How long it takes from packet 4 and interview in Canada? For example in Kazakhstan it takes 3 weeks


Once you get Packet 4 from Montreal, it means your interview is scheduled, which is generally within a month of the Packet 4 date. It's the wait time between Packet 3 and Packet 4 that is the long wait. Someone called today and was told that from a Packet 3 mailed in March, the interview would be in five to seven months.

She just had her K-1 interview at the Ciudad Juarez, Mexico American consulate and was APPROVED! :dance:

It's been a long process but I'm so glad its done...now onto worrying about the AOS!!!


Congrats! I can only wish that the US consulate in Montreal was as speedy as that! We still have a 4-6 month wait. I'll probably be the last one left in this thread.

Took mine 21 days. Have you gotten through to NVC at all? Around 7:30am or from 8pm to midnight Eastern time are the best times to call. Apparently NVC doesn't send the beneficiary nor the petitioner anything in the mail. The next correspondence you will get will be the Packet 3 from the consulate.

Still no record of mine at the NVC via the automated voice system. I don't think K-1s stick around the NVC long enough to be accessed that way, from what I've heard. It wasn't nice hearing the automated guy saying "there is no record of your case." My NOA2 was the 7th of June, and haven't heard anything from anyone since then.

You guys are brave setting your wedding dates even before you've submitted ... try to be flexible just in case.

Worst case scenario the ceremony will just be for show, and we'll follow up at the courthouse after the visa is in hand. You can't plan the kind of wedding we're doing in 90 days, anyway. :)

Yikes. That sucks. I sent mine to Nebraska, and the check finally cleared and the package is at CSC, now. I made my check out to Department of Homeland Security, and that's what the back of the check is stamped with, too.

I'm really hoping that I don't get dinged an RFE for this very issue. I only sent a couple of photos. My fiancee and I live only a few miles away from each other so we didn't really have anything like passport stamps, airline tickets, hotel receipts, etc. Although, we did take a vacation together to Florida, I was cleaning up stuff and threw away the boarding passes a week or so before filing the I-129F.

I'm doing the same thing. We also scheduled the wedding before filing the paperwork. There's a SLIM chance of our ceremony being a legal one, too, but I'm not counting on it.

I guess I'm just weird about stuff like that. Personally, it'd be a big let down to me if I had all the fuss and still wasn't really a missus.


I don't know how one could do it differently, to tell you the truth. If you are having a nice extravagent wedding like we are, we were lucky to schedule the location only 7 months in advance. With the expirations on the visas, I don't see how you can plan a real wedding bash in that short amount of time.

You shouldn't have any problems whatsoever in July, very much more likely than not you won't have your visa, yet. If you filed VERY soon, since your fiance gets to file with the Vermont Service Center, you MIGHT have your visa for September, but the Montreal Consulate has been quite slow scheduling interviews, so, unfortunately, you probably won't have your visa by September, either. Checking out the timelines would help. Choose Vermont Service Center and the Montreal Consulate. I'd say you'd probably be looking at 5 months, so, that would bring you into late September/early October for your visa if you filed now.

During the process, you probably won't have a problem, but make sure you carry with you your mortgage papers or utility bills, paystubs, a copy of the NOA1 (the first I-797 that you get back after your fiance files), and anything that says, look, I'm doing things by the book and I'll be returning to Canada.

You know what, TimsDaisy, most of us are pretty clear that they won't end up accidentally legally married in this case. We're worried about them having to prove that they're unmarried due to a slip-up at the interview or POE or when it comes time to adjust status.

To the OP: if you get married, say, and file for a spousal visa the next day, you won't look particularly fraudulent. It's the whole relationship that makes your marriage legit, not whether you've been married for years before filing.

I think either a) or f) is your best option. I'd lean towards f), since the difference is only a couple of months and the religious ceremony seems to be pretty important to both of you.


Another vote from me for either a) or f) If you want your fiancee living with you in the States as soon as possible. It seems that the K3s and K1s end up taking about the same amount of time to process, anyway, unless your fiancee is on the west coast or praries and will be dealing with the Vancouver instead of Montreal consulate. Least "risk" would be f), and probably quicker to get married at a JoP in the States, three days in most states, I think.

I'm pretty much in the same boat as you are, except our "wedding" is in September in the States. If I could do it over, we'd probably go with f). Our biggest determining factor at that point, is which way would we be living together the quickest after being married, though. However, also at that time, I didn't know about the wait for the consulate portion of the process, and actually delayed sending my petition off, so she wouldn't be stuck in Canada and not be able to visit me without using her K1. Man, was I wrong.

Sadly the London embassy doesn't do direct consular filing - I know because I rang the embassy and specifically asked them earlier this year.

So, you living in England? As long as your fiance resides in UK, and he can prove that it shouldn't be a problem. But my question is, if you, the USC are still residing in UK, why you guys don't get married and do a DCF in London? I think it is faster ;) .



