I had my interview at mumbai embassy on 25th sept 2012 I applied for IR1 visa ,yes earlier I have submitted the I-864 form filled by my wife with a written explanation ,why she dint file her tax returns,however now she has few months tax returns and her current job pays her $41000 per annum,so can I send once again the I-864 form signed by my wife along with other documents ,cuz that time they felt it might not sufficient but now she fullfills the powerty guide lines or is there a way my wife talk to the mumbai embassy, cuz we do not want to ask her parents for joint sponser.

Today I recieved a letter from Mumbai Embassy asking for the following documents ,

 

PCC police clearance certificate 

Medical  report

 

you must provide sighned originals of 

I 864 from a joint sponser

I-864A from the joint sponsers spouse

Photocopies of the 2011and 2012 IRS TAX forms the joint sponser (and spouse)

Photocopies of the 2011 and 2012 W-2 forms of the joint sponser(and spouse)

 

I have PCC and Medical report ,however I am bit confused regarding I-864 ,my wife is my sponser and she has a job for the past 8 months,her income 

meets the poverty guide lines.

 

Please help me understand exactly what the embassy is asking for,

if ur wife is NOT CURRENTLY employed while filing the AOS then u will have to get a joint sponser NOMATTR EVN IF SHE IS WELL ABOVE POVERTY LINE BY LAST YRS TAX INFO.

 i have ma intrvw coming up next week..and even i have been asked to carry i-864 to the intrvw as there wr some incomplete infos and docs.

We had to get a joint sponser cos ma husband wasnt employed while we were filing the AOS at NVC but right now he is.

i have kept all the docs ready for the intrvw...as i do not know wat they might ask me. 

WHAT ALL DOCS DO U THINK I SHLD CARRY?AM pretty nervous now aftr reading urs.

 

y is dat they asked u to submit PCC and medical  & marr certif? didnt u submit PCC at the NVC or take it to the intrvw? and didnt u take  medical report with u?

 doesnt the APPOINTMENT LETTR(email) frm NVC SAYS ABT THE DOCS U R SUPPOSED TO CARRY to the intrvw?

Appointment letter gives the complete list of docs which you need to carry to the interview.

In my case the docs expired so they are asking for the docs again.(pcc and medical)

Marriage certificate .I did not carry it with me to the interview,so they asked me to submit .

 

Here is the list of documents which I carried to the interview.

Originals and photocopies.

Birth certificate.

Marriage certificate.

PCC

Medical Report.

I-864 along with the supporting documents

Passport

Pictures

wedding card

proof of relationship(cards,pics,letters,cell phone detailed statement)

 

Questions which the consular asked are very simple,

how did you guys meet?

Love marriage or arranged marriage.

Marriage date,date of birth of my wife.

Date when did we meet for the first time.

how did you know your wife?

my wife is still employed and earning enough money to full fill the I-864 form requirements.

My Visa application is 2 years old,PCC (valid for 12 months from the date of issue) and Medical (valid for 6 months)

As both got expired they asked me to resubmit the docs ,

 

Earlier when I was interviewed ,my wife started working for the first time so she could not submit the tax papers,however we submitted the (submitted,pay stubs,employment letter and explanation letter why she dint file taxes)

 

My question is as she is working for the past 18 months to till date ,she has all the papers required including the tax returns ,will the consulate accept I-864 from my wife along with the supporting documents including tax returns of 2012,instead of a Joint-=Sponser?

Hi,

At the time of interview I have submitted I-864 form filled by my wife to the CO,however I recieved a 221g letter,asking for my marriage certificate,So I recently sent the original marriage certificate and my passport to the mumbai consulate and again I have recieved a 221g white slip asking for PCC ,Medical and A JOINT SPONSER..

Earlier I submitted I-864 form without tax returns (submitted,pay stubs,employment letter and explanation letter why she dint file taxes)

 

I got the PCC and Medical.

I-864 form signed by my wife  along with the 2012 tax returns and W2 .

Her income is well above the 125% of poverty guidelines.

 

Do I still need a joint sponser?

Please suggest me what should I do.

I did not receive any mails from the consulate,when I checked the status online it says that. 

They game me a 221g white slip 3 months back asking for PCC ,medical ,I-864 and my passport,which I am going to send them in few days as soon as i get the mail from my wife.

Please provide a written statement to the Embassy or Consulate outlining the circumstances beyond your control and noting that you still wish to pursue this visa petition.

 

So do you have an explanation for them that was out of your control why it took you so long. And now you submitted the papers and got another 221g. Goodness.

 

You need to notifiy your embassy and get some direction what to do.

