CBP and USCIS have two different 'databases' for their information, and I don't think the two communicate. You and the OP are USCs, what kind of 'file' do you think you have...that CBP could alter to make themselves look better? That's a bit big brother-ish don't you think?


Actually USCIS would check CBP files. How else would they find out certain info about whether a person has tried to enter the US fraudulently (one of the things they check and an exclusion criteria for a visa)?

You can request you CBP file via a Freedom of Information and Privacy Act request. I did after a certain incident. CBP exaggerated the incident and claimed I did and said things I did not do, serious offenses. I suspect this is causing me scrutiny.

That's not quite true. While it should not affect approval, every single person I have found with CBP issues (you are the 6th?) had or are having much longer NOA2 times. Kim and Russ were the only ones with normal processing times.

See another post I have about doing a FOIA request on your CBP file, or PM me for a sample letter and info. CBP put a lot of untrue items in my file to cover their rears when they treated me badly. I am sure this is why I am still waiting and I am starting to file charges against CBP. I am trying to get a copy of my fiance's record now.

I tried the contact the politician bit & found out they are worthless. Isnt it interesting that they all have a trained staff to placate us? The infomation they do come up with is just about usless by the time they get it anyway. My Senator ( Finestine ) herself did nothing. Her staff did contact USCIS. They then sent me a letter to the wrong address. After 3 more calls to them they sent the letter to me. What the letter said was of no use to me & was so far out of date it was usless anyway. These letters are simply designed to placate us.
My case was " lost" & eventually took 402 days to be finished. during that time I recieved absolutly zero assistance from any government agency or politician.
Haole says that says his did a great job. Please let us know exactly what they did. How long did it take to get some info from them? How bout the two friends? Same Senator? What exactly did they do for the friends? Any info would be helpful to many of us. This is the only case I have seen where there has been a positive out come.


Sadly, legal immigration affects just a very small percentage of the US population, so it is not a priority for lawmakers.

I doubt travel to 12-13 countries is the reason. Many who travel have been to that many or more places. Between my fiance and I we are probably at like 30+.

There's no way for them to know what countries you have been to except those which involved a transfer to/from the US. They can always look in your passport though, for the stamps smile.gif

For the 6 months or more living in another country, I'm not sure how they confirm that. I think some of it may be 'honor system' (sometimes its hard to tell these things from the stamps in a passport alone, and sometimes you don't always get a stamp - common with travels to Europe).

My lawyer is going to the Infopass because she thinks they may give her more info than if I go. We don't think they will hide info from me, but they are more likely to just tell me layman's terms where they might tell her specifics, like we are in security checks, or supervisory review, or something. Plus I don't have to interact with them....

Your fiance isn't getting any real info from the USCIS helpline. I think they always pick a date prior to yours and say they are processing them.

It can be very helpful if you have a rather urgent issue or a complicated question that benefits from a face-to-face discussion with a trained USCIS officer. However, some officers may be unwilling to show you everything, or anything, so the outcome of your visit really depends on whom you talk to.

You do not have to wait for your case to be outside the processing window to set up an appointment, and you don't need a USCIS notice to go to your local office either. However, if your case is pending security checks, an USCIS officer cannot help speed up the process.

To make an infopass appointment, go to the secure USCIS web site. After typing in your zip code, you will be presented with several options. To check case status select "You need information or other services." Click "Continue" on the next screen, you will then be able to input your personal information such as your Alien Number and Receipt Number. The last steps are selecting a day and time for your appointment, and printing out a confirmation page which you will need to bring to the local office. If you wish to cancel the appointment, you will need the case number printed on the confirmation page.

I am debating making an Infopass appointment, but would like to know if anyone actually found that it helped their case.

I don't like dealing with DHS workers (USCIS, CBP, etc). If I meet with one of them and they are useless, I'm likely to just get frustrated more.
I'm not sure its even worth my time.

Anyone have a positive experience with Infopass?

There appears to be a problem, or serious lag, in the online case status system. We received our NOA2 CSC 4 weeks ago (and the petition has been received by the embassy in Paris) and the online system still shows no updates for our case. The message still reads 'pending and received.'


