Yeah, it's kind of funny. My grandfather married a Canadian woman, my other grandparents moved from Germany to Canada to the US, and even though my mother was born in Canada, and I'm not a dualie. No need for another topic, I've had one or two already on it. Basically, I'm not Canadian because under the Canadian citizenship law in effect at the time, my mother lost her Canadian citizenship when my grandparents naturalized as American. However, I may still try to get the dates of my paternal grandmother's naturalization, to see if perhaps I'm not Canadian through my father, who may be a dual citizen and not know it.

So, last Saturday Kristy and I were "married" (had a ceremony with friends and family, but no marriage license/certificate) and, on Thursday we found out that we are pregnant!

It's been an absolute hoot telling my friends and family that I'm going to have a child. For the longest time I was the committed bachelor, now, in the span of one week, not only do I have a wife, but a pregnant wife at that!

No, you are not stuck in Canada and can usually come and go as you please. You would be documented on a visitor record (not allowed to work or study) and usually CIC will renew the visitor record past 6 months as long as you are keeping up with your Canada immigration process. Cool. I'm not going down that route until/unless we get denied the US visa for whatever reason. And then it would be my intention to immigrate there, and not just "hang out." I'm just afraid at how long/how much money I'd lose trying to sell my house, if it did come down to that. Although, I could probably rent it out.

Yeah, I did more digging into that, and you are right that we wouldn't be able to file as conjugal. Wouldn't want to get married until after we've exhausted most of our possibilities of still going forward with the K1+2. That's still our first choice because of the job and house market.

I'm a bit more destressed right now. We'll just have to take things one step at a time. First, we'll try to get the form signed by him and a lawyer. Second, we'll try to change the court order, but if we get the consent to immigrate, maybe that will wait until after we AOS so she could travel to court if need be.

I know a K1 is single entry, but what about a K2? Would I be able to bring her into Canada so she could visit with her father if he actually wanted to spend some time with her?

The main thing I'm worried about is that the ex will pull a Hague Convention international abduction case against K.

My fiancee and I are getting more and more worried that her ex-boyfriend won't sign a "consent to immigrate" form or vary the custody and access court order. If we are denied a K2 visa, then I'm going to have to move to Canada, but still work in the US. Is that possible?

If we don't get that form before our interview, will the visa be outright denied, or could it possibly be approved pending receipt of it? The consulate in Montreal has not ever mentioned that such a form is necessary, but many of you on here has said it is.

I'm more stressed today after going to speak with duty counsel with Kristy than before. Do we look for an immigration attorney now, or a family law one? In the States or in Canada?

Hmm, this same issue just came up with Kristy and I, especially because she is pregnant right now and doesn't want to have any lapse in coverage. I also plan to speak with someone in my benefits department, since we cover same-sex domestic partners I'd imagine we would be able to start coverage early. Unless OHIP will cover until the marriage.

I can't wait for our NEXUS card. We're approved, we're just waiting for our interview for it on Oct. 20th.

It's $50 US, or $80 Canadian if you are paying by money order. They process $80 Canadian if you use a credit card. We sent the paperwork for that on the same day we sent the Packet 3 to give you an idea of how long the processing takes. You can also use a NEXUS card in lieu of a passport at land crossings, even after they start forcing Canadians to have passports to cross.

Yes, as well as Employment Authorization.

I believe Emergency AP is applied for at any immigration office. For instance, by land you would go to immigration on the US side BEFORE crossing into Canada, and at an airport, well, I'm not sure. Probably the international terminal somewhere.

1. Statement from an officer of my bank, with date account opened, total amount deposited in the past year, and the present balance

3. The I-134 signed and notarized

I also don't have any bonds, so I don't have to worry about that part. Also, I just need to check "Do not intend," for the specific contributions, right?

Instead of asking your questions in an already started thread, you will probably want to start a new topic, in order for your question to get the best visibility. To do that, go to where you see the list of topics for Canada, and click on the "New Topic" button up top.

In regards to your question, though, there are different types of family based visas, since you are talking about the NVC, I'm assuming you filed for an IR1 or CR1 visa. In which case you don't receive a "Packet 3" like us K1 or K3 filers do.

Same here with regards to Kristy's seven year-old. She wants to be a happy family living together, but she doesn't want to leave her neighborhood friends. And also based on that review, if the daughter had her fingerprints taken, that we should bring Kristy's daughter, too. Although, sixteen hours out of forty-eight in a car does not sound like very much fun with a seven year old. At least I got her a portable DVD player for her birthday a couple of months ago to keep her occupied.

You didn't answer whether or not you are living in Canada too - it's important as you can't file at the consulate if you don't live in Canada too. To file with the consulate/embassy you both have to go there in person and you need to be a resident of Canada.

If this is not the case you will need to file with Vermont.

