When we sent off our I-129F packet we included a copy of the receipt from the jewellers for Megan's engagement ring. But having looked back at it we sent the packet away on April 5th and the receipt is dated April 3rd. Will that look too suspiscious to the person judging the case or am I worrying myself over nothing?

I dont think it would make any difference, but you need to be home for the packet 3 which will be sent to you from the embassy in your country.


Already called Continental and they said that it would be £50 to change flights to any day earlier, other than weekends pretty much. I hope to spend that £50 Sal and Jay, let me tell ya!!!!!

As some of you may or may not know, we are currently filing for our K1 at Vermont while I am here on the Visa Waiver. I arrived on March 17th and intend going home on June 11th.

What we are wanting to know is, if it makes any difference to the time that Vermont processes the petition because I am currently in the Country than if I was back home in the UK?

And has anyone else done the same thing as us?

Hi Everyone!
I am relatively new to VJ and have been reading for a while but this is my first post. I am in the process of finally sending in the 129-F packet for my fiancee. Given that he is from Morocco (and it seems like they are rough on approvals there) I am looking to make sure I really front-load with proof of relationship and meeting. I met my fiancee online and went to visit him and his family for two weeks this past May. I have all of the pictures and receipts from my visit, but I am trying to figure out what to include in the attachment explaining how we met.

1) How much detail should I provide on the trip itself? Is it acceptable to give a condensed itinerary?..where we went, who we met? When I knew he was my soulmate?
2) One of the things I was unsure of including is the fact that I pushed a bit for our engagement. Long story short, he had just completed a very messy divorce and was a bit unsure at first of remarrying. Would it help or hinder our case to include that detail? I know they often assume that the men from this country are "scamming" there way into marriage for citizenship....so not the case here.

Any advice is greatly appreciated. We are so anxious to be together again, I want to make sure that we are not delayed by lack of evidence or me forgetting to include enough detail.

It is supposed to be just made to Department of Homeland Security. I, however, misread the directions and made it out to USCIS. They still cashed it with no problems or delay. I had a small panic attack when I relized my mistake, but it worked out fine.

With all the expenses surrounding the visa and the AOS yet to come, we are thinking either a quick civil ceremony here or a quick trip to Vegas. Later we will do a big wedding with the families, but the timeing and expense is a bit much....plus, just not knowing how long things will take. Either way, the important thing is we will be together :D

I do not know what to say,but after our K-1 case was returned,today we get the letter from VSC saying that the validity was expired and the case was closed!!It is very hurting,so please can you give me any other solution,is it possible to refile a K-1 again with the same first pictures and first tickets of my first visit??I hope you can reply me as soon as possible and thank you so much..


As far as using the tickets and pictures from the first visit it would depend on timing. Remember you have to prove that you have been there within 2 years of filing. When was your trip? If it was before August of 2008, you won't be able to reapply without going back to Morocco for another visit. Besides, as Belinda said, on a refile it is probably a very good idea to take another trip first and document your visit/relationship.

Our's was a similar situation, I wouldn't panic just yet. It took nearly two weeks to get from the NVC to Casablanca. Though, I definitely know how frustrating it is!

Unfortunately if she has not yet adjusted status or recieved advanced parole she will not be able to reenter the country if she leaves now. It is my understanding that in order to bring her back you will need to start the visa process over and try to obtain a CR1 visa, sadly though, that could take several months to a year.

moroccogirlny is right, you cannot be too prepared for an interview there. If you don't have the ticket stubs, you should definitely take copies of the entry and exit stamps from your fiance's passport. Also, you will need to make sure you take the I-864 Affidavit of support form, they are requiring that out of Casa with all K1 interviews now. Is there any chance your fiance can scan and email you the information for you to print before your interview? I know they prefer original copies and could still insist that you provide them later, but I think a scanned copy of your proof is better than nothing.

