What I find really stupid, with regard to denied entry, is we are all from modern, respectable English speaking countries (UK, NZ). Why would anyone from one of these countries live illegally in the US when their home country is just as nice. The ONLY reason Cindy is moving to the US is to be with me. US immigration is brainwashed to think the whole would wants to move here illegally. I'm the American and I don't think this place is that great smile.gif

Jon was also denied entry in June 2008 for the same reason. We too are still waiting for our petition approval.

While I don't think they're being intentionally malicious as your lawyer implied, I do think we're waiting longer because of that incident. We definitely will get a hit on the FBI name checks because Jon now has a file with immigration. All of these people waiting in name checks and being approved last week has given me hope! Hopefully we'll all hear something soon!



We are in the same boat. Cindy was denied entry in Oct for a visit. CBP was EXTREMELY rude and unprofessional towards her.

While I respect that people say being denied entry does not affect K-1 approval, and I expect our petition to be approved, I also wonder why we are still waiting when most everyone else from our time frame has been approved.

yes we have thought about it, because of his education and being a doctor it makes sense for him to be the one to do that, im a graphic designer and still lacking my BA in creative writing........

i would love to stay and fight csc to the end but it just is a waste of time i think

I only know first hand about NZ (and somewhat Australia). The process is very straightforward and their immigration people are nicer than the US. Once you both have residency elsewhere, an IR-1 in a few years should be easy to DCF for. Healthcare in these places is pretty good too.

Senators and Congressmen can only do so much. One federal government department cannot put undo pressure on another federal department. It sucks, but they can't do much more than research your case and apply gentle pressure.

The Department of Homeland Security is accountable to no one. Combine that with the fact they are also very lazy and unorganized and it is very annoying. It's sad because I haven't seen this with other government departments to the extent in DHS. For example, when I file my taxes, they are processed in a timely manner (even when I'm owed money). Why should USCIS petitions be different?

BTW: on a similar topic, there is a petition on the ACLU's website regarding unfair treatment by DHS you can file out. Its a little off topic, sorry:

Hey kenneme. While misery loves company, I am sorry to see you stuck too.

The immigration system is terrible here. “outdated, unjust, and ineffective” are just a start. The fact that family based immigration is given such poor treatment, while we continue to let foreign workers in on H1B (and other) visas by the planeload just baffle me.

Having gone through the reverse process myself to acquire residency in New Zealand, I can even more state that our system is terrible, My immigration to permanent residency in NZ was smooth and everyone I dealt with was polite and responsive.

I think congressional pressure is the only way some people have been able to get their petitions out of USCIS. If another month passes for us without approval, I will start having my congressman and senator contact them. I will also do the InfoPass and formal inquiry and then pending the outcome, a formal Ombudsman complaint.

We did have a congressman’s letter to help with entry as a visitor, but it didn’t help us.

There is no reason this type of processing should take the USCIS quoted 6 months. In reality, there is really no reason other than laziness that a petition approval should take more than a month.

Are you living in France now? Or just a visit? If you live there, why didn’t you process this at the consulate there and avoid USCIS?

Hope you hear something soon.

Thanks for the thoughts. I have dealt a lot with DHS (mostly CBP and TSA) and know they are jerks (and that is being polite).

More and more I think we have been escalated to security checks. USCIS seems to be solidly approving petitions over a month after ours.

My fiance and I have records with CBP that probably triggered something. She was denied entry from Canada to the US (Vancouver POE) last Oct. This was the last part of a round the world trip and we hired a lawyer to try to get her again a second time (with all the correct docs, etc to satisfy them it was only a visit). CBP bypassed all the laws and still denied her and probably put nasty comments in her file. Because of this, I am also harassed by CBP every time I re-enter.

I will wait another month, then start being pushy.

YES, sort of. I actually lived for 4 years in my fiance's country. Before I left, we didn't research K-1 visas enough to know the long time they took. I am constantly kicking myself for not marrying and doing DCF in Auckland before I moved back to the US last summer. Once I realized the long time a K-1 takes, it was too late for me to relocate back to NZ to establish residency again and DCF.

It can be hours or days or a couple of weeks...really depends on how quick they respond to you.
I had one congressman's office reply within an hour of talking on the phone to them.
My senator took a couple of weeks, but was responsive and helped out.

Its unlikely to be lost in the mail...even if the USCIS NOA2 did not arrive in the mail, you would still receive the NVC notice shortly after....and if that one got lost too, your fiance would receive packet three from the consulate...very unlikely any of those will go missing in the mail, and all three would have to go missing for you to not hear anything. I think you have a better chance at winning Lotto smile.gif

You haven't filled in your profile info..I'm curious where your fiance if from and which service center you are applying at.

By the way, we are at 6 1/2 months waiting....

Your timeline gives you your best estimate of when your NOA2 will come. The people who get theirs super quick are actually more the exception than anything and often are hardship cases that had their application expedited. I know it's long and seems far off but everyone's going through this sad.gif

I do not want to bash USCIS but, as a starting point, they could ask themselves why the Vermont Service Center is so much more efficient than the California Service Center.......... and then strive to make their other service centers more like Vermont. Is it management? Is it caseload per officer? Why are documents sitting 3 to 4 weeks in the California mail room but not in the Vermont mail room? Simply adopting procedures that work in other Service Centers would shave about 2 - 3 months off the total wait time for those of us not lucky enough to be processed in Vermont.

Just a thought.................
