So if my husband's interview is after April 15 (which it most probably will be) he'll have to bring copies of our 2013 tax return, with copies of my 1099 forms (I'm self employed)? Do we have to do an updated I-864 too? Or is a copy of the taxes sufficient?

 

And also, dwheels76 thanks so much for adding us to the list. I was going to do it but didn't want to mess it up no0pb.gif 

 

dwheels76...On this subject, I am currently living in Canada and therefore I get an automatic extension until June from the IRS, my parents are our co-sponsor since my hubby is the main bread winner in our family.  They filed for an extension, so when we go to the interview I am assuming that proof of both extensions for 2013 will be okay correct?

You got me thinking of POE and I was wondering...after we get the visa can we just cross the border in NYC and enter there and then come back to MTL to finish packing and the sale of our house?  We are moving to Texas in the summer but I was wondering if it matters where you enter and do all of the POE stuff?

Flu shots are not mandatory. There are 3 basic shits that are required. After the Doctor gives you a little Q & A that?s how they determine what you need. But Flu shot isn?t one of them.

 

And remember the 6 months must enter the US time ticker starts the moment you have your medical.

Parrish 77?  I was recently sent to CSC on Nov 13. It looks as though they are moving pretty fast. Was your application pretty right on? I think I may have made a mistake where it says list all relatives and their relationship. Well I listed my husbands relatives but I wrote step-son and step-daughter instead of just son and daughter. I thought they wanted their relationship to me. DAH! So stupid now that I think about it.

I was wondering if anyone in the list, with a pd after march 22, lives in the US.
I ask bc, if I remember correctly, Parish, you are not living in the US, there was a discussion, some pages back, in this thread's pages, how ppl living abroad are getting processed faster.
Maybe there is nothing to my inquiry, But I was just wondering bc my pd is march 28, as parish, but it seems no one, from the vj list, with a pd after march 22, has transferred yet, with the exception of that small list. Does anyone know if all those applicants do or do not live in the US?

Yep, I would wait for the paper notice to see exactly where your app is. I got the local office email too, I am filing from Canada and mine was sent to California. Pretty sure all of the "local office" emails are mistakes as there was talk a few months back that NBC would no longer be sending apps to local offices for processing any more.

Okay thanks.  I'm March 18.  I wonder if I'll get transferred to a local office, since I filed from abroad and technically have no local office. . .

We are in the same boat (filed from Canada) and got transferred last week.  My email notice said to another USCIS office, then changed to local office.  Have no idea where my file is now, hoping to get the paper copy this week. I tried calling on Friday but the Tier 2 said their system has not been updated yet to show the transfer location.

This is so frustrating! I got the 2 emails about my file being transferred, 1st to another office, then to my local office.  I am a USC filing abroad so technically there is no "local" office for us.  I called today to speak to a tier 2, before I got to him the automated recording said "Your file blah blah blah was transferred to LEES SUMMIT MISSOURI on Oct 24.  Huh?  Isn't that where it has been all this time???  The tier 2 said he could see that there was a transfer but he could not see where to.  He said to call back in 7-10 days and check again.  #######?

Can we tell from the timeline if the approved cases are DCF?  Couples who live in the same country (regardless in USA or elsewhere) get approved much faster than those who live apart.  It doesn't quite make sense as those who live apart would want to be reunited asap and to the opposite to those who are already living together would not care as much of the approval unless they are planning to move to the States together immediately.  

 

I have private-messaged few couples who got approved within 3 months and they were all DCF cases. They were all married for few years and feel that it's about time to get the case filed but with no urgency to moving back to the States together.

 

PS:  Hubby called the office today, the lady said the same thing, they are filing Oct 12 cases..Let's hope she does not know what she is talking about!

My husband and I live in Canada together, we have been waiting over 6 months for our i-130, the idea that US citizens abroad are approved faster is not the case anymore, there are actually a lot of us still waiting with you.

We didn't get married for my husband to be able to immigrate. We lived in his country for nearly 8 years together, 7 1/2 of those were while we were married. We have two children together and plan on trying for more. I don't understand why a fiance visa would be processed faster than a immediate relative one. It really makes no sense. The whole point of having the distinction between the IR and the CR is to lessen the amount of fraud that goes on. (At least, that's what they say.)  What I'm seeing now, is that if I hadn't married my husband, he would have been approved in under 90 days, but because we got married, we could be waiting nearly 2 years for him to finish the process and be able to come over. This is absolutely ridiculous.

Exactly!  My husband and I have been married for 10 years and we have 2 kids together...this is beyond frustrating!!!  We too have been waiting over 6 months...ugh.


What if your file was never transferred to local office? It will collect dust at NBC?

To be honest, I don't care about the K3. Not even a little. I want the I-130 for our CR-1 approved in a timely fashion, and I think that's what we should all be campaigning for -- not the revival of this secondary form. The K-3 has the same limitations that made the K-1 undesirable for me and my husband (e.g., no immediate work authorization or residency status). It's not what we want, it's not what we filed for. I just want the form that we did file for -- that all of us in this community filed for -- to be processed in a reasonable timeframe.

Does anyone know if all of the cases that have been approved in September were sent local offices first?  We applied March 28th from abroad (Canada) and our application is at the NBC and from what I understand will not be transferred.  Just curious if the apps sitting at the NBC are being touched at all.

Call the main line...  National Customer Service Center (NCSC): 1-800-375-5283  The Tier 2 Immigration Officer also called me back from that number.  I think they are transferred between departments to mask their actual number, to prevent people from calling them directly...  I could have stayed on hold, and waited in line, but decided to choose the call back option, and see if a different number popped up when they called...  Nope.  Same one.  Hah!  So much for thinking I could be sneaky...

