, the responses never say much, but at least they are responding to me. My response this morning said: "we are in receipt of the requested verification from the Philippine civil registry. The case has been referred to a consular officer for review. Once the review is completed we will notify the applicant". (again, we were waiting on the birth certificate for his daughter, who is a K2 to follow).

Not much info, but at least I know they now have the document they have been waiting on. Who knows though how long the "review" from the consular will take. It's been 4 weeks now since my fiance's interview (Sept 14th). UGH! So very frustrating. The e-mail address I use is: IVManilaReplies@state.gov. You need to make sure the subject line is the beneficiary's last name, first name, MNL number, and type of Visa (K1 for us).

We're on AP. My fiance's interview was Sept 14th, and at the end, the CO told him everything was good, but that she needed to check on a document, but to wait for the Visa in the mail. Being nervous, my fiance didn't ask what was needed. He was NOT given any white paper.

He told me he was approved, but they needed to check on something. Knowing that this isn't how it is usually done, I asked him if he got a white slip of paper because it sounds like we are in AP. He insisted that he thought he was approved.

I knew this wasn't quite right, so I e-mailed the embassy and sure enough, the embassy is requesting a birth certificate for my fiance's daughter. They were not requesting he submit it, but they were ordering it themselves. They insist they told him this and that he got the 221g form. My fiance insists they said no such thing and did not receive any other paperwork (the 221g form). I tend to believe him, because he HAD his daughter's birth certificate with him, the lady at the first window took it, but gave it back, and the CO never asked for it again. Had they told him what they needed, he would have reminded them that he had it with him.

I e-mailed the embassy again last week to get an update,and they said it can take anywhere from 3-4 weeks to get the documents. They would then make a decision once they received it. Very frustrating that we have to wait another month (or more) for something he had with him. Even more frustrating that there is no set timeline and we really have no idea how long we will have to wait. I will e-mail the embassy next week for another update if we don't hear anything.

I would imagine that you're unable to get an American passport, as you're not yet an American citizen, so you'd need a Philippine passport. Maybe if you call your local consulate branch, they can help you with your passport renewal. Here is a link:

I then went to the DMV and they issued me a license without any problems. The only thing is that the expiration date on the driver's license is the same as the expiration date on the 2 year GC.



Is it different from state to state or our DMV made a mistake ? My wife's driver's license is valid for 6 years - way longer than her conditional GC. We are in Indiana.


In Oregon you don't have to provide a Social Security card or a green card, as long as you have 3 alternate ID that they accept. Lucky for us!
