We chose option A. We have 10 days from interview date to flight home. Sure hope it's enough as yea those change fees are pretty significant. Assuming Lena is granted the visa we plan to wait to pick it up ourselves at Fed-Ex in Kyiv so hopefully that will take only a few days then it is back to her place to pack and then back to Kyiv...

Can I pick your brains a little further, I have actually tried to figure this out for myself but it is a little unclear so... What about a social security number for my wife and my step-daughter? Do we not need that before filing the I-485? I see that form I-485 asks for a SSN but maybe it isn't mandatory?

If anyone knows the answer to this it would be great. My fiance (now my wife) and her daugther entered the US with me on November 19th, 2009 with K1/K2 visas. The daugther turned 19 on November 21st. She has decided that she wants to return to Ukraine to continue her education and be with her friends. My question is, is she required to leave within 90 days of entering the US on the K2 visa and if she does or doesn't what implications will this have on possible future attempts to return to or visit the US?

USCIS probably do not check whether an applicant has biometric data in file that is still valid. they would just schedule a date for every applicant that pay for biometric.

i was wondering if there is a formal process to request for a waive.

i don't have any issues with re-taking it again...i don't expect my biometric to be different than last time but like i said before, i'm just trying to shave the processing time of this whole thing.

i won't just not show up for my scheduled biometrics time before i get waiver, that would not be smart :)

I just submitted N-400 application and have a date to for biometric on 9/21. I took my biometric for I-751 (removing conditions of green card) about 12 months ago. Can I skip the N-400 biometric since I just took it so I can speed up the N-400 process? I figure I can shave at least 1 month if they can use my previous biometric data (waiting for biometric date + biometric processing time)

i had my high school friend in the US as my joint sponsor for the i-864 and the CO in the embassy in Singapore did not accept him as a sponsor.
she said there is a rule change requiring the sponsor to be a relative, but i didn't ask to see it in writing...my high school friend is making way beyond the poverty line to support his wife and myself....the i-864 is a legal contract that he signed stating that he agrees to support me...i find it unreasonable that the CO will not accept him as a sponsor just because she doubts the credibility of his intention to support.

anyone ever encounter this? what should i do?

I have made 2 mistakes in my I-129F application:

1. instead of the originals, I photocopied all the forms and sent the copies (including photocopied signatures.) I did sent color printouts of our pictures as evidence.

2. On the Biographical Data form (G-325A), instead of filling out page 1 to page 4 with petitioner data and the second set of page 1 to page 4 with the fiance data, we only filled out page 1 with petitioner and page 2 with fiance data, not sending page 3 and 4 at all.

Are these major mistakes? Should we correct our mistakes and re-send now so that we can save time or should we just wait for their reply?

I agree with what everyone has said and you need to be careful because it seems like you are running a very fine in between being totally honest and intentionally committing visa fraud.

For the record, You CAN file a K-1 with the petitioner not residing in the US. As long as the petitioner has a US address that they can receive mail at and a way to prove they can support the Non USC (either because of a job abroad or through a co-sponsor), then it is no problem.

I lived abroad throughout my entire K-1 process.

From what I am seeing though, it sounds like it is best to get married and do DCF. If you fiancee plans on staying in Singapore between now and June anyway, then that is ALMOST 6 months. Why don't you get married tomorrow at the courthouse (or as soon as you legally can based on how long it would take to get needed documents in order), live in Singapore while you wait for his residency of 6 months and then file DCF?

And just so you know, the residency requirment of 6 months is a bit different in every countries. Some countries require that you are a legal resident for 6 months. Other, like Brazil, only require that you have been IN the country legally for 6 months as long as you are a legal resident when you apply. For example, I entered on a tourist visa in Jan and will apply as a legal resident in July, it doesn't matter that I entered as a tourist. Email your consulate and they can tell you the answer, that's what I did.


