Hello,

My husband and I are applying for his visa through the consulate in Warsaw. We have a joint sponsor for the affidavit of support. I have spent the last three years living in Poland and this seems to be our biggest barrier now as they want me to return to US before they will grant his visa. 

 

I am submitted the following as proof of US domicile per Form I-864 Instructions:

1.     Letter from my bank showing an active US bank account

2.     Statements from E*Trade Securities LLC showing US stocks owned 

3.     Statement from Capital One showing my US mailing address

4.     Statements from PayPal showing transfers made from PLN to USD (x3)

5.     A copy of my US voter registration card

6.     A copy of my Karta Pobytu decision showing my status as a temporary resident in Poland

7.     A letter from mom confirming that my husband I will live at her home upon our arrival in the US

8.     A letter from a company stating their intent to employ me upon my return to the US

 

...and we were still denied. 

Any other ideas?

Anyone from Poland made it through this process?

This all sounds very strange. I actually did not know you can do DCF at the American Embassy in Warsaw.   Let me ask you this: do you hold a U.S. passport or just have a GC? Also, how long have you been living in the States and how long has it been since you came back to Poland?

No u should not sign it. Your wife should sign it either online or hardcopy.

If you could not get BC for them, You can get a letter from local corporation or municipality in which city or town they born , explaining wats the reason for not having the records of them at corporation. and also they might have some ID proofs such as Voter id or pan card or passport which reflects their birth date and place of birth, using that, u can get notorial affidavit for affidavit of birth certificate

 

I think this wil be the procedure so dont take my points as a final one, search for more info. i may be right or wrong.

Very true in pointing out that we should keep everything as it was when we submitted the I-130.  Best not to disturb things.

Apparently Indian passports have a section where they indicate marital status (US passports don't have this) and he went for his PCC today, but they told him to return with marriage certificate since his status is still listed as unmarried on his passport.  He is now worried that the status not reflecting married will negatively affect his interview.  I've not read of this coming up as an issue, but anyone have any insight?

 

I know in the US, agencies overlook things like that because they know many people don't change the details on government issued docs until it is time to renew (passport, drivers license, etc) since usually it is very costly.  They go by whatever information is listed on the application, form, etc.

 

Should he get it changed?  Will it cause a problem during interview or is it fine as long as he has the marriage certificate and everything else to back it up?

My experience, I hvenot added my spouse name in my indian passport. I havenot applied for reissue to add my spouse name. since it is optional i didnt update my passport after marriage. When i went to the passport office for PCC on scheduled time, I was asked for the country for which pcc is required. Since i filled out my spouse name in PCC appointment form, I was asked for marriage certificate, I showed them the marriage certificate(photocopy), but they didnot collect it from me(some office may collect it from u for evidence). Later they printed my PCC in which my name,passport number and my spouse name, USA are reflecting and it says i hve no any criminal records. Dont go to any agents to fil the form, its very simple to do. If u have done with police enquiry when u applied passport, you will get PCC in 40 mins. If u have not done with police enquiry for ur current passport, they wil make u wait til the enquiry is done , in that case it may take 30 to 60 days to get your PCC. Adding spouse name or showing marital status as married in passport are optional. Pls Dont think it wil affect visa process or interview. You can simply say to consulates during interview that u didnot update your passport after wedding . Already one of my friend went to US on CR1 , she didnot add her spouse name in passport. You should be fine as long as u hav marriage certificate and all other evidences for bonafide marriage. No one can ask or do anything for passport stuff. everyone thinking that getting PCC is very hard. I am wondering y all my indians having so many confusions abt PCC. Its very simple guys. 

 

 

Since you applied for i130 and got noa2 , dont touch or update ur passport in the middle of the process. You should have added ur spouse name by applying reissue before u applied i130.

My interview time was 7.30 AM in mumbai embassy. I arrived there by 7. Since it was raining heavy, An officer called up the 7.30 applicants and let us go inside the building. I was the second person in the queue. So I was nervous.I went inside by 7.10 AM.There are some consular assistants who are helping applicants to arrange papers in order. So Applicants were asked to arrange papers in following order.,

1. DS260 Confirmation Page
2. 2 US style photographs
3. Medical report
4. PCC
5.Original and photocopy of Birth certificate, Marriage certificate( If we submit originals to NVC, we can jus use photocopies at this stage in interview)
6.AOS packet(I864,I864A and updated tax returns)




