Not that it's a thrill to be on the "watch list" Married_my_love, but I do feel better knowing that I am not the only one. *And*, that being on the "watch list" will not prevent the K-1 from being issued. I have been kinda worried about that (in a "back-burner" kind of sense in my mind) all along. I answered Yes on the DS-230 about it (advice from another VJer).

I was only yelled and screamed at for 2 hours, not 5. Wow. That must've been horrific. My next 2 visits after that ordeal that I made before the K-1 process began I was required to bring in a small binder of evidence of ties and they issued me an I-94 and put a B-2 stamp in my passport for each crossing. Since K-1, though, no crossing at all. I'd probably be considered a HUGE major risk now. :)

I wouldn't advise attempted travel while a K-1 visa is in progress. You are likely to be turned down for crossing because you post a risk of staying there. Here's what I read on this site (don't ask me *where* because I copied and pasted it to a notepad document and saved it to my hard drive rather than saving the page itself in My Favourites).

There are no guarantees.... Many people historically been turned away at the port of entry after
starting the k-1 process. If you try to make an entry during the k-1 process you may be turned back and
sent home. If you elect to visit, be aware that the POE officer may not to allow you to enter the US and
turn you right around (at your cost). Be aware of this risk. It is not illegal to enter the US during
this process but you have to realize that there is an elevated risk that the POE officer will decide
that you are trying to bypass the fiancé(e) visa process. I would personally advise anyone considering this
to make plans for the US Citizen to travel abroad instead. Why take the risk just for a visit? Keep in

Hmm . . . I wasn't aware of such a thread. Don't believe that I ever posted there. I also do not think of myself as a (regular poster).

I did the same thing as you when I started seeing November and December filers being approved before us. I thought for sure that it meant an RFE or that we filled out the paperwork incorrectly and we get to start again and pay again.

And I wonder about that thing of USCIS that says that they are now processing files whose receipt date is July 17 and before---because if that is true, how coud we have been approved? But, I am new to all of this and perhaps I am mixing apples and oranges.

However, I feel that you should vent whenever you need to vent. It is physically unhealthy not to do so. :)

I resisted for about an hour and a half---but, I can't keep it up. And, I wanted to be in my own posting. We did not go for the checking every day for touches. We just waited it out.

My boyfriend emailed me some time today to tell me that the NoA2 arrived by snail today. The approval date, however, is January 16. I was so stressed about getting an RFE or, as was more likely, asked to try again because we forgot to cross a T somewhere.

But, no: approval instead.

We'll take it.

Last week at work, I was asked how things were going and I put my head down on my desk because the night before the average days between sent and interview had gone up to 215 days! And, it may still take that long, but I don't care about that today.

I'm CONFUSED! about all the different timelines

Yes, yes, I joined in Jan of 2006, but I am only recently active because we were trying to cram in a music festival (involving me going to the US) before filing to begin the K-1.

Under this url it lists XX days for our total. After some backwards and forwards arithmetic I arrived at the conclusion that the number of days---at this point---is calculated from the time the packet left my boyfriend's fingertips to whatever is the current date.

However, when I go to the page http://www.visajourn...eline/stats.php it only lists "filing" to "interview." Is the "filing" date the same as mailed date or is it NoA1 date---and *which* NoA1 date? In historical trends, it has filing to NoA2---and then I have to figure out how many weeks and days to approximately add to that based on the K-1 flow chart in Guides.

We are going through Nebraska and Canada is the outside country. Average total days to interview is 189 for K-1 and immediately below that is the graph showing 192 days---from "initial filing." Is that 192 days from the time the I-129f left my boyfriend's fingertips to the interview or from the filing date of NoA1 or from the day that *he* got the NoA1 in the mail?---or is it something else? And, why does it say 189 days in the written part? What are the 189 days?

That means that the date on the document says October 18, but the bf didn't receive it until October 28. Hence, the question about *which* NoA1 date is used.

If I must glue them to the forms (2 X DS156), then what was the point of signing the backs of them?


Part One
Page 1 of my checklist wherein the instructions about photos are says, "The applicant must sign the reverse side of each photograph." (For my consulate they require 5---which the photo store sells only in pairs so I have 6). On page 2 it implies that the photographs are stuck on the form, but doesn't say so in so many words. "Complete on-line form DS-156. All questions . . . must be answered. If your children apply with you, two copies of Form DS-156 for each child must be completed in full, including photograph."

I only figured out that it is the DS-156 forms that get some of the photos asked for because of the line about the children. On the DS-156 form, there is a space to place the photo and that it must be glued or stapled, but does not say by whom.

Well, apparently, it must be put there by me. However, how will they know that I signed the back of the photo if it's glued face up on the form?

Part Two
Is it better to staple or glue?

If staple, just one staple in the middle at the top (so that they can lift it up to see the signature?)?---2 staples on either side---1 staple in middle at top and 1 staple in middle at bottom?

If glue, will glue stick be okay? It's all I have for glue.

