K-1 Fiance(e) Visa Process & ProceduresMoving After the Wedding

out of curiosity I'd like to know if there are any restrictions to move to another state after the wedding?
if for example the US citizen has to move for work...

You need to inform USCIS of your new address. You CAN'T just put a fowarding address in with the post office.

K-1 Fiance(e) Visa Process & ProceduresMovement of K-1's
For a while, there were four service centers that processed K1 and K3 petitions. Those locations were Nebraska, Texas, Vermont, and California. Then, at some point in the past, Nebraska and Texas stopped adjudicating K1 and K3 petitions (I wasn't around here then, so I'm not exactly sure when that happened, but at least two years or so ago), but, the instructions for the petitions were never changed, so you were still to mail the petitions to Nebraska or Texas if you lived in one of "their" states, and the NSC or TSC would forward them on to California.

Now (as of July 30*), Nebraska and Texas still no longer process K1 and K3 petitions, but you can send directly to either California or Vermont, again, depending on where you live, but things should be more even now as to the number of petitions going to California and Vermont, so hopefully there will no longer be the great disparity of processing times between California and Vermont.

* You can send directly to the service center that will process it in advance of July 30, as long as you send it to the right one.

K-1 Fiance(e) Visa Process & ProceduresTotal Cost Sheet
With the new fees, it appears you are right. Since a lot more of the "hidden" fees are now included, such as biometrics and such. Oh, and the I-94 at the POE may cost you $6 or $7, or is that only at land crossings?

K-1 Fiance(e) Visa Process & ProceduresPassport Problem?
When my future step-daughter got her passport, the name is different than the birth certificate name. In Canada, at least, and I think in the US, as well, is that they want the name on you passport to be the one that you "are known by" and not necessarily your full, legal name.

K-1 Fiance(e) Visa Process & ProceduresCan you travel to the US while K1 is processing?
It goes the other way, too, USCs! Last weekend I needed to submit proof of ties to the US. Granted, I travel to see my fiancee about five times a week. Although, when I voluntarily went to the immigration office on my next reentry with that proof, the immigration officer couldn't figure what and why I was there, as primary didn't give me a "yellow ticket" and tell me to go there.

K-1 Fiance(e) Visa Process & Proceduresage requirement
Nathan,

The other thing you are over looking is the fact that even if she *could* come over here on a fiancee visa without her parent's permission, you and her would still have to have met in person before filing the petition for the visa.

Only 2 consulates in Canada handle immigrant visas like K-1, Vancouver and Montreal, pick the one closest to where your fiancee lives, I believe Vancouver handles Alberta Province.

o no i just sent out my paperwork and put OTTAWA as the consulate!! will this delay my paperwork ALOT???

No, it will go to where it needs to go, based on the address of the beneficiary. I put Toronto on our form, but Montreal received and is interviewing Kristy on Friday morning.

K-1 Fiance(e) Visa Process & ProceduresK1 from Germany...unclear...help?
Well, in that case, it might be a bit harder for you. You'd have to have clear indication and documentation that the person entering the country would be leaving after their trip. We lived right on the border, and crossed many times while the visa was in process.

K-1 Fiance(e) Visa Process & ProceduresK1 from Germany...unclear...help?
If, by some chance, it doesn't happen and time, and you have a non-legal ceremony, your guests probably wouldn't be any the wiser. Only the ones I told knew that. We even still went off to the side afterwords to sign something. In this case, it was a little thing the reverend typed up himself stating that we know that what he performed wasn't legal, etc., in order to protect his own behind. Plus, we then had proof that we weren't married at that ceremony if it ever comes into question.

K-1 Fiance(e) Visa Process & ProceduresYes, you can visit!
I'm the USC, but it works the other way, too. My fiancée lives just across the border from me, so I cross the border at least 4 or 5 times a week. I was pulled into secondary about a month or so ago, and the IO asks me if I have any proof of ties back to the US, etc. I didn't have much on me, just my work ID, etc. The officer worked out with me what would be some documents that would be acceptable to show the next time I cross. She ended up issuing me a "Visitor's Record" good for the weekend, and when I head back to the States I was to go back into the immigration office and relinquish it. On my next trip back, I wasn't told by primary inspection to go to secondary, which the original IO told me they would. So, I pulled over to secondary anyway, the Customs Agents outside asked for my yellow card, I said, I don't have one, I just need to go to the immigration office. The immigration officer asks me about 3 times why exactly I'm here, and I explain three times that I was told to come in here on my next visit and show my proof of ties back to the States. She glances at it, and puts a note in the computer that I've voluntarily given proof of ties to the States or some such.

