What about California and other states where same sex marriages are legal now?

Have they just simply not followed up immigration-wise with the new laws they've created?

That's a big shame and a huge disadvantage for gay couples, IMO.

I have a friend who has a close friend who is gay and married a US Consul. He supposedly has an immigration visa that allows him entry only to the 3 states in the USA who recognize same sex marriages. It took him barely 3 months to obtain it but obviously it all went through diplomatic channels.

I don't even know how true that story is. I trust my friend and she heard it directly from him. But I can't really confirm it. Just repeating what I've heard.

Quick question: my husband has just bought a house and will be moving there soon. He currently lives with his parents a few miles away and there's no problem getting mail there even after he moves.

We are on the last stretch of the USCIS stage - expecting to get our approval within 2-3 weeks (if things go well). So is it worth changing the address with USCIS now? Maybe it's better to just notify NVC once our papers get there?

Use whatever name she'll have in about 6 months when your case gets to NVC. Also make sure it's the same name she'll have on her passport.

I made the mistake of putting my maiden name on the i130 and g325, since that was still officially my name. I changed it and had all my documents changed (incl passport) about a month or two after we got married. Now it's kind of complicated to notify USCIS about that change.

So think ahead and use whatever name she'll have in her passport in about 6 motnhs.

Don't worry. Just put your current name on the DS230 when you send it to the NVC and have hubby write a letter of explanation that you've changed your name after the process started.

I did the same thing. My husband called USCIS but it seemed that they didn't need this info updated. It will be needed for the NVC part, though because that's when you send them a copy of your passport. So just update this info as your case gets to NVC.

Congratulations! What a load off your chest it must be.

Our NOA1 date is also Dec27th and we're still waiting. We're at CSC, though and most Dec cases have already been approved there. Hopefully ours is coming soon as well.

Also, check into processing times for fiance/IR1-CR1 visas when the petitioner is a LPR versus USC. For citizens it lasts much less than LPR's.

So I totally agree with mrsfrisbey - try and get her naturalized first before you plan the rest.

I'm afraid with any scenario you choose, you should be prepared for a year or more of wait time before you can be together in one place for good. So I'd suggest gathering as much info as you can and start your process asap.

Good luck on your journey. Life can be very surprising sometimes. Throws us in all kinds of weird places and has us fall in love with people across the globe, like a nearby town is just not enough ;-)

I spoke to my mailman in person. And I paid a visit to my Post Office. They know my name as both me and hubby have been getting mail here for a few months now. We live in a house and I see my mailman out on the sidewalk every day so he remembers me quite well.

I've called USCIS and put in a service request twice. I've never gotten a welcome letter nor the GC.

USCIS claims they sent it but it was returned by the Post Office as undeliverable. The first time they sent it I think they got the zipcode a bit wrong. But I gave them the correct address TWICE after what and both times the mail has not reached me.

When I call them they say they cannot tell me what address they keep sending it to because "the system won't let them access this information". I ask to speak to a supervisor but the they supposedly can't access this information either.

They say there is no other way for me to receive my GC. I would literally fly to Texas and pick it up in person but this is not allowed. Oh yes, TSC is taking care of this. Or not.

What can I do? I'm lost. How many times can I go through the same process over and over? Isn't there anything I can do about it?

Hey folks,

Long time no see. Sorry for that but I have so much on my head since the begining of the year.
I just wanted to congratulate everyone of you for getting through the embassy process or being almost there! In case you are still ahead - don't worry it's going to be OK!!!
Anyway I had my interview on January 22nd. It was smooth and easy conversation.
Got my visa and envelope in my hand last week! I have approx. 2 months to pack up and take off to my baby. Few days ago I bought my flight tickets to US and I'm flying to Louisville,KY thru Chicago on March 31st. We plan to get married on June 20th. I am so excited!!!

Now I'm getting focused on closing everything up here in Poland (banks, offices and all other places).
I am going to quit my job around mid March! Can't wait to get on the plane!

Good luck to Everyone!!!! I will keep my fingers crossed for all of my VJ family!

I dont know how I would get through that!

I'm just going to miss him so much and we won't be reunited until Christmas when he comes back to England. Any words of encouragement people...?? How do we get through this? unsure.gif


Well as everyone on this forum can confirm it is not easy to stay apart every single day. But I think the most important thing is to stay focused on your goal! I mean just imagine how happy you are going to be in several months and from there you will be together forever and ever.
Me and Sara see each other approx. every 6 months. Since I lefft US in March 2008 we have met 3 times (2-3 weeks most). The bright side of this horrible situation is that both of us are very busy right now at our jobs (she's a 3rd grade teacher and I work as a Logistics Anaylst). Also time zones do not help us out to talk to each other but we manage to find some time everyday.

I am not sure when I see her next time. We are thinking about Christmas but considering the flight prices we better save up money for the wedding which is planned for June 20th.
This means we get together after NOA2 and Embassy processes (April-May of next year). Sucks but We are see the Goal!!!
I think you are going to be OK if you won't see your fiance just for few months. It's only 3 months! Stay positive and think about this time you are going to spend together again.

