you can file anywhere between 90 days and the day the green card expires but it is best to file it as soon as possible within those 90 days...

mhh now i am confused.. i have to file for my I-751 in middle march.. do i have to pay the new fee (465$) or the 275$?

Removing Conditions on Residency General DiscussionI hope I didn't screw up

Well that's what I was thinking too. I was wondering why that was relevant to his address changing. I will just go ahead and send it in without that information. Do they send you something letting you know the change has been processed? Should I bother spending the extra money to send it overnight or receipt confirmation?

I would send it with some sort of receipt confirmation because they don't send you anything...

you also need to send out a Sponsor's Notice of Change of Address - I-865

Removing Conditions on Residency General DiscussionHow long are you going to wait before you file your N-400?
I think they should either bump up the citizen requirement to 2 years or lengthen the removal of conditions to 3 years...

that way you have a choice on whether you want to remove conditions or apply for citizenship... it would save some money for those of us that want to become citizens...

Removing Conditions on Residency General DiscussionReceipt Notice and NOA1

Customers who have an application and/or petition which has been filed with USCIS but has not yet been decided (also known as a 'pending' case) should notify USCIS of any change of address as soon as possible after moving.

The law requires nearly all non-U.S. Citizens1 to report a change of address within 10 days of moving by completing a Form AR-11. Abiding by these legal requirements and completing the necessary forms does not update an address on any applications or petitions pending with USCIS. Non-citizens with pending cases must do both.

https://egov.immigra...i/go?action=coa

Regardless of whether or not you are a U.S. citizen, if you choose not to use the electronic change of address notification, you will need to call customer service at 1-800-375-5283 to request that the address on your pending application/petition be changed. If you are not a U.S. citizen, you will also need to complete a paper Form AR-11.

If you are not a U.S. citizen and you have a case pending with USCIS, you will need to do both ? call customer service and complete the paper AR-11. Completing an AR-11 does not update your address on any pending case. Also, notifying customer service does not meet the legal requirement of completing an AR-11.

Filing Form I-751?
Want to know what you can and can't do after your card expires?
Missed the small print in Ewok's post?

Read the USCIS page first, please.
How Do I Remove the Conditions on Permanent Residence Based on Marriage?

If you file your USCIS Form I-751 (Petition to Remove the Conditions on Residence) on time, the USCIS will extend your conditional resident status for up to 12 months while your Form I-751 petition is under review.

Me: You will be mailed a letter receipt for your I-751 stating the above. Carry it and your expired Green Card as proof of your continued status as a PR. ie: Nothing Changes.

i of course didn't do this :P I am kicking myself that I didn't think of doing that...

Removing Conditions on Residency General DiscussionMoving while holding Temporary Green card ( 2 years holder)

Yup, just file the AR-11 to let the DHS know that you've moved (needs to be done within 10 days of moving). Then, when you come to file the I-751, you will need to include an additional sheet of paper listing all your addresses since you got your conditional green card (this is what I just did as I moved twice since I received my conditional green card). The I-751 instructions tell you everything you need to do.

if your spouse is also moving then they will need to file I-865 within 30 days...

I didn't know about this -- what happens if you don't file within 30 days? We moved in November, could we still file this now? :o

file it now.... I was a little behind on filing those forms, it shouldn't be a problem...

Removing Conditions on Residency General Discussionmoving from Chicago to New Jersey

yes we do have some time. With the move and all I don't want to miss anything.

Thank you very much for the advice. I checked out those forms and will file them in March as soon as we move. Do you know if I will get any letter from USCIS as a confirmation saying that our application has moved to Vermont after I submit the change of address forms?

after you move and it is time to submit the I-751, submit it to Vermont with your new address,....

there is no need to inform the Nebraska Center that you moved unless you have a case pending there, which you don't have at this time....

Removing Conditions on Residency General Discussionmoving from Chicago to New Jersey
I just wanted to let you know that you file the I-751, 2 years after you get the green card.... you have a 90 day window up to the date your green card expires....