After finally finding a co-sponsor, my k1 visa petition is about to be filed, but it has been about 90 days since I signed and dated my G-325A and letter of intent... is this an issue?
Do I have to send him recently dated copies so he can file?

I would not worry about it...my fiance sent me his G-325A dated in October 2009, but we did not file until January 2010, we had no problems at all. Probably close to 90 days later...I think you should be fine.

Ok, my mom sent me the check image and it DOES have a number after EAC stamped on the back, but the problem is that the very last digit is not readable (I don't know if it says 2 or 3 or 7). Zooming doesn't help! Do you think that if I call the INS and give them the other numbers they'll be able to figure out what the last digit is?

Hmmm... I'll have to try to figure out a way to call and find out what's going on. The return receipt that my mom got was from the post office saying that it had been received. I just don't know if my mom still has the check that was cashed or if maybe the bank has an image of the check.

Hi All,

I'm new to the forums and I'm kind of having a heart attack right now and I'm not sure whether I should or not.

My fiancee and I live together with our son here in Mexico, and the mail system is notoriously unreliable, so hopefully that's the cause, but I'm not sure. My mother was visiting in October and after I filled out all of the papers for my fiancee she took everything back to the U.S. to mail it. The address that I have on the forms is the address that I share here in Mexico with my fiancee. The problem is, I never received the NOA1, but after my mom sent the papers to the Vermont SC she received the return receipt dated October 28th, 2008. We have received absolutely nothing here. I also haven't received any emails or anything, which I thought I would if anything new happened with the application.

My uncle processed the exact same visa for my Aunt, who is from the Philippines, and she said that it took 3 months for her to receive the NOA1. The problem is, I don't even know where to begin with this, because without any sort of reference number, will they be able to look up the file so I can check to see where we are? Would it be a wise idea to change my mailing address on the app to my mom's address in the U.S. so that I can be more certain that any correspondence actually arrives?

Hi again everyone! You all were so helpful about the "missing" NOA1, I thought I throw another question your way.

My fiancee and I have been together for going on 2 years and we have a baby together that's going to be a year old at the end of this month. He was born here in Mexico, and we went together to the consulate to register him (last July) and he has his birth abroad report with both of our names on it.

I know that this can't possibly go against us when applying for the K-1, but I'm not sure about the amount of primary evidence we have apart from that, if it's enough.

What I do have:

The birth abroad report (if that's not enough, our baby's American passport. our baby has my fiancee's last name)
Boarding passes from only one of my trips to Mexico
2 rental contracts (one from Cancun and one from Merida)
Passport stamps from entrances to Mexico
1 vacation itinerary from a week long trip here in Mexico with both names on it (and our baby's name)

I also have a Christmas card that my aunt sent me via snail mail addressed to our apartment here in Mexico.

Apart from the rental contracts we don't have any accounts or utilities in both names. We never corresponded via email or regular mail and our cell phones are pay-as-you-go.

As for secondary evidence, we have millions of photos together, so that shouldn't be a problem at all.

I guess I'd rather have TOO MUCH primary evidence rather than not enough. My question is: do you think this is enough?

Well, just googling the Hanoi embassy, you can see that the req's are the original birth certificate and marriage certificate *only* if the couple is married. Since you submitted the I-129F I think it would be a good idea to plead your case the the CO rather than get married just to put your name on the birth certificate (and thus the I-129F goes down the drain...). I'm sure the embassy probably recognizes that this is an issue. You should be prepared for a DNA test.

Put your name on the Vietnamese birth certificate. The consular officer WILL ask for it, and I'm pretty sure you will have issues if your name is NOT on the Vietnamese birth certificate!!! Once the birth abroad report is done, it cannot be changed (except in the case of typos).

