That's a good idea Sweetgirl, I'll have to call my consulate here in the US to ask if they'd put a stamp... Because getting a new passport through Polish embassy in the US costs $110 AND you wait about 6 months. If you go to Poland for a visit on the other hand, you pay no more that $30 and you have it in 3 weeks.
I called Lufthansa about the name thing and they told me that as long as I have marriage cert with me it doesn't matter which name is where, because both are on the certificate.

You can travel without any problems now. Have your marriage certificate with you, and you'll be fine. And while you're in your country, why not get a new passport with the new name?

I've just noticed that my permanent resident card contains incorrect information (year of becoming a resident is 2005 instead of 2006 and expiration because of that is wrong). I'm gonna file I-90 (thank God no fee!) but what worries me is that they ask me to send them my original green card... I'm currently looking for a new job, so what am I supposed to do if they take away my card?! Does anyone know how long it takes them to send a replacement with correct info? Thanks!

I didn't include any photos, I figured things like taxes or mortgage are more important than pictures. But maybe I was wrong. I'll send pictures. I'll also send more docs covering the last 3 years... I don't know what to do about the utility bills though. I think all our bills are either in mine or my husbands name... I think USCIS should get real with that. A lot of companies won't even let you add a second name. How did you guys go around that? I looked at my house warranty (is that the deed?!) and it says something like "(my husband's name) and (my name), husband and wife, occupying the property at (address)". That shows joint residence right? I'm also going to ask my parents in law and friends to write letters... I really can't think of anything else... Many people I talked to (including USCIS 800 number) said the docs might have gotten lost (nice). So I'll just resend everything plus some more. Thanks again to everyone that responded!

I just got my first RFE in this whole immigration drama and I have to say that I hit me hard! I know I shouldn't sweat it, since I haven't even spoken to USCIS (I got the letter an hour ago and USCIS is closed right now) but I just don't know what they could possibly want! I sent our mortgage agreement, taxes for the past 3 years, medical insurance, house insurance, cars' insurance, bank statements etc... All joint. Aren't these the most important documents they are looking for? And that's not "sufficient enough"? What is then? That's ridiculous. We've been happily married for 3 years... What a beautiful gift for our 3rd wedding anniversary (on Monday). What do you think I should send? Pictures? All this stuff all over again? I just don't get it.... crying.gif Can somebody please help?

Again I'm trying to say in theirs timelines the sending date for I-129 petition is IMPORTANT, because theirs PRIORITY dates are still in JULY.

I'm telling:
Asumig most I -129 f petitions on your list gets to USCIS before July 30, theirs PRIORITY dates are not from August. Thats why I said I don't see August approvals.

The second priority date is for the I-129F and there are a few for August. When you're file the I-130 and then the I-129F later, the receipt day for the first does not count as your priority date. It's the receipt date for the I-129F. That is what was explained to me and what USCIS considers as my priority date.

Indeed USCIS goes by I-129 dates.
However please check the difference on your NOA1 for I-129 between PRIORITY DATE and RECEIPT DATE.
Priority date is the date when USCIS received petition (let say about 3 days after sending). Not when they produce receipt about receiving.
On USCIS. gov there is information they go by PRIORITY dates. And picture witk NOA1 and priority date is highlighted. Hence I don't see August approvals.

BTW In what order do you think USCIS is going? I was checking timelines by sent dates both I-130, I-129, and by NOAs but I can’t tell. Also it is something new that they process petitions separately.

Unfortunately I’m still waiting for both NOAs but what I read:
*To approve I- 824 (Application for Action on an Approved Application or Petition) takes 6 months indeed, and then from 3-6 to process I-130 in NVC.
*Unless you didn’t mark clearly (on envelope when sending I -130) that you want consular rout, to avoid waiting your option is continuing K3.

John and Celia, this is strange, both of your applications should have been approved. I was told the same thing...that my I-129F would take from 30 to 60 days to approve. However, I was also told by a USCIS agent that since my I-130 was approved first and even if my I-129F was approved I could no longer use the I-129F to seek a K3. Is this true?

I am very discouraged right now.


It is strange, I know, but I think I know what happened....if what the lady said was correct, then maybe two separate people reviewed the applications, and only one of them updated the website. There have been a few remarks lately that people have received their NOA2 hard copies but the website says "still pending". I'm hoping that when I get my hard copy of the I-130 NOA2 that the I-129f NOA2 will be in the envelope too....we can always hope! Good luck on your cases too! good.gif

It is NOT true, as long as your I-130 is not approved by NVC and later on arrives at embassy the I-129(K3) is still valid.

I just noticed that my I-129F was touched today after it been closed since 1/24/08, perhaps they did re-opened after I called them to see what was happening in my case.... They are driving me CRAZY!!!! But still no phone call to let me know status and today I called my congressman and both Senators and they all told me that I would have to wait a couple more weeks!!! Dear Nita
If you still have a choice between CR/K3 my humble suggestion would be K3, maybe a non- immigrant category will go less likely under long AP if any, this is only a suggestion.

I'm sorry to read this calamitka. Why did they tell you it would be cancelled? What is the current status of your I-129F? Our case was also one of those not so common, in which the I-130 was approved before the I-129F. I don't understand why USCIS doesn't follows the same procedures with everyone. After our I-130 was approved, they never sent it to NVC (even though the NOA2 said it would be sent to NVC)...they held it until the approval of my I-129F. It was strange that they paired our petitions after the approval of my I-130. You should try calling again, but call through the RFE line, they are able to provide with more specific details about your case.

Well looks like we are now going with immigrant visa I-130 was forwarded to NVC and they received this petition and case number was generated. When we caled to USCIS (RFE)they told us that there is new policy.Online status says still pending. Well I don't believe it, indeed the policy says that I-129 will be cancel but when both I-130,I-129 hits embassay.
Yesterday NVC sent AOS bil(afadavid of suport) and Choice of Agent form. If all process will take not more than 3 months it will be great , (no dealing with USCIS with AOS)but I'm afraid it is about luck. lots of luck yes.gif
Anyway congrats everyone to their recents approvals.

This is so true YGandMAT. How quickly you get through that stage really is all about luck. It depends on whether you're unlucky enough to be first in the new box or lucky enough to be the last in the old box.

We actually mailed in December this form 7001 to ombus. with questions like
Why our case was closed ? and after a month my hubby got the letter with the answer that all questions we should sent to USCIS. I don't want to bother my hubby to scan this letters, he get anxious when he only hear the word USCIS. Kind of alergy reaction.

I try to sent email to USCIS with inquiry.
