Removing Conditions on Residency General DiscussionBiometrics
Well, I had my biometrics appointment this last Tuesday, March 13th....

We got there kind of early around 2pm and my appointment was for 3pm so I told hubby that we should just drive around for a bit or something....

I finally went in about 2:45pm and hubby waited in the car... and when I went in I kicked myself because there were a ton of people in there.... I think there was some sort of back-up too right before I got there.....

I went to the Security desk and the guy gave me a form to fill out and a number and he said when I call your number bring the form up to him to check out etc... Well my number was not anyone where near the number that was currently on the board... i can't remember how long i waited but it was at least 30 minutes

and then after they looked over my form i was told to sit in some other chairs and wait for my number again..... My number was one of the last ones..... again I can't remember how long I waited but I think my number was up just after 4pm... I was out of there about 4:15.... They were moving pretty quick by then because they closed at 4pm and they wanted to go home... :P

My poor hubby was waiting in the car the whole time but he said he didn't mind to much because he had his satellite radio to listen to....

So my advice if you have to go to the EL Monte, California ASC is to go early....

Removing Conditions on Residency General Discussionaddress change after the I-751 ?

What is the I-865 for?
My husband is the Citizen, I'm the immigrant...

As immigrant I'm not sponsoring nobody, so, I dont think I need to do the I-865? is that correct?

the I-865 is the "Sponsor's Notice of Change of Address"

your husband needs to file the I-865 because he is your sponsor...........

and if you have a case pending when your address changes you should file those forms but also call it in...

I was told that filing those forms doesn't officially change your address... it just lets them know where you are....

If you are not a U.S. citizen and you have a case pending with USCIS, you will need to do both - call customer service at 1-800-375-5283 and complete the paper AR-11. Completing an AR-11 does not update your address on any pending case. Also, notifying customer service does not meet the legal requirement of completing an AR-11.

Removing Conditions on Residency General DiscussionTravel abroad while processing
as long as your green card doesn't expire before you get back from Canada , you should be ok...

about a month or so after you submit your forms you will receive a NOA which extends your conditional Green card for a year from the date your Green card expires... .. if you travel internationally you need to take this NOA and your Green card....

I was just doing some rough calculations and I think that if you submit your form on June 1st that might be cutting it kind of close to the 90 day window... You can file within 90 days of your green card expiry date and not before....

and it is 90 days not 3 months....

The CSC seems to be pretty quick when it comes to the I-751....

looks like it takes about 3 or 4 months from start to finish....

I filed in LA recently too....

I sent my package out on Feb 3rd and they received the package and cashed the checks on Feb 7th....

I got my NOA on Feb 27th and Biometrics appointment letter came on Feb 28th... My BIO appointment is on March 13th...

I think you should get your NOA and Bio appointment before you leave... If for any reason you can't make the BIO appointment you do have the option of rescheduling it...

Removing Conditions on Residency General DiscussionChange of Address
if you are in the middle of filing anything and you move you need to file the AR-11 and you need to call them....

You can do that here on our website with the Electronic Change of Address tool. If you choose to use this online tool, you can complete an electronic Form AR-11 and notify USCIS to update your address on most pending cases.

Regardless of whether or not you are a U.S. citizen, if you choose not to use the electronic change of address notification, you will need to call customer service at 1-800-375-5283 to request that the address on your pending application/petition be changed. If you are not a U.S. citizen, you will also need to complete a paper Form AR-11.

also remember to file the Sponsor's Notice of Change of Address

i file my papers next wk, so can i just write a letter explaining to them what happened?

i am so confused about when to send in our petition as some people say 90 days before and some people say anytime before the date the card expires...

my card expires on the 26th may and we was going to send ours in between now and the 12th of april...is this ok, will i still recieve my 1 yr extension before the 26th may?

you can file anywhere between 90 days and the date your green card expires...

Removing Conditions on Residency General DiscussionFiling Tomorrow, the day her greencard expires!
I found this on a site... it might be a good idea to do this...

If you file your application too soon, that is, earlier than 90 days before your conditional residence expires, application will be sent back to you. Remember that you need to file up to 90 days in advance, and 90 days is always not the same as 3 months. If you are late only by few days for few weeks, mail the application with a cover letter, explaining the delay.

Removing Conditions on Residency General DiscussionWhen have the conditions can be removed .

MarilynP,

Point of clarification: the person has to petition to have the conditions removed in the 90-day period. The conditions do not have to be removed in that time frame, and most likely they will not be removed anywhere near that soon.

Yodrak

the conditions have to be removed anywhere between 90 days and the day your green card expires (although it is wise to file the paperwork as soon as possible within those 90 days)...

.....

thanks, that is what I meant to say...

oh ok... yeah, nebraska that is then. also, i had no idea it may take a year or so.

thanks for your help. i guess i better schedulle my biometrics. man, i forgot everything, since life was pretty good without worrying about any immigration processes.

you don't have to schedule the biometrics....

you will mail off the package and when they receive it they will send you the NOA which extends your green card for up to a year... not sure how long it takes to get this NOA, it varies by service center...

then shortly after you get the NOA you should receive a Biometrics appointment letter which will tell you where you need to go and the date you need to go.... if that date doesn't work out for you, you can reschedule it and it tells you how on that letter....

