10. 11. Order of Processing
a) Routine and Expedited Cases . Generally, applications and petitions should be processed in the order in which they are received. Exceptions can, and should, be made for a number of different reasons, and sometimes those reasons may appear to conflict with one another. Reasons for prioritizing certain applications and petitions over others may relate to:

• A statutory requirement, such as the requirement that joint petitions for removal of conditions under the marriage fraud amendments be interviewed within 90 days of filing and adjudicated within 90 days of being interviewed ( section 216 of the Act), or that L-1 petitions be adjudicated within 30 days of filing (section 214(a)(2)© of the Act);
• USCIS -wide policy pertaining to the type of application or petition being filed, such as The USCIS Director's fiscal year priority that backlogs in a given type of application or petition be reduced to a specified level;

My husband has just scanned NOA1 for me. Explanations by phone about all this dates was a bit confusing. I’m in Poland now and for “learning language purpose ”as a K3 beneficiary I decided to take care of all this process. I really, really have no idea in what I jumped in. Not to mention that the vacation in Poland has turned into months of waiting.

Well, my received date on NOA1 hardcopy is August 1, notice date August 22, and USCIS case status online is telling me that they received I – 129 F on August 21, 2007 which I guess is the date when they entered the case into the system.
Anyone has any idea how much the online status is irrelevant cool.gif to the actual (pile of papers in the officer desk)case order?
They will honor received date but which one 08. 01(hardcopy) or 08. 21(online)??

As for buisnes you still can use your maiden name, Can you?
I change my last name only because my maiden was typical polish -no one was able to pronounce it and when I was spelling it I was using half of alphabet smile.gif .
For two years although I was using my old passport without a problem.

If so, probably looking at people timelines will help get the answer. After forms enter the system(1-2 weeks) it usually takes 2-4 weeks to case complete.

If assuming Lima is Appointment Processing consulate(I didn't check) then first you cooperate smile.gif with NVC by sendig 70$,I-864,400$, DS230+biograph info(packet 3). NVC will review this and, will schedule interview and forward to embassy EVERYTHING. Once at embassy your SO will receive packet 4- date of interview and date and place of medical.

Recently most consulates changed requirements. Instead processing immigrant visas in Standard Processing now becomes Appointment Processing.
So the rules where to send back p.3,4 also changed.
Package 3 -DS230 part I AND II plus all beneficiary biographical documents
Package 4 - invitation for interview and medical.

I don't remember on which official government web page probably on visa.travel.gov is a format how to write an inquiry to NVC. Basically as a subject you write nvc number, and in the post petitioner and beneficiary dates of birth, names,adresses (to be safe also phones). Make sure you receive automated notification they got your email.

We have chosen to send originals. Hovever when I was gathering all documents from local court etc. I always asked them to make two documents. This way, even something happens I will have another set with me during the interview or for any other purpose.

Thanks for the response. I know what you mean about not trusting attorneys. I just want to get our original I-130 approval from the local attorney because he has no clue. Keeps telling me he wants to file the I-129F at the Bangkok Embassy and everything I read says this isn't possible, yet he's been carrying on about it for 3 weeks now. Then the attorneys in BKK are telling me two different things. Sheesh, I'll be glad when it's all finished.

If we can file for both CR-1 and K-3 that would be great, but I don't want to cause any confusion with them. I just want my wife back here soon and I have no problem waiting for AOS while she is here with me. I wish there were more time lines for Bangkok so I could get a better idea of the time for CR-1's in the past few months.

I might be wrong but I don't see why not to apply for both.
However now to pursuit CR/IR rout FIRST you have to submitt I- 824 Action on Approved Application or Petition.
With K3 the problem is that USCIS to approve I-129 usually wants pending concurrently I-130 and since yours has been approved already you might face after 6 months waiting for I-129approval a cancellation of it. You don't want this. Hence I encourage you to file both I-824, I-129.

Did you get a letter asking for your DS230 before you had a chance to send it in? If so I was wondering if you responded to the letter? I received one and just sent in the DS230 with my supporting documents. It doesn't seem like I needed to answer the request for the DS230 since I was sending it in anyway. Well the thing is we are using James' shortcut so the next day after form DS230 was GENERATED my husband sent everything. He hasn't received actual letter asking for forms as of today (02.21).
We learned about RFE by automated systemon 02.16. I called on tuesday and I've been told after I-864 was completed, they "mising" DS230 packet and RFE letter was sent on 02.15. So it was "false" RFE, we had not have chance sent it by then. Just like you.
Yesterday DS230 entered into system(per operator) and I'm waiting for saturday update to hear this.
OK. My answer is like a maze but do you feel I have kind of answered for your question?

Welcome on CR/IR forum smile.gif. Our K3 was cancelled as well and we also didn't care about AOS or my ability to work but uscis decided otherwise.
As for now
I can really recommend using JAMES' shorcuts - they really save time. They work for us.
As for latest version of documents - I think the best is official Department Of State page.

About NVC mailing on Feburary 11- your mail is probably at their mailing room. It takes them from 1 to 3 weeks to actually mail letter.

Correct if your interview will take place after 03.16.08 your visa will be IR-1.

About conditional (CR)v. nonconditonal(IR) I'm not sure. I think to remove condition (2 years validity change for 10 years) you have to be still married. I might be wrong.

To talk to live operator you might call between 7.30 a.m- 12.00 a.m EST

Automated system is available 24/7 so using your INS number ( I-130 receipt number -including first 3letters) or NVC number (if petition is at NVC they give you new number)you can learn about your case status.

As for lawyers.
If there is not complicated situation this process is fairly easy.
I'm the beneficery I still learn English and because my husband is now busy with preparation to his March exams I'm practicly doing everthing by myself. Fee for lawyer we are saving for vacation smile.gif

I must admit without VJers I haven't chance to do it.