The I-134 instructions don't refer to any minimum income - only the I-1864 does so it must just be an assumption on everyone's part.

I-134 Instructions:
As the sponsor, you must show you have sufficient income and/or financial resources to assure that the alien you are
sponsoring will not become a public charge while in the United State.



Travel.State.gov states:

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the need for the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA

I will try to just write them down myself and separate them into the different issues and *then* post them the next day. These are all the questions that my BF asked yesterday on the 'phone. About the I-134:

My BF would like to know why he needs 3 notarised copies of the I-134 and I don't know so I am asking you.

If he does need 3 notarised copies of the I-134, who gets each of the copies? When do they require the copies? Does the notary need to witness the making of the copies (like, my BF makes copies on the notary's photocopier)?

Does he or does he not need to fill out an I-864? (We are K-1)

Where does he get a current version of the I-134?

He tells me that the I-134 requires "evidence." Does he need to have the "evidence" copied? If so, how many copies? Do the copies need to be notarised? Or would it be acceptable to be able to produce the originals at the interview (ie: he brings them with him when he accompanies me to the interview)? For instance: the income tax return. If he gets a notarised copy of the income tax return, it will, of necessity, be last year's return. Should the interview be after *this* year's receipt of return, then the notarised version will no longer be the most recent---colossal waste of money. Another For Instance: can he bring the original of the most recent bank statement rather than get a notarised copy? Or does the original need to be produced?

#3. This Affidavit is being filled out for the benefit of . . . who? Is it me?
Relationship to Sponsor? Fiancée?

Is it necessary to fill out any of the other information (like about the personal property) if, say, his income and other junk reaches the sufficient level of support required. What I mean is: is it necessary to fill in *all* the blanks if his yearly salary reaches the required amount for the support the number of persons in his household?

(Off-Topic: when does he need to produce the evidence that he is free to marry me and to whom does he show it (or for whom to have it copied and notarised)? The original of his divorce evidence is a copy. The "real" original is on file at the court. Is the copy that he was issued considered sufficient?)

--The required supporting evidence, as stated earlier, looks like income tax returns and a "W2." Also, the sentence reads "Ensure that *it* is notarized" not "Ensure that *they* are notarised."

5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically, you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and useful information on the Affidavit of Support Form.
--If he is there in person at the interview, why does he need a bank official's opinion on paper about his bank account? Why are the original bank statements insufficient when he will be there to present them? Is this, perhaps, a requirement if the sponsor cannot be at the interview?

When my visa counselor checked it she said need to change it into TO BE WITH MY FIANCE AND MARRY HIM. She let me print another DS forms without barcode...coz i had barcode in my previous DS 156. I asked her why??? for K1 is without a barcode. So i have learned that DS FORMS in K1 application need not to have barcode. She checked every box..So to those who r doing the DS forms see to it to fill it out all boxes...u can put NONE..if it is not applicable. q32 and q33 if u want then check yes..and write BUT NONE AS OF THIS MOMENT.Q37 need to check all the boxes and dont forget to put NONE if it is not applicable. Q 39 CHECK no and fill out q40 write ur name and address put MYSELF after relationship to applicant then sign.

and in DS156K in q4 and q5 put NONE if its not applicable...just in the first blank. see the words below??? DO NOT WRITE BELOW THIS LINE...U can write the balnks to marry (write the name of ur fiance) then sign. and put the date (date of ur interview) at the place where u have ur interview.

Long form meaning:
In the year 2007 and 2nd month and 9th day the VANcouver, British Columbia, Canada US Consulate sent packet 3 (and more than 4 weeks has past since they sent it and it is only going from VANcouver, British Columbia, Canada to Calgary, Alberta, Canada. Like what? You're kidding!)

I have gotten used to calling Vancouver just VAN. Just as West Vancouver is called West VAN. Didn't intend to confuse, only to shorten to fit better on one line.

Okay, yeah, I read your timeline in your signature. 2 things I don't understand already: how do you know that the petition was sent to the US embassy in Manila? and how do you know that packet 3 was sent?---and when?

I don't have access to the receipt numbers from either of the NoAs as my boyfriend is the USC and *he* has them. I cannot 'phone the NVC and ask about anything because I only know the names (his and mine) and nothing else. I only know things when he tells me about them---and he's very busy besides.

But again, if the pkt 3 that you guys were waiting for was sent 11 days after the arrival at NVC (I cannot compare using the NVC sent because I don't know that date---assuming it was sent to VAN) then it follows that, perhaps, our pkt3 would have been sent February 15. Highly unlikely scenario as I am in the next province east of BC and I can't fathom the ride for a largish brown envelope taking 14 days to go from BC to AB (and from "major centre" to "major centre" to boot!). I've been wrong before and may be again.

So, I guess, from what you're saying, I should go ahead and encourage my boyfriend to remember to call the NVC and then remember to call the VAN consulate.

? Really?