Since I was aware of this order,I already organized papers at home itself and were waiting for my turn.An Indian officer in a counter called applicants one by one. I approached him in my turn, He jus asked me the interview appointment letter and pasted token number label on it and told me to wait for my number to be flashed on the screen.By 7.45 AM, I saw my number flashed on the screen and approached counter no.4. She was a nice tamil lady from chennai and was talking to me very friendly in tamil. She asked me about my moms maiden name, my maiden name, marriage date, my parents name,husband name. It was jus for verification. 
She then returned to me the IV package(photocopy of my passport,original BC,photocopy of PCC, certified copy of MC) and AOS package(Federal tax return,W2,1099INT,1099DIV,Tax transcripts of 2012 and 2011). She was organizing papers like original passport, DS260 confirmation page,2 US style passport fotos, Medical report, Original PCC (which i submitted to NVC, She did not return it to me),Photocopy of BC and MC,Federal tax return,W2,1099INT,1099DIV,Tax transcripts of 2013.She Gave me domestic violence pamphlet and asked me to go through it as i m waiting for interview with US consular. I was jus waiting for my turn and reading the pamphlet. 
By 8.20 AM, I saw my token number on screen and approached the mentioned counter. 
She was a nice beautiful US consular, Actually i was admiring her. We both greeted each other.She asked me interview letter and taking the oath and fingerprints. started asking me questions.,


1. Who is calling you? 
2.When and where did you get married?
3.How did you meet your husband?
4.Whats his profession?
5.In which state does he lives?
6.When was your last meet?
7.What do you like the most about your husband?
8.How many times do you talk to your husband in a day?
9.When did u talk to him last?
I answered, Before entering into this building.She asked me back that if he is waiting outside in this heavy rain? I answered " No, I was on a call with him".
10.Is your visa pick up location Chennai?
11. Did you read and understand the domestic voilence?










I answered for all questions confidently. She said to me that " Ok Ma'am Your visa is approved , You can collect your passport and visa at your pick up location. She then provided me a instruction paper for green card fee payment and was told to pay it before departing to US.I said Thank you and you look very prettyy   She thanked me back and smiled.She did not ask me any of my evidences or wedding photos or even a single paper. I walked out of the building with a surprising smile by 8.30 AM. Pheww That was a big relief really.
I came back to my hotel and checked ceac site ryt away by 9 AM and it showed " Administrative processing" I again checked the visa status after lunch by 2 PM, It showed " ISSUED". 
Consular assistants and Indian officers were very helpful and friendly.Consular interview also very cool and easy. I still cant believe that I am done coz I did not feel that i took interview. I hope this helps all my i130 friends. 
If you are really well prepared for your interview, then you wont be facing any difficulties.

Fun quotes.. :)  RFE for the one who failed to get permission from USCIS to get marry. If it was the situation, CR1 petitioners would have gone thru the paperr works for marriage, they would have got NOA0 first , then NOA1 and NOA2 comes next.

Why should fiancé's have to wait for their loved ones over spouses? I believe both should go at the same speed. There could be lots of reasons why one would choose fiancé visa over spousal even if the time was the same. Both groups are in love and it's only the timing of the marriage that's different.

 

Married couples are started their life but fiance are jus gonna start their life after they marry. thats the only reason. Preference can be given to one who already started. coz the pain is more for married couple. They shouldnot end up their relationship while the CR1 is on process. the legitimate relationship is more powerful n committed one than fiance visa applicants.If fiances breaks up the relationship, they wil be still single n can get another fiance. but for married couples, if they ends up the relationship, their status wil be changed to divorced. I dont want this to happen to married couples when CR1 is on the process. If they live together , the interest n intimacy wil be increasing. It decreases the divorce case. they can stay , committed with the relationship. I jus dont want USCIS to be the root cause for couples getting divorce. Any more explanation u want?

Hey All!

 

Will it affect my chances if I apply for a B1/B2 visa? I am sick and tired of just sitting and waiting for USCIS to approve my petition,originally it shouldn't take this long,or are they trying to test the strenght of the marriage or what? Sometimes I don't know what to even think, K1's get approval within a short period of time while we don't. I don't wanna do anything that may affect me later on so I'd like to know if its wise to give a tourist visa a try.

Really a great sense of humour u have :) hehehe. Even i m also thinking of applying for tourist visa to visit my husband. But dont know how much it wil affect to the CR1 process

I don't know if its just me or someone else is going through same BS from USCIS! We've filed an i130 petition in March and still no NOA2! Isn't that just crazy? I noticed people who filed in August though for a K1 get approval within 2 months! What da hell is wrong with those guys giving priority to people who aren't married while keep those legally married apart for long?

