IR-1 / CR-1 Spouse Visa Process & Proceduresstupid question
check the websites of the countries you are visiting

U.S. citizens require one of the following:

* A valid passport and a return/continuing ticket.
* A birth certificate with raised seal and photo identification and a return/continuing ticket.
* Naturalized citizens must show an original naturalization certificate with photo identification and a return/continuing ticket.
* Permanent Resident (Green Card) holders must have a valid passport and a return/continuing ticket.

http://www.st-maarte...equirements.htm

To enter The Bahamas, U.S. Residents who are not U.S. citizens need the following documentation:

Alien Registration Card (Green Card)
For visits NOT exceeding 30 days:
An original Alien Registration Card is required, along with a national passport (passport from country of birth). Passport can be expired up to 5 years.

For visits exceeding 30 days:
A valid national passport and a Bahamas Visa are required for U.S. resident non-citizens wishing to stay longer than 30 days.

http://www.bahamas.c...&toplevel=59196

Puerto Rico Passport & Visa Requirements
Entry requirements for Americans: There is no immigration control for United States citizens arriving from the United States. However, US citizens arriving in Puerto Rico from central or South American countries, or from Caribbean islands, require proof of United States citizenship or a birth certificate; those arriving from elsewhere should have a United States passport.

IR-1 / CR-1 Spouse Visa Process & Proceduresstupid question
yes, they can leave and come back without Advance Parole...

Some countries though have different requirements for permanent residents (greencard holders) entering their country so you might want to look into that....

Agh!

family name is her married name (unless the person kept their maiden name, then they they would put that)...

there is a place further down the form where it asks for other names used including maiden names..

No there isn't. Look at the section asking about the United States Citizen. It only asks for their family name. There isn't a part that asks for other names used. I don't mean to be argumentative. I hope I have the right version of the form. I downloaded it from the USCIS website. Look at Part 4 "Information about the spouse or parent through whom you gained your conditional residence."

Then again, her last name was the same as mine when we applied for my Adjustment of Status so that makes sense! Thanks.

sorry I misunderstood.. I thought your wife was the immigrant...

yes, the family name is her current married name.... which is your last name...

It looks like the application was REJECTED (that's to say NOT ACCEPTED) because you sent a check with a wrong fee.
It was NOT DENIED. They are telling you to re-file with the right fee. So do it ASAP!

FYI, applications are rejected when the forms are incomplete or the fee paid is wrong. The process does not even start.

Once the forms are complete, the fee is correct and evidence is sent, the application is ACCEPTED and the process will begin. It'll be pending for a few months. If they need more evidence they will send you a letter Requesting Further Evidence and/or they may also send you an appointment for interview. After all this the application will be APPROVED or DENIED.

if you read the OP's time line it says they already received the NOA1 and the biometrics appointment...

A cover letter with Dear Sirs: Re your full name and A# application for I-751.

Please find enclosed a check for application fee amount and biometrics amount for the total amount of $xxx.xx and the enclosed evidence listing your evidence.

List.

These are financially hard times for many of us, but a very brief description like, my husband was laid off, we purchased a home or whatever, had to file bankruptcy, we had moved in with my parents, I did find a job to help so can only submit one tax return. My husband and I are deeply in love and committed to work through these hard times with the help of my parents, we had to put off having a baby, etc.

Don't get emotional, keep it short and direct, be honest and keep the total letter on one single page. These letters are difficult to craft, but that way they will know what's going on and won't have questions.

But it's up to you.

The list is quite reasonable. A few more photos won't hurt. Also, try to make sure you've covered all of the last two years (ie all tax returns together not just most recent, utility bills from every couple of months since you've been here etc etc)

I back up "more pictures".
Pictures are still worth a thousand words!

I would also add copies of both your driver's licenses or State ID cards showing both of you at the same address. For your tax returns, I suggest sending tax transcripts from the IRS.

the prob is that we changed our address thru online and we didnt renew our driver's liscence with the new address...

You should update your driver's licenses or State ID's ASAP. You should be able to walk in and get it done and have the new ones the same day. Also, I am not sure what the laws are in your State, but in Iowa, I think you have to update your IDs after moving.

here in Cali you can update the address on your DL online but the address on your card stays the same.. they say to just put a piece of paper with your new address in your wallet along with your DL....

Removing Conditions on Residency General DiscussionI left the US on gov orders Before removing condition!!???
I am not sure where you got the idea that you couldn't remove the conditions from overseas because actually you can...

QUOTE
Exception: Those who reside overseas pursuant to military or government orders, including conditional resident dependents residing overseas and listed under Part 5 of the form, must submit the following items with Form I-751:

1. Two passport-style photos for applicants and dependents, regardless of age.

2. Two completed fingerprint cards (Form FD-258) for applicants and dependents between the ages of 14 and 79. You must indicate your Alien Registration Number (A#) on the fingerprint card and ensure that the completed cards are not bent, folded, or creased. The fingerprint cards must be prepared by a U.S. Embassy or U.S. Consulate, USCIS Office, or U.S. Military Installation.

In order for USCIS to identify filings based on military or government orders, applicants are required to indicate on top of Form I-751, "ACTIVE MILITARY or GOVERNMENT ORDERS", and submit a copy of their current military or government orders.

When filing the I-751 form I understand I will have to pay total of $545.00 for the application and biometric fees.

My question is for my step-son, do I have to pay $545.00 for the application and biometric fees or just the biometric fee?

Thanks ifor the help.

if you are including the step-son on the application you just need to include an extra $80 for the biometrics fee for him...

but if you have to fill out a separate application for him (if his card doesn't expire within the 90 day window of your spouses card) then he would need to submit the $465 (plus $80 biometric service fee)

QUOTE
Base petition fee plus $80 biometric services fee for all conditional resident applicants. Each conditional resident child listed under Part 5 of this form who is a dependent seeking to remove their conditional status, is required to submit an additional biometric services fee of $80, regardless of age.