That said - since your wife lives in the Eastern part of Canada she will interview in Montreal. Interviews for K type visas only take place in 2 places in Canada - the Montreal consulate and Vancouver consulate, as she is closer to Montreal - she will interview there.

So I think where the confusion is - is between interview and applying.

Applying - if you are also a resident of Canada you may file your I-130/I-129f at the consulate or embassy.

Interview - Montreal (as you are residing in the Eastern part of Canada).

Hope this helps!

Side note: Some consulates require that you mail in the application and then they will set up an interview appointment to review/approve your I-130/I-129f application. You will need to check with the Embassy/Consulate you are using to see what their procedure is.


I live in the US and my wife is in Canada.

On I-129F there is a section at the very bottom that says where will you be applying for the visa. So in that box I will be putting Vermont? That doesn't really make sense to me. Based on the instructions, the application for the visa should go to the consulate in the country that the non-USC spouse resides in.

Put either Montreal or Toronto, it doesn't matter. It will go where it needs to go, which is Montreal. My fiancee is in Sarnia, and Toronto definitely would have been easier to go to for the visa processing, too. I put Toronto, and we're at the last step, just waiting for the 9th of November to get here.

Really? The only B2 I received while visiting Bee was from JFK - other passport stamps I received (if any) didn't have that specific notation. Whether it was out of laziness on the officer's part, I'm not sure.

I entered from 2 ports. 1 YVR airport, 2 peacearch border crossing. Each time I got a stamp, from different officers at very different times. It could be that only BC/WA ports force this, so I shouldn't broaden my assumption to every port. But in my experience I was not simply let in VWP (as I should be) I was stamped and dated.


Just a point of clarification, Canada isn't a part of the VWP. There's a separate treaty that I don't recall the name of right now that allows Canada trips without visas. I cross nearly every day (granted I'm the American) and have never been stamped, but have been given a Visitor's Record once.

Oh, and technically I do believe the length of time is six months in any twelve month period of time. So various short trips in the previous year would technically count against the length of your long trip.

I just want to add that I was at an ATM at CIBC yesterday, and in the list of services above it, it said "Deposits" and had a Canadian flag and an American flag. So, I'm assuming that meant it would allow you to deposit into a US account. I have no idea what kind of fees would be involved, and Kristy and I also straddle the border, so that might be why, too.

Also, you can cross the border with less than $10,000 without extra paperwork.

Today my valuable nexus pass was "confiscated" by the US Border Patrol 'cuz they said I had a pending immigration application to live in the USA (plus I had just quit my job etc etc). I was soo pissed cuz I voluntarily went to their office to update my info with my new married name & passport number! Boy it sucks to be honest!! Canadian side no issues just the U.S.

So just warning any of u in the same position as myself that they can easily take back your nexus privilidges at any time or when u most need it! Why do they make it so tough to be with your family in America??!?!?! i hope they still "allow" me to visit my hubby south of the damn border! mad.gif


Oh wow - good thing we didnt apply for Mary to get one!

I love my NEXUS card. It rocks. I rarely get hassles at the border, but a few times of being held up for an hour is enough to pay for the NEXUS.

We were going to wait until Mary has her GC to apply for a NEXUS card - but when I went there they were all so nice and said if anything changes (my passport, my citizenship status, my drivers license) that I should just stop by the office and they'll rescan the new documents.


Kristy and I both got our last weekend, and her visa interview is coming up quick. Again, they just said if anything changes make sure you update your info ASAP, as if your documents don't match what's in the RFID chip, then you are screwed. The Canadian immigration officer that interviewed me made me well aware that I shouldn't be "living" in Canada, and I assured her that I don't sleepover except occasionally on the weekend, as that was her interpretation of "living."

And hey, I live in Port Huron! I'm looking at possibly selling my house, so we can move closer to my work. IM me if you're interested.

Sorry to hear that. Sounds VERY much like what we are going through with my (to-be) step-daughter's father. So, in that case, I HOPE you have a leg to stand on. It sounds like it to me, but, alas, I'm not a lawyer.

Thanks for the advice. The Penske trucks I've seen on the road do generally look nicer than UHaul. My main concern was whether or not I could pick up and drop off in the States, in order to save money by doing a "local" move.

It'll just be with my local U-Haul franchise. I'll be doing all of the loading myself with maybe a little bit of help from my father-in-law. There's not even going to be any furniture, really, mostly just boxes and a TV. That move will be another month or so off, when I go help my mother-in-law move her stuff out of the house and into an apartment.

The cost will be $35 + $.99/mile. When I pick up the truck, I'll ask about a car trailer, but I'd imagine it's not a problem if I'm right behind her car in the UHaul when she crosses?

Well, I just called them and said it would be no problem to do a "local" move, and renting it from the US and dropping it off in the US, since we're talking about 16 km round trip.