 

Just doesn't make any sense to me!

Keep Calling USCIS or get info pass appoitment to meet tier 2 officer. for me its been only 2 months since we filed i130. So i m waiting patiently. I dont know if i am gonna get into the same situation in 3 to 4 months. We need to be ready to face all the hurdles.

Today I recieved a letter from Mumbai Embassy asking for the following documents ,

 

PCC police clearance certificate 

Medical  report

 

you must provide sighned originals of 

I 864 from a joint sponser

I-864A from the joint sponsers spouse

Photocopies of the 2011and 2012 IRS TAX forms the joint sponser (and spouse)

Photocopies of the 2011 and 2012 W-2 forms of the joint sponser(and spouse)

 

I have PCC and Medical report ,however I am bit confused regarding I-864 ,my wife is my sponser and she has a job for the past 8 months,her income 

meets the poverty guide lines.

 

Please help me underst

Never mind.  I just read your interview review and I saw that you handed them a I-134 instead of I-864.  Hope you got everything squared up by now.  Good luck in your new chapter (living in the U.S.).    

 

P.S.  I'm not sure why that is, but some reviewers say the Embassy didn't want copies and some say they do.  I'll have mine just in case.

I had the wrong Affidavit of support, which was all our own fault and we accept that, but at the first interview window the officer said that all I needed to do was to get the correct paper work from my wife and using the courier service, get it back to London for them to complete the application (no need for ME to go back down)

 

So my questions are :

 

Do I send: I-864+Tax Forms+ Letter from wifes emplyment along with Part 2 of the DS230 and wait for a response?

Or,

Do I send: I-864+TaxForm+Letter+PT2 DS-230+Passport? (I would assume this one so that they can get it all done at once) Just looking for clarification.

 

Hello. By wrong I-864, do you mean the old revision of the form or erroneously filled? My wife's interview is around the corner, and my 864 is bound to be deemed "does not meet" in earnings, but her co-sponsor's will suffice.  Although, when you cannot meet the requirements yourself, than you always worry, right ;)

my ceac changed to 'issued' yesterday (4th/ August)
and I was just wondering from other people's experiences who have recently received their passport/visa and 'issue' Ceac.

how long after your issued status, did you receive an email from DX ? :)



 

My wife's interview was on August 7th (Thursday) at 8am.  By the time we got home around 1pm, the status has changed to "issued."  Email from DX Group came this morning (Monday August 11th) and the package will get delivered tomorrow.  Considering we just had a weekend, the Embassy works quite fast.  

 

What's your update?

There is a reason it's more relaxed, that being people who go there for things like a K1 (especially if they are British anyway) are far more likely to be going there for the right reasons than in many other countries. It's not a high fraud country.

 

OP, glad it worked out alright for you.

 

I think you're missing some facts. There are plenty of non-British citizens who live in the UK and want to travel to the U.S. either for tourism or to move there.  My wife happens to be Polish born.  She and I, came to live in the UK, for two reasons. The main one was because I was able to file my petition for her through the quickest route possible - DCF.  This could not be possible in her native Poland.  It doesn't matter what country you're in, there are plenty of people out there who are trying to get visas for all the wrong reasons.   The Embassy staff in London just happens to be very professional and there's no reason to be rude or cold in order to follow their procedures.

Leaving in the hotel is the best idea if in doubt. She can also check things at Gould's Pharmacy for £3-5.

I will say I have been reading London reviews for six years and have never heard of anyone getting busted for cosmetics. Yes busted (before changes) for phones, memory sticks, earphones, iPods, car keys.
Not busted for snacks and drinks for their kids, watches, cigarette lighters.


 

So, I guess we should be ok then.  Not being able to take her hair iron is already a big deal ;)  We men, got it so easy :P

From everywhere I read, the consulate/embassy seems to be very strict in what you can bring. 

 

If she is staying overnight, she has a luggage of some sort, right?

I would either leave it at the hotel room, or if she has to check out,

most hotels will keep the luggage for you at the front desk. 

 

I had this discussion with my fiancee...she will leave everything at the hotel,

and she is only going to bring her visa related documents, and a small wallet for 

her IDs, cash, and credit cards. 

 

Just keep it simple...

 

 

 

No luggage at all.  Just a purse and my small backpack for the paperwork.  We live about an hour from London, but getting up at 3 or 4am to get there by 7:30am would not be great, so we've decided to get there the night before - just for the night.  We're not staying at a hotel (airbnb.com) so wouldn't be able to leave anything behind.

