Thanks so much for the info. I know she must fill in one for her and one for her son. On her sons form, he needs to sign it and date it. He is only 5 years old, and I am not sure how well he can write to do this. How have any of you done this or any advice would be appreciated!

My love received her Packet 3 today so I am pretty happy, but a little reserved because the worry that maybe our case will get shipped back because the we got our NOA1 after March 6. I have a question I hope I can get a definate answer on. She needs to fill out 1 DS230 for herself and 1 DS230 for her son. We are still not positive if her ex is letting her son come with her now, and if not he will in a few years. So when she fills out the DS230 and they ask if her son will come with her now or later, should she wait until she has a definite answer? She is giving him 2 weeks to make a decision. If she was to state that he will come now, and then her ex says no, will this creat any problems at the interview and her getting her visa? Or if she checks that he will come later, and then her ex says he can come now, will this create problems?

I wanted to stay ahead of the game, so I went ahead and ordered my FBI check. I went to my local police department and got my fingerprints taken, as they are required to send in for your FBI check. THe fingerprinting was free and the FBI charges $18 (money order). They say it takes 8 to 10 weeks. I figured what is $18 compared to waiting for 1 month and them requesting this from us, and waiting 8 to 10 more weeks. If they ask for it, I will have it to send in. I aslo did the State Police check. I found their website online, and you just do it online. It cost $10, and you just print it out if you have no record. If you have a record they will mail it to you.

I think this is each individuals call as whether to jump ahead or hold tight. All I know is I can't stand waiting and being without my love, so I am going to do whatever I think will help us as quick as possible.

Well, at least it seems they will be sending the new form shortly, so this should be somewhat good news, compared to what some of us suspected. I think they will do the criminal checks themselves, the reason the will send us a new for is for us to authorize them to release our criminal history to our Fiancee's if need be. I don't think they can do that unless we give them authorization.

This question has always brought a lot of debate. I used a service for our petition, and I explained how we met online and how we continued to communicate and she invited me to visit her to see how our feelings were after meeting. My lawyer stated that they are not askink how you can meet, as this is one of the questions usually at the interview, but they are asking how you met physically. We stated on our petition that I met her when visiting Vietnam, because this is actually when we first met in person. One thing they did tell me is the fact that the more information you give them the more chance of raising red flags. I would suggest be short and direct to the point. Good Luck

I opened one of the notices, and I think this is something everyone should look at. It lloks like all of us can email our comments about this new form. One of the comment areas is in regards to us, and the burden put on us. It dicusses Electronic filing, so take a look and I think we should all respond and let them know we want action immediately, and whatever process is going to be the fastest is the one we are interested in. Thanks so much for the info. I just wonder how long it will take them to print out 10,000 RFE's to send out, and how much it will cost them to mail these. Then they will receive 10,000 back and have to go thru one by one. This could take a while, but I hope not. Why couldn't they keep these at the consulates to share the workload, and not cause such a delay in our timelines. If you were looking to hire a company, would you hire them????

The statement doesn't state they will be mailing RFE's, it states they will be issuing RFE's and using a template that has been approved. Everyone remember the information collection request had to do with Electronic filing. I HOPE THIS IS TRUE!!!!

To all of you that have had their cases recalled and sent back to the US, don't be suprised if you are placed in line with everyone else. I emailed the consulate as soon as I was told our case was returned, to ask them some questions. Here is what happened. They sent my fiancee packet 3 on May 10, and returned our petition on May 12. They never notified either of us, and we only found out after she returned her DS-230 that our petition was returned. So I emailed them to ask if they were going to file the DS-230 part 1 until they receive our case back in their office, and this is the email response I got from them:


Dear Mr. XXXXXX,

Please be informed that the Packet 3 was sent to your fiancée mistakenly. We apology for any inconvenience caused to both of you. As stated in our most recent response, we already returned your case to the US Citizenship and Immigration Service office where you filed the petition on May 12 as their request. Therefore, you should direct your concerns about the process of this case to them. Your case is now closed in our office. We regret that cannot remain your fiancée's form DS-230 PI as per your request.

Ok so if I do send this in for expedite service, who do you send it to? You will send the RFE to the department who receives the them, and the Expedited Service papers to the Expedite Service. SO why should we wait to send them, if they are going to two separate people? I am thinking about sending in the Expedite Request now, and the RFE when I get it. Maybe that will even expedite the RFE.

I would send it now if you're ready. Your additional visits will help prove a bona fide ongoing relationship at interview. At the petition stage, you only need to prove you met in person within the two years preceding your filing date. USCIS doesn't evaluate bona fides for K1 petitions. That is left to the Consular officer. Three visits in four months is pretty good evidence. Of course you'll need evidence of communication too.

I just figured if I already had what they were looking for, maybe I could file now. I've already completed the Affidavit of support as well. Just waiting to send all of our stuff in. Completing the affidavit of support at this point is just "practice". It isn't needed until asked for at the interview. At that point, the affidavit and supporting documents should be as fresh as practical. In your case, the 2007 tax return will probably be needed.

You don't seem to mind but it irks me that people think they need to give motherly relationship advice. This is a visa support group. Unless a member asks for relationship advice, it's out of line, IMO.

I'll keep in mind that the affidavit of support isn't required during the petition phase but i'll go ahead and send it anyway. I agree. I just figured I could atleast file early on since the entire process takes about a year to unfold and I knew we had these other things planned over the next few months. I've heard mixed reviews about the whole filing part and just figured I would be getting a headstart by sending the main info they needed now. I heard that multiple visits/ communication etc. can certainly help by the interview stage but for the I 129 you need to just prove evidence of the relationship and the "meeting" in the last two years requirement. Other than that, you're right...more time gives us more time to get to know each other and more Proof! thanks! tongue_ss.gif

Or just call the NVC and ask them when it was sent(I didn't do this so your mileage may vary). I guess I would wait a month tops and then go to higher powers, ie your senator. It really, really,really helped for us.

