Well looks like you have more proof than we did, so hopefully that will gain your approval. How "exactly" we are supposed to prove it to them is the part that is challenging, because they do not give us exact steps, or even vague ones, really. I wish I knew, but at this point the only thing we can do to hopefully guarantee him being approved is for us to move down there. Which we are now making plans to do so. And as far as the timeframe, my guess is however quickly we can get them more proof, and from there how quickly they can process it....my guess is a few months....but really, really hoping that it will go quickly sad.png I really hope all goes well for you and that you aren't put in the same awful predicament! sad.png

When is your interview? Do you have family in the states? I would move down there to be with them and get as much proof as you can, otherwise it's very likely you will get as far as we did and be denied. After going though this, I would not wish it upon anyone. I'm so sorry you are in a similar situation, the unknown is so hard to cope with sometimes....all the best to you.

Ours was just complete last week we are waiting for the date.  Thanks for the advice, I pretty much go back and forth quite often so I guess I just need to focus on getting even more.  I can show a job offer letter showing I have already started working in US and an airline ticket close to the interview date showing I flew back from the US to CA for the interview....I hope this, on top of what I already have will work because if not I have no other ideas.  I have the proof because we have honestly taking the steps to move back, just like you guys.  It blows my mind that they essentially want us to be seperated from our spouse and children long term as proof.  Insanity!

 

How exactly are you supposed to prove to them?  More evidence?  And what is the time frame before they will give you the visa???

What I find absurd is the rejection itself; the mere fact that a family is pursuing the legal route to move to the US should be proof enough of their intention. 

Why else would a young family choose to go through the immigration process if they don't have the intention of moving there?

 

I honestly don't understand their rationale. 

EXACTLY!  This is just plain crazy and heartbreaking for those involved.

I thought it was pretty much understood that with Canada the spouse had to basically move back first to prove domicile.  

 

Especially for Canada, I feel that your evidence was a little light.  

 

For us, and keeping in mind that Canada is harder, we did the following:

- Current US driver's license

- Current active library card and AAA membership

- Communication with school for daughter's enrollment 

- An accepted will by the probate court and real estate evaluation showing that I was the sole inheritor of a house in America

- Proof of being on my mother's car insurance in America

 

The attempt is to show that you actively live in a place - car insurance or things that you'd only have if living there.  Sending mail to an address or transferring funds is not really showing that.  Think about having utilities in your name, actually moving in with your father for a few months, registering your car in America, etc.

 

I don't think you need to rent an apartment if you are planning on living with your father.  Just grin and bare the couple of months to get the domicile in order.  I can almost assure you that if you move in with your father (and have proof of living there like receipts, etc.) and you do some of the normal activities of life like car insurance, you'll have no problem in meeting the requirements.

 

Did you get a 221(g)?

We are in the exact same position and I would like to get your take on our evidence, how do you think this looks:

 

-US Voter Registration

-2 US Bank Accts

-2 US Credit Cards

-Maintained my US retirement fund

-Maintained payment of my US student loan

-Filed US consular report of birth abroad for my 2 kids

-Contract from realtor showing our house for sale in CA

-Letter from former business partner showing sale of my CA business

-Affidavit of residence for condo rental with my sister in US

-Letter from Mazda certifying our car meets standards to move to US

-Letters from US schools regarding enrolling my kids

Just wondering if anyone can answer the question above, our attorney says the application will stay at the National Benefits Center because our physical address is in CA but I am worried it has gone to the NCY office as there have been more than a few applications sent after ours that have already been approved.

We used our address in Montreal as our current address on the biographical information for both my husband and I.  We used my Mom's address as the address as the perm address in us where we intend to live....so are we still screwed?

Thanks so much for this!  We have decided to move our family (we have 2 kids) to the US to be closer to my family.

 

We are using an attorney but I am trying to wrap my head around all of this as well, the more I know the better I will feel.  As for the domicile proof that scares me as I have been living in CA for the last 10 yrs as a Perm. Resident...I have virtually no ties to the US at this time. I let my DL, credit cards etc.. go many years ago.

Hi,

 

I am sponsoring my husband and right now we are waiting on his i130, we are using this time to get everything we will need ready for the next stage.  Yesterday I asked him to go and get his photos taken, he only got 2 instead of 4.  My questions is this, do the photos have to be exactly identical?  Can he go back on Mon and get 2 more or should I send him back to have 4 more done?  These pics are not cheap but I don't want to do anything that could cause a problem down the line...

so you have a utility bill in your name on a house in the USA?

or a yearly tax invoice on the house in USA?

 

if no to either, you not maintain a domicile (per DoS standards)

 

 

I currently rent a condo in the US as of Jan of this year, all of the bills are paid by my landlord and are included in my rent  but yes I do get mail there.  Since Jan I have been going back and forth while waiting for my husband and children to come when able.