DCF has recently been reinstated at many consulates. They didn't have the resources to comply with the Adam Walsh Act, but now they do. It may not hurt to ask again.

If his Canadian fiancée lives in Ontario or east of Ontario, though, K1 or K3 takes quite a while to be scheduled for the interview in Montréal. Your original estimate of 9 months is most likely the case. 3 months for CSC, and 5+ months waiting for interview at Montréal. If you live in the Eastern US and file through Vermont, and she lives in Western Canada and will have her interview in Vancouver, then you're looking at more like 3-4 months total: 1 month at VSC, and 2-3 months for Vancouver interview.

A similar thing has cropped up with my petition. It turns out that on my fiancée's daughter's "long form" birth certificate, it lists her name as hyphenated since the daughter's father had checked the "we do not agree on the last name of the child" box. On her "short form" wallet sized birth certificate, which is the only one that my fiancée ever had, only lists her last name. It probably won't cause a problem at the USCIS side of things, but I'm wondering if it will when it comes to getting my future step-daughter's passport and then visa.

I had seen somewhere on here that you should keep the service center on your timeline the same as the one that you originally filed at, even though Texas and Nebraska get sent to California. Don't worry too much, California has been speeding up lately. I got my NOA2 in 69 days after my NOA1.

You may want to look into getting married first and filing for a K3. My fiancee and I probably should have done that as well (we're a Sarnia/Port Huron couple). Although, you MAY be able to simply adjust status, but as you are living in Windsor, and not in Detroit, that may be a problem. Not sure on the specifics of that student visa. I'd imagine you could live in the States with it. Consultation with an immigration lawyer may help.

Mine was probably any exception to the rule. I would not advise anyone to only do what I did. I examined the EXIF data in the JPEGs from the pictures, printed them on plain paper, and wrote the date and time the picture was taken and an explanation of the picture underneath the picture. I submitted two or three. That also was the ONLY evidence submitted, other than writing in the box on how we met explaining that I live in a border town and that we were introduced by my brother and I see her at least 5 days a week.

I agree with fwaguy. The SSN has gone FAR beyond it's intended purpose. That is, your account number for Social Security. I mean, the gas company, phone company, etc. all want it, too, and if you say "no" they have no idea what to do. I'm sure there is some form of identification that would be allowable, probably their A-number on their visa.

The problem I'm having with my K2 is figuring out how to enroll her in school. The school officials I talked to said it shouldn't be a problem, just need her birth certificate, immunization record, and my gas bill or something that says I live in the district.

There's not much info on here about K2s, but I'd imagine they'll get an I-94 stamp that is good for ninety days or until their parent is married. In the case of a "follow-to-join" I'm not too sure how that would work. Seeing as my step-daughter-to-be is only six, it's not much of an issue, and you only get a $400 break if the K2 is under 14 when the new AOS fees go into effect.

also, to clarify, i did not come here with the intention of getting married when i entered on may 5th, 2007. This was discussed a a recent possibility and was encouraged by our lawyer as a way to sort of bypass the wait times of the fiance visa. I really just dont want to have to go to canada and aimlessly sit around for months and months waiting for this visa.

why is it that you need a fiance visa to enter the country and get married, but if you were already here, and you just decided to get married you can do so without issues and get a marriage lisence easily? that doesnt make sense. Why wouldnt everyone just do that and claim they "didnt enter with the intetion to marry the person" even if they did.

Couple reasons, its hard for citizens of certian countries to get tourist visas, unless they are very wealthy.

You can claim that, but you may be asked to prove it. And that may be hard to do. If you fail to prove no intention upon entry, you can be deported or even banned.

Technically, K visas and Tourist visas are both non-immigrant visas, but the K visas allow you to file for AOS. The tourist visas only allow you to file AOS in certain conditions.

If your attorny says its ok, then get married soon and file AOS before July 30th when the rate hike goes into effect. Keep all evidence of your intention to return so you can provide it if asked for it.

When you cross from Canada, you may not have an actual tourist visa in your passport, but you are in the country, legally, as a "tourist" with a sort of "implicit visa." The "snowbirds" do it every year.

Just wanting to let you know, I'm in the same boat, and we are doing the same thing. Although, both the "wedding" and the "marriage" are going to be in the US, since my Best Man, and possibly others, are not allowed into Canada (DUI convictions).

I had no problems receiving my physical NOA1 or NOA2, but, many of us approved in June have also been waiting a longer than usual time for our cases to be sent to the NVC. I called USCIS and they only said "it can take up to 90 days to forward the petition." Why? Who knows. Is my petition sitting at the NVC waiting to be checked in, or is the hold-up at CSC waiting to be sent out? That's all I want to know right now.



Have you called NVC to see if they have it?
