I believe your correct about the I-864. The I-864, Tax transcripts, Bank account, and emploment letter will be needed later on down the line, but should it be submitted with the I-130?

I really think that there should be a secific forum for stepkids and children. It is very difficult to find much information on this and not too many people have much experience on this subject.

We have gotten through the USCIS and NVC process, and greatfully without any RFE's.
They have their interview set for December 13.

I believe what you have ready is correct. Honestly, I believe I sent copies, not originals, but double check the USCIS website for the instructions.

After you submit the paperwork (I always sent it overnight, and had someone sign for it- then you are able to track it, and have proof it was received), you will get a letter (NOA- Notice Of Action), letting you know they have received your application. This letter will also have a receipt number.
You can go on the USCIS website, and enter your case number and track the progress- which many times in nothing! You can also sign up to receive email updates from them when something has been done on it.

After your application has been approved, it is then sent to the NVC, and applications, finacial support evidence, originals, passport size photos to name a few will need to be submitted.
Again, you can check either on this website, or the NVC website to give you an idea of what will be needed.

The one thing I didn't find anywhere, but someone was kind enough to let me know is you will need a letter from the other parent giving permission for the child to immigrate to the U.S. This won't be needed until you send in the paperwork for the NVC. Also, for the NVC paperwork, since the girls are minors, my husband (LPR) signed all of the paperwork. That saved time not having to send the paperwork overseas for a signature, and then having it sent back.

After the application with NVC is approved, you will receive information about your interivew (date, time) and will need to have a medical done. They will also send you a checklist stating anything else the embassy may require (I'm assuming this may be embassy specific).

Keep researching these forums. They are full of good advice. Look at the "flow charts" it will show you the paths the petitions/applications take.

I wish you luck on your journey. It can be long and frustrating many times, but when good news comes your way, it's great.

Don't be afraid to ask questions here, the folks on here are great, with an abundace of experience, knowledge and support.

Hello Mike,

I will try to answer your question to the extended of my knowledge of the Police Certificate. As far as it goes (PC) can be obtained by any Vietnamese from her local police department, by bringing "HO KHAU" and "CMND" (ID card). Asking the Police in her "Cong An Phuong" (Police Ward) or "Cong An Quan" (Police District) to give her "Giay Chung Nhan Khong Pham Phap va Khong Co Tien An, Tien Su". This could take up to two weeks for the Police to verify. Since Vietnamese govt. doesn't have a robust information system/record of its criminals, so it will take sometimes.... prepare for it! Ultimately, she must go to "SO TU PHAP" in her district of residency for this kind of paper.

IF she is in HCMC, she can visit "So Tu Phap" at this address: 143 Pasteur, Phuong 6, Quan 3, HCMC.

BTW, i hope you are fully aware of the fact that her husband must sign a document "A QUIT CLAIM" of a minor child, and agree for the child to immigrate to the US? Not just a simple, "please let my son go". I don't know anything about this, but I pray for you Mike!

I am aware of the "Quit Claim" her ex must sign. Her father has talked to him, and is awaiting his answer. We are also hoping that he will realize that he would not be able to take care of her son himself, therefore he will agree to sign the quit form.

I am hoping soe of my fellow Vietnam Journey men and women can help me. I have been tryint o explain to my fiancee about the police clearance certificate, but with a little language barrier, it is hard for me to explain to her what she needs to ask them for. So I found this on a website and was not sure if theis is the correct name in Vietnamese for the police certificete "Phieu Ly Lich Tu Phap"? Is this the correct naem, or what is the name in Vietnamese for the police paper?

Also I am in a critical situation. Her exhusband is not swaying his decision to sign for her son to come to the US with her. HE is only doing it to hurt her, because he doesn't care for their son. I talked to her about letting her son living with her ex for 1 or 2 weeks so he can understand everything that he must do in order for him to take care of his son, because he has never had to do this since my fiancee does this everyday. We are still worried that he will not sign the paper for her son to come here. I have read other threads from other countries regarding this, and they go to court to fight for the fiancee to bring their child to the US. Does anyone know where my fiancee can go to do this in Hanoi Vietnam? Or any other action she can take?