They also told me to call every 2-3 weeks or so, to get updates.  She said keep calling, and DON'T wait for status updates through e-mail and text.  She put some service request in on my file also to be processed or something.  Not sure what it was all about, but she said keep calling about my I-130, and wished me luck for me, and my wife.  Much better then the ####### that hung up on me a few days ago for no reason.

The only way this is going to change we have to start some political action group. I was thinking could we call the ACLU help start a class action lawsuit. Maybe can call it discrimination since we are all married to foreigners. I called my Senator and Congressman, done Infopass. Nothing has worked it seem the only thing that get there attention media. How about doing a lot of youtube spots explaining our stories. I filed in March 19 it seem everything has stopped from January 2013 for Married couples. If we do a youtube we should use just one channel maybe each day for a month a different person put up a video. If anyone else has ideas at least it better then just sitting and waiting. We have tried all the legal ways and channels we have been told we could use. We just keep getting the same answer ######### blablabla The other idea we should all put in change of address to oversea so it look like we are living out of the country. I wonder what they would due. 

It wont help to change your address to out of country, I am filing for my husband and we both live in CA. No NOA2 for us either...

whatever the date they used to tell you they received your file..  If you received it in the mail on April 5th... that's just due to slow mail... Use the date they used in the body of the letter

So when I fill out my timeline, where it says NOA1 date, I should use March 28th? Not the date I actually received it?  I want to be sure I am doing this right for the stats to be correct.

When you check your case on the USCIS website, what is the date they use in their blub?  On such and such a date we recieved your case for BLAH BLAH BLAH...

 

That is the "so called PD date"    I am confused as to why you are using March 28th as your PD date and NOA1 date as April 5th.    PD and NOA1 are the same date

Sorry, to be clear, PD date is March 28th, the day they received our application and is stated as such on the USCIS website.  We received our paper NOA1 by mail on April 5th.

Wow so not much in the way of NOA2's. yet from the service centers? 

 

Its hard to get a feel for the new time frame. At least they are shipping the ones that have set the longest first.  I read that last year they did not.  So maybe this time (the train wreak) is a little more planned out. I just keep my hopes up that there are alot more people working on our files now. 

 

From what I've read about the new Overland Park Office.  USCIS cant fill the seats.  I think the pay rate is too low,  27K to 41k.  So a new hire cant marry a lady with 3 kids and bring them in on that pay.  So thier plan failed for the most part and now its plan B.  Maybe they will still get some part of this done with the staff they could hire. 

 

Even though the posted dates are October 2012 there are 2-3 times as many service centers working for us now, than a month ago. I'm hoping the transfered files are not going to the back of another line.  I think we'll know when we see the first transfered files getting approved.

Yep, feeling the exact same way.  When this happened last year do you know about how long it took to see the approvals start coming in?

That figure seems inflated. Is there a single March filer with a priority date beyond March 8 that has already been transferred? Those files had better zip out of those service centers if this is going to happen.

I agree with you but I was transferred last week and my PD is March 28th, so I think there are at least a few of us.

My husband is US citizen filing for Cdn spouse.  We have the same April 10 priority date and still under review. I spoke to Tier 2 over a week ago and she said I should hear end of October or sometime in November.  We are both living in Canada at the moment -- he will move back to the USA later this year. Married 22 years and both kids have dual citizenship -- so no flags! 
 

We are in the EXACT same boat, married 10 yrs, 2 kids with dual all of us are living in Canada right now.  Ugh, all of this waiting is such a drag.

You can also get a State ID if you do not drive wink.png   but the job, lease, kids enrolled, moving quotes, voter reg, business and home in Canada for sale, and US student loan should be more than enough for domicile.  You really covered it with the job and lease.   The rest is extra.   If need be open a bank account down there too (You can do CDN and US RBC or TD so you can transfer the money from your business and home sale to the USA easier as well.) 

We already have an RBC US acct and US credit card not to mention a US Old Navy card too. :)

Awesome, put in a few pay stubs or the employment offer or proof of employment.  You're golden and likely don't need much else

Even better... add that to the employment and you don't really need anything else.  

 

This is what Montreal wants: Job, place to live, kids registered in school 

 

Everything else is to prove you're going to move because you don't have those things.   Parrish, you have more than enough. 

Thanks NLR you have always been a help to me, this ####### is stressing me out!!!  I just want to be home and I cannot for a second imagine having to add more time to what has already been way too much.

Okay so I have been going back and forth between MTL and Texas for a few months prepping for our move, I have a job in the US and signed a lease there.  I do not have a driver's license or car insurance since I do not drive at this time.   Do you guys think the lease, job letter and a boarding pass from Texas showing I just came back for the interview and the prep to move my family in addition to:

-US cc and bank accounts

-TX voter reg.

-US retirement fund

-US student Loan

-Contract with agent for our house in CA that is currently for sale

-Proof of sale of my business in CA

-Moving quote

-Emails for enrolling the kids in school

 

is enough?  If not, what else do you suggest???  This is just plain craziness.

Well looks like you have more proof than we did, so hopefully that will gain your approval. How "exactly" we are supposed to prove it to them is the part that is challenging, because they do not give us exact steps, or even vague ones, really. I wish I knew, but at this point the only thing we can do to hopefully guarantee him being approved is for us to move down there. Which we are now making plans to do so. And as far as the timeframe, my guess is however quickly we can get them more proof, and from there how quickly they can process it....my guess is a few months....but really, really hoping that it will go quickly sad.png I really hope all goes well for you and that you aren't put in the same awful predicament! sad.png