I don't think Singapore residency will be an issue to us. My US citizen fiancee has been in Singapore for 10+ years and she's a permanent resident here.

what is more of a concern to us is establishing her residency/domicile in the US for I-864. my fiance was born is dallas, left the US when she was 9 y/o with her family. she has never been back to the US since then and now she's 24. she has never filed any US tax returns. her parents are also in singapore. any ideas?

yes now we plan to do the direct consular filling after we get married in singapore...

the only reason we chose to do the k-1 is because we thought it was a faster process than k-3 and we don't need to wait until we get married, which is scheduled for this june....what else would we chose that for?....but that's life, we live and we learn, and now we know better...

is there a proper way to cancel the i-129? the application has not arrived at USCIS and i already ordered a stop payment on my check/bank draft... is there any use to send a letter stating we want to withdraw?

actually we sent the I-129f for K-1 visa on 10-Mar-09. but we plan to get married this June to satisfy the family. the reason we chose the K-1 instead of K-3 is because it's a shorter process. we thought we can just not disclose the fact the we're married during the interview and get married again once we're in the US. turns out this is fraud and the consular are able to do checks, if I get caught i'd risk deportation and ban from entering

so now seems like k-3 is the way to go. do i need to start over and pay the application fee again? or is there a way to change from k-1 to k-3?

If you get married in Singapore, neither of you will have a fiancee and therefore cannot apply for the finacee visa. You will forfeit the fee for the K-1 and have to start over with the K-3


Please stop even mentioning the K3 visa. It's obsolete. A married US Citizen living as a permanent resident of another country would follow the CR1 or IR1 visa path using a Direct Consular filing.

A US Citizen establishes US domicile by using a parent or other family member or friend's address as their intended temporary or opening bank account in the US or both. Since she would be leaving her job, she needs to find a new one first of have a joint sponsor.

Married is married. Once married anything later could look, sound or smell like a marriage but would not BE a marriage.


we are married now and will file the i-130 at the embassy as DCF.

we will use her friend's address in the US to establish domicile. we'll also open a US bank account.

we are looking for a joint sponsor for i-864

my fiancee, the USC, will not be transferring back to the US with her employer. she will look for new employment after moving back to the US. She also has never file tax return while she's overseas (the past 15 years), although i believe she doesn't owe income tax because she doesn't make enough in US$.

Ok, getting married and claiming your single to get a k1 fiance visa is called "married single" that is VISA FRAUD the penalty for fraud is a lifetime ban on any visa for you. Even if you get the visa and then declare it at the POE you will be sent back and lifetime ban will be placed on you. Even if you make it past the POE and it is caught upon review years later when you apply for citizenship and they do a review of your all your paperwork and they catch your fraud then you could be subject for deportation or you can get your citezenship but will be barred for life to apply for your immediate family to come here. My best advice is NOT to do that be honest not DIShonest.

If you get married in singapore you will have to cancel your petition and re-file under another visa category K3, IR1 etc..

The problem you might have is in order for you to qualify for a visa your fiance has to prove he will be permanently residing in the US. So be sure to gather all evidence of his US domicile.

In any case your gonna have to be patient. At times the quickest route is often the shortest road to disaster so just do it right and wait in time it will happen good luck

Happened to us too! 5 months, 15 days and counting without a touch. We are at VSC however, so it seems the same inconsistency plagues the process no matter what location. I've had an INFOPASS session and talked with my congressman's office, both of which have yet to produce any results. And the experiences I've had with calling USCIS's 1-800 number... Today's phone call went something like this:

Woman at Call Center - ...sir, I see VSC is reporting a 5 month processing time frame.
Me - Yea my I129F was received on March 5th.
WACC - Okay, March to April, April to May, May to June (I'm thinking 8-3=5 you !@#$), June to July, July to August. Sir it's only been 5 months, so you will have to wait a little longer, until it's been more than 5 months.
Me - Well it has been more than 5 months as it was filed on March 5th and this is August the 20th. That's more than 5 months and 2 weeks.
WACC - Let's see, March to April, April to... (she went through the entire process again) ...to August. That's only 5 months and that's within their processing time frame.
Me - Well ma-am, this is now the middle of August and it was filed on the 5th of March...(interrupted by her)
WACC - March to April, April to... (she attempted to count the months again and this time I interrupted her)
Me - Okay thank you (click).

