I would echo JQ's general points. Especially in the sort of job that Russ has taken (You say yourself he's picked something below his abilities so that it could be simple, low responsibility etc) the deal is you show up to work when they tell you, you work, you go home and relax. If you miss the first step, you're hosed. Any paid time off is actually a PERK! Time off really is at the discretion of the manager. It can be highly personality driven, which is unfortunate. As you say, however, it sounds like the job that awful woman (no question that she does sound like a witch!) is holding isn't very stable. Hopefully things will work out better!

Sure in salaried types of jobs the deal is different - typically because the jobs are more about what you can accomplish on a longer time scale and not just "warm body" types of things - There are some weeks where my boss doesn't really care where I am or when, how much overtime I have to work or if I'm gone for 3 hours over lunch -- so long as my report hits his desk on time. Although like the past two weeks there's been a panic where I've worked 60 hours (& no overtime pay), it also means there's more flexibility for negotiations regarding time off and shifting hours.

That's the give and take of the job he's picked, and I think he knows it...I'm sure we are all very sympathetic about your situation - I too hate it when I've been planning something and getting all excited about it and plans have to change, believe me! Maybe if Russ is still having these problems as it gets closer one of your friends or family can travel with you from the UK to ease the trip? I know Nik was glad for his Best Man's company & moral support on the emigration trip.

That is how I read what you posted.

Have you read your embassy info page (link at the top) or the reviews for your embassy? (Also a link at the top of the page)?

There may be other fees which will need to be paid - for example in London we also had to pay a courier fee for the passport to be returned with the visa. Perhaps this is the extra 45$? Others who have gone through your consulate before will be the most appropriate people to advise you, and their experiences will be captured there. You may also want to check out the regional forum.

Self-employment is frequently seen as a bit of a grey area. Someone once asked the consulate a similar question about being self employed, or working remotely for the same company in the US, and the response was "basically, you cannot work in the US without EAD"

Keep in mind that income need not only be employment based. Some people get income from investments or other more passive sources. Also remember that people are adjusting status from all kinds of backgrounds, some of them allow them to work in the US where this can be relevant, and that's why it's on the I-864.

Just so you know, last spring processing on family based visas basically stopped for 6 weeks in April coinciding with the H1B filing deadline (or start date - basically the same thing as they fill up so fast).

As someone said earlier, if you plan for the worst, all of your surprises will be pleasant. If you get your mind set on a super fast approval, then you're more likely to be disappointed.

Be sure you get all the way through the process in your mind, and try to make sure you do what you can during your visa process to make the remaining processes easier.

Ex:
-If your fiance(e) gets all of the vaccinations before the overseas medical (not always possible - I know, but worth a little hassle), this will make the vaccination supplement for AOS easier.
-Several financial proofs are required for the visa affidavit of support and ALSO for the I-864 for AOS. If you make extra copies, then it's less hassle to gather it later.....etc.

Yes, you can start the K-1 process by filing an I-129f petition while the beneficiary (foreign citizen) is visiting the US. You'll likely be able to wait out a majority of the petition adjudication time together.

Although in casual language these terms can be used fairly interchangeably, in visa-speak they mean different things and apply at different parts of the process. There are two distinct phases of the K-1 - First the US citizen petitions by filing the I-129f + supporting documents then when the petition is approved (months later) the foreign beneficiary applies for the visa based on the approved petition.


You might also look at a CR-1 visa - get married now and file the I-130 petition. It is in many ways a superior visa to the K-1. Before selecting the K-1 be sure you understand the entire process all the way through getting a Green card.

I think you're doing all you can.

How frustrating! Continue to keep up with their customer service, and insist on being escalated to higher-up managers until you get to someone who you feel can implement a solution and be accountable, and make sure you know when their solutions will be implemented. Also, I would have your fiance in the US follow up with the US side, since it was over here that things got messed up. Cut out as many middle men as possible between you (or your fiance) and the person with the answer to what's going on with your package. The whole "I called the guys here and they called the guys there who called the guys here who told me X" seems like an unreliable method to get information.

Get their names and keep a log of your interactions, requests, and their responses.

I understand that that packet had basically all of your personal information, and having it in the wrong hands can be very disconcerting. The random chances that it ended up in the hands of someone with no-good intentions is small. Don't whip yourself into a frenzy over that, there's nothing you can do about it now. I would think that most people who receive a package like that would immediately see that it wasn't addressed to them and call DHL back. If they got so far as opening it, they probably said "WTH is this??" and then called DHL back. Or if they were lazy they threw it away...but still, not very high chances for identity theft to my mind.

You may consider it more cost effective to get your records together rather than simply repeating the required vaccinations....

Anyway, if you lost your vaccination records and need to get them completely re-done, then you have a few options:
- Go to the public health department - they will frequently do them for a lower cost
- Get on your spouse's health insurance and get them from your regular doctor
- Get them at the CS who does the transcription (most expensive)


Once you have the vaccinations, they can be transcribed by a CS. As others say, you may need to call around some before you find one with a reasonable price who will do just the transcription. Also carefully inspect their work before you leave - make sure all the required vaccinations have dates by them. Make sure they have filled out and signed part 5 (and not part 6 as ours did).