The $335 is not for Fiance' K-1 applicants--the fee for K-1 is only $100. K-1 Fiance and K-3 is handled as a non-immigrant during this phase.


Ooooh okay :) It gets a little confusing with the immigrant/non-immigrant stuff. Thanks for clarifying guys! I found out today that my packet 3 is on the way.. it seems with each new step I have more things to think about. AAh!

The visa fee must be paid by beneficiary AT the consulate (or slightly beforehand, depending on the country where located).

(and, BTW, Immigrant Visa fee is outside the glister of K-1 anyway).



We don't have to fill out an I-130
On the US Department of State website, it lists a fee of $335 for the DS-230 and I have to fill that form out.

I was worried at first about things going slow.. but it's actually been fairly quick compared to some. We sent out the I129 February 21st.. got NOA1 Feb 24.. NOA2 March 10.. NVC sent it to Montreal March 15 and I just got off the phone with Montreal, they sent my package 3 on March 23rd.. which should be here anytime.

But we also have our wedding scheduled for October 14th so we still have 6+ months. We planned for a year long engagement.

So, when I got my results for my medical, there was a note attached saying that there was something abnormal seen on my chest x-ray. Went to see my doctor and after many tests I found out yesterday that it is Hodgkin's (a type of cancer). The problem is that I have my interview next month. With treatment and such we can't get married in October. Does anyone know if they might extend the process or will we have to start again?

I'm pretty sure you won't really have to "worry" about it until the time comes when you have to fill out the form DS-230 above that asks if you have ever been denied entry. A letter explaining it beforehand is not neccesary, it is going to come up eventually.

My wife (then girlfriend) was denied entry at Pearson International in Toronto before we started any immigration paper work. She didn't have a job and still lived with her father so hence no lease. They said she didn't have enough ties to bring her back to Canada, and denied her entry into the Unites States assuming that she was intending to just stay here. They didn't fingerprint her, but did take her picture and wrote "Refused" on her boarding pass.

The denial never came back up until she was filling out the DS-230 and had to acknowledge it on there (never lie about something like this). At the K1 interview we were asked about it and the lady giving the interview gave us a little bit of a hard time about it, apparently the guard that gave my wife the third degree wrote up a little report and said it appeared to him that she was living in the US, she wasn't. She asked us at least three times to explain it and the final time she said "Are you sure that's the story you want to stick with" when we kept telling her over and over that she was just coming for a visit. I guess that was finally good enough for her as she said she was going to issue the visa (imagine that, the truth worked for once).

It came up again during the AOS interview but that was a lot smoother as the lady giving that interview asked us once, we explained the same exact way as we did during the K1 and she just nodded her head and said that yes, it happens quite often.

So basically after rambling on here for a while I think my main point is just dont sweat it, plenty of people around here have been turned back at the border. Just make sure you dont try to hide it, dont lie about it. Just tell them the honest to goodness truth when you are asked about it, everything will work out for you in the end.

After we got used to the idea of getting married so quickly, it sort of began to fit. So now I'm afraid of fraud on both sides. I'm afraid if he comes on the work visa it could be argued that we planned to get married all along, or that if he comes on the finace visa it could be argued that we got married, or at least accelerated in the direction, so that he could get a visa at all.

I mean, they can't both be fraud, can they? I'm frightened of fraud. I don't want to have anything to do with it. I just want to follow the rules and get the appropriate visa for him. I like the idea of marrying him. I also like the idea of not having to do it 90 days after he gets here. I want to invent my own visa type, the H-1C, the pre-engagement/work visa for the non-professional.

Legally, how is it decided how far a person is along the road to the altar? According to the courts, when does a relationship become an engagement? When you talk about getting married someday together? When he proposes and gives you a ring? When you set the date?

I don't even know the answers to these questions without the confusion of visas, let alone with it. :unsure:

The trouble with the H-1B visa is that he's not a "professional" and doesn't have a four-year degree or the necessary work experience. His english isn't very strong yet, so he wouldn't be able to apply for college here and come on a student visa...
Although, if he came on an H-2B visa and polished up his english could he change to a student visa?

First I'd like to say that I'm new here and so excited to have found this forum. I was so sick of getting lawyers when I did a google search!

So, this is my situation.

I was recently living in Poland for nine months, where I met my boyfriend. When we first started looking at visas that would help him come and VISIT/WORK in the US, it seemed that it would be immpossible, so I thought, hey, why not a fiancee visa. It's not THAT big of a deal. So we talked about it and decided that maybe it would be the best route. We told some of our family and a few of our friends the sort of visa we were applying for, but that things were very much still up in the air, as there was no way to know if he would even LIKE the states.

Recently though, I read that it would take six months or more to get the fiancee visa and that it really was a HUGE deal. The day after realizing the length of time it would take for a fiancee visa, I (by serendipity) found a place that would sponsor him to come and work on an H-2B visa.

So this is the BIG question.

If he did come on the H-2B visa and discovered he liked my family and liked living in the states, and then we got married here, most likely at least over a year from now, would the INS accuse us of having planned it that way all along and then deport him?

I haven't filed any paperwork yet and I don't have a ring on my finger either. I'm just so confused and afraid!

My fiance, who is Polish, is currently living and working in Scotland. When I fill out his paperwork, should I put down his address in Scotland or maybe his parents address in Poland? Also, when his interview is scheduled, will it be at the American embassy in Scotland or in Poland?
