I can't twittle :wacko: my thumbs waiting for the NOA2 I-130 Petition... Is there anything, I can do to get additional upcoming paperwork rolling or completed. I have my I-864 form ready with federal taxes going 3 years back along with the $88 fee.

I know it sucks but its the process like the stages of pregnancy :) We are only on day 50 awaiting the I 130. We had anicipated 1 year for completion so we are happy to see it is less than that for most

Keep yourself busy, involve yourself in something, church, friends, classes, volunteer... I threw myself into work and volunteer at the animal shelter from time to time when I am feeling alone (now I have 2 cats lol) Money is tight for us so I spend alot of time home online. I have a school lined up for Saif, English then computer IT stuff. Checked into Gov grants and even bus route to the school. Everywhere I go, even to the grocery store I take pictures or videos for Saif, it helps me to feel like I shared my day with him

If you read again what you quoted, it says ORIGINAL/CERTIFIED COPY of certificates. So of course sending certified copies are sufficient. A lot of people don't even have originals. I didn't of my birth certificate. As for the marriage certificate, I sent the certified copy one as well. All were accepted without problems.

And yes, they want two more passport photos of the beneficiary. In total, USCIS/NVC/consulate has 9 photos of me (2 for the I-130, 2 for the IV package, 3 for the medical, and 2 for the interview).

Yeah I was afraid thats what they wanted....as many times as I see they have lost or misplaced documents, it really makes me uncomfortable. Thanks for the confirmation

Are they asking me to send THE original documents?? We both have certified stamped marraige and birth records (embassy and certified translation stamped) that I am not willing to send ANYWHERE. Won't certified copies be sufficient?

Also they want more of Saif's passport photos? I send 2 with I 130 and Saif has 3 for interview. Do I really need more?

Hello All,
After doing more reading about the Affidavit of Support, there are different forms. I would complete the I-864EZ, 1. If I'm the person who filed or is filing the Form I-130, Petition for my husband; 2. My husband is the only person I am sponsoring and listed on the Form I-130 petition; 3. The income I am using to qualify is based entirely on my salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former employer(s).

I'm double checking all my forms.. Getting ahead of the game. Thanks for any replies..


They want to know you can support the person you are bringing to USA and will not require goverment assisted programs like Food Stamps or Welfare to support a foreigner. Government LOANS for school will be ok when your hubby comes because you pay back loans

I provided 3 yr tax records/W-2's and 6 months paycheck stubs and a formal letter from my HR dept. declaring my employment. We are waiting I 130 approval but like you, want to be prepared

Thought I'd share in case there are others in the same situation.

So, to summarize my findings (and please, anyone feel free to jump in here to add to/correct what I've found):

  • If you did not file because you didn't make enough, as per the I-864's instructions, you have to write a letter explaining why you did not file.
  • This letter should specifically reference the tax code under which you are exempt. My internet research has turned up the following (found at http://forum.diveint...php?t-3607.html):
    • Title 26, 6013(a)(1) states that married US Citizens with non-resident alien spouses will not be eligible to file a joint return. As a result, if required to file a return, they must file separately as as if they were an unmarried individual.
    • Title 26, 1(d) provides married individuals with the election to file separately. Those filing separate returns will have certain rules regarding unmarried individuals applied to them, including...
    • Title 26, 6012(a)(1)(A)(i), which states that individuals earning less than the exemption plus standard deduction are not required to file income tax returns.
  • You can also opt to "cover your bases" by requesting a Verification of Nonfiling (form 4506-T, found here http://www.irs.gov/p...-pdf/f4506t.pdf) from the IRS. This is not concrete proof that you did not need to file (so you will still need to show evidence that you are indeed exempt under Title 26), but it is further documentation that you can show the immigration officials that you did not file.
  • And here I'm just conjecturing, but to really play it safe, you should also provide whatever financial "proofs" you have that you are exempt under Title 26 (i.e. pay stubs, or tax returns from your resident country abroad, etc.).


Whew! So what do you guys think? Does that sound about right?

The tax question downthread (http://www.visajourn...15#entry5133415) has raised a few questions of my own.

I actually have not filed for taxes since 2009, the year I left the US. I got married in Jan. 2010, which is also the same month I started school. I've been a full-time student in Canada, and what little income I've made here has been between $0 and $8,000/year (the $8000 only being from this year as I had a particularly "lucrative" year!). I don't have any dependents, and I don't own any assets back in the US (the one asset that I do technically own a share of is also co-owned by my grandparents, and they pay taxes on that). So I just didn't bother to file.

I've already been thinking about filing back taxes in case this decides to complicate things for us during the I-864. But, as Carlos' Wife points out, this raises questions over how to file. The best advice seemed to be to file as HOH and to file by hand, so that's probably what I'll do, but I also know that I won't owe anything, so is it really necessary to file at all?

