Im pretty sure, if im understanding your situation correctly... You'll need to clear that up with the Canadian Gov. But, if the paperwork says she has sole custady, you may not have much of an issue (other than working out the visitation issue)

Also, im not too sure you really need to go down the road of a formal "adoption", the child should be able to enter under your fiancee's application.

Mind you, this is only my humble un-educated opinion, but I think that all you'll need to do, is come to some form of an agreement with... whatever the canadiian equivilent of "Freind of the Court" is... to either waive the visitation for a year, or clairify that he would need to come to the states to visit. Rest of it should not really be a problem for you (after you manage to get the passport at least)

We didnt get an "ead stamp" per say... on the back of the i-94, she hand wrote "Employment is Authorized." I seemed a little odd to me, and we didnt ask for it or anything. Not too worried about it however, with an 8 month old at home, and another on the way... taking a job right now isnt really part of the picture.

We got to the bridge a little before 8am (hoping to beat the crowds), and it was an hour wait then. By the time we left, the line for secondary was out to the road... so Im not too supprised by a 3 hour wait later in the morning.

CanadaBluewater Bridge POE Review
Sorry we didnt write up a review for the montreal trip, being as Allie posted what we would have posted anyways being as we were there at the same time. My husband had the bright idea to borrow and trailer and towing with his jeep. Once we finished loading up the trailer last nite, we hooked it up to the jeep and well, the front wheels were almost off the ground, hehe. Well, we made the trip over using the Bluewater Bridge POE today. We didnt have any problems coming over. We pulled up to the booth and told him that we needed to activate a K-3 Visa, he filled the yellow form and sent us on in to secondary, after going into a fairly long gripe about how us guys that are doing things the right way get #######. He said he is glad that the new bill didnt get passed. The officer was awesome, he had a very good sense of humor. Upon entering secondary, we got into line and stood there for about an hour, of course being as its the long weekend, there was quite the line. Once we got up to the counter is was a very quick and painless procedure. She was awesome too. All the officers that we dealt with today were really good. She took my passport/visa, and my envelope. She realized it was a k-3 and said oh, i need to go and get my book. Then she came back, she stamped my passport, a few pages in the packet, and stapled the work authorization into the passport as well, and said that the visa expires in 2 years, and then she said we were free to go. They never asked to see what was in the trailer. I made an inventory list of everything I had, and they never asked to see that either. All in all it was an awesome trip despite having to wait in line for so long, but I suppose that it could have been worse. I am very happy to be home, its about time.

the UPS Store (formerly Mailboxes etc.) also provides a notatrie service. other than that... a letter from your employer and bank... i added pay stubs and tax returns... and your gtg.

I had a little trouble with that form figuring out how to answer one of the questions regarding our daughter.. but that was an odd case.

Someone from the bank should be able to notarize it. We also included a written letter from the employer confirming salary etc etc. Was pretty easy.

CanadaI feel completely hopeless
as far as the getting married in canada (with a divorce) part goes... I recently jumped through those hoops, and it wasnt too too bad.. Getting the actual mariage certificate afterwards was the bad part.

Take your US divorce decree to an CA lawyers office... any will do... He'll give it a read through, and make sure the requirements for canadian divorce are satisfied. He just types up a letter, which you then ship off to thunder bay (Allong with your wedding date set)

Once your married, however, you have to apply for the certificate before you can procede with any imagration stuff... that was a 3 month problem for us. They would not expidite it (like they did with the license to get married) because there was no "solid date" we needed it by... so they drug their feet.

Since your looking into making the move to canada... waiting of the actual mariage certificate may not be such a problem for you, as im not sure when/where they will require that.

Rach ran into the same problem... it seems the size they ask for does not exist. If you measure the envelope in inches (and the letter also gives the size in inches i think), its correct, but ehh.. there is something wrong with their math for the cm measurement.

We used little "post-it bookmarks" on each document, and labled them original or copy. When you go to turn them in, she'll ask for each document one at a time (and quickly!) so that helps allot to be able to find them as quickly as she's asking for em =)

But yea, as it was said, bring the original and copy of EVERYTHING. They'll return most of your originals except for i134, police and medical at the begining of your verbal interview.