Yes ,It was delayed only due to I-864 which I coudn't get a joint sponser,however my wifes income now is $42000 per year and I also found a joint sponser.

I have a question ,the recent 221g which I have revieved few months back also said that I have to complete within one year ,so I thought from that date to one year.

 

Will that be okay to send the required documents with a written explanation why it took so long in a few days?

Do u have access to a computer and printer? If Yes, download the I864 form and make the corrections yourself and print out the pages that u need. Go though the I864 she sent u and get rid of the pages with the wrong info only then replace them by the corrected ones that u just printed out. Be sure to KEEP the page with her signature on it

For the address on the I-184... since I'm currently living in the Philippines, should I put my mailing address as my current Philippine address or my address in Texas where I WILL live? When I filed my I-130 I initially put my Philippine address for my own, but then the USCIS clerk told me to change it to my (previous) mailing address in the States. At the time of filing the I-130, we weren't sure where we would be staying so we just put my grandmother's address. But now- after the I-130 approval - we've decided to move in with my mother. SO WHICH ADDRESS SHOULD I PUT ON MY I-184??? My grandmother's (to match I-130)? my mother's (where we plan to live) or Philippine address (where I'm currently at)? :wacko:

Tax forms are only used as "evidence of CURRENT income" for the self employed. Otherwise they are simply the source of information about past tax returns. Current income is how people qualify. So, both the petitioner and joint sponsor will provide INFORMATION from three tax returns but the joint sponsor will also need to show evidence of CURRENT INCOME in the way of pay stubs and/or employer letter. Include the 2012 tax return if it has been filed, otherwise use the 2011. Provide all three if you think it will HELP.

File for the last 3 years complete 2555EZ first.The final sum you get on this you enter on form 1040 under the income section #7 . You then go to #21 (other income.List type and amount. (Write 'Form 2555EZ' here, then you write you write the yearly income again in brackets ( 10.000) line below that Total comes to -0- , put -0- on line 37 aswell. Then if you dont have anything to declare or claim you do the same (-0-)on 38.41.42.46.54.60.71.75. Sign and date at the bottom.
At the beginning of the form you enter your details.If you are not filing joint you don't have to enter your wifes name here and for her SSN just put N/A.( As I assume she hasn't got this). As we were married but I was filing my own taxes in UK we ticked 'Married filing seperately' under filing status.
I got help with all this from an official Tax expert plus confirmed with the IRS legal dept.
My husband did the same for three years back tax returns, took 2 extra copies of each one ( 9 copies in total) For each year add any proof you got of income. If your previous employer can write three seperate statements of income to go with each Tax return. You need to have some kind of record even if its estimated. you need 3 copies for each year to clip to the taxreturns.
You then take this to your local IRS office where you get all 9 copies date stamped . They will file 1 copy for each year. ( IRS Done)
Submit stamped copies 1 for each year together with your I-864. Dont forget evidence of your current earnings.
The last set of copies you keep for yourself as evidence that you filed your taxes.

This Format is only applicable if you qualify for FOREIGN EARNED INCOME Exclusion Form 2555EZ and did not have any claims,taxes or credits
You can phone the IRS legal dept or get advice from an official Tax Adviser if you aren't sure about something. Good Luck

Receipts are not needed to support income, when filing a tax return. If you claim income the IRS doesn't know about and are willing to pay the tax on it, they won't argue about whether you actually had the income. Since this income can only be used as ultimately meaningless information on the affidavit and cannot be used to help qualify as a sponsor, the Consular Officer won't require actual evidence of it either.

The OP needs a joint sponsor or a new real job in the USA to qualify.


I do have a co-sponsor who will fill out a separate I-184. :thumbs: It makes me feel better about the IRS not actually requiring proof of my income... I'm thinking of writing a letter to explain why I haven't filed in so many years and why I don't have any "paper trail" or w-2's from my "cash' companies. Do you think that will be ok?

No receipts.. no nothing...just straight cash. i spoke with my supervisor today about the whole deal, and she said they could make a "Certificate of Employment" for me. This would be a sheet of paper on Company letterhead stating the following: my name,position in company, Date i was hired at company, gross monthly salary received (in cash). That's it. I'm hopingthat will be OK at least for my 2012 tax return. For my "back" years I don't have any documentation at all. So I'm hoping they will just take my word for it about the money I made.
What are your thoughts about the Certificate of Employment? Do-able?

