Congrats!!  That long wait between NOA-1 and NOA-2 is tough huh?  But it feels great to finally get NOA-2 doesn't it?   We recently got our NOA-2 also, and now waiting on NVC.  Called on Wednesday evening and they hadn't received it yet, but hoping it'll get there soon and no AP.  With a little luck we'll get to spend Thanksgiving together. =)

It was a long wait because I wanted to know. I was thinking that I might get a RFE. Thank god I didn't. It defiantly feels good to have the NOA-2. Congrats on your NOA-2. How long should it take to get to the NVC. I should call maybe next week sometime. I hope everything goes smooth for you and you will be able to spend Thanksgiving together. smile.png

Congratulations!  Waiting on our NOA2 as well.  Our 1st NOA was about 3 weeks after yours, also at Texas.  It would be great if ours went as quickly, and smoothly, as yours.  But we're fine with the norm of 5 months as well.

The foreign fiance(e)'s passport is not required for the I-129F petition. If there were stamps/visa in it that could help prove face-to-face meetings, then they could include copies of those, but no reason to copy the entire passport. Only the USC needs to prove citizenship for the petition and that is what the entire copy of their US passport would be for.

 

 

You don't. It is not a requirement for the I-129F petition. She will provide her passport and birth certificate later for the K-1 visa interview.
 

Ok thank you. That is what I thought but when I posted what i did just make sure I did it right. Other people said I needed her passport copied. Then I was getting all confused because I didn't see it in the checklist that was provided on here. Thank you so much for clearing that up for me. Jimmy

It's a good idea to have her domestic and/or international passport copies in there, and any visas she may have from any trips you two took together. We included my fiancée's international passport in our I129F packet. The order should just be in the order that you have them written on the cover letter but with the check being the very first thing they see. Just like most people they want to see the money first tongue.png

Her passport also needs to b copied & sent.. Along with proof u have met withing the last 2 years, plane tickets, Flight Itinerary, and copy of visa as well as copy's of your passport page containing date of Arrival & also date of departure (Immagration Stamps) from when u visited her.. Or vice versa if she came here to meet u.. Or both if u both have traveled to see eachother... The more the better but one time in the 2 years prior to filing the K1 is all that is needed for it to be withing the guidelines... Good luck on ur journey smile.png

Divorce papers from either or both of you need to be included.  You mut show you are both "free to marry" They do not "go with" anything, they just need to be in there.  Hers need to be translated.

I am going to be mailing the I 129F packet on monday,  Sonya and myself are very  excited  for the first step but I follow the checklist that is provided here and the one thing I am not sure about is the divorce papers from Sonya. Do I put that with her G325A or leave it separate.

Removing Conditions on Residency General DiscussionWhen to remove condition from Conditional Green Card?

Your permanent residence status is conditional if it is based on a marriage that was less than 2 years old on the day you were given permanent residence. You are given conditional resident status on the day you are lawfully admitted to the United States on an immigrant visa or adjustment of your status to permanent residence.

Your status is conditional, because you must prove that you did not get married to evade the immigration laws of the United States. To remove these conditions you must file Form I-751, Petition to Remove Conditions on Residence.

You and your spouse must apply together to remove the conditions on your residence by filing Form I-751. You should apply during the 90 days before your second anniversary as a conditional resident. The expiration date on your green card is also the date of your second anniversary as a conditional resident. If you do not apply to remove the conditions in time, you could lose your conditional resident status and be removed from the country.

 

The above text is copied from the USCIS website. You must apply for the removal of conditions within 90 days of your second anniversary of entry to the US. There's no point applying early, they will reject it. But you cannot be late either, there are no extensions to the 2 year conditional period. You just have to be able to prove that the marriage is still valid (living together, joint bank accounts etc)

Updating my comments just a few days ago, when I had not heard anything, I have just been notified I-130 approved. I am the beneficiary, my wife the LPR petitioner.

Timelines:

Filed (PD) 12 April 2013, sent to Vermont

Transferred to Nebraska 04 Sept 2013

Approved 15 Oct 2013

 

Now comes the difficult bit, getting all the documents required by NVC (we haven't heard from them yet). But at least we are able to get on with it now, rather than just waiting for that first tick of approval. I hope this encourages other filers to believe that they are getting things done at USCIS, even if they don't give any info until it's done.

My petition was filed April 12th 2013, initially sent to VSC, then transferred to Nebraska. I haven't heard any more yet, still in Initial Review. I will update this site with any developments in my case. The only way we will ever get up-to-date information is by sharing our own experiences, as the USCIS stats are so old by the time they are posted they are not much help.

My NOA for an I-130 was sent by USCIS on October 15th, informing us that our petition had been sent to NVC (my wife is LPR, I am the beneficiary). When I called the NVC just 2 days ago, they said that the petition was received on November 4th, and as yet has not been assigned an NVC case number. 

 

It appears that they take a few weeks just to receipt it into the system, and then a few weeks more before someone actually looks at it, assigns a case number, and sends out a notice listing requirements for the next stage. The first thing they will send is the Fee Bill - until you have paid your money, nothing else gets done. So far we have had nothing from NVC. When I call them, they just tell me it takes up to 20 working days from the date received before they send anything else out. The customer service reps are polite but firm with their standard answers, that is you just have to wait for us to contact you.

 

It's frustrating I know, I am in the same situation, as are thousands of others. It often seems that some people who received NOAs jump ahead of others who got theirs earlier, but maybe some cases are much more complicated than others. So we wait, and try to be patient.............

Just an additional note. If you don't already have a lawyer, and don't want to pay their exorbitant fees for signing up with them, there are many US immigration lawyers that offer online or telephone consultations for a fee of $100 or less. There you can ask a question or two to see if you have any alternative possibilities to waiting for consular processing. Be careful of relying on USCIS customer service reps advice. And beware of taking the wrong path, and getting on the authorities wrong side - they are not very forgiving types! Good luck..........

When you get a visitor visa you are agreeing that you will not attempt to remain in the US. My wife is LPR, and is petitioning for me to join her, and I have to go via consular processing. I checked with a lawyer about the possibility of doing what you suggest, and was advised that this is regarded as fraud. That is to say that you entered with intent to immigrate, when you obtained a visa or visa waiver on the condition that you did not have that intent.

 

So I have the long wait to do it the proper way. If it was possible to do what you are thinking of trying, everyone would be doing it. It's not worth the risk of getting caught out trying to get around the system. But if you wish to try, check it out with a lawyer first, you may have your own circumstances different from mine which make it a possibility. But don't attempt it unless you're sure you have a valid case, you may find yourself in trouble.

There is no official rule that you cannot visit the US while I-130 is pending. My wife is currently resident in the US, and is petitioning for me to join her. I am currently at the waiting-for-interview stage with NVC. I visited my wife in December, on the VWP. When asked at immigration why I was visiting the US, and how long for, I stated that I was visiting my wife, who is a permanent resident for 2 weeks. The immigration officer then stamped my passport with thee standard 3 month visa and let me through. He didn't even mention my pending application, which presumably was shown on his screen.

 

If you have a valid ESTA, and can provide reasonable evidence of your intention to return to your current home country (if asked to do so), there is no reason why you should not go. It is only if they have a reasonable suspicion that you may attempt to stay illegally that they could deny you entry.