Then after the Biometrics you just have to wait until they send your card to you... which also varies depending on the service center... You usually don't have to go for an interview but they do call some people in, For quality control, I think....

there is some good info here on what to do...
http://www.visajourn...p;page=751guide

for the address change thing you need to file form Ar-11 and Sponsors Notice of Change - I-865 separately from the I-751 package once you move ....... There is an option to file the Ar-11 online but the I-865 you need to mail in....

and on the I-751 Form you need to list your new addresses and any previous addresses where you have lived....

and I am not sure if you know but you can't file for the removal of conditions till anywhere between 90 days and the day your green card expires... which would be sometime after May 25th for you....

and you will need to do the Biometrics again...

and you will mail the package here...

Anyway, remember they want to see primarily items that carry both your names, so if some bills don't show both names, you might want to consider excluding them, to keep your package in a reasonable size. Overall your list looks good.

this is not necessarily true.... I think it is good to include a few things that have just one spouses name on it, specially for people who might not have a lot of other evidence.... I submitted a few bills with just my name and a few bills with just hubby's name....

I just submitted one copy of each recent utility bill.. one copy of a recent bank statement...

i also only included the page that had the names on it.... like I didn't include the whole bank statement just the page that all the pertinent information on it.... Same with the tax forms... I didn't include all the pages just the one with our names on it....

Removing Conditions on Residency General DiscussionReentry Permit

Form I-131, Application for Travel Document)

If you are in the United States as a permanent resident or conditional permanent resident, you may apply for reentry permit.

Departure from the United States before a decision is made on an application for a reentry permit does not affect the application.

You must be physically present in the United States when you file the application. However, a reentry permit may be sent to a U.S. embassy or consulate or department of Homeland Security (DHS) office abroad for you to pick up, if you request it when you file your application.

With the exception of having to obtain a returning resident visa abroad, a reentry permit does not relieve you of any of the requirements of the United States immigration laws.

If you stay outside the United States for less than one year, you are not required to apply for a reentry permit. You may reenter the United States on your permanent resident Card (Form I-551).

If you intend to apply in the future for naturalization, absences from the United States for one year or more will generally break the continuity of your required continuous residence in the United States. If you intend to remain outside the United States for one year or more, you should file a Form N-470, Application to preserve Residence for Naturalization Purposes. For further information, contact your local USCIS office.

http://www.uscis.gov.../form/I-131.pdf

1-2 Years: Reentry Permit

If you are a lawful permanent resident or conditional permanent resident and wish to remain outside the United States for more than one year, but less than two, you require a reentry permit. A reentry permit is not required for a trip that is shorter than one year. (You should note that an absence of more than one year will break the period of continuous residence required to become a citizen, even if a reentry permit is issued -- see Application for Preservation of Residence). A Reentry Permit is also issued to lawful permanent residents who want to travel outside the United States, but cannot get a national passport from their country of nationality. A reentry permit is valid for two years and may not be extended.

An application (Form I-131, Application for Travel Document), along with the supporting documentation and fees, should be submitted while in the United States, at least 30 days prior to your proposed date of departure, to: U.S. Citizenship and Immigration Services, Northern Service Center, 100 Centennial Mall North, Room B-26, Lincoln, Nebraska 68508. If you think you may have to leave the United States before the reentry permit is received, you may have it sent to a U.S. Consulate or USCIS office overseas for pick up. There is a place on Form I-131 to furnish the information necessary to receive the reentry permit outside of the United States. However, even though you may receive the reentry permit overseas, the application must be submitted while you are still in the United States.

Removing Conditions on Residency General DiscussionRisk of losing job if I don't get either extension or the 10 yr GC

I’m notifying you now because the renewal process can take two weeks to three months and sometimes longer.

It is also very important for you to understand the XXX Office of Personnel Management (OPM) will not accept an I-797 Notice of Action.

Wow, I like how they think that the process can take as little time as two weeks. Now that would be a record renewal, I wonder what the record time IS. I also like how they think the average longest time is three months. It's usually 4-6 months or more these days.

And they won't accept the NOA???!?!?!? Is that legal? I know someone on this board went through this whole fiasco recently.

But yeah you don't have to ask for the year extension, you will get that, hopefully within 1-4 weeks after applying. But apparently the one year extension (the I-797 Notice of Action) is not good enough for them. :(

mine took less then 2 months but I was going through CSC, which seems to be processing I-751's pretty fast these days... hopefully the other service centers will catch up soon...

Removing Conditions on Residency General DiscussionRe-entry permit

Do I Need to Be Physically Present in the United States at the Time of Filing?

The Form I-751 (Petition to Remove the Conditions on Residence) can be filed regardless of whether you are physically present in the United States at the time that you file. However you must return to the United States with your spouse and your children in order to comply with the interview requirement.

If you are in the United States as a permanent resident or conditional permanent resident, you may apply for a reentry permit.

A.Departure from the United States before a decision is made on an application for a reentry permit does not affect the application.

You must be physically present in the United States when you file the application. However, a reentry permit may be sent to a U.S. embassy or consulate or department of Homeland Security (DHS) office abroad for you to pick up, if you request it when you file your application.