I can't seem to find any information on personal grooming items.  My wife will be spending the night in London - before her interview, and I wanted to know if she would be allowed to walk in with items such as travel size bottle of body wash, liquid and powder make-up, tooth paste? Body wash and toothpaste could be thrown away, but make-up not so much.

Hello to everyone on this thread.  My wife is ready to schedule her medical and we wanted to know, when is the best time to send the Notification of Applicant Readiness form to the Embassy?  The results from Knightsbridge usually take up to 4 days to reach the Embassy, so is it safe to assume they will schedule her interview NOT earlier than 3-4 weeks post her medical?  We're planning a trip next month and just wanted to make sure we don't miss the appointment.

Yes you can choose a date subject to availability (if you want one as soon as possible you won't have as much choice of course) and they offer a choice of appointment times the day you ask for as well. As an example I called them on the 18th of April and they had dates available from the 30th onwards.

 

Ok, thank you. Good to know, for we have a scheduled vacation and will not be back until the 20th.  I guess, it would be good to call Knightsbridge now and see if we can schedule for a certain day, right after we come back.  I noticed your interview was scheduled around 3 weeks after your medical. Would it be safe to assume that we will have that good 3 weeks after medical before the interview?  I'm still waiting for some documents to arrive from the U.S.

Hello there.  We have just received my wife's LND # and are now ready to complete the DS-260 and schedule her medical.  My question is, how long do we have to wait for the medical appointment and can you choose the date that suits you best?  


Medical is tomorrow, am getting the 3AM coach from Exeter as the train was like £90 to get into London before 9AM so I'll probably be too sleepy to be stressed! Wish me luck, I'll write a review after I'm done :P

You'd be better off getting them for free before the medical and having the records updated and printed there and then like I did. If memory serves for IR/CR1 and DCF all vaccines must be complete at the time of the medical/visa interview anyway. K1 does not, as they have to have them all complete by AOS.

 

DS-3025 is also not really an issue for anyone going down the IR/CR1 route, or the DCF route for those either. It's a K1 thing and that's the form you send in with AOS instead of having to go to a Civil Surgeon if you don't get all your shots done in the UK.

That makes all the more sense, thanks.  I will schedule an appointment for my wife with her GP and have her get all the shots she needs.  Hopefully, Knightsbridge will not get fussy about it.  Just a quick question though, can someone go to the medical with my wife - in order to help with paperwork and translation? She might need that.

She can, if she wants to, decline to have all the missing vaccinations administered there and then, and have them done at her GP afterwards, but then they'll be marked as missing on the form given to her from the Medical (DS-3025). Then later on at AOS you will have to pay for a Civil Surgeon to put the two records (the one from the Medical and the proof of the subsequent vaccinations from her GP) together into the required i-693 form instead.

 

Personally, I decided it was less hassle for me to pay £70 and have the DS-3025 completed properly there and then and be sure I could use it for AOS than to go to my GP for the vaccinations and then have to get a CIvil Surgeon do a i-693 instead.

We are still waiting for NOA2, so the medical will definitely take place after March 31st - which is why I said earlier that I doubt she'd need to get the flu shot. Good thing, 'cause I believe they do more harm than good. Of course, this is a matter of personal opinion ;) However, I do suggest reading recent studies on it.

 

I'm not sure what you meant by: "(...) form given to her from the Medical (DS-3025)."  - I thought the completed form is sent by the doctor to the Embassy. Am I wrong?  Also, my wife is not going to be doing AOS, for she will have an IR-1 status and we're doing this through DCF.   Anyway, the reason I mentioned getting missing vaccines the day after her medical, was because someone has mentioned that earlier in the post - this one or a similar one.  I just wanted to make sure that this can in fact be done.  Some GP's give some vaccines for free, so why should I pay at Knightsbridge. The 235 quid for the medical, is already a lot.

You can do that if you think you know what she needs to have. In my case it was MMR and Dtap (diptheria and tetanus booster I think)  Depending on the time of year the medical is done a Flu shot is required too. However your GP may or may not have those vaccinations, or she may end up getting shots she doesn't need for the purposes of US immigration. That's why I left it to the vaccination nurse to access (on advice from here) as they will confirm what is really needed based on the form they complete for you.

 

But its entirely up to you.

