K-1 Fiance(e) Visa Process & Proceduressupplement letter for question 18 on I-129F
[quote name='debby1' date='Aug 17 2006, 12:55 AM' post='382658']
I had to make my font size 8 to fit our story in of how we met, fell in love, saw each other and got engaged.
Is that too small?
I've re-read it over a few times and can't think of what to cut it out, to make the letter shorter, and I read that it has to be only 1 page.
Thanks for any advice
Debby
Hi Debbie,

Congratulations, you finally found true love.

I too had a similar problem reducing the love story to a one-page memoir, but I kept the long version and submitted it anyway. It is the truth that counts. My better sense tells me to say less when there is something to hide or not truthful, but in your case, you are so spontaenous and candid about the story. And I guess, you are verbose when you are in love.

My fiance and I are both good writers and we had so much difficulty shortening our 6 month love story, since every event just flowed on to the next.

I can't categorically say you should cut the story; I would maybe suggest to shorten the part on the first fiance who backed out. That was best for both of you, and I saw it coming.

Well, get the paperwork moving as love is in the air.

Best wishes for both of you.

K-1 Fiance(e) Visa Process & ProceduresAfter all the IMBRA, forgot the fee's needed for med and interview

Well it seems us IMBRA folk are at the tail end of this ordeal and it also seems the trend is the final interview is a week to two weeks away from when the consulate actually recieves the re-approved petition. SO I have som quick thinking to do.

I am out of the philippines, so if this needs to be moved, ok. But this is for K1 visa.

After all this though, I have forgotted what the final fee's will be for the medical exam and the interview itself.

Was it $155 for the whole thing?

Any other fee's I need to know about outside of the airport exit (ransom) fee?

thanks

Hi Z,

The travel tax for Phils is P1,620. You can pay this with the ticket purchase. Then at port of exit which is at the Manila airport, after check in of luggage, you go through immigration and pay P550.

By the way, there is the CFO seminar where you pay P250 for the conselling fee and P400 for the CFO sticker/stamp which is a pre-requisite for the visa approval.

After the interview, if visa is approved, you have to pay for the passport delivery fee by Delbros and this depends on the destination/address of delivery.

Hope I was of some help.

My Richard has decided to come and visit in Sept...to see the children and bring them their books since they will be late for school opening. There has to be a better way to deal with the waiting...let's keep praying and keep in touch.

K-1 Fiance(e) Visa Process & ProceduresFiancee visiting - will she get denied access?

Some brief background... I'm engaged to a Philippine citizen who has worked in the cruise industry for 7 years. She married a USC in May of 2005 and their marriage fell apart quickly (1 month later) after they each went back to work. They have not seen each other since the day they married and had no communication other than to discuss getting divorced. She is currently in the process of getting divorced but no paperwork has been filed as of yet. I met her in January of this year and we have been in a relationship from then until now. I visited her in Manila in June and I'll be going back to visit her in November.

She will be ending her contract in October and I am going to drive to see her when she gets off the ship. We are hoping the agent checking her off the ship will allow her to stay in the US for a short visit. I called the US Customs & Border Protection office where she will end her contract. I was told her C-1/D visa allows her to stay up to 29 days but it's 100% up to the agent checking the crew off the ship.

The way I understand it, the cruise company will give her a return flight for the day/evening of the day the ship arrives in port. When she checks off the ship she will be given an I-95 with an expiration matching the day her return flight and a D-2 visa. Normally she would go directly to the airport and return home using those documents. She would like to request to stay in the US for up to 29 days. I was told she has to ask the agent checking them off and it all depends on what she says and if the agent believes her or not. I stressed to the person I was talking to that she's not an immigration threat. She's been in and out of US ports for 7 years and if she wanted to come here illegally she easily could've done it long ago. She's never requested a stay in the US before and has always returned directly to her country as scheduled.

She does have family in the Philippines and is late in the process of building a new home for her/them. It is not finished yet and I do not believe the home or lot is in her name yet. She does have a long record of money transferred to build the house and might be able to come up with receipts. She will have plenty of cash on her for her proposed stay (she will not need it though as she would stay with me). She also has a bank account in the Philippines and will be leasing a flat in Manila when she returns.

What are your opinions on the following...?

