And after 8 months ,transfered to california service center, got an RFE sad.png :'(((((((( . I am so lost .. I dont know what did we miss here..

 

Either it's for beneficiary BC((which according to the checklist is not required at this stage) or More evidence of bonafide marriage. we sent 2 affadavits by my parents.. No pics thou.

 

Any guesses guys?

 

We will get in mail in 3-4 days prolly.. until then suspense is gona kill me sad.png

IMO, I think it would be a good idea to call the NVC to inform them that there will be a new joint sponsor and provide brief explanation if asked why.  In addition, when the new paperwork is submitted, a brief explanation should be in a cover letter explaining the change.

If the joint sponsor your friend had lined up is no longer able to sign the paperwork, then your friend will need to find another one.

No harm in having a back up, if the paper work submitted so far for the joint Sponsor is OK then there is probably no need. Life expectancy is not a factor.

But the nvc is requiring him to send his brrth certificate and additional itr, according to my friend he can't work on this anymore..what to do then?thank you

I'm posting for my friend they already sent their AOS to the NVC and since his wife has low income they did it with a joint sponsor. After their aos were evaluated and were returned to them by NVC they found out there are some required documents that were need to be send again. But here what happens, after they received their papers from the NVC their joint sponsor was suddenly diagnosed with pancreatic cancer and it already spreads his liver too! In short, he might be dying anytime cause the doctor said it is really worst. Now the dilemma is this, can they still change their joint sponsor? He can't do the sponsorship anymore cause he's really sick and can't take care of the papers. He will undergo a chemo-therapy too. Can he be replace though his name and other documents were already at NVC? Please let's help them. We need your wisdom and guidance bout this matter. Thanks guys!

I already received an email from the NVC the Re: Checklist. They said they've already received my supporting documents such as police clearance, birth certificate etc. In their email they told me what's just missing is the DS-260 form online. They said i can't be eligible for a visa interview unless I completed it.

As soon as I receive their email I did the DS-260 online and it's completed.

 

Now my question is can i already have my medical exam now? Thanks guys for your advises.

To clarify whether or not you'll need to file an AOS again, I'm not sure if there is such thing as amended AOS due to death of joint sponsor or you'll just basically need to submit a new AOS again with the info of a new joint sponsor. But then again calling the NVC would be your best bet. If there are other VJers knowledgeable on this information, some might chime in later. I hope that link helps somehow. Regardless, it's going to be alright, this may slow you down a bit but you're almost there. Good vibes! Really sorry for the loss.

Our joint sponsor just died today! we already sent the aos and they were check by the nvc. They said we just need to correct something on the forms and our case will be complete.

 

We are just about to send corrected documents tomorrow but we were shocked to hear that our joint sponsor just died now! It is really shocking and unexpected. =(

 

What are we gonna do please help.

Yes on the checklist they listed birth certificate,marriage certificate,police certificate and pass port biodata page which i did submit on 14th april in original forms.

It might be an automated email but I suggest you call the NVC to clarify. It also happened to me they sent me a checklist that i need to send my police certificate but I already did it before their email came. We called the nvc and we found out that they lost the copy of my police clearance so i did send it again to them. Please call them for clarification.

why need to get a new one??? Don't they have the one u sent to the nvc??and if they have it..it's still valid for sure coz it's valid for a year..so that means we need to get into a long line again for the nbi that we already submitted?

I already secured one to be sure. I did wait yesterday for at-least 7 hours just to have another original copy again. It was a long long line!

Yes get another one just to make sure you're ready enough. Bring all your documents (originals & photocopies) (AOS & IV packet) especially the W2 2013 of your husband. if you sent an original cemar to NVC no need to get another one & most importantly your pictures together.

Hello guys do i still need to bring an original police clearance during the interview or a photocopy will do? when we first sent the packet to the NVC we included an original copy of my police clearance but somehow they lost it and they sent us a checklist that i need to submit another. I sent to them my personal copy of the police clearance which is a certified true copy too. Now what's left to me is just a photocopy. 

 

What's your suggestion guys? Do I need to get another original copy of a police clearance or a photocopy will do?  Do I still need to provide all the original documents that we sent to NVC during an interview? Thanks!

It happened to us too. We sent them all the documents they asked and then suddenly we got an email that we have to send my NBI clearance. It's the only item they request me on the 2nd checklist they gave. We called the NVC to be sure and they said they didn't see it in the packet we sent. (in other words they lost it) How many documents they require you to send? If it's 1-3 items then it's not a false checklist.

That's just how long you have to activate the visa itself by travelling to the US. 

 

When you do they will stamp the visa - which then is basically your 'green card' until the actual card arrives in the mail. 

 

The first green card you get will be your conditional card and will show it is valid for two years. 

 

When you remove conditions you will get a new card with a new expiry date of ten years.

I have some questions regarding my visa. So my Visa Category is CR1 which I believe is I will have 2 years of Conditional Residence. Why on my visa it is stated that it will expire on October 10, 2014? My visa was just released this month (June) does it means my visa is just valid for 4 months??

Yes, one original, (not copy) should be enough.  If they ask for another, send them a photocopy.  There is no point in arguing with them, and no problem for you to comply.

Why argue with them.  Make a photocopy of your "personal copy" and send it in.  I agree though that the original NBI police certificate is all they actually need.

I already photocopied my personal copy and the first copy we sent to them. I'm just confused cause if they want my personal copy it only means they need 2 copies of police clearance cause we already sent them the first one. From others experience they only submitted 1 copy.

If they told him that, they gave him incorrect information.  We sent exactly one copy of my wife's PI police certificate to the NVC.  We did not bring her personal copy to the Embassy for the interview and they never asked us for it.

 

Are they holding up your petition until you send them another copy?  If they are, have your husband call and get through to a "supervisor", because that is not the normal process.

 

What was the validity period of the police certificate?  Did you live in any other countries form more than 6 months in the last few years?

I just got my police clearance last march 2014 and it is valid for a year. Nah i didn't live in any countries.

Don't send your personal copy to the NVC.  The copy you sent with the packet is what they need.

 

It could be a false checklist or you could be in a situation similar to ours, where the NVC overlooks or misplaces some of your documents, then sends you a checklist saying they don't have them.  If you are 100% certain that the document was in the packet, call the NVC and escalate until you reach a "supervisor".  Advise that person of the situation and insist your case documents be reviewed by a "supervisor". 

 

Do not let them delay your case because they have made an error by not properly reviewing your documents.  USCIS and NVC errors are official grounds for possibly having an expedite approved.  Although with our case, the "supervisor" simply pulled the petition from the desk of the first level processor, reviewed the documents, found the "missing" papers, and then personnally approved the petition. 

 

This happened after our Senator's staff contacted the NVC, made them aware of the fact that they were actively monitoring our case, and advised that we (my wife and I) were absolutely positive the NVC had made errors. 

 

So have your husband contact his U.S. Senator for assistance.  Every U.S. Senator has liasons who can help out when needed.  Make sure you advise the NVC "supervisor" that you are in contact with your Senator's staff, that they is actively monitoring your situation, and that his staff will be sending official inquires to the NVC regarding your case. 

 

My husband call them to double check if they got my police clearance in the packet. NVC said they have it, they told my husband they need another copy for the embassy. I am still doubtful if I need to send them my personal copy or I could just bring it to the embassy during the interview?

If it's just in the checklist, it's just a reminder that you have to get it done. If the police sends it over, the consulate should have it in record. Bring your personal copy to your interview as a back up.