I should have been more sensitive to what others have to go through. I wasn't aware that only CSC and VSC process the I-129Fs. We actually put off filing for the visa because before I found this site I saw the 3-5 month estimation, but didn't realize that's only for the USCIS Service Center portion.

We take it for granted living in a border town, because it is so easy to cross, generally, and the differences aren't that great, but we still have to go through the same process as everyone else.

Arghh... Why did my case get transfered? It's going to be forever plus a day in California before it goes on to Montreal which takes another forever plus another forever! Our "wedding" is September 1st, but now that it's in California it seems to me like we won't be able to live together for over a year! Granted, I can take solace in the fact that my fiancee lives only 7.4 miles from me, but this process is just so arduous.

They really need to reform the immigration process. I can see why we have so many illegals.

I would just like to know if there is anyone out there that can shed some light on how much longer now???
My I-129F (K3) was transfered to Vermont yesterday.

It is just frustrating not to know when to resign at your job to prepare for the move.. Here we need to give 30 days notice to leave the company...

This site is huge and if I had to sit searching for others with the same situation I would be here all day......


Well, I wouldn't resign from your job until the visa is in your passport. On the issue of your spouse's petition being transfered to Vermont, that is a very good thing. They are so much quicker than California is, I wish mine would get moved over there.

Did you send it via a trackable method? I sent my 129F packet certified priority, and it took over a week to get from Michigan to Nebraska, when it usually only takes about 3 days sending something that way. It took 13 days from the day I dropped it off at the post office to when CSC issued the NOA1, and about another week or so before I received the physical NOA1 in the mail.

Has the check cleared and have you been able to read the case number so as to punch it into the USCIS site to get information that way?

California received mine from Nebraska in late March and I just got my NOA2 yesterday. 69 days after they received it. California has been taking Nebraska and Texas' I-129Fs for some time now, too.

Oh, I didn't know I could still get information like that from them for a K1. I thought once they transfered it to the consulate, I'd have to deal with contacting the consulate directly.

When asking about Packet 3 and/or 4, do you actually use the terms "Packet 3" and "Packet 4," or are those VJ terms that the DoS Operators won't know?

It took nearly three weeks for my petition to even be sent to the NVC from the CSC. How did you find out when Montreal actually received it, and not just the fact that NVC sent it?

What is needed before the interview at the embassy in regards to the father of the child coming over on a K2? Is the judgment of sole custody enough, or do we have to hope he will fill something out or sign a form or anything? He's not the most reliable fellow out there, and he lives three hours away from my fiancee, so it will be hard to get him to do so.

I am wondering if anyone can help. I am getting ready to send back my checklist. Now thing is....my fiance is a farmer and of course his income is not HUGE. I am worried I will get rejected (since it is me and my 2 girls) that he is sponsoring. He does not have a problem paying bills...he owns heaps of stuff. Has a moderate savings as well as investments. But its the "farm income" on his taxes that show a small amount. I really don't know how taxes work but I'm a worrier and I don't want to get denied after ALL of the work we have done.

Not sure who posted it or where to find it, but I had heard that assests can be listed on a 3 to 1 ratio. Such as $30,000 in assests would count as $10,000 of income. Unfortunately, I'm not to that point in my journey, yet.

(2) DS-156 Completed online with barcode for Kristy

Do we send copies of divorce decrees, custody papers, passports, police check, etc. at this time, like the DS-156K suggests, or just the forms as the checklist suggests?

Oh, and do I fill out and get notarized and have bank statements, etc., for the I-134 now, or for the interview?

Hello,

When the consulate says that we need to provide police certificates obtained from all localities that we have resided in for 6 months or more since the age of 16, does this mean I need to provide a certificate from every town I've lived in? I've always lived in Ontario, but I have moved from one town to another. I'm not sure how literal to take this.

Any help anyone can provide is greatly appreciated.

