I think you just got an adjudicator who didn't know what he was doing..

lots of people include all their children and yours is the first I have heard of someone getting in "trouble" for doing it... unsure.gif

Part 5 says to list ALL children. However they "mean" to list all children you want to remove conditions. NOT if the children are US citizens.
There is no place that fits for US citizens. If you do so they may send a RFE asking for the $80 biometric fee for the kid. It's happened and screwed up the process for awhile. VERY difficult to correct and get the process moving again. Been there and done that!

From the instructions for I-751.

Conditional Resident Children
In Part 5 of the form, please make sure to include any conditional resident children applying with you in order to have their conditional basis removed, or they may file separately. Please remember to provide their A-number.

and it says, please make sure to include.. it doesn't say please list all or only the conditional resident children....

well, it is a requirement to file the I-865 and I wouldn't advise not sending it in... you never know what could happen if you didn't....

I don't mean it is a requirement to file the I-751 but it is a general requirement of the Sponsor....

I am not sure what you are getting at but yes I know you can do the AR-11 online but you can't do the I-865 online, you can only mail it in...

Our RFE stated we needed to send the full bank statement not just the part showing name and address and same for taxes, even gave us the number to call the IRS to request the transcripts.

I really think it's up to the person reviewing your case.

yeah and that is another part of this removing conditions process that sucks.. shouldn't there be a guidelines to follow?.. seems like some of these adjudicators make up their own rules as they go along..

yeah they could do that but they would also have to call the USCIS to change the address on their pending case..

Why does this NOA say if you have not already done so, provide supporting documents to assist USCIS in processing your petition.......then they list lease, joint ownership of assets, tax returns,etc. That is what was included with the I-751 filing and you needed to submit these documents with the I-751?

Hi, She cannot get an I-551 stamp in her passport for removing of condition I 751, you only get that when you adjust status, once, for I751, you only get an extention letter which will be mailed to you soon, then after that you either get an interview date or an approval for her 10 yr green card, what you can do at the biometrics appointment is explain that she is travelling and need a fast extention letter,they might be able to issue one quickly. so before she travel, make sure she gets her extention letter,if not she might not be able to get back into the country, be careful not to travel without the extention letter.if not immigration at the port of entry might bare her from entry,you will get it the mail soon,be patient