Please advise :)

OP, from your other recent posts I can tell you are very upset about your family's negative reaction. You may want to take some time of to be with your husband, even if it is just a long phone call, as your posts don't make much sense right now.


It is quite simple, when it was stated in the steps for NOA they wanted certified originals (and I have always been told to never part with originals) I had thought that certified copies would be sufficient...I was incorrect.

For documents such as Birth Certificates, its not nearly as difficult or expensive as it use to be. Looking online, I have found you can order Certified Birth Certificates for 18.00 USD for most states in US, 28.00 for a few others and they will arrive in a few days unlike the 6 to 8 weeks I had to wait a 6 yrs ago. You may order as many as you need.

Conclusion: Order the certified original document

Are you referring to birth certificate? If so an original, or original certified copy is what they're after. They usually get stamped by the record official.

As long as you don't just send a photocopy you should be okay.

If that's not what you're asking, perhaps you could explain a little better?

I was stupid of this until 1 week ago...I was always told never send original BUT in NOA 2 Your Birth certificate must be original from state you are born ( you can order another copy) The marraige Certificate must be the one with stamp ( as I read) Maybe others can share more???

Yes it seem you need "original" document HOWEVER ordering originals is unlimited, me being born in IOWA I am not eligable for the 18.00 original...but 28 bucks is ok. Most other state good for the 18.00 one

Would any of your other relatives be able to write affidavits on behalf of your relationship? I think it would be a good idea to bring as much physical evidence as possible. His age will likely make them scrutinize the relationship quite closely, and especially if there is an age difference on top I would come armed with everything they could possibly ask for. Going with what Silverberry said, I mean relatives on your side of the family. Other people's experiences suggest that affidavits from American relatives are given more weight than those written by the beneficiary's family.


Thank you both! I do have a half sister that Saif speaks to on FB occasionally, I did not grow up with her but we talk. I am closest to the people I work with, they know me best and my story, do you think statements from them would be acceptable?

Yes I knew the age would cause eyebrows to raise, yes I am older but never married, this is why Saif made sure we got approval from ALL possible athorities even if it was not required we went for permission anyway. We understand the age may cause delays but we will not give up.

May I ask what kind of age difference you have? Given his age, if you haven't done so already I would suggest getting affidavits from his family attesting that they know about and approve of your marriage.



Mom and dad both wrote letters and went with us to get permission to the president in Kairouan. Then mom and dad were our witness at our marraige along with uncle and aunt and other family. They sign marriage contract too. We also got permission from the embassy

All this is so VERY helpful, we have just begun the proccess. From looking at the other timelines we have about 2.5 to 3 months to wait for the I 130 to be complete. I am one that like to have everything in order ahead of time. as you said, I would rather have more than needed than not.

We have marraige certificates in French, English and Arabic Notarized by the Embassy and registered in Kairouan, married in Hajeb Layoun with her (suprizingly a lady preformed the marraige) notary stamp as well. We had to get permission from Kairouan "president" to marry because Saif was not yet 18

My husband just had his interview on Oct 24th in Tunisia. Here are the questions they asked him:


My name
My age
Names of my parents
Names of my brother and sisters
What I do for work
What work I did in the past
Where do I live and how long have I lived there
Did I live in another town before that
What work did he do when he lived in Italy
Has he ever lived any other places besides Italy and Tunisia
When and how we met
How long have we known each other
When did we get married
How much time did we spend together
Where was he living when he asked me to marry him
Why did we decide to get married on our first meeting
Why didn’t I come to visit him more than just once
They also mentioned the name of our joint sponsor and asked who she was

These seem to be the standard questions asked at the Embassy there according to what I have gathered from others who interviewed in Tunisia. I think my husband was asked more questions than the others that I've corresponded with. We had over 2000 pages of chat but only printed out a bit over 200 of them, a good sample from each month from the time we met until the present. He also took all of our phone bills. They didn't ask to see any of those things BUT others who have had interviews since then have been asked to return with their printed chat logs. So be sure to take anything you have, it's better to be safe than sorry. My husband was only asked to show photos of us together. He gave them about 6 photos and they looked at each one. He was approved but had to return the next day with a different marriage certificate than the one we had submitted to the NVC. The one we submitted to the NVC was from the Notary who married us. The Embassy wanted the certificate issued from the local government (his township). When my husband went to his township he found out that our marriage hadn't yet been registered with them but it only took a few minutes for them to do it and give him the certificate. He took it to the Embassy the next day along with an English translation and received his visa 3 days later.

When he went for his interview he was also asked for 3 passport style photos which he had with him. He wasn't told before to take the photos but I had read somewhere that he would need at least 2 for the Embassy. Luckily, he took 4 with him.