I think they must be trained at the call center to frustrate callers. I hope for her and her loved one's sake that that is the case and that she wasn't serious.

Gosh I hope it is much closer to 10 days than the 8 weeks, after waiting almost 6 months at VSC I'm about to lose it. Argh--then another 3 weeks just to get entered into the system??? Well if it ever gets there it is nice to know that maybe the interview can take place fairly soon afterwards. I had heard that they aren't too busy there now. We pretty much have everything done already and Lena will go for the medical exam next week probably. I am a little worried that maybe some things we have completed too early, such as the statement from the police stating that she and her daughter have been involved in no crime. If that is dated a month or more before the interview I hope it will pose no problem. I guess if they say anything about that I can produce the "forwarded in a week" letter and state that we thought they would actually do what they said they would do... This process is maddening!

Let me ask you, how can I know when the petition is entered into the system in Kiev? I am worried that communication from there may not happen and or may happen very belatededly. I also hate to call there often as I don't want to irritate anyone there and maybe get our case delayed due to that.

we got the same letter and our case was out of there in a about two weeks maybe one or two days shy of full two weeks.

National Visa Center (Dept of State)...within a week... letter from NVC
I've read several things on VJ concerning this apparent form letter that often gets sent out from NVC concerning K-1 visa petitions and now I'm wondering what typically happens after this letter. As for myself, I received this letter (that states "...within a week the petition will be forwarded to the appropriate visa-issuing post...") dated the 8th of September and as of today, one week later, it still hasn't left NVC. I was also told today that our petition is undergoing "additional processing." I read one post that says your petition will be received at the embassy (in this particular post they were talking about Kiev/Kyiv) within 2-3 weeks after this "forwarding" letter. I'm hoping this is accurate. Actually I was hoping for a shorter stay at NVC but I guess I shouldn't complain about that if it does indeed happen as I have read that often it is much worse than 2-3 weeks.

In case anyone else is curious about what is really happening after this letter from NVC, I thought maybe those of us that have received it could list the date the letter was received and then the dates of any significant occurences after receiving the letter--hopfeully the day it leaves NVC and or the day it arrives at the embassy. This can either help to ease our minds or to give us more reason to worry, but either way it would be nice to know what is really happening.

Billy, She asked me why you didnt answer the phone when she called you.... it was the same # that you got on caller ID and it still has the same message when you call it...

The best estimate at this point if someone gets Actual AP is to expect a month and if less than that its great... nothing can be done to speed up the FBI check... nothing .. so dont let it get to you if you are in it.. treat it like a rip tide... just go with it and it will let you go before too long... fighting it just wears you out and does no good....


Congratulations Scott!!! Glad you needed to be, and were, outed only from NVC...not that there's anything wrong with that... smile.gif I figured/hoped it would be today for you. Strange that she asked that??? blink.gif The reason I didn't answer the phone was simple--I was down the hall and heard the phone only on the last ring or two, so--just missed the call. I would like to ask her "why no voice-mail?" headbonk.gif Oh well it all turned out ok - was one of the biggest "whew" moments in life.

Thank you for the congratulations everyone! Yea really a great day. And like Ladonna said, the operator seemed so happy to give me the good news. I am still curious about that phone call yesterday morning but I guess I will never know the reason for it. CrazyMary was probably right, the person that tried to call me would probably be fired for being nice, if that is what they were doing, if a superior at NVC found out that they had tried to call me. smile.gif))

May main objection (and it still is) was the letter they sent me when my case first arrived to NVC. That letter clearly said my case was approved and would be forwarded to the consulate within 7 days. I found out 2 weeks later it was still in NVC and it stayed there 2 weeks more after that. They should stop sending that misleading letter to people, and replace it with a letter saying simply "your case has arrived at NVC and is undergoing processing... we will notify you when there is a change in your status or if we require further documentation." That would solve a lot of grief.