In my own experiences at the consulate in Merida, Mexico, my fiancee had to be there with me when we did the birth abroad report because he was claiming the child as his (I'm the woman, and the American). I had to take photos of me pregnant, and ALL of the doctors records, etc. I know it's probably different if the man is American because what the consular officer is worried about is whether the baby is American or not, and if there's any doubt about whether the American is the father, I imagine they would ask for a DNA test. The consular officer DID ask both of us questions, and had a good look at the baby before commenting that the baby does indeed look like both of us. I think that it comes down to the CO's judgment and if you have enough evidence to prove that you are the father (like photos with her during the pregnancy and after the birth, and even better if you have one with her in the hospital after she gave birth). Nothing ever is certain, so be prepared to take a DNA test if necessary.

The income requirements are non-negotiable. So if the USC's income is below the 125% of poverty amount you will need a co-sponsor for the I-134.

If your income situation changes by AOS time then perhaps you will not need a co-sponsor for the I-864. The I-134 is just for the K1 process. The I-864 is the biggie where the co-sponsor does commit themselves for a 10 year (40 quarters of employment) period of time. Read through the I-864 instructions to familiarize yourselves with the requirements.

So, from I understand - as we are both now slightly confused, For the I-134 for the initial K1 visa the USC needs 100% or above poverty line from what we've researched. However when it comes to the AOS and the I-864 form after we marry the USC needs 125% or more. Now, this to me sounds slightly crazy, why the diffrence in 25%? Why not 125% for both the I-134 and the I-864?

I was doing a bit of research on this exact subject today and I came across this on apex visa (those who have more experience on the subject can verify whether this is true or not, I'm just sharing what I found):

Form I-134, used for nonimmigrant visas (K1 fiancés and K3 spouse visas), until the person arrives in the U.S. and applies for change of status from non-immigrant to immigrant visa.

The I-134 Affidavit of Support is a Paper Tiger without legal support, and is "requested" at the time of the K1 visa, or K3 visa interviews. This is basically a "Fishing" document to see if the sponsoring petitioner has the ability to supply an I-864 Affidavit of Support for adjustment or change of status after the K visa beneficiary arrives in the U.S.

Hey all,

I have a question and hope I am in the right forum here. I am sitting here in Cairo waiting to come back to the US tonight and we are now officially engaged. We both could not be happier. So now the fun begins. So we met in Egypt, and everything went great, but there were concerns about her passport. A month ago we tried to go to Paris, but her visa was denied. Essentially when the French embassy called her manager at work to ask about her employment he was not there to talk, so rather than call back later they said, "Next." So she now has a stamp in her passport they probably says in French, "Visa was deined for France." So moving forward we decided on Egypt and less than a month later here we are in Egypt. She went home yesterday and I am heading back tonight. Had a wonderful time, but she had a concern about the French stamp saying her visa was denied. Our question is does she need a new passport so that stamp is not in there now? She thought it would be a good idea to get a new one because of the French, but now she has an Egyptian visa in this one which obviously will not transfer. Should we worry about this, or will she need a new one? I looked in the application guide and there really was nothing that said we need to show a copy of the passport for the application. However this may not be true for the interview and she may be asked baout it.

Also I must have not seen in the guide where it says she needs a passport sized photo for the application. I never thought about asking her to bring one, or even getting one when we were here. Is there a ways she could email me the passport photo so I can make the copy, or is it acceptable to look at the many pictures we too and try to find one that meets the specs? I'm sure she could take a bunch herself and then email them to me and I can use one from there. I'm sure we could use DHL or FED Ex to send the photo, but as most of you probably know the Russian mail is slow as hell. Not to say ours is much better.

I took 150 pages' worth of emails, chats, and texts spanning the past five years. The CO flipped through a couple pages and gave them back :P Everyone had told me it was overkill and that the CO wouldn't need nearly so much material, but if I had to do it again, I would bring even more stuff. Better to be overprepared than not having something the CO would like to see.

After listening to what everyone said, I decided to file through scotland and was about to put all the paperwork in the mail when I had a thought. My fiance doesn't speak english. If he goes for an interview to the american embassy in scotland, how will they conduct the interview? Is he allowed to bring a translator with him or something?