This is pretty common and lots of people go through the entire process without their case changing from 'pending'.
There are people here who are AOS approved and their petition is still listed as 'pending'

First, please fill in your timeline smile.gif

Second, you can't extend the 90 days once you are in the US (it sounds like you are in the US, but I'm not sure). One of the reasons its 90 days (rather than a shorter period) is to give you time to live together and make sure marriage is still what you want (its hard to judge these things in a long distance relationship). Sometimes it takes being together in a more normal life setting to realize one does or does not want to marry.

If your fiance is not ready to marry, then you need to return before the 90 days, or you risk having problems with possible future travel or immigration to the US.

Hope things work out one way or the other.

Infopass won't do much, as its really a 'one-way' communication. They won't feed any complaints or requests back to VSC.

why there are a lot of cases that have been sent after my case but got approved before? (Because thet USCIS say that they process the cases in order they receive them)

If someone has an advice about my situation, I'd be very glad...

We had original ones sent with the I-129F application. We wrote updated ones that we mailed back with Packet 3 (or you can bring to the interview). Something recent is better than what you sent with the I-129F, because its probably been many months.

Something to think about, if you are curious, is to do a FOIA request (Freedom Of Information Act) on your CBP record.

Request the date you were not allowed to enter the US. You can see what CBP entered into your file. PM me and I can send you links and a template letter.

Cindy and I were traveling together when she was denied entry.

I just received my records from CBP regarding that event yesterday. It took me two requests and a follow-up to get the data, because I believe once they realized what was entered into my file, they did not want to release it.

In our case, CBP lied about the event (to cover their ####). I won’t go into detail because is personal, but they stated we did and said things we did not. I believe this is why our petition is being held up. I am in the process of filing formal complaints again CBP for violation of rights and liberties. I may end up filing a federal suit against them too.

You may be surprised what corrupt and uneducated federal officers claim you did and what they enter about you, especially when they thing its information you won’t ever read.

FYI: couples that I know of on VJ where the foreigner was ‘denied’ entry (withdrew application) and their NOA2 times:

Me (Ed+Cindy): still waiting at 5 months
Caroline_L: still waiting at 7 months
krystiandjon: still waiting at 7 months
KimandRuss: 4 months to NOA2
Wendy+Greger: 10.5 months to NOA2

Of those 5, only one couple had a ‘normal’ NOA2 time, compared with current averages.

There is one other couple I know of, but I can’t remember them. It’s a Canadian who has been approved already that was originally denied temporary entry for her wedding. I can’t recall her NOA2 time.

Russell was denied entry in Sept 2007, also in Dublin (although he was treated nice). I am quite familiar with many couples who have experienced this and the wait times are consistent with any other filers here. This happens all the time. Being turned back at the border should have no effect on your K-1 visa other than the fact that you already have your A# and you are on the 'watch list' for your ineligibility to use the VWP.

You are not technically 'denied' entry... you are "allowed to withdraw your petition to enter the US".

There are security checks at every stage of this process. Any one of these can hold you up for any amount of time.


You guys are the only couple that I've noticed that were denied entry (withdrawn entry) and had a 'normal' NOA2 processing time. You were also at VSC, and the other 'denied' people were/are at CSC. I don't know that this matters. I don't have enough data points on the issue.

We've spent a fortune too, because I (the American) have been forced to take time off work to travel for visits. Really pisses me off because all CBP/USCIS have done by turning her away and pro-longing our K-1 petition is to cause me to spend several more thousands dollars on travel and financial support.

This whole process is absolutely infuriating to me. When you consider that New Zealand immigration has been so kind to me over the years, it is even more infuriating.

I know of a few others on here that were denied and approved, but they are not as recent.

I would bet any amount of money those petitions who were denied entry take on average longer to approve. I woudl love to have more specific statistics on that.

Caroline, why were you yelled at by the immigration in Dublin for going to the US?

I (CINDY) totally understand how you feel about being interrogated by immigration officers. I was interrogated by 6 CBP officers in total on 3 counts of over 3 hours per session. I just wanted to leave but I think they had so much fun interrogating me blink.gif The funny thing is that they asked me to THANK THEM at the end for their decision. Did they do that to you?

What I find really stupid, with regard to denied entry, is we are all from modern, respectable English speaking countries (UK, NZ). Why would anyone from one of these countries live illegally in the US when their home country is just as nice. The ONLY reason Cindy is moving to the US is to be with me. US immigration is brainwashed to think the whole would wants to move here illegally. I'm the American and I don't think this place is that great smile.gif