Matt, that is a beautiful ring. It is very similar, in style, as the one I gave to my fiancee. I had it wrapped in a jewelry gift box, and carried it in my carry on. I had a compartment in my carry on that I could lock, so no one could get into it. I never wrote anything on the the form about it either. I had no problems at all. Just keep a close eye on where you have it located. The only think I was worried about was on the plane, when I wanted to sleep. I placed it inside my pocket in my cargo shorts in a bathroom stall in the airport. Then when I was sleeping, I made sure I kept my hand over the pocket. Good Luck!!! Thanks for the support. Actually I just called them before I read your post and I am so relieved right now. She told me they sent out her Packet 3 on Tuesday of this week. Then she told me it usually takes 4 weeks for her to receive the mail, I don't see how.

I have been trying to stay ahead all along. My fiancee is picking up her single status paper right now and applying for her police certificate. I also sent her the example DS230 to fill out, so when she receives the one in Packet three she can easily fill it in and mail it on the next day.

I AM SO RELIEVED NOW. I am hoping for a July interview and I pink slip, please be pink, it it is pink I will will a pink shirt the rest of my life, lmao!!!!

Menyoo, thanks for the great idea. I still have no confirmation that they have even received the hard copy. They replied to my email almost 2 weeks ago, and I sent another email the day I received theirs, knowing it takes 2 weeks for their response. I will cal their tonight, and check our status. I tracked it thru DHL, and there was only 1 package sent from NVC to HCMC the day that NVC said they shipped it, and that one arrived in HCMC on April 3rd. So it has been 1 month. Shoudl I be worried?

I'm divorced without kids. I have have the orginal divorce decree in 11/2003 which has a court stamp on it. I make 2 copies and sent it them back already, but I'll carry all orginal documents with me when my fiancee gets the interview date. My fiancee should already get the package 3 in hand by now. I have the divorce decree in hand already, and provided a copy in the original petition, only 1 page. When I got divorced, me and my ex wife settled everything out of court, so there is nothing in the system. My ex called her lawyer today and they are going to type up an affidavit letter explaining that we settled out of court, with all the information including my kids names, kids DOB, divorce date, and what me and her agreed upon. We will both sign it. I also contacted the office I received my divorce decree from and they just said for me to access our file online. So I printed that out as well. So I will provide the Divorce Decree, the information I printed from online, an affidavit from her attorney, and my statements with a copy of the checks she cashed.

Hopefully this will be good enough for them.

Does anyone going thru HCMC, have any experience with the petitioner being divorced with kids? I read another post in the general forum about his fiancee being asked for records of him paying child support. The only record I have is my bank statements, which shows my cashed checks to my ex wife. We didn't do the support thru the courts. My ex wife has been good to me, and we definately get along much better being divorced now for over 10 years.


On the I134 it will ask you for persons who depend on you for support. Also, you need to submit the divorce decree and judgement to the consulate. In there it will state whether you were ordered to pay child support.


I have the decree which is one page. Where can I order the judgement? Is it the same place as the Decree?

The same day that I received an email back from the consulate (4/18) indicating to me that they had only received the electronic file of our case and it could take 8 weeks...yada...yada...yada, is the same day (4/18) that they mailed the first packet 3 to my fiancee's address in Can Tho.

I was thinking the same thing you were, then, BAM, they had already sent out the first packet 3.

Thanks, that does make me feel better. I just don't understand how a US Consulate can be so disorganized, to the point that they can give you correct information. If we were to give them incorrect information, then we would be in deep sh*t.

Is it unusual that our case and Matt_Stevens arrived on the same date to HCMC, but our case hasn't been updated in the system as a physical file yet? Each time I contact them they give me the same response of "received the electronic file," yada..yada..yada. I saw that Matt's packet 3 was mailed out on the 4th of April, and yet we are still electronic?

I'm not worried about timing. I live in HCMC and my contract is through December 2006. I'm just concerned about the actuality of our case physically being in HCMC.