I am including both, since I moved to Canada I have maintained domicile by keeping multiple accounts, voter reg, student loans, etc...  I have also taken steps to re-establish domicile fully by signing a lease, excepting a job, selling our house in Canada.  I feel like it is better to cover all of the bases but that is just my opinion.

You can go to http://www.lawdepot....idential-lease/ and create and print a lease, it looks much more legit than an agreement.  It will only cost you like $5.00, if I remember correctly you basically sign up for the service and on the same day cancelled it.  Good luck!  We are dealing with the same thing and have our interview on April 8th.

Can someone give me the list of vaccinations required?  Sounds like my hubby is going to need all of them as I am pretty sure he has had none since HS.  He will be seeing his doctor next week, I am assuming he could give him the list and go ahead and take care of this now.  We are still waiting for our i-130 to be approved so I figure this is one thing we can work on getting in order as we wait.

Study up on the DS-260 though.  It requires exact addresses for everywhere you've lived since you were 16, for any length of time.  Maybe you haven't moved much, but I had 18 moves, (13 different addresses.)  /nightmares  LOL

We haven't done POE yet, but I'm pretty sure as soon as you enter the US you're legally allowed to work. It might be an issue with waiting for your SSN though, because I believe you need that in order for your company to be able to pay you and withhold your taxes. I'm not 100% sure though, I'm sure someone else can help.

Hi,

 

Our i-130 has not been approved yet (6 months and counting) so I am using this time to familiarize myself with the NVC process.  When we started down this road we were overwhelmed with a lot that was going in our lives and chose to use an attorney to help us.  Honestly, I have nothing bad to say about him or the services he has provided so far but I want to be sure that using him will not slow us down once we get our i-130 and move on to the next step since we are already 6 plus months waiting.

 

 So here are a few question I am hoping you can help me with.  Is the K1 Guide to Montreal here basically the same for 1R1/CR1 as well?  Can  our attorney file electronically the same way we can?  Not MTL specific but...What is the income requirement?  I am not the bread winner and assumed we would need my parents to co-sponsor but now I am thinking we might not need to do that based on some of the threads I have read but I am not 100% sure.  Thanks in advance!  

 

Oh and I could be posting this question in the wrong spot but generally how long after POE will my husband receive all of the documents required for him to work legally in the US?  Again, THANK YOU!

Hi,

 

I currently live in Canada, I am a US citizen and Perm. Resident of Canada.  As soon as my husband gets his Visa (we are waiting for case complete) we plan to move to Texas.  We are going to sell our little car here and would like to buy a new one (bigger) in the US.  I have both an address in the US and one here in Canada.  We obviously don't want to buy a new car here in Canada so can I cross the border to Vermont or NY, buy a car at say Car Max, bring it back to Canada, pack it up and make the move? I guess my question is... would I have to pay duties on the car considering that I have an address in both countries?  Hope I am making sense.

 

Any input would be helpful!

I'm still here, waiting for case complete, sent checklist in and it was scanned at the NVC on Feb 12...next week will be over 20 days waiting for more info.   Anyone know when they normally schedule interviews for MTL?  Praying we don't miss the window for a May interview since April has come and gone.   Feeling so down, this month marks 1 yr since we started this process and I feel like it will never end. :(

My wife and I just recently submitted our I-130 a week or so ago and received our confirmation of NOA1 the other day.

 

We're currently working and living in Toronto and were wondering what other's experiences have been in terms of processing times when applying from within Canada?

We filed our i-130 on March 28th, my husband and I are living in Montreal right now.  We have not received our NOA2 yet and it has been 6 months.  Hope things speed up soon but be prepared for the long haul.  When we started our attorney said 10-12 months no problem for us.  Well, he just told us last week that due to the huge backlog it could be much longer.  :(

Holy #######, we just got our interview date and it is April 8th!!!   I just got the email and now I have some questions, hoping you all can help me out.  My husband is flying back from Russia tomorrow (he was there for work) and is scheduled to leave to Japan for 1 week on March 29th.  We did not think we would get an interview till early May...

Is there any chance he will get his medical in time?  I am going to call on Monday to try and make an appt at Medisys anywhere else I should call?  Also, the letter did not request that I be there nor did it mention Proof of Domicile, is this how it usually goes???  Thanks so much, so excited! This is the first time anything has been ahead of schedule for us!

I called several times and made an infopass appointment. Both were useless because they could not give us any better updates or respond effectively to my questions. I even made a service request (enquiry) over the phone. As I write, we have not received a reply to that service enquiry.

In the end, we resigned to just waiting until the approval came exactly 8.5months.

The petitioner can call the USCIS call center and talk to a tier 2.  Also after 6 months you can put in a service request.  But you're right at the weird spot where Kansas started holding onto the I-130s so you may want to wait until after the end of Sept to see what's up.  Don't freak out yet!