CanadaThere's something weird about the flu shot.
I suppose you could call it a conspiracy. The big push behind the flu shots... and the government funding to keep them cheap, is to try to curb massive flu epidemics. The strains of flu virus in the immunization are supposed to be some of the more contagious strains.

Why could you call it a conspiracy? well... if 1/2 of the workforce is at home sick, not making money... thats that much less you can be taxed for, that much less product being made, and overall bad for the economy.... ok.. yea... its a far cry to call it a conspiracy.. but the foil hat wearers could cling to that.

As for getting sick from a flu shot... Its not uncommon to catch a cold after any immunization. While your immune system is busy fighting off the fake flu, its left somewhat vaunerable. At least thats the way its been explained to me....

CanadaIR1 / CR1 - Montreal Timeline to Interview
Just a quick update on our status.... We had our interview 5-7-2008, got approved, and picked up the visa the next day! Were finaly done! On a side note, our interview was originaly scheduled in march, but we rescheduled due to a sick baby. The bonus of that, is that our 2 year anniversary was in april, so we got issued an IR1 instead of a CR1... so WE ARE DONE!!!!!!!

K-1 Fiance(e) Visa Process & Proceduresquestion about the whole visa process?
just doing an AOS makes perfectly logical and legal sense for anyone here on a long term vesa for work or school... and a totaly beliveable story in the interview (Over the past year i've been here, we fell in love and decided to get married, yadda yadda). I mean, it would be really counter productive to have to quit your job, move back to your home country, and wait on the k1/k3, only to move back and be unemployed.

I think the only contentment to be had is the fact that it is a system that can be and sometimes is abused... and well, if you can sleep sound at night then i guess its that persons descion

Hi Lisa,

I'm not really familiar with the K1 process and I'm not bringing any children with me, however I'm sure there is someone here who does know.

Did you file a K2 for your Sons - did you check to see if this is an option?

Thank you for responding. My 2 sons are on my K1visa application. I think that is what a K2 is, not positive though. I think I'll post the last question as a new topic and see if someone can help me. Thanks for everything.

I was wondering that, too. If your sons came here with K2s (named on your fiancee's original petition), had their interviews, and got a visa put into their passports, then they need to adjust status once you marry your petitioner, too.

Cats are really easy to bring over. As long as they look healthy, they're good to go, but you may want a letter from your vet just as a safeguard. There was a post in the last couple of days that had a link to the actual regulations on cats.

From the sounds of things you both are living illegally in Canada. Do either of you have residences in your home country? Have you been "visiting" Canada for longer than 6 months?
Why woudn't you return to the UK and bring your wife over there with you so at least one of you can work while the US process is going? I think your only option is either go back to your home countries and wait it out or get a good lawyer before Canada Immigration finds out deports both of you.

OK, thanks for all your responses, got much more info here in one day than from my Canadian "lawyer" in a year. I just have a visitors visa for Canada, I've been here longer than 6 months but the "lawyer" has extended my canadian visa twice already. My wife just "visits" me as we are close to the US border. I never knew that having a visitors visa is not sufficent for going to the interview in Montreal. No lawyer has ever told us that. Looks like we'll have to put our thinking caps on.. Thanks again for the replies

In order to help alleviate their backlog, Montreal had just recently (June, I think) stopped accepting visa applications from third-country nationals such as yourself.

OK,
Still trying to think about this, or lawyer has told us lots of untrue stuff. We have a co-sponsor who filled out an affidavit of support. Our lawyer told us that all 3 of us (My wife and I, and our co-sponsor) HAVE to go to the interview in Montreal. I read somewhere that only 1 US citizen is allowed into the interview with the benificiery. If I do go back to the UK would all of us have to go?? or just me?

Thanks

One US citizen is allowed, but not necessary. Many people go to their interviews by themselves.

CanadaPOE/K1 Visa Question - Canadian & Detroiter!!
Figures. The part that neiks bolded also stated "immigrant" visas, and remember, technically, K-1s are "non-immigrant."

Once Doug does move over, he's continuing to work for his Canadian employer? Someone's going to drive the load across the border and then he'll take it the rest of the way?

So, even if he does have to activate it as soon as he has his passport back, it's not a big deal? You were just concerned about the week or so he'll be without a passport and visa?