Just an update for you all with pending emails sent to the consulate in HCMC. I called today just to check on the address update email I sent last week. The woman answering the info line told me they were just now answering emails from April 5th.

Anyway, packet 3 was mailed out to my fiancee's Can Tho address yesterday (4/18), but the woman was very nice and offered to take my updated office address in Ho Chi Minh City and mail out another packet three tomorrow. Now there is some positive news to share about the HCMC consulate. She apologized for the email delay and said their systems have been having a lot of trouble as well. In fact, she couldn't access my case the moment I called because of the system being down.

So if your expecting a reply and don't have the patience, you might be better served calling the info line.

My fiancee is working for her government in Vietnam. She works at the Banknote Printing Factory for her government. It was already approved by the USCIS, so I am not sure if they are ok with this or if it mught present us with a problem. I hope this is not a problem in getting her Visa. Does anyone know an answer to this?

If it is a problem, can she quit her job now, and how would we give this information to the consulate? Should she send something before her interview, or at the interview, or is it too late?

Believe me, I am not going to take their response to heart. I will definately get the required papers translated, but my question is, do they only accept translations from specific places, or can she get them translated anywhere? Also I had her divorce papers already translated from a company in the US, as well as her and her sons birth certificate, and the company certified them as well. Will the consulate accept these or does she need them translated again in her country?

As for my dovorce papers here is what I have gathered:
1 page divorce decree

My fiancee's lawyer typed up an affidavit stating that we settled everything out of court, and stated the amount of my child support payments, and stated that I have paid all support on time, and in full.

Her lawyer also printed something from online staing the dates everything was done, on the county website. I also got a single status paper.



I just love the fact that they try to create every opportunity for them to give her a blue slip. If the papers are nt translated they would blue slip her, if she doesn't have her medical done in time to provide at the interview they would either reschedule her interview or blue slip her for that, and the same would happen with the divorce papers. I am going to have everything and more for Huong for her interview.

Hello Everone, well after 2 weeks they relpied to my email. I had several questions, since I know how long it takes to get an answer.

QUESTION:
Since I am divorced and have 2 children, and my ex wife and I settled
everything out of court. What documents besides the single page divorce
decree are needed if any?

ANSWER:
As normal requirements, divorce decree is enough. However, it depends
on the interviewing officer's decision at your fiancée's interview
whether further documents about your divorce are required.

QUESTION:
Once Huong gets her police clearance, is she able to get these
translated anywhere in hanoi, or are there specific places that you request
them to be translated?

I had her divorce decree and birth certificates for her and her son
translated here in the US, is this ok, or will she need them translated
there as well?

ANSWER:
We don't request the translation of any documents in Vietnamese into
English

QUESTION:
Does the medical need to be done in HCMC, or is there a location in
Hanoi? If it needs done in HCMC will she be able to get this done a day or
so before her interview or will she need to travel from Hanoi to HCMC
once for the medical and once for the interview?

ANSWER:
And the medical examination must be done in Ho Chi Minh City. She can
do it one day before her interview and submit the results later.


Well as you can see, the information is pretty much useless, because not one asnwer was completely true. Of course I could get them the medical late, but it will also postpone her Visa. The translation issue just kills me. On their website they ask for translations, and now they don't? As for the divorce info., I am supplying more than the minimal requirements.

Thanks for the advice. I am sorry about the one question that I asked because I didn't define exactly what I was asking. In the scanned copies of the Packets 3 and 4, it states that you need your original birth certificate and one certified copy. Does this just mean a Notarized copy of the original?

It also states that all documents should be either typed or handwritten using block letters. How have those of you who have filled this form out or your fiancee filled this in. I am not sure if she understands block letters. Is there a downladable form she can use???

My fiancee is now in the process of filling out the DS230 part one. If anyone can provide any useful information for filling this out it sure is welcome.

Ok, I am confused. A post in the General thread said that I only need to supply copies of my paystubs, w-2's, bank statements, phone records, and so on, and not the originals. For those who have already had their interview or those that are approaching their interview at HCMC, are you sending originals or photocopies? I prefer to send copies and not originals, but I thought that they can ask for originals at any time. If copies is all we need, are we allowed to black out our account numbers, etc.?