I was under the impression that I am waiting for pkt 3 to come from the VAN consulate (possibly preceded by a letter stating that I am waiting for pkt 3) and that some time after I send the forms from pkt 3 back to VAN there will be pkt 4 with further hoops through which to jump.

I am an October Filer and had been searching the board for HOURS looking for information that includes the terms October Filer Packet3 (spelled like that because an error occurs if you look for "3" as a lone character).

I think that it is taking an inordinately long time to send from the east coast US to the west coast of Canada---but, I don't know if that is a "think" based on real things. I wanted to find others like me (who either have or have not got the pkt3 and who filed the initial I-129f in October06) so that I could compare my experience right now with theirs---and possibly feel better, or feel worse or get some advice about what to do next.

My fiancé, on his next set of days off, is going to contact the NVC to find out IF the petition was sent and when and get the various numbers for the case. With this info, he can then contact the VAN consulate.

BUT

Is it too soon to really be doing all this contacting? I dunno.

I had read that earlier today the member ELW had been finally gotten to the bottom of their Pkt 3 question and it is from there that my question comes. It took 8 days from actual NVC sent date to the consulate in INDIA receiving ELW's petition.

My fiancé received the notice that NVC received our petition on Feb4/07 and, like ELW noted, told him via a notice that the petition would be sent out within the week. Don't know if this actually happened at this point. One week from Feb4 is Feb11. 4 weeks was Mar4---a Sunday---so, say Mar5 instead.

Why would it take more than 4 weeks to go from the NVC to the Consulate in Vancouver, Canada?

Has anyone experienced such an elongated wait for Pkt 3 recently?


Looking for guidance and comfort. :unsure:

I had read the guides---January of last year and in September and again in October, November and December and then once again in January of this year. I couldn't remember how to get to the examples either.

Since I had misplaced my paper copies of the samples from the Guides, I searched the forums for the answers and was unable to find them. I had noticed that others had asked specific questions about the numbered items and thought that I would give it a whirl.

But, hey, thanks for the immediately clickable links to the samples that I can access via my profile box (by selecting to read this topic). :)

I had not been able to open the samples for a few hours and I panicked. It turned out that there was a glitch in the Adobe programme on my computer. I went to Adobe and downloaded a patch and things have worked fine since---with Adobe.

Thank you, misa, for the answer about people crossing with me. I really had no idea what they were asking there. :)

I cannot get the DS-156K, though, because the link at the government website doesn't work---it only opens up the DS-156 again. What I was wondering was if it is acceptable to the consulate to fill out the Adobe form that I already have (expires September 30, 2007) and print that---even though it would not have a bar code on it. The instructions that I have inside my pkt3 says to go to a particular website to fill in these forms. That web page doesn't exist anymore. When I fill in the address in the address bar and hit the arrow, I get redirected to another web page. This other web page has clickable links to yet another web page with ALL the fillable forms listed. DS-230 isn't there at all. DS-156K opens DS-156. DS-156 also opens DS-156.

But, I guess I will have to email the consulate again on Monday to find out what they think that I should do.

Thanks for all of your help. It is appreciated. I am very frazzled from the mix up earlier about my packet 3 and the resulting lack of sleep combined with the stress has made me a bit crazy.

Elsewhere I have mentioned that I emailed the US DoS about the DS-156K problem and about the lack of any link at all for the DS-230. I indicated the address at the tops of each of the pages so that they might be able to trace the problem more easily and fix it. Dunno what we're supposed to do in the meantime.

I do see that if I answer YES to any of the bulleted items that I will be required to appear in person before a consular officer. Euh? (I just think it's funny considering the circumstances of the visa for which I am applying.)


Since the link for DS-156K is dead, would anyone be able to tell me if the practice out-of-date DS-156K that I have is significantly different in the questions asked?

As for the G325a in quadruplicate, I don't have copies of them. My fiancé (the USC) has them. We didn't make umpteen copies of the I-129f: only 2---an extra for him and one that got sent to USCIS. He will bring the copy with him so that we don't have to reprint all the copies of the emails again---only add the newest ones since that time.

I have a question about Question 8 of the DS-156. It asks for other names used and then lists possibilities in parentheses (maiden, religious, professional, aliases).

I have, initially while practicing filling this form out, put N/A in the box. But, when I got my Police Certificate back from the RCMP it says, in one of the boxes at the top "Other Names Used" and lists the surname that I used for a while when I was previously married.

On the DS-156 Question 9, where it asks for "Other First and Middle Names Used," I filled that in with my nickname (since no one uses my long legal name unless they don't know me).

I am confused about the verb tense: used. I still use my nickname, but don't use the adopted married surname anymore because I am no longer married to that person. So, do they mean used at any time in the past as well as now, or do they just mean now? Because it could be taken either way: used in the past and still using or only used in the past.

Sorry for the bother if this question is answered elsewhere. It's not in the samples because the samples just say NONE or N/A (can't remember which at the moment).
