For those who filed income taxes where you had to apply for a ITIN for your foreign spouse, does anyone know how long until we get our refund?  I've heard 3-4 months. 

 

My husband filed taxes early febraury as Married filing seperately, He got his tax transcrips, tax returns and w2 on march 10th. Now we dont want to think of amendments , or any, we can jus organize papers for AOS now.

So to clarify, you had your interview over a year ago, but only sent the stuff requested at that interview last week?  

If so yes, what they did is normal... they are checking if you still want to go ahead with the visa application, as it is very unusual to wait so long, and a red flag.

I had my interview a year ago and i was issued a 221g white letter twice in the year,the only reason why it held this long is because of the I-864 ,last week I have submitted I-864 ,PCC and medical and in return I got that letter asking me to come to the interview with DS230 and 2/2 photographs.

Yes,I want to finish this process as soon as possible.

 

So,please suggest what else I should be prepared for at the interview and any other docs.

Husband and I both work in web technology. We're in the best place for that. I have no interest in living in Australia.

 

 

I agree. Good money to be made in the IT field in the U.S.  The only downside is, you don't get enough vacation time at most companies.  My best friend in the U.S., has changed his field, got some IT certifications and found a new job. Had to work for a year for less then usual pay (for junior admin), due to the lack of work experience, then changed jobs and was able to get more money from start.  This is what I love about America,  in many cases, you can land a job if you show interest in learning something new.  I hate to say this, but this is not the case in a lot of countries within the EU.  Even in the UK, you have to have NVQ's and all kind of certifications from trade school or courses, before you can be even considered for an interview. Would you agree?

USCIS is not concerned with whether or not USCs file their tax returns or not. Their concern is to have the USC prove that they are making enough money or have enough assets to qualify as a sponsor.

Huh? You have to file US taxes whether you work in the US or not if you are USC. The US wants to know about your earnings, even abroad.  London mentions this also:

Yes, normally you do. Although, you do not have to file if you had no income. This is actually a common misconception among the taxpayers.  Also, I have a dual citizenship.  Therefore, I am not in Europe as an American.  I'm a Polish-American and there is "No Double Taxation Treaty" between the U.S. and Poland.  I do not have to report my income from Poland.  For the I-864, they need the W-2's or/and 1040's from the past three years and since I have not lived and claimed any income in the States, I would not qualify as a sole sponsor.  I would need a co-sponsor. That's all.

 

I will definitely re-read your guide, but there are some things that I still have questions about, which are not covered in your guide.

 

P.S. How come you've moved to the States? Most British Nationals immigrate to Australia.  They pay well there and the houses are much cheaper. In example, for what you can get in the UK or U.S., you can get much nicer house for the same amount of money.

You not speak of prior years income in USA or current annual income in USA,
so I assume you not have those.

You'll need a joint-sponser / co-sponser for the I-864 as well.


 

I'm aware of the need of a co-sponsor. That's not my concern though. The concern is mainly with domicile.  I've paid taxes in the U.S. for a long time, but no, I have not filed since 2005 for I have not worked there since.

1. I mention in my guide that the I-864 goes with the applicant to the interview. The OP in this thread did not file DCF, so did not take the I-864 in person - that would have been mailed in advance to the NVC, as Darnell says, but likely assessed on the day by the interviewing officer. 

 

I'm sorry if I get a bit confused. I've been reading a lot of information and some of that information negates one another.  I thought, that after you file the I-130 (which is to be mailed to the Embassy), you get your NOA1, (right?) then you get more paperwork to fill out, along with your background information on both parties (applicant and beneficiary) and the I-864 and you also mail this in.

a signed lease, and a signed job offer letter, are the 2 things the OP was missing in her list.

 

Those two things are hard to obtain while not yet living back in the States. It should be understood and taken into consideration.  No one will offer you a job if you're not there, unless you're applying for some specialty job or as an executive.  In my case, I can secure the lease, because my friend will not charge me rent until I can move in, and he can wait a month or so for that.  As far as the job goes, I know I can get one fairly quickly, because I know people.  Unfortunately, telling them that, may not be enough.  However, while in Europe, I  have worked with my friend (as a EU National) and I thought about filing to register a business (LLC/LTD) upon arrival in the U.S.  This would be something I could do in my spare time, besides getting full-time employment somewhere.  Do you think these (my new lease and business registration) could be enough?

