QUOTE (phoenix1 @ Aug 29 2008, 03:49 AM) <{POST_SNAPBACK}>
Hi,
I am wanting to buy my financee a ticket to visit and I am currently waiting on a NO2 aprovel...I have read the following page on vj saying this

Can the foreign fiancé(e) come to the U.S. for a visit during the K-1 Fiancé(e) Visa process?

Yes, the foreign fiancé(e) can visit but there are no guarantees that he/she will gain entry.

It is not illegal for the foreign fiancé(e) to enter the United States during the K-1 process. However, the burden of proof is on the visitor to show that they do not intend to remain illegally. Tourist visitors to the U.S. are expected to have sufficient funds to support themselves while in the U.S. The U.S. Customs and Border Protection (CBP) presumes that every alien entering the United States is an intended immigrant, unless proven otherwise. Therefore, it is vital that the visitor bring along valid proof-of-ties to their home country.

What kind of documents should the visitor bring to show intent to return to their home country?

Recommended documents to show intent to return to home country include (but are not limited to):

Return ticket.
Copy of lease/rental agreement or mortgage payments for housing.
Letter of employment indicating expected date of return.
Copy of class schedule or other pertinent documents if in school.
If arriving on an extended stay, copy of bank statement showing sufficient funds to support yourself.
If you do not appear to have the means to support yourself while in the U.S. a letter from whomever you will be staying with stating that they will be financially responsible for you during your stay.
If you are leaving a child behind in the care of someone, a letter from them stating when you are expected to return.
Copy of the K-1 application and any NOA(s) received.

With that said im just wondering does this apply for everyone or is it specific to each consualte? Is there information available on Uscis website? I will look......Some other important information is she was her from March to july on a tourist visa......I started the NAO1 when she left..........And now here we are looking for to come here again in October........................

Another question would be she is a student and wants to come after finishing? Im not sure what prove she would have to come back? Could that be her K1 visa application would be proof? Any suggestions or info would be great...I dont want to do anything wrong so Im asking

Can someone please explain this to me. I did not think the Beneficiary could work until the Ead was done...

Here is how it reads on the flowchart next to POE

* Depending on which U.S. airport you fly into (NY JFK) some will issue a temporary 90 day work authorization if asked for. If issued, the employment authorization ends on the day the K-1 expires. You will have to file for an EAD when (or after) you file for AOS. If you do not receive your EAD before your K-1 expires you must stop working until it is received.

thankyou good.gif

ChinaDoc's needed after EP in China
In EP it just said to send my 2010 tax return.

When it was done at NVC the email said anything that was scaned & sent to NVC needed a hard copy.

1- Do I need to send the original tax returns that I scaned for NVC or can I send a copy?..........I sent my wife a copy of 2008, 2009, 2010 & 2011 not the originals

2- Do I need to send paycheck stubs also?.........I did not send them to her

I was the only one on the I-864, no Co-sponser. I sent her the original DS-230, I-864, she has the P3 Sup.

All the other things asked for were from my wife, the (white books). We had two sets so I did not send her my set.

Thanks for your help.......

I downloaded the form from my Congerssmen's web page & mailed it on a Sat., Monday was a holiday. Congressman's office emailed me & called me on Tuesday. My I-130 was approved on Thursday with a NOA1 date of 8-9-2011. NVC got it on 2-28 & I had a case number on 2-29 with a bill for the AOS & IV apps. If I were you I would contact your Congressman !!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresCongressman
Today I sent the form from my Congressman's wep page in as well to release the info to him. I will be following up with phone calls in a few days. I think it can't hurt to try. My lawyer called the CSC on Friday while I was in her office & she was told I-130's were now taking 8 months. Since I have not been on VJ for a long time, when I filed the I-130 I also filed the I-129f for a K-3, the date on that is 8.29, the I-130 is 8.9. She was told that the I-129f will be looked at in 16 days. At this point I am thinking about pulling the I-129f but I'm not sure what to do. I chatted with my wife & she said she would just wait for the I-130...CR1. I think I would rather go the CR1 route because the I-129f has taken so long now........

IR-1 / CR-1 Spouse Visa Process & ProceduresHow to obtain single status certificate in US?
I got mine before going to China. I got certified copies of my previous divorce's, had my name checked where I live now to see if I applied for a marriage license, had that certified & the state seal on it. Filled out the single status certificate & had that notarized. Took all documents to the China Consulate in L.A. (I live in Phoenix). I think I could of given them a pre-paid FedEx envelope to send it back but didn't so I went back the next week & picked it up. I had no problem in China & married 2 days after I went back. Be sure to get all of your white notarized & translated documents in China after you get married.

Good Luck......

You can log onto the USCIS website and check your case number to find out if it has been updated. It'll say "touched" and the date it was touched.

I have checked there... I guess I will know what it looks like there once I've been "touched". Thank you.

It means that someone did something with your application I would think...doesn't mean anything major has happened, but it's not just sitting there gathering dust.

...and I would know that sombody did something with it how...? I don't see anything that would show me that at USCIS.

We had our interview today and our visa was approved!!!! It is amazing to think that after so much waiting and worrying that we are almost there. Of coarse there is some more waiting for the actual visa to arrive back to him, but at least we are in the final proccess. I want to thank everybody who sent us well wishes and everybody who posted their stories to VJ. We recieved alot of helpful information from everyone sharing their question, answers and personal journeys. I would very much like to send out love to everybody still waiting. Your day too will soon come. The waiting is the worst, but in the end it is worth it. I will be writing a review soon. Best of luck to everyone!

US Embassy and Consulate DiscussionPacket 3
Hello,

Have a question about packet 3. We recieved notice on May 4th that the NVC was sending out case to the Embassy in Kingston. I believe that they need us to send DS-230 part 1 to them. Should we wait until we recieve packet 3 in the mail, or can we just go ahead and send it now. We have our Embassy case #. Anybody know what is the best thing?

US Embassy and Consulate DiscussionThe case of the missing Packet #4

So, I've emailed the embassy about 6 times...I can't get through on the phone, and my beloved DOS staff is now useless...our interview is July 1, we need to get the medical done (and can't without the appointment letter)...someone tell me what to do, please.

We are having the exact same problem. We have sent several e-mails to the embassy without a response. We recieved notice that they sent out packet 4 along with the appointmant letter on May 24th, we have still not recieved it. We also have to complete the medical and cannot do so until we get the letter. Our interview is on June 30th. I finally called the US State Department Visa Services, and the lady (who was very friendly) basically told me that is how the Jamaican mail works and that even if we dont recieve the letter we should still go to the interview, and then we will have to wait to obtain the medical approval which essentialy is just going to postpone everything. She told me there was no way to obtain a copy of the letter except from the embassy, but I have requested a copy be e-mailed three times now and haven't been able to get one. It is frusttrating because they supposidly mailed us our packet over three weeks ago. We have gotten mail from each other internationaly quicker than this. I am also upset about it because we have all the other paperwork ready to go. All we need is the medical. Feel like I am trapped. The only thing I can say is it is just a set back and try to keep a positive attitude. Seems like we are not going to get approved on the 30th no matter how prepared we have been on our end, all because the mail service couldn't get us a packet in less than 3 weeks. I am so sorry to hear that you are in the same predicament that we are. If I find out anything I will for sure let you know. In the mean time just plan on going to your interview and hope that your paqcket surfaces any day now, along with ours.