1. Is there something she can say or show to assist her chances?
2. Should she mention that she's in the process of a divorce to her current husband? She may need to appear in court to finalize the divorce.
3. Should she mention that she's in a relationship with me?
4. Would it help if she got a ticket to return to the Philippines dated 28 or 29 days later?
5. Would it help if I had a ticket for the same flight?
6. Would it help if I give my info (name, address, phone, SS #, DL #, passport #, etc) to her to provide to the agent?
7. I would assume they will ask where she will stay. What should she tell them?

I was told that the agents are only trying to prevent illigal immigration to the US. She is not an 'immigration threat' and I wish it was easier to prove that to the agent. I don't want to lie and I don't want to get her in trouble because I want to petition her with a K-1 after her divorce is final. I really want to see her again but I will be going to visit her in Manila at the beginning of November anyway so I will see her shortly after anyway. It would be nice if she could stay here even for a few days so she could meet my family and friends and see my (soon to be our) home.

Here's my ten cents worth of opinion.
1. The immigration officer at the port of entry may assume that she is going to jump ship this time since she must have a reason to stay longer this time. And she will be asked where she is going. If not to relatives, then it becomes suspicious. If to relatives, she will be asked for name and fone number which they will call to verify and they will ask the relatives to guarantee. My friend has been in a similar situation so this is live example, not a theoretical answer.
2. If she mentions she is getting a divorce, then it just reinforces the suspicion that she is entertaining a possible relationship and may not go back to Manila. She does not really need to appear for the final decision if she has already appeared at least once in the petition/hearing for annulment...no divorce in the Philippines.
3. If she mentions the relationship with you, then she has a greater chance of being denied entry. I remember that in my third visit to the USA to see my fiancee (before we filed the K1), I was asked why I had been to the USA 2 times in the last 4 months, then again this time (3 times in 6 months), and I just replied that I am going to see my fiancee to finalize documentation for K1, but I did return everytime and stayed only for 2 weeks since I had a very stable job and needed to be back to fulfill my work responsibilities, and that I had my sons who need me as their mom...the point is, you must show sufficient proof and convince the officer that you are coming back to Manila because of work and family reasons.
4. Tickets dont really make an impact since you can always change date or cancell or not use them.
5. If you provide your name and address, it may help, but then again she has to prove your relationship or casual friendship...a relationship leading to fiancee will definitely be more suspicious to the officer.
6. November is just around the corner, and in my opinion, it may be better that you visit her in November than take the risk of the stay in USA.
7. But, there is always a pot chance that the immigration officer will be kind and see her sincerity and honesty.
8. I would not begrudge her for wanting a better life with you...we are all entitled to a better life and a second chance at happiness.
Good luck!

K-1 Fiance(e) Visa Process & Procedurescertified document

I'm a newbie on this website. I am petitioning my fiancee from the Philippines. We filed the I-129F forms ourselves. This website is very informative and I have learned a lot. Wish I knew about this website before I mailed in our forms. Now for the VISA application, I read somewhere that its best to have certified documents for the assests. Now I have a checking account and the rest of the monies are in mutual funds and in my retirement plan. Is it advisable that I ask someone financial officer to certify via signature the amount of my assets in these mutual funds/retirement plans or can I just give them the latest account statement (i.e., copies). How about my real property. I've already paid up my condo. If I were to assess it value, can I just pull a similar listing on the real estate market or should i go and have my property appraise? any help will be appreciated.

welcome to the group. I am a Filipina and we engaged the services of a lawyer in the preparation of the 129F forms. As far as I can remember, there is no need to have an appraisal of the real property since you have the purchase papers to show, only when requested. I would be helpful though to have the printed copy of the bank statement of the current account, and the other monies in the mutual/retirement. Again, just have them ready in case they are needed as proof.
Good luck in your journey.

K-1 Fiance(e) Visa Process & ProceduresHelp? Newbie here

Thanks Maria, Youre right. Ive been told the same thing by my friends and thats what im doing now. Preparing for my new life and spending as much fun time with family and friends..
but ofcourse, I miss my fiance thats the hard part.. what can we do but wait..-sigh-

spending time with family and friends is a great way to re-kindle bonds. Dont be afraid to take the challenges of change in lifestyle...no guts, no glory.