I've been living abroad for about 10 years... during that time I've only received cash for my tutorial services. Even though I was "employed" by English tutorial schools, they never deducted any taxes and only paid cash. I never filed any taxes with the US IRS. Now here I am trying to get my husband an IR Visa to the States, which requires the I-184. I'm not sure how to proceed with this form. I've been "loosely" employed, but have no paper trail to prove it. I know I'm required to show tax return slips, etc to supplement the I-184... What do I do? I just tried to pay the immigrant fee with elis... got all the way to the place to insert my bank account info... CLICKED SUBMIT PAYMENT (was careful to only click once) and then the website crashed... to the "grey screen" that said "Unable to load requested page"... ohmy.png So after staring blankly at the screen for what seemed an eternity... I clicked reload page... returned to clear white screen of ELIS... and nothing. I don't know what happened to my payment... I DID NOT RECEIVE any confirmation from ELIS about receipt of payment. I'm afraid to try again for fear of multiple payments being sent. ANY SUGGESTIONS???

You mentioned the blue paper issued by the USCIS with a note: "new joint sponsor" -  what did they mean by that?  Did you file the Affidavit of Support, having a joint sponsor earlier and that person was rejected or what?

 

If you have earned  the required minimum income last year, then you might be able to see if you can be her sole sponsor.  You'd have to check on that, because I'm not a 100% sure.  

 

You should definitely apply for your daughter to receive the SSN.

In general, when you receive an RFE, you have to respond within the time frame indicated (usually 30 to 60 days) so that the immigration official adjudicating your case will have enough evidence to make a favorable decision.  Simply ignoring an RFE, will result in denial of application based on an assumption of abandonment.  This seems to be what has happened in your case.  However, you have mentioned something about contacting the USCIS by phone and being told not to send anything? That's very weird.  Myself, I would have never followed what was said to me on the phone, but would have at least replied in some way through regular mail.  Documents get lost, but phone conversation is quite hard to recover and a petitioner should always remember this: when a government official makes a mistake, he/she will always be on he winning side, for it is you that wants to get the petition accepted and not the other way around.  Hope you can still do something and finish the application process.  Good luck.

I'm sorry, but you're wrong. It is irrelevant.  You ought to familiarize yourself with the guidelines I provided the link to.

Whether it was just a possession, possession with intent to distribute, this guy was still convicted and incarcerated for 4 years. If he got that much, he must have been convicted of a felony - which is enough to make him ineligible to procure any type of U.S. visa.

the last one was 2009. the first one 2002... ai had 3 times problems with drugs and i was arrround 4 years in prison.

 

Hey. I know people do things that are stupid and regret them later.  I don't know anything about you, except for what you've told us.  For all I know, you might still be around drugs, guns, etc.  I'm not here to judge though.

 

Based on what you've told us, I'm not sure if there is anything you can do to gain legal entry to the U.S.  It's a sad thing, because of your kids, but these things happen - sometimes, parents get deported even and kids are left to stay. I understand, you'd like to be able to at least visit your kids time to time, but the way things are, the only way - at least for time being, is to have them come to you during summers and/or holidays.  

 

Meanwhile, I would suggest to discuss your case with a different lawyer and contact that lady, that someone has mentioned to you about.  It doesn't look promising, but it's worth a try.

That is one of the reasons of asking for any other name used; so if there is inquiry with the "wrong' document, all other names would come up and it all would resolved.

 

True, but I just want to make sure of one thing: when my wife goes to her interview and hands over her passport (with maiden name) for the purpose of having visa affixed, the consulate employee isn't going to reject it and tell her she needs to bring her updated passport.  That would not be a good thing, for it would lengthen everything.

LOL! Yes I think you got it all right... to clarify...

 

1, My birth certificate is in my MAIDEN name

2. My Passport is in my OLD married name

3. I filed my AOS in my NEW married name

4. My green card and SSN is in my NEW married name

 

Because my visa is different to the one you and your wife have applied for I will throw it out their to other VJ members to advise if the visa in your wife's married name is fine in a passport that bears her maiden name.... but I would imagine the majority of people will still have their passport with their maiden name in it by the time their visa's are affixed into their passport.

 

Right, that's what I'm mostly afraid of - that they might not want to affix the visa (clearly, it will be issued in her married name) in the passport which is in her maiden name.  Your visa must have matched, because your passport was already in your married name. Thanks for all the info ;)

It was double weird for me. I was previously married and divorced about 6 years ago. I never changed my name back to my maiden name, and kept my married name until I met my (Now) husband. So.... My passport was in my OLD married name, my Birth Certificate was in my Maiden name, and my AOS was filed in my NEW married name LOL!!!! It was NEVER questioned at all through the whole process EVER. It was never brought up at my interview, and even when I supplied my Birth certificate passport and EAD to apply for my SS# it caused no problems. In other words? Your fine my friend... and I see we are kinda from the same neck of the woods in terms of location? Good luck, you will be fine.