My husband also insists that I tell you that your husband should make sure that your marriage is added to the comments on his birth certificate if it hasn't already been done and take a copy and translation of it with him to the interview.

Hello All, I gathered all my AOS documents already.. Justing twinkling my fingers for the GREEN LIGHT for NOA2.. :whistle: I went to the IRS Building (Jan. 2012) and I requested for my Federal Transcripts (past 2 yrs) I was so excited, ahead of the game and rounding up what i needed. I noticed they gave me W2's Transcripts when I heading out the door. The processing line was long and it was closing (security at door) so I couldn't go back into the building.. Bummer!! Does it matter if the IRS Transcripts are for Federal or W2s when sending out with AOS packet???

no don't give them the originals they might not give them back for record did your lawyer tell you to send the originals. because mine are also translated from arabic but my lawyer said it was fine.

You have to give originals, this is what they ask for....its 20 dollars to get originals remade from place you get them from the first time. If they need translated, have official document translator and get certified by embassy

i call the NVC and they said that my case complete and they are waiting for apoitment to send my case to tunis embassy but they said that they need certefite copie of my marriage contract and my birth certificate , i am already send them cerifite copie stemped from the goverment and they refuse them and they ask for the original and i did send them the original and they recive them in 12/04/2O12 , i dont understand i did send them every thing i can

You do have to send originals....if you have to go to court and get more made ONLY this from court is valid NOT even certified copies. If you gave them originals and they say they don't have.....just go to official office that give document to you and request more. If marraige court, go there. If birth record place, go there. They want documents from these official places

You only get an Invoice Identification Number after you've received your Case Number from NVC. Have you received a case number yet? I checked your timeline and you only have up to your NOA1 indicated.

If you have received your NOA2, it will take about a week (sometimes longer these days) for your case to be sent from the CSC to NVC. You can start calling NVC a week after you receive your NOA2 to inquire if you have a case number yet. It has been taking NVC up to 4 weeks (and again, sometimes longer these days) for a case number to be assigned. When you call and are given a case number, ask for your Invoice Identification Number and Beneficiary Identification Number. You will need your Case Number and Invoice Identification Number in order to access the payment portal. What fees do you believe are ready for you to pay at the payment portal? Also, have you e-mailed your DS-3032 Choice of Agent form?

Hi everybody our petition was approved and is on its way to Tunisia, but I have  some quick questions before I send a package to my fiancé. He has a complete copy of the petition and documentation that was sent in with it.
 
I realized that what was sent in for the petition was my original certified copy of my birth certificate(one with the seal). Should I have go ahead and get a new certified copy and send it to my fiancé or can he ask them for it at the interview and give them the copy he has.
 
NOA1 & NOA2- Does he need the originals of these for the interview or is copies ok.

OK WAIT!! I may be wrong (not the first time) I did some google searching and reading. I thought you could take an original to a lawyer and get a "certified copy"....I found this link .... http://www.***remove...ified-copy.html
I will do some checking and find out more. I registered my original BC at the embassy as we went to them to to register our marriage even after registering in the city court. Maybe other that have completed the I-130 and prepared their NVC packet that was accepted can shed some light.

Hi everybody our petition was approved and is on its way to Tunisia, but I have  some quick questions before I send a package to my fiancé. He has a complete copy of the petition and documentation that was sent in with it.
 
I realized that what was sent in for the petition was my original certified copy of my birth certificate(one with the seal). Should I have go ahead and get a new certified copy and send it to my fiancé or can he ask them for it at the interview and give them the copy he has.
 
NOA1 & NOA2- Does he need the originals of these for the interview or is copies ok.

I didn't mean to send the orginal birth certificate. Do you know about the NOA1 and NOA2 if theses are needed at the interview in Tunisia?

Hi everybody our petition was approved and is on its way to Tunisia, but I have  some quick questions before I send a package to my fiancé. He has a complete copy of the petition and documentation that was sent in with it.
 
I realized that what was sent in for the petition was my original certified copy of my birth certificate(one with the seal). Should I have go ahead and get a new certified copy and send it to my fiancé or can he ask them for it at the interview and give them the copy he has.

Never send originals, order another certificate, take it and have a Certified COPY (with a stamp on it) and send that. The certifier will put his/her stamp to verify the copy they made was from the original document

I just filled out my timeline and did not see a selection for a conulate for Guayaquil, Ecuador...the only I could see available was Quito..From what I understand there is one there.....Is this just not a option available in the timeline or did i miss something?

Does anyone know if the sponsor is married that the both the sponsor and there spouse has to sign the Form I-134 Affidavit of Support...I was reading some other post and it was talking about this being true.. Please advise