When you move you need to file a AR-11 which you can do online now too...

https://egov.immigra...i/go?action=coa

you will also need to send in a Sponsor's Notice of Change of Address

when you fill out the forms for the I-751, include your new address.... but if you have a case pending before you move you need to call customer service at 1-800-375-5283 to request that the address on your pending application/petition be changed.....

but from the looks of it you probably have enough time between your move and when you can file...

Removing Conditions on Residency General DiscussionFrom temporary green card to Citizenship directly

From your timeline it looks like she can apply around Sept 2008.

Jackie (F)

Jackie,

yeah, thats right. its just that somebody told us at the superbowl party that we set an appointment or something with the immigration officer and ask about the US citizenship. With the fees going triple, who doesn't want to get US citizenship before the fees go up, right?... :) thanks Jackie!

Marilyn,

we know very well that i have a "conditional" greencard. we also very well understand that i have to get a 10 year greencard, wait another three years before applying for US citizenship. that means i still have four years in waiting. no arguments. its just that somebody wants to help us. thank you.

KAROL

no, you don't have to wait another 4 years....

you can apply to be a citizen 3 years after becoming a permanent resident, which you are now, conditions and all....

so 3 years after you got the card you have now... you can apply for citizenship....

Removing Conditions on Residency General DiscussionFrom temporary green card to Citizenship directly
you have be a permanent resident for 3 years (if you are married to a USC) before you can apply for citizenship..

no ifs ands or buts about it.....

your wife is a permanent resident now, the green card she has isn't temporary it is just conditional....

she will have to apply to remove the conditions anywhere between 90 days and the date her green card expires.... (which is 2 years after she received the green card)..

sometimes the process of removing conditions might overlap the 3 year mark but she can still apply for citizenship at that time even if she doesn't have the 10 year green card yet...

Removing Conditions on Residency General DiscussionFiling N-400 without waiting for I-751 approval?

Not to hijack your thread...

Kim came to America under K-1 in May 2005, got her CPR in March 2006. Plan to file her 10yrs card sometimes in Jan next year. Question: when will she be able to file for her N-400? Is it 3 years or 5 years living in America continuously? Thanks....

its 3 years after becoming a CPR, if you are married to a USC... so sometime in the beginning of 2009, she would be able to file the N-400

I received my NOA yesterday and it mentioned on it that my conditional residency had been extended for one year.... and it also included my application number which I entered into the USCIS site and my petition came up....

Removing Conditions on Residency General Discussion10 yr GC from California Service Center

I just wanna thank everybody for helping me out to clarify some issues at the time of my filing for I-751. I finally got my GC today from California Service Center. Here's my timeline:

11/26/06 sent petition thru priority mail ($205 fee)
After 2 weeks, petition came back (wrong date on check)
Mailed it back the following day
1/16/07 Biotmetrics taken
2/20/07- petition approved
2/28/07 GC received from the mail.

To those who are still waiting for approval, good luck and just hang in there.

Hi everyone, just a quick question ... so it's really a:

$205 personal check/money order .. payment you will send along the I-751 & requirements? or 2 checks one for $205 and one $70 for biometrics?

just curious although its far for me to be.

Thx for info's on this!

you can send one check for $275

or two checks.. one for $205 and one for $70

Removing Conditions on Residency General DiscussionA little confused about the I-751

Oh I forgot to ask, with the fingerprinting, its up in Portland (Im like 200 miles away) and both me and my wife work at the same place, so we need to schedule the same day off (theres no way Im up to drive around portland myself) are the fingerprinting center's open on weekends and do you think it would it be cheeky if I could ask for a weekend apointment.

https://egov.immigra...office_type=ASC

if you scroll down on this page.. it will have a place where you can enter your ZIP code and find the closet ASC (Application Support Center) nearest you

ok I just checked Oregon and they only have 3 ASC's.. that kind of sucks....