 

I doubt she'd need a flu shot and if so, I'll be glad if she doesn't have to get one.  Anyway, I will have her consult with her GP about her vaccinations, but if the doctor at Knightsbridge says she needs certain ones, can she have them done at her GP and mail the proof back to them?

If you show up with vaccination records they're kinda pointless unless they are recent. I couldn't prove i'd had MMR or tetanus in the last 10 yrs so I had them again. I've had MMR countless number of times now from moving from country to country and losing medical records inbetween but it doesn't hurt to have them again. Most other things are waived as not being 'age appropriate'. It cost me £70 for two shots which was steep but it was done and recorded properly on the form they want for AOS so that saves a big hassle down the road.

 

That's why I want her to do the tetanus and whatever else she might need, locally at her GP's office. It doesn't cost that much.

Piece of advice for anyone waiting for their medical, and thinking that they may need a letter:

 

I came pre-armed with a letter from my GP, which the (very rude) doctor refused to accept. He insisted that I supply them with a new letter (which had the same content).

 

So- f you suspect that you will need a letter from your GP for any reason my advice is not to get one beforehand, but rather to have an appt with your GP set up for the day after the medical. If Knightsbridge need a letter, you can send a scan by email, so as soon as you have it, you will be able to send it and the medical paperwork won't be sitting at Knightsbridge for too long. 

 

I was beyond peeved to have thought/planned ahead and end up running all over London to get a new letter anyway! Luckily my GP is wonderful, and I could beg for an appt asap and keep everything moving.

That's horrible. All of that for nothing.   Well, my wife isn't from the UK and wegot her vaccination records translated, so she can take it to her medical.  Some of that stuff was not legibly written, so I wonder whether or not to take it to her GP first, instead of Knightsbridge.  I'm afraid they might not want to study the vaccination report and tell her to take shots she was already given in her country - which costs a lot when done there.

The sweet irony of course being that a returning USC doesn't have to get a medical and could bring all kinds of illnesses home!

 

It does and doesn't make sense at the same time.  They way they look at it, they cannot deny a returning American entry to his country, just because he/she has AIDS or some other virus like illness.  However, the U.S. Government can decide whether or not to let a foreigner with such illness, because they know right away, that that individual will use the healthcare system.  Although, not like it's a free one :P

For DCF, without the police certificates/cost of travel/hotels/postage, your costs will be:

 

$420 for the I-130 - paid with petition package

£235 for the medical (plus extra for any vaccinations taken there) - paid at medical appointment

$230 for the visa (plus extra if you are having the passport+visa couriered back to your home) - paid online in advance, details outlined in Packet 4 interview invitation letter

$165 Immigration fee - paid before US entry, see http://www.uscis.gov...s-immigrant-fee

Okay so if you are DCF, put that in you profile. There is a choice for that. You don't process at NVC. You do have the medical before you can be given an interview date. You don't pay anything to NVC. Your visa fee is paid online once you know the Interview date. The DCF process is a lot like the K1 in many ways.

Sorry for the confusion.  As I am the forum's user, I put my own information here and not my wife's.  She will be the upcoming beneficiary.  We haven't filed yet, but yes, it will be through DCF process.  I've read the typical London's DCF process - provided by lost_at_sea, but there are still questions that arise.  The medical cost was one of the.  Although, I do have another one: you have posted a list of fees and I'm confused about the $230 visa fee and $88 AOS review fee.   In my wife's case, the AOS review fee obviously does not apply, but what about this $230 visa fee on top of the $165 immigrant fee?  Correct me if I'm wrong, but the latter, isn't that the one you pay at the POE, in order to receive the permanent resident card?

 

Could you, please create a list of fees (minus the obvious Police Certificate fee) and the time frame in which they have to be paid?  I will greatly appreciate.

Not sure what 90 days you mean. You pay along the way as you move from USCIS to NVC to London and beyond.

CR1 route

What I meant by the +90 day period was the fact it takes around that long for the CR1 to be processed via DCF in London. So just as I said earlier, all this cost will be incurred by me within that period. 

 

It was my understanding that the Immigrant fee was payable on the day of the interview, before the interview can commence.

The same clinic has two locations, but only one location does the visa medicals. If the x-ray machine breaks down, they may send you to the Basil St. location but the prices are the same.

I've looked at the info provided in the link you gave me. Wow! 235 quid for a medical exam? Only 110 if you're under 14? It's ridiculous to think that a 15 yr old has to pay (his/hers parents most likely) double that.  This 235 quid is a lot of money when adding everything together...because you basically have to shell this out within the 90 or so days of filing.