 

P.S I have received my Green Card which is in my NEW married name, and have been told that It is fine for me to travel out of the country and use my passport with my OLD married name as long as I have my marriage certificate on me.

 

Hey.  Wow.  I'm glad it only sounded complicated, but it wasn't.  I think that in the end, it comes down to the professionalism and competency of people who handle paperwork.  Let me make this clear though:

 

1. Your passport bears the Last Name of your ex-husband.

2. You never went back to your Maiden Name.

3. You re-married and assumed new husband's Last Name.

4. AOS was filed with your yet another new Last Name.

5. Your green card and SSN, both bear your new married Last Name

 

Am I correct?

 

So, you think there's no need to update my wife's passport and they will affix her visa (in married name) in the passport that bears her Maiden Name without questioning it?

I think it would have been better to n put her maiden name because they generally want the name that matches the birth certificate. For our application I used my maiden name for everything. And even though I changed my name legally last summer, I still kept everything in my maiden name because that matched my birth certificate and application. I would say call the visa service center to check...wouldn't hurt smile.png

 

I guess, in the end, it would've been easier to do that (leaving her maiden name). Although, USCIS shouldn't get confused in any way, since all the information on G-325 and I-130 matches any legal documents and is self explanatory.  Wife's birth certificate bares her maiden name, and so does her passport, but on forms, it is clearly stated that she is married to me and what her maiden name is.  

 

We basically wanted to have my wife to use my name upon entry to the U.S., legally.  Green Card and SSN would be given in her new name, and all without the extra charge.  However, I did not realize how complicated and time-consuming - changing her passport will be; hence my question on here.

 

So....if we DO NOT have to get her new passport before receiving visa, then I would postpone the changing of her passport until after her entry to the U.S.  Her visa will not be valid anymore anyway.

My wife assumed my Last Name after marriage (it took place in UK). She's not from UK, and her passport bares her Maiden Name.  When I filed my petition, I put her assumed name (mine) and put her Maiden Name in place where it asked for 'other names' - it does say including maiden name.  My question is: when the time for interview comes and she she will receive her visa, does her passport have to be the updated one (with new Last Name) or using the old would suffice?  The reason I'm asking, is because in her country, it is NOT necessary to register her marriage from abroad with the country's Registry Office, but if you need to update your passport, then you will have to do that first.  Lots of paperwork comes with that and if it is not absolutely necessary to have your passport updated for the purpose of receiving your visa, then I would be glad.  Although, I'm afraid that one should updated his/her passport in such cases.  If anyone knows the procedure on this, let me know.  Thank you.

I just called NVC this morning to find out what the status update on my case was and NVC said that USCIS has REQUESTED the case back.  Has anyone experienced this?  I asked them if it was sent back for revocation and they said no, it was USCIS that requested the case back.
 
If anyone can help figure this out it would be very appreciated

 

 

Can you elaborate on this? I'm not familiar with this "request the case back" term.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 form filed. Can we continue the process in California?

I recently sent in the I-130 form to Chicago as the embassy in Warsaw no longer accepts these applications. 

 

My wife ended her work contract in Spain before we wed. I freelance back home and I am not legally allowed to work in Europe. 

 

 I would like to know If we can continue the process of getting her green card back in the States. What would be our best option? She has had her US tourist visa since 2010. Can I apply for an AOS while over there since she is my wife not my fiance?

 

I need some advice. It was very difficult getting married here in Poland. The paperwork was tedious but well worth it. Having to deal with more after our marriage is really a pain. It seems to never end. Some advice would go a long way.Thank you for your time.

 

Hello there. I will start by saying: I'm so glad I didn't have to go through the marriage process in Poland - my wife's Polish.  We've met in Poland, and dated for a few years, then decided to move to the UK together, get married here and file I-130 through the Embassy.  This is a much quicker and cheaper process.  Obviously, you weren't able to go that route.  Anyway, since you filed your I-130 in the U.S., your petition should be approved soon. Then the process starts for your wife.  It will take quite a while before she's issued her IV, but be patient.  Since she has her tourist visa, she can always travel to see you.  When she gets some paperwork proving that she started her process of acquiring IV, when she travels to see you, I don't see why she shouldn't talked to the CB officer to make sure he gives her an ample amount of stay.  It shows that she's respecting the immigration laws of the United States, but while she awaits the immigrant visa, she's visiting her lawful husband.  There's nothing wrong with that.  Peace of advice, when she travels to see you, she should make sure that all the paperwork that might come from the Embassy, is received by someone she can trust and she should make sure she's in Poland for all her scheduled appointments (medical, etc.).