Domicile is only really addressed towards the end of the process (just before interview for CR/IR-1 normal cases), as it's a requirement for the I-864, which isn't submitted with the initial petition (and for DCF cases is only seen on the day of the interview).

 

I've read your CR-1 DCF guide a few days ago, but didn't see this info there.  You learn something new everyday though.  I still think that the user WrotoMco's documents should have pleased the CO.  

 

So, as with my coming case, I might face the same difficulty, unless I can make some things happen that would allow the Consular Officer to be certain of my strong intent to reestablish my domicile in the U.S.   From what I've gathered from here and the official information, the entire CR-1 through DCF usually takes no longer than three months.  With that said,  would you think it would be feasible for me to start the process and file the initial petition (I-130), letting the wheels start turning forward, while securing a rental property for me and my wife back in the States?  I have a friend who owns a property that will be available for rent again in January.  I could get him to type up a lease agreement and sign it in front of a notary public here in Europe.  In your opinion, would that lease, my bank account information and recently renewed U.S. DL, suffice to prove my intent to move back to the States?

We filed the petition through the Chicago lockbox in January. It was approved in March and sent to the NVC. The NVC forwarded our paperwork to the embassy in Warsaw in September, but did not include our joint sponsor paperwork. My husband had his interview and medical exam in Warsaw in October and we were shocked about the domicile problem AND that they didnt have the joint sponsor paperwork. I called the NVC the same day and they said that they never received any joint sponsor documents for our case.

SO I started gathering documents again and a month later we received a package (in Poland) from the NVC with all our missing paperwork stamped "Received August 26". No idea where it sat for 2 months and why there was no record of it when I called. No explanation from them. So we passed it along to the embassy, the joint sponsor was approved, and now we are stuck on this domicile issue. So there is the whole story. I dont know it is always such a mess or if we've just had bad luck, but if I sound a little bitter with this process thats why smile.png

 

Yeah, you should always make copies of every thing you send to the government ;)  I know a case where the USCIS lost the paperwork and the only thing the person could do, was to re-file it.

 

It seems to me, that since the visa application process has gone forward all the way to reach the interview, your domicile should not had been the issue. The consular officer is in the wrong.

I have done my research and it seems to me that I have submitted enough proof. Everyone I know who has been in a similar situation (different embassies) agree that what I've given is sufficient. Last night I spoke with an immigration lawyer who reviewed our documents and he also agrees that the embassy has made an error. Unfortunately none of this validation equals a visa for my husband, so in five weeks I will travel alone and wait until the consular officers are satisfied.

I agree with you.  The information you have provided , should have sufficed.  It clearly shows your interest to reestablish your domicile in the U.S.  I think, that given the history of visa processing in Warsaw, this could have been a factor in your case.  How long has it been since you filed your petition and what level of completion are you on?

I can only say, it's sad and unfair that being a U.S. Citizen, you would have such a difficulty with moving back to the U.S. with your foreign spouse.  The government doesn't care how long you've been living abroad when you come back to the States.  They don't care if you have a job or will live under the bridge, but when you want to bring your spouse in, all of the sudden it matters.  My situation may not be any different from that of WrotMco's, because I (as a dual citizen) have lived in Europe for the past 5 years and I have no mortgage, lease or car payment in the States. I left the States to care for my dying grandma so I knew I wasn't going to be back for a while. I'm ready to go back, because I basically grew up in America and that's where I got my education and work experience.  United States is where I feel I belong.  I just renewed my DL last year and reopened my bank account. No rented place, but I still have my valid mailing address (at family member's house).  I now have a fiance and I want to move back to the U.S. with her.  I've got enough money put away, to rent a place for a while and find a job.  I could have gotten a job "yesterday" but I don't want to fly back without my wife.  I want to be here with her to support her throughout the visa process and guide her through the airport and all.   Procedures are procedures, but it does clearly state, that one should satisfy the consular agent with evidence of (in mine and WrotoMco's case) genuine intent of reestablishing the U.S. domicile.

