Yes, they can deny you entry even if it is a valid tourist visa. They can also bar you from entering the U.S. for 10 years This is not true. You can only get a 10 year ban for serious misrepresentation, or overstaying for a very very long time. You can't get a bar when you are entering the US with the intention to visit your Fiance(e). . Or they can let you in Once again, nothing wrong to visit your fiance(e) during K1 process, they might ask you some more questions. Just be honest. I know the odds that they will bar you are probably pretty low but when you enter the U.S. while the visa process is ongoing they can easily see it as though you have abandoned the visa process and have decided to give up on immigrating legally, so you are just trying to immigrate ilegally on a valid tourist visa. The bar you will have is pretty low?? You have that in your own hands, as long as you're being honest to every question they ask and show them strong proof to your home country..

My fiance and I thought about having him come back here while we waited out the visa but our lawyer strongly advised against it (he has a lot of experience in K1s and he didn't overcharge us). He said that you had about a 30% chance of being let in. The big problem is that if they don't let you in you have to book an immediate flight home (which will cost at least $1,000) and you don't even get to see your fiance. Your lawyer was wrong, you are allowed to visit your fiance(e) during a K1 process, there is no such law that says you can't. Make sure if you decide to go you bring STRONG proof or having to return home (you would think and interview for a visa approval would be enough but it really isnt). My fiance lives with his parents and has a temp job; he would have probably been denied on the spot! I know being apart is terrible but it is just part of the process. If you have the money to burn and don't mind taking the risk, then go for it, but just be aware of the consequences. He wouldn't get denied, and he could have brought a letter from employer stating what he does and when he expect him to come back to work, even though it was only for 3 more weeks. And 99% of the people here haven't burned their money by visiting their fiance(e).

; I travelled back and forth to my, at that time, fiance (he is USC :innocent: ) during my K1 application.


Whenever I flew to the US, I always brought the following:

- Copy of I-129f package, including NOA1, so they'll know that you are working on immigration legally
- Return ticket
- Letter from employer

- B2 Visa (most peeps don't have one, which is OK!)


If you also have a contract of a house/appartment/car-lease, that would be great proof too!!



Point is, as long as you have enough proof to show strong ties to your home country, you should be fine!!


After all, visiting your (L) in the US isn't forbidden or anything, like any other country in the World... :thumbs:

DO NOT hire a lawyer if you don't have a complicated case. It can be such a waste of money and a part of that money you can use for Interview Fee, Medical and AOS (still cheaper :blush: )


Majority of the members here, including me, have done it ourselves.


On this website (guides) it tells you exactly what you need to do in order to file a petition. It's really clear and it has links where you can download the forms.

; Yes, you and your fiance have had a stoke interview. They ask questions you never would have thought they would ask. Unfortunately, they seem to ask these kind of questions whether to see if you are intimate and whether you two answer the same answers about a very important aspect in a relationship: Intimacy.


Going thru an interview like this is very sad, because you expected more general questions about "where did you meet", "when did you meet", "how long were your visits", and so on.


If you go through the questions, files/documents, do you see any other things that might have caught their attention and/or raised a red flag- other than the fact both of you having a child from previous relationship?



Did the CO give you any other forms? Did the CO tell you to wait on an "appeal" letter? Do what ever you can to make sure your petition don't get send back to the US and do everything in your power in order to appeal and get a second interview. Contact your senator and ask for help, and make sure you meet the requirements on the appeal letter. Also gather more supporting documents as proof of ongoing relationship.

Do this all ASAP.

Like I said, you offered her help, she didn't accept the plane ticket ticket home and from now on, she can clean up her own mess. If her I-94 expires, she'll be here illegally and trust me, looking over your shoulder scared being caught is not a nice way of living, but that is what she has choosen :whistle:


Best thing is to do is for her to deal with the consequences and try to move on.

; one tip... don't send anything to your fiance YET.. I would suggest you send out the package right after receiving NOA2.

It will take an other 2/3 weeks before he receives packet 3, and then he has to send the required forms back to the US Consulate/Embassy (DS 156k, DS156 (2x), DS-230, only part 1 signed). Then an other 2/3 weeks for the packet 4 (interiew date) arrive and then you have to wait 4/6 weeks for the actual interview. (all in all, so much time to send in everything, trust me)

Don't fill in anything yet, as the date on the forms would be "old" after months...

The I-129f package you can send right after NOA2 + a new package with the requested forms (affidit of support) and new proof between the NOA1/NOA2 such as tickets, hotel receipts, pictures, phone/chat logs.

Send it all together, and it should arrive way before he actually receives his packet 4.

Last Friday I received a letter from the USCIS stating that they have transferred my case to California for faster processing.

Does this mean it'll go faster?
Does this mean no AOS interview is needed?

My access to the US got denied once because I lied about my relationship at that time. I told the Officer that we were just friends, went to secondairy inspection and they found stuff in my suitcase that indicates that he was more than just a friend :blush: .


They put me back on the airplane, under supervision of two police officers, back to the Netherlands (no BAN, thank God!), and I had to apply for B2 Visa. I did, passed interview and flew to the US couple times after. Lots of questioning, showed them that I have had enough proof to my home country, a job, NOA1 and NOA2, and a return ticket :innocent: .




However, Aaron joined my K1 interview just in case. They questioned me a lot about my denied entry. Thankful we passed and we flew to the US 2 weeks after. At my POE, they were very sceptic and I was honest in any single way as of I could be. I was defending myself after, telling them that I went to a lot of emotional times, worked hard for my B2 and didnt have any problems after :hehe:



Now I am happily married, and in the US. :dance:

5. All of the above- even when finding an American guy, intention is moving, for family, not for love!!!!





Personally, I think that's wrong! Try other options (school/work) first, instead of throwing yourself into American arms...

Good luck! My last minute advice would be just to make sure your fiance is just as confident and relaxed as he can be during the interview...they do watch body language a lot. One thing my husband said was that they kept asking the same questions over and over and over again, luckily he was calm and confident in his answers because he got his visa. Casa is a tough consulate, but as long as you are prepared it should be fine.

Hi,

When my husband had his interview, it took about 3 weeks before the embassy scheduled it from when it was forwarded to the embassy. I would say if he doesn't receive something soon you can email them and ask if he has been scheduled. They may just be delayed from the holidays, however, Morocco is definitely not know for having a very reliable mail system so there is always the chance his packet is missing.

If your income is enough, no need for savings or even listing any you have.
If your income is not enough, you need x5 in assets for what you are short- so if your income is $1000 short, you'd need $5000 in assets. The assets need to be easily liquidated within one year without undue hardship. So savings or stocks are good, a primary home not, a 501 probably not.


Ok, so as long as I'm above the $18K for a 2 family household we shouldn't have any problems?