In my case, I am physically handicapped with a teen-age daughter in USA and my 3 boys to take care of, and I am not afraid of the adjustment. Just think that the adjustment is a shared effort.

I used to think that I could not survive without a nanny, a maid, and a driver. But now, I am able to cope, with the help of my children and my fiancee.

This time of waiting when you are apart is a time to be strong for each other. Sure there will be anxieties (and my children dont even know if they can spend Christmas in Manila or if they will finish the schoolyear here), but just think that everything that happens, happens for a purpose.

You may call me at *** when you need some reassuring strength or if you need a shoulder to cry on...I'll be here to help you with the waiting anxieties.

Keep praying and He answers in His time.

K-1 Fiance(e) Visa Process & ProceduresHelp? Newbie here

hey guys! im new here. I think this site will be very helpful. We sent our petition July and we got NOA1 August. We were expecting to receive our NOA2 last two weeks ago but nothing... should we be worried or thats ok? Its really frustrating..

and by the way, what do u guys mean by "Touched" on the timelines? lol..sorry, I have no idea
and my fiance and I met on a dating site, should we have checked "yes" on the "Marriage brokerage" something question? because we checked "no"

Thanks guys..

Welcome to the waiting club...no need to get alarmed yet. We filed March 6 and no approval yet, but we are hopeful we would get something within this month. And then the next wait is for the Manila interview.

I encourage you to make use of the waiting time to condition yourself to the adjustment of life in the USA, which is so different from life in Philippines...the snow, the culture, the loneliness. I already taught my children to share housechores, let their nanny go, and learned how to drive.

Keep your faith high and pray for strength and approval.

K-1 Fiance(e) Visa Process & Procedureshas anyone done the K2 for younger kids

Hi everyone,

I have been searching this site hoping to find out if someone has done the K2 visa for younger kids. My kids are 2, 8, 11.........I was hoping to read about someones experience with the K2.......One question I have , would you not marry if the father didn't approve of you leaving and taking the kids to another part of the world? Would you give up your kids to be with the one you love? How far would you go to be with the one you love? Hope to get some stories.

misseshedquist

From one mother to another mother....I think first you should discuss with your fiance that the kids are your responsibility and he should accept your children as his own. This being the case, he should include the children in the petition as K2 (derivative visa). If he truly loves you, he should accept and take in as his own your children which is part of your package.

The matter of their father approving of the kids leaving the country is a matter you need to discuss with the kids' father because if he is convinced that your fiance can give the children a better future, then he would agree.

To share with you my story, from the very start I told my fiance that I have 3 boys who are teeners and can be difficult to handle but he replied that if I love the children and that if he loves me, then they should be with me or I would also be unhappy if I keep on worrying about them being left behind, and in the end, the marriage will be strained. So he decided to visit us and bond with the children, and then he decided that he wanted to adopt the children so he filed for a fiance visa and included them as k2 (derivatives). We got approved and are now waiting for our interview.

Sorry to say this but your children may not forgive you for leaving them behind.

K-1 Fiance(e) Visa Process & ProceduresVisiting your loved one while awaiting K1 visa
Hello,

Maria and I have traded a number of visits from/to Philippines. Her multi-entry tourist visa has been sufficient and her current ties of children and job in Manila pose no problems to visit - BUT there is always the possibility of some border official thinking of problems if you have no information to support a K-1 (or future K-1) applicant returning home as expected.

P.S. in my years of dealings with lawyers I find 10 lawyers=10 opinions=10x10 preceived problems

K-1 Fiance(e) Visa Process & ProceduresPassport-style photo with I-129F

Regarding the passport-style photo which is to be sent with the I-129F, the instructions specify the following:

"The dimension of the full frontal facial image of you and your fiancé(e) in separate photos should be about one inch from your chin to the top of your hair in 3/4 frontal view."

What exactly do they mean by a 3/4 frontal view? The instructions specify a passport-style photo. To me, the "3/4 front view" sounds different than a normal passport-style photo.

I understand 3/4 frontal face view to be the VERY slightest side tilt to plainly show the right ear, especially if you have long hair. Perhaps someone else can elaborate or correct.

