Removing Conditions on Residency General DiscussionCompilation of Evidences for I-751
umm, if that were the case then birth certificates of your children would be required documents too as they are listed in that same part...

QUOTE
The documents should cover, but not limited to,the following examples:

1. Birth certificate(s) of child(ren) born to the marriage.

2. Lease or mortgage contracts showing joint occupancy and/or ownership of your communal residence.

3. Financial records showing joint ownership of assets and joint responsibility for liabilities, such as joint savings and checking accounts, joint federal and state tax returns, insurance policies that show the other spouse as the beneficiary, joint utility bills, joint installments or other loans.

4. Other documents you consider relevant to establish that your marriage was not entered into in order to evade the U.S. immigration laws.

5. Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. (Such persons may be required to testify before an immigration officer as to the information contained in the affidavit.) The original affidavit must be submitted and also contain the following information regarding the person making the affidavit: his or her full name and address; date and place of birth; relationship to you or your spouse, if any; and full information and complete details explaining how the person acquired his or her knowledge. Affidavits must be supported by other types of evidence listed above.

YES you need to include the Affidavits. The forms instructions specifically list them as a required document to be filed, seperate from your supporting docs. You don't want to give them ANY reason to send your application back as incomplete.

I am on the process of filing for I-751. I was wondering if including sworn affidavits to the 1-751 application is not really necessary. Please take a look at my list of evidences and let me know what you think... Thanks for all your help! More power to Visa journey!

But note that, per the links you quoted, the exception to passport requirements for land travel ONLY applies to US Citizens.

I believe those who are not US citizens require a passport, even for land travel. I think that's true even for Green Card holders.

It sounds like she should renew her Mexican passport at the nearest consulate in the US before travelling.

Thanks Marilyn.

I tried to transfer two of the utility bills in my name. Not sure if they could process that in time for my submission next month that in time. And maybe there's still time to add my name to the lease.

Also, I might have to include a signed affidavit from two people that we know, to state we are living together from the day that I got here.

I would still include the utilities....

Removing Conditions on Residency General DiscussionWhat evidences did you submit?
you could still add your spouse to your utilities.... that is what I did.. it is pretty easy and can usually be done online...

I would also send in some bills etc.. that are in your name and some that are in his name... but they will show that you live at the same address...

I started saving envelopes a long time before I removed conditions because I knew I would need them for that...

copy of rental agreement
copy of car insurance

copy of 401K that states that I am the primary beneficiary
copy of health care statement showing that I am covered under hubby's health care insurance
copy of one recent gas bill

copy of paper showing that hubby added me to his bank account
Copy of some bills (Sirius, Netflix etc) with just hubby's name and our address on it
Copy of some bills with just my name on it and our address (recent electric bill etc..)
Some envelopes with both our names and address on them...

I just sent in the most recent bill for each utility.... The phone and gas were in my name but I added hubby's name, the electric company didn't let me add my hubby's name...... and I just included the most recent bank statement.... and the application that we filled out to add me to hubby's account...

you said she has been living in the US for 3 years but how long as she been a permanent resident.. you can apply for citizen 3 years after becoming a permanent resident, conditional or not...

me thinks since you applied for the removal of conditions this year in March that she hasn't been a permanent resident for 3 years yet...

well heres what happend - she came on fiance visa march 05 - got married apr 05 - had GC number issued to her which was wrong and belonged to someone in USA already at the time so we went to infopass got that sorted out and got new GC in May 2006 which expires May 2008

we applied for 751 in March 08 (within 90 days per guidelines) and in April technically speaking she's completed 3 yrs in USA (1 yr on old GC + 2 yrs on new GC number) so technically, she's definitely been in USA for 3 yrs now.

but would her having the wrong green card number for one year really count though??

it is actually very sad to see that you too are in the same situation as I am. I cannot believe that they play with our lives like this. It is very difficult to deal with this emotional stress. Anyways, I too will be sending a letter to CSC Director, first thing tomorrow morning. Let me know as soon as you hear anything from the officer at the local office or via any other correspondence. I will keep you posted as well. Let's keep in touch regularly until we resolve this.