Nope. Not K3. Definitely CR-1

 

Ok. CR-1 is similar to K-3, with the difference that with CR-1, you don't have to file the adjustment of status and the beneficiary (your husband) gets his green card right away (few weeks after arriving in the U.S.).  

 

User lost_at_sea has made a good point about the requirement of proving your U.S. domicile or the intent to reestablish one.  I think, it all depends on who you get that oversees your paperwork.  To me, you have enough evidence to show the genuine interest to reestablish your U.S. domicile.  It looks as though, you may have ran out of options and coming back to the States, securing a job might be the only thing you can do at this point.  Sorry and good luck.  Sadly, my case is very similar to your.  Although I haven't yet filed for my soon to be wife.  I've been living in Europe for the past 5 years.

We actually filed through the chicago lockbox and everything was sent from the NVC to the embassy in Warsaw. So I guess thats not DCF. Sorry, I guess I read the bit about both spouses living abroad and got mixed up. They told me that I need to prove US domicile before they can issue the visa and that it would be almost impossible while I am physically in Poland. After the domicile claim was denied I tried to submit documents showing intent to return and re-establish domicile and they were also insufficient. 

 

So you basically filed for K3 visa (spousal visa).  This is a long process and it takes up to 12 months.  It is very strange for them to deny further processing due to your lack of U.S. domicile. Although, since they know you have resided in Poland for the last three years, they may be afraid of fraudulent visa claim. It's hard to say.  You should move with your husband to a different country in EU for a while and then file DCF.

US Citizen must show proof of US domicile/intent to reestablish domicile to qualify as a Sponsor for the I-864.

 

it says that one must show proof of domicile or the intent to reestablish. It doesn't say anything that you have to have a job, lease, etc.  There are many American expats living abroad and they have the right to marry a foreigner and come back to the U.S.    However, I am confused as to how WrotoMco actually filed and how.  I mentioned this in my previous reply.

I am a US citizen and hold a US passport. I lived in the US from birth until 3 years ago when I moved to Poland to be with my spouse. He is the one applying for the visa and he was denied because the embassy has concluded that I no longer have domicile in the US. 

 

 

I got you :)   Although, there's another thing I'm not understanding here. How could your husband have filed for CR-1 with DCF?  The petitioner is you - the U.S. Citizen and he's the beneficiary.  That's how filing for CR-1 filing works.

I just remembered something and this may make you ineligible to file through DCF in Poland.  According to the requirements, you cannot file at the Embassy located in the country your Non-US spouse resides in.  What did they tell you exactly at the Embassy? It would be almost impossible for them NOT to accept all your proof of U.S. domicile or the intent to come back there.

Hello,

My husband and I are applying for his visa through the consulate in Warsaw. We have a joint sponsor for the affidavit of support. I have spent the last three years living in Poland and this seems to be our biggest barrier now as they want me to return to US before they will grant his visa. 

 

I am submitted the following as proof of US domicile per Form I-864 Instructions:

1.     Letter from my bank showing an active US bank account

2.     Statements from E*Trade Securities LLC showing US stocks owned 

3.     Statement from Capital One showing my US mailing address

4.     Statements from PayPal showing transfers made from PLN to USD (x3)

5.     A copy of my US voter registration card

6.     A copy of my Karta Pobytu decision showing my status as a temporary resident in Poland

7.     A letter from mom confirming that my husband I will live at her home upon our arrival in the US

8.     A letter from a company stating their intent to employ me upon my return to the US

 

...and we were still denied. 

Any other ideas?

Anyone from Poland made it through this process?

This all sounds very strange. I actually did not know you can do DCF at the American Embassy in Warsaw.   Let me ask you this: do you hold a U.S. passport or just have a GC? Also, how long have you been living in the States and how long has it been since you came back to Poland?