K-1 Fiance(e) Visa Process & ProceduresK1 visa, I have not meet my fiancee in-person, can I still apply?
wow, that is great. I am a chinese by ancestry and speak chinese too and there are lots of chinese here in the USA.

One requirement for a fiancee visa is for you to have met in person at least once within the latest 2-year period...and in truth, this is a test of how well you will get along with each other on a day-to-day basis. I dont want to douse cold water on you but the chinese can be very conservative and there are many cultural differences which can best be tested once you have met each other and stayed together for some weeks.

But I really do wish you all the happiness together as I have found my own handsome prince charming!

IMBRA Special TopicsIMBRA definition and application
It was a week before I returned the 3-question IMBRA RFE. Maria and I met on Match.com (the USA website, not a foreign branch). I contacted Match's legal department, who hasn't responded after two weeks, even though their customer service put me in touch with them. My initial thought was "yes" to question #1 but I went with "no" and added an affidavit. Under my circumstances, it sort of seemed "damned if you do and damned if you don't" without an affidavit to clarify. I used the IMBRA exception that Match's principle business is not international services and its services charges for all (foreign and domestic) are comparable. Also through Match, I had also met and dated women in my own and neighboring states in the US before meeting Maria. To the first post, I believe marriage brokers are not legally allowed in the Philippines (Maria is from Manila). You may want to check into this further. Hopefully your "yes" respond does not cause undue problems during the upcoming embassy interview. If by chance you get a 2nd RFE, you would have the opportunity to clarify. Good luck.

USCIS Service CentersCSC vs VSC (and TSC/NSC)
partly frustration-partly boredom I tried to find headcounts within the USCIS, service centers, etc. Not easy. Found total noncontract staff at TCS was 330 (Aug 2003), showing 475 total (Aug 2006). ~1300 USCIS+contract workers at the VSC (APR 2006). Nothing on NSC or CSC. ~15,000 total USCIS+contract overall (March 2003) and at ~30,000 by March 2005 which includes all branches of the USCIS including overseas. More importantly found comment "must retain temporary adjudicators on hand (~1100) through end of fiscal year 2006 and fill vacancies to increase permanent adjudicator staff by 27% (~460) to maintain productivity and prevent future backlogs through fiscal year 2007". I take that to mean there are about 1240 permanent and 1100 tempory adjudicators. They handled 5,700,000 applications at the stateside centers in 2005. I can't determine how they are spilt up among centers. If they are all doing 50 hour weeks, i.e., overtime, they seem to be working Saturdays, then I am optimistic in thinking they all do. Taking this further, that is about 5,600,000 worker hours for the 5,700,000 stateside-handled cases under the best of conditions. I also don't know the 2005 case overflow into 2006. The TCS and VCS had some odd announcements that revealed staffing on the web, but couldn't figure the others and of course there was no indication of how the the adjudicators were split up. Maybe someone else has more info, then you could make more sense of relative efficiency at the various centers. Too many months waiting drives me to some of this, duh.

Asia: East and PacificFlights from Manila

Hello all,

My fiancee is in Manila and looking for a plane ticket. She has only been able to find one that will get her from Manila to Los Angeles. They are saying they can not get her any connecting flights from Los Angeles to my Chicago, Kansas City, Des Moines or St. Louis...
Is there anyone that is dealing or has dealt with the Philippines that can help me out here? There has to be a aganecy in Manila that can book the enter trip to one of the places listed above...

Thanks in advance..

To all,

Cebu Airlines is noted for intr-Philippine and regional Asian traffic, based out of Manila and often has discount flights. They have been approved and are in the process of opening their first continental US destination to California. Should prove interesting to see if US-Phil flights get some price decreases in the future.

Asia: East and PacificHelp -- Job Hunt in PI While Waiting for Visa

Anyone know where I might look to find employment (even part-time) for my fiancee while we are waiting for an interview date and visa? She lives in Cabanatuan City (Nueva Ecija, Central Luzon). Unfortunately, she did not finish her last year of high school and has no degree or certifications. Asia: East and PacificFlights from Manila to USA

Hello all

Can someone share their experience with picking the best flight to bring their fiancee to the USA.

Thank,
Bryan

I suggest that you determine the date of the flight first, then canvass for price deals through the internet. Another thing to consider is the airport of final destination.