Based on all this statistics it tells you when your application might be reviewed (approved).

My income was definitely below the threshold. What section should I write that in? On a separate sheet of paper, or on the actual AOS form?

Do that for any year it it applicable. Tax returns are not about proving you DID work. They simply require the historical information FROM the three tax returns, as applicable.



Is it for the last 3 tax returns, or the last 3 years?

Working abroad does not exempt you from filing tax returns. You file, even if there is no tax due on the foreign income. Have you been working abroad as well as living abroad? If so, you've got some back tax returns to file.



I was living here in Poland working in my family's business. I never filed any tax returns here, I would have to check with my father to see if he filed them for me. Do I need to file for that in this situation?

Hi everybody,
My I-130 was recently approved, and now I'm preparing my I-864 as the petitioner, and I have a question about the required most recent
tax return. I did work for a few months in 2011, but I haven't done my taxes yet. I'm living in Poland so I would need to e file my
taxes, but I don't have the required bank account in the US. Right now my income is $0.00 so my brother will be the co-sponsor. Also,
other than the few months I worked in 2011, I didn't work in USA at all for about 4 years because I was living abroad. So...

My question is this:

Will I need to file for a tax return and get the tax transcript
from the IRS to send with the I-864, even though my current
income is $0.00?

I'm curious about this because I read that the most recent year tax return is REQUIRED, but I don't see why they would want me to prove
that I DID work. My brother will be the only source of income until we get there and find work.

Any advice or comments will be much appreciated :yes:

You don't assign yourself as the agent, the beneficiary (your foreign spouse) assigns an agent. Furthermore, the DS-3032 email is sent by the beneficiary.

Finally, it will make no difference who the agent is in regards to how fast the process proceeds.

True. What I meant was if they have to send all of the paperwork overseas, would that slow down the process compared to just sending it across the country?

Should I (USC Husband) assign myself to be the agent even if I'm living in Poland with my foreign spouse? Of course, I want this process to go as quickly as possible, so would that be the best way to do it?

I'm concerned about something I read today.
In the I-864 Instructions Page 11, under the Check List, For Some Sponsors, line four, sub-line 2, I read:

--If you are using the income of persons in your household to qualify,

--[You need] Proof of THEIR RESIDENCY IN YOUR HOUSEHOLD and relationship to you.


Q: Does this also apply if WE will be living in THEIR HOUSEHOLD? Do I need to show proof of this?

It would be great if anybody who has experience in this matter could give me some info. Thanks in advance :blush:

Yeah thats the solution but might not be the best option at this time.

It might delay the whole NVC process specially when I-130 Petition is already approved by USCIS. I am planning to brief my spouse about the situation just in case, if she is questioned during the interview. Personally, I see I - 864 as financial document rather than relation oriented. So, if there is no other red flags about the relation, marriage filing single should not delay the process. Hope I am right though...lol. :innocent: :innocent: :innocent: ....I am still on WAITING GAME.....

I think what he means is that as long as you aren't having problems proving that you are married, then you shouldn't have to go through the extra work involved with filing Married Filing Jointly. Maybe you can just amend the return and file as Single. That is what I did (We got married in 2011, but I just filed as Single) and I also think that should be okay.

Maybe some other members who have experience in this area could give us some input on this?

Hey JTSG,

Your household size should be 2 -> you and your husband. For 21a, enter your 1 husband, and 21b is automatically selected for yourself. 21c is confusing because you should enter "1" if you are married but you cant count anyone twice. Enter "0" for 21c because you already counted your husband in 21a. For 21d-g, enter "0" for each of them. For 21h, enter"2" for your household size. In my experience, it's better to try to avoid the I-864A unless you don't have a choice because with the I-864A, you need to prove household membership, and you don't need to with the I-864.

As for your dad, he should file a separate I-864. If he makes enough money according to the Poverty Guidelines by himself, then your mom doesn't need to go through the hassle of filing an I-864A.

For example, your dad's household consists of 4 people: himself, your mom, you, and your husband. As long as he makes at least $25,000 a year, then your sponsorship package only needs your I-864, and your dad's I-864.

If he makes less than $25,000 a year, then your mom will have to combine her income with his and file an I-864A.

I wrote a letter to the Embassy explaining that my now-husband will be coming to Poland and would like to attend the interview with me, I gave them the dates. Later I called and when I was scheduling the interview, the lady saw the letter I sent before and gave us the date I wanted. If I hadn't written the letter my interview would have been month later! So it's always worth a shot, I think.

It took less than a month for me because I actually called them and told them my then-finace was coming to Poland and would like to be present at the interview. They were nice enough to accommodate us.

I got mine years ago, but I had to do it in Warsaw too. That's where they give you all the docs for the Embassy. I don't know why, but it's been like that for years. You can only get it at that one place in Warsaw.
