Actually you may call by yourself to NVC to ask if they have your approved I-130.
You need I-130 number and beneficiary date of birth.
NVC phone: 603- 334- 0700 To talk with live operator pres 1, 5.
Line is busy so best time to call around 7.30 a.m or 11. 30 p.m. EST

Since in DS230, in Q11 you have to give an adress where you want your GC (if is different than in Q10)and this adress should include name of person who currently lives there I assume putting PO box is not possible.

On uscis.gov they state that they go by priority date and priority date is equal to received date.
Also they state that dates on uscis timeline mean: there is no petitions to work on than posted dates.
Example:
I-130 - July 19
means no more petitions at USCIS with priority/received date July 18.
Here on VJ we learn it's not always true. sad.gif

I'm James' shortcut follower, and from yesterday I'm walking in the glory of case completion. smile.gif With RFE, Christmas on the way took 90 days from NOA2.

I believe this shortcut is not for everyone so choice is yours.

Also look at the example of Noelandtintin timeline he should consider changing his name e.i TornadoNoel because of going so faaast and this because James' shortcut smile.gif

I think you should be fine if NVC accepted already I-864, even if interwiew will be after April 15 your wife don't have to bring tax return for 2007 but always better to confirm this with embassy. If you submitted DS230 with doc, who knows your case might be completed already. We called to NVC just 2h ago smile.gif

I believe we saved time in which mails would be stuck in NVC mailing room. This shortcut is only for CR/IR visas.

As of yesterday our case has been completed at NVC. With one RFE it took 90 days from NOA2 to completion.
We were using James' shortcut and I believe this save us apx 2 months.
My hubby and I are so happy for this part being over.

I'm under impression that when your IR gets to the embassy your K3 will be cancelled. So, at interwiew your wife will be granted IR instead K3 even was scheduled for K3. You shouldn't cancel this interwiew.

Hi Dani smile.gif I'm already in States. I came a week ago on Saturday and even though I checked in Q 33 in form DS230 that I want my SSN mail, I went on Thursday to SS office to check if I'm already in the system. I wasn't, so I filled out aplication, and yestarday an officer called me home that they have for me my number. It started from 7. It means my number comes from checking Q. 33 on DS230. I went to office to pick it up. I guess will be much easier for your hubby just wait 10- 15 for mail delivery . I want to make next week driving license so this is the only reason why I went to SS office. Good luck.

I can now officially add us as December filers. My husband gave us both the best Christmas gift possible and was able to file our I-130 today!

The post office had closed before he got a chance to put everything together so he ran straight to FedEx. I sure hope that's ok and our application will be accepted. ??

We filed our I-130 in my maiden name since I hadn't had it formally changed then. Now I carry my husband's name, I have a new passport and we are getting our docs ready for the NVC process. So I'm using his name as my Family Name in the DS-230. Is there any form out there that I should file separately to let them know I changed my name during the USCIS stage?

I'm sorry, but heartless is not a name. It's an adjective and therefore cannot be considered name-calling, imo.

I think we all know what Gary meant when he said it. It wasn't anything personal against CBP's. We all know it's their job to be suspicious and expect the worst out of people. It does make them seem heartless, though and there's nothing we, nor they, can do about it.

They are heartless alright. We had just returned from a honeymoon in the UK when I was refused entry. I have never set foot in our Florida house since we were married 9 months ago. When it comes to CBP's don't be tricked into thinking they have a conscience. However, if you are ready for the worst - an instant 8 hour flight back to the UK and a ban from ever using the VWP again ( not that he will require it), then it's worth giving it a shot.

As GoshaBee says, it will not affect the process of the approval. It's just a boat load of stress and annoyance.

My advice is go for it, but be very aware of the pitfalls.

Reading that (looooong) thread brings tears to my eyes almost every time. The fight and determination in all of you is quite impressive. I'm sorry I don't have any valuable advice for you. I am the beneficiary and in a few months will probably face a similar situation as your husband. I do own a flat in Poland and have a few bills in my name but my employment situation is a bit iffy and I believe that would be the strongest argument on my part.
All I can say is give it a try. The only real thing you might lose is the ticket money plus of course a whole bunch of stress on both of you. Fortunately such deportation incident doesn't play a role in the overall process of your approval. But maybe it'll work out? I sure hope it will. I can't imagine the CBPs being so heartless to not let him in after you explain all the mistakes the USCIS has done in processing your application.

Her current passport is in her maiden name, but she's in the process now (while there's time to do this, get it processed and get it back prior to summer travel...) of being issued a new passport with the new (married) name. I guess it would've probably been wise to submit the I-130 with the anticipated (married) name, but we didn't have any paperwork / documentation of that at the time, so we were worried that USCIS would see the paperwork, could wonder what was going on and send out an RFE, which we *really* want to try to avoid.

But ANYWAY, thanks for your advice on waiting until it gets to the NVC.

I'm in the exact same situation as you. And I also regret I hadn't asked VJers about that issue prior to submitting our I-130. My husband and I have also decided to wait until we get to NVC and request for the name change there. I already have a new passport with my married name and I really would like to avoid any confusion / delay in the process.

What about California and other states where same sex marriages are legal now?

Have they just simply not followed up immigration-wise with the new laws they've created?

That's a big shame and a huge disadvantage for gay couples, IMO.

I have a friend who has a close friend who is gay and married a US Consul. He supposedly has an immigration visa that allows him entry only to the 3 states in the USA who recognize same sex marriages. It took him barely 3 months to obtain it but obviously it all went through diplomatic channels.

I don't even know how true that story is. I trust my friend and she heard it directly from him. But I can't really confirm it. Just repeating what I've heard.