I downloaded the instruction pack for HCMC from another thread. It stated that they want one original and on certified copy. A certified copy just means Notarized????

Thanks so much for your kind words everyone. We will continue to push forward, and get packet 3 in asap. I don't know if any of you thought I was just going to give, but in no way was that even an issue. I am staying strong, and just hope that there is no additional time, as we would like to have our reception outside in late summer, so the kids that will attend can have their fun too. AS for telling her, I don't think I will unless it is necessary. Like I said why make her worry if we are not affected. If we are affected, then I will just have to tell her the truth, a new law was installed for all petitions dated after March 6, 2006 which they have to do some security checks before we can get your interview date.

Yeah it was a huge relief when she called me at work, the 2 ring rule, lol. I usually call her around 10:00 her time before she goes to sleep, and when she called me, I was int he elevator heading downstairs thinking, I bet she got Packet three. When I called her she was so excited, and she said I got my police clearance paper back today, and I was happy but sad at the same time, and then she said AND I got mail from Consulate. We both just felt like we were side by side.

Now is the tough part, as you can see in my timeline, I fall after the March 6 deadline. What I don't understand the new law has the name MArriage Broker in it, so why are people that didn't use a broker being recalled? So here is my problem. I have not said anything to Huong about this new law, becuase I am not sure if our petition will be recalled. I don't want her to worry if there is no reason to. I just don't know what to do, to make sure we won't be recalled. She got Packet 3 on Friday and we want to send it in, and use fast mail, but I don't want her to spend the money to send it if our petition was sent back. So should we just continue on and hopefully we won't have any problems, or shoudl I call about another question, and hopefully they will just answer my question and not say anything about our case being shipped back.

Any opinions would be great!!!!

Thanks, I am hope we continue to push forward, but I have worries about my case specifically. My NOA1 date was after March 6, so I hope my case won't get returned to the US for this new law. I am praying it won't happen. Why do they need to send the entire case back to the US. Don't they keep a record of our petition in the US, so why don't they just do the checks on our names, and leave the petition where it is. MAKES NO SENSE!!!!!

I remember before my trip to VN to see my love, and wine was one of the gifts that I needed to give this as a gift at our ceremony. After several conversations about this, I realized that in Vietnam, whiskey is called wine. I bought 2 bottles of Jonny Walker Black Label at the Noi Bai Airport. It was much cheaper than buying it in the US. After buying this I realized my luggage was misdirected. They delivered it the next day.

There is a certain amount of alcohol you can bring into the country or purchase at the duty free shop, and once you exceed that amount, you pay x amount for the amount over the allowable volume.

My fiancee has scanned some of the papers in packet 3 for me and she will send the rest of them today. One of the papers she sent me is called APPLICATION FOR IMMIGRANT VISA AND ALIEN REGISTRATION SUPPLEMENT. Does anyone know what this form is?

Also in the forms that were posted in this region, the one form states that the applicant and the petitioner need an original and a certified copy of their birth certificates. I don't have my original, but I ordered and have an exact copy from the issuing place. What do they mean when they say certified copy? Does this mean just a notarized copy?

We are trying to get the DS230 and checklist sent back to the consulate, but it seems the papers that she received are a little different than those posted in one of the regional threads. Is their just a one page checklist called applicant readiness? or is there more pages to the checklist? She ran out of time last night to send the checklist last night, so if anyone can help, it would be greatly appreciated!!!

Does anyone know what they want from the USC, when they say an original and one certified copy? I lost my original, and ordered 1. So will this be my original or certified copy?

it took forever for the file to get from NVC to HCM, now we have to start all over again. They had 60 days to implement the new law, yet, they didn't even start the recall process at this point, which is over 4 months after the law was signed. even HCM snailmail services are more efficient.

Your petition should be fine. They are only recalling those with a Receipt date for their NOA1 of March 6th and after. I noticed you got your NOA2 in February. I don't understand why it took so long for your case to get to HCMC.