I agree on the advice to use Vancouver. Time the request right and it could shave MONTHS off your wait time once NVC approves your petition. Where will you be filing btw? What office?

Also - before you decide to do K1 and not K3 - double check wherever you are getting married that it is not considered legal. If the embassy even THINKS that you are legally married, you will be denied.

I don't mean to scare you - just give you some info that I have learned.

There's no way we can swing a trip to Vancouver. On the I-129F it asks which embassy or consulate will your fiancé be filing, I put Toronto, as that's the closest consulate, but I'm getting the impression from here, that it's either the embassy Vancouver or the embassy at Montreal, and not at any consulates.

How would I check the legality of the marriage? If I just have a family friend preside over it, there's no way that would be legal, right?

If it is remoooooooooootely possible for you to go to Vancouver then do it. Move heaven and earth to make it happen as that will be your best chance at getting your k1/2 in time. Make sure you have all legal issues as far as custody and consent for Kailey to move with her mother resolved ASAP if you havent already. So often that throws a wrench in peoples plans to move.


Don't think Vancouver would be an option. We're spreading it thin for the wedding as it is.

I tried asking Kristy about the custody thing. She says it won't be a problem since she has full custody, but wouldn't the father still have visitation rights? He never uses them, but he still has them...

Anyone have experience with that aspect?

Oh, one other thing, that may or may not help, is that my mother was born in Canada and was naturalized as a US citizen as a child.

What exactly would you guys think my options are? Being a visa waiver country are there things I'm overlooking? Am I fretting too much? Should I just file for the K-1 ASAP and cross my fingers that it will be done in time?

Well, the cable bill and half her home are hers. We, well I do, cross the border about 5 times a week, and she comes and stays at my house every other weekend or so. But, if it's not a legally binding wedding anyway, she could truthfully declare that she's going over to visit friends and family, I guess.

Yes, that's definitely a danger.

I was crossing with my Fiance and they pulled us aside and ultimately did not allow entry because I didn't have strong enough ties to show I was coming back to Canada. I've visited other family in the U.S. as well as the Fiance since then, but I've gone over with parents/siblings instead as a precaution.

I find it's best NOT to cross together. If she lacks ties, they may think you're bringing her permanently and won't let you enter. Also, bringing strong evidence that she has ties to Canada (i.e. paystubs, letter of current employment, other obligations) will increase the liklihood that they'll believe you and will let her in as a visitor.

Hopefully that makes sense.

OK, I'm taking the day off of work to take care of this now. I'm going to file for the K-1, and cross my fingers. If we don't get it in time, then we won't have the legal ceremony and then do that when she does get it. From what I can tell that leaves me with.

Scenario #1:
-File for K-1/2 and everything goes quickly.

Scenario #2:
-File for K-1/2 and don't get it in time.
-Proceed with non-legally binding wedding/reception
-Get visa hopefully shortly after and marry at courthouse
-Kailey starts school in Canada, and switches schools
-DANGER: Kristy may not be able to enter US for visits and/or the "wedding"

That last part in #2 is what scares me the most.

Definitely have the same thing here. My fiancee was tal.king to her step-mom last night, and she was stating things like "well, so-and-so never had to go to an interview in Montreal." Well, rules change and who knows what the other person's situation was. I'm assuming that before the Walsh Act or whatever that is, it was much easier by being able to directly file at the Toronto consulate, which is what I'm assuming many people have done. My aunt even married a Canadian, and she doesn't believe what I'm going through. Well, her husband had work authorization and didn't "intend" to get married.

CanadaMoving to Canada down the road...
I was wondering if anyone here, if they didn't stop visiting here after they got their visa, has then moved to Canada. At this time it made more sense for my fiancee to come to the US, but it would actually be more convenient down the line for us to move to Canada. I would actually be closer to my work in the US if we did so.

If we did, it would probably be in about two years or so, and it's just conjecture if I don't end up finding a job closer to home that pays as well as my current job. I commute about 120 miles each day, and that's time I'd much rather spend with my future wife and step-daughter.

Anyone have any insight on this?