If she is travelling out to your place alone and for the first time, it would be best to get a seamless one airline only flight...meaning no connecting flight using 2 airlines as there are bound to be baggage problems in the course of the transfers.

Normally, Northwest Airlines flies to the Texas area and the flights start from Manila to Japan for brief 30 mins stop, then out to Detroit or Chicago (port of entry where she needs to pass immigration and present visa papers) and thence to TX. With NW, you can book her flight, reserve a seat all the way to TX and purchase her tickets for her on-line. You can then email her the e-ticket and voila, she is ready to go.

Let me know if you need some contact persons at NW Makati office...maybe I can help her as I am a regular passenger of NW and I can guide her with the flight details.

A one-way ticket should suffice...she is travelling on fiancee visa and not as a regular tourist.

National Visa Center (Dept of State)check the new list of interview dates at manila embassy..

 How many nurses can the Philippines export to the U.S. anyway. Maybe they are getting back to regular visas again

I do not know if there is a "quota" for such in the Philippines, but I do know that a four year degree is needed and that a specialty line of work is the biggest help. Locating a US hospital that will officially sponsor for the specialty nurse is the way to go. If the Philippines-based nurse works at a well-known/respected operation already is another great asset. One of my (future) stepsons is in nursing college.

K-3 Spouse Visa Process & ProceduresVisa for Wife in the Philappines

Greetings to all of you who miss your wife desperately and hope for a speedy visa approva.

My wife and I were married in the Philappines on May 2 and have hired an immigration attorney to process all of our paperwork.

I am back in the states now after having spend 1 month with her over there. I miss her desperately!!!

My question is for those who also have a wife in the Philappines:

1. How long did it take you to complete your visa and get approval from the date the paperwork was submitted?

2. What were the problems you encounterd, if any, and how long did they delay you approval.

3. How did you keep from going out of your mind longing to be with your new bride.

Thanks for any encouragement.

Rob

K-3 Spouse Visa Process & ProceduresVj members..anyone who feel so excited and yet nervous on interview...??

hello my fellow vjer's.......im so much excited but queit nervous with my upcoming interview this june 6....To all my fellow vjer's GOOD LUCK and MAY GOD BLESS UN ALL..........

Alex-Lyn

Hi alex and Lyn,
It is perfectly alright to ve nervous and excited about the interview and it is healthy because the excitement creates the boost of adrenalin you need to be alert and keep yout mind racing.

I was so prepared for all the documents and questions during my interview, I had prepared for all the possible questions, but then on the interview, there was a candid question that just came across with a bang....and that was the first question so it oculd make or break the interview results.

But my thoughts to you is to keep cool, be honest, and yes, be sincere in your answers to show that you have a valid relationship and will make every effort to abide by the rules of the country.

The consular officer can read your reactions and replies and you just need to be yourself.

If you want some tips, post me a message and I will mentor you through.

I am already here in the USA, happily married and adjusting to life as a fulltime housewife. But I plan to work as soon as I get the documentation for EAD or AOS. SO dont be afraid to adjust and move your cheese (read the book WHo Moved My Cheese) and you will not be as nervous but be excited about the changes. It is not the interview alone that you need to plan for...it is the married life in the USA.

Will keep you in our prayers.

US Embassy and Consulate DiscussionI-134 Evidence
With my immigration lawyer's advice for the visa applications, I gave any separate account information that had significant value. Anyone can lose a job, have unforeseen problems, etc., so the fatter your reserves, the better you look. In my case I am absorbing some additional dependents and I recently changed jobs (for the better). It will all depend on who reviews the paperwork anyway and may not be an issue, but to rephase a friends quote "peace through superior firepower" I use "flatten bureaucrats with more data than even THEY want " Bank officers will send you (on letterhead) your amounts, length of deposit and current value if you so request.

US Embassy and Consulate DiscussionFinancial Documentation questions
Hello,
I am not self-employed. In preparation for Manila, Philippines K-1 work, our immigration lawyer requested my last 3 years tax statements, bank statements of savings and a letterhead from my company stating my date of hire, title and salary. You can call (800) 829-1040 and the IRS will mail you free of charge any previous years official statements you request. You can contact any bank officer and request a letterhead statement of your savings amount, savings start date and length of time, also free of charge.