I think a hard look at her status (and how easy it is to maintain) in Dublin should be strongly considered in their decision to go through Dublin or Thailand.

I've read of too many people here on VJ who have not one but TWO immigration issues because they are 1. Trying to maintain legal status in a country where they are not a citizen AND 2. Trying to get immigration status into the US. These two processes can be quite conflicting.

Unless she can get legal status in Ireland for a year or more without having to renew, I would say go for Thailand. You don't want to be in a situation where one needs your passport, but the other is holding it for some sort of processing.

Reference: MARM (Passport was with UK home office with student visa renewal for 6 months and he couldn't get it back in time for his interview, then AP until 2 weeks before his UK status expired!!! Talk about making a person sweat!) and ParisHeart (Also interview w/visa in AP or otherwise delayed, and only a couple days left of legal presence in France).

You talk in other ways, I'm sure that you feel as though you know them well enough to get married, so see what evidence you can gather that you have done your "due diligence" on the relationship side. If you primarily email, print out a screen shot of your inbox filled with emails back and forth, or if you're on Skype, the same with your call history. You have a lot of time between now and the interview, so you can be aware of this and compile your evidence over time instead of trying to cram it all at the end. This puts you in a much better position than some people. :) I'm sure it will be fine.

There were some other things that Nik and I took into consideration when choosing his POE vs. wedding dates - He could get on my health insurance here on the day we got married, but not before. Sometimes there is travel insurance available, but their terms are different if you are just visiting or if you are immigrating. For immigrants, some plans barely cover two weeks' worth.

This whole health insurance -> vaccinations -> transcription -> AOS filing issue lead us to take several weeks between marriage and being ready to file for AOS. And that's the easy part. What about in case of accidents - etc.

Filing before our I-94 was a priority for us - for reasons like what Bobby+Umit posts.

Last year, processing on family based visas basically stopped for several weeks when this came around. (No, this is not an April fools joke) Maybe they will balance the workload better this year - maybe they won't, but as Bernie says, prepare for the worst, and then be pleasantly surprised.

If she got here, stayed a couple of weeks then had to leave for a family emergency and was ready to come back in a few weeks, it may be possible to have the visa reissued by the consulate.

How long she stayed on the first trip and how the date of the first I-94 relates to the present date are two important pieces of information.

If you act fast, visa reissuance may be the fastest and most cost-effective solution to your problem.

7 months is over the processing times. Since you are over the published processing times, you can call and make a service request on your case. They may come back and say "security checks" or something with no time limit, but at least you'd know they hadn't lost your case.

Actually, if my reading is correct, the I-140 is a petition for an immigrant visa - So, if she follows through with that process she comes out of it with a green card AND a job.

On the other hand, if they go the K-1 route, they pay Maybe $2500 and no job and lots of hassle.

Are they expecting the I-140 to fall through for some reason or take an inordinately long amount of time? Economically, it seems clear that the K-1 is NOT the preference here.

Aside from the multiple visa filings, the other possible issues that may come up is the expiration of her student visa in the UK.

The K-1 visa is valid for 6 months before it can be used, and the interview can be put off for a few months in addition to that, so they should be sure that they apply early enough that if there are any bumps in the road she doesn't go out of her UK status while waiting for her US visa. The last thing she'll want to be doing is panicking about her status in the UK expiring while she's waiting on the US embassy.

I thought the first one was interesting. I had always thought that the religious prohibition was that both were of the same religion, were marrying within their religion and were abiding by the customs of that religion.


However, the first one seems to be a "We are in love and forbidden to be together" case - opposite to what I had thought before - of different religions and therefore one is not allowed to meet the other because for religious reasons the marriage is considered to be unsuitable. Anyway, I don't envy that couple at all - imagine how difficult things will be for them to get through the embassy - how does she get mail, how does she go to the embassy unaccompanied, how do they communicate to prove bonafide relationship??

As to when to go, it is usually recommended that you go a couple of weeks after entry - the theory is that the entry database isn't updated minute by minute to the database that SSA checks when you go in for the card. Some people have had success getting it sooner, others find that they aren't in yet.

I hate to disagree with Krikit, but I recommend that you apply for her social security number in her maiden name and then change her name with the marriage certificate later.

There are two distinct processes with the SSN:
1. Initial issuance - the name must match the name she enters the US with. It's in the SAVE database (her maiden name)
2. Name change - Can be easily accomplished with a marriage certificate on an existing social security number.

The working and traveling prior to getting the green card forum is full of people who have issues with the SSN, and trying to both get a social security number issued AND change her name simultaneously is obviously too much for a government agency to handle. It helps if you think of any government agency as a twitchy and extremely stupid bridge troll. You want to get across the bridge, so Be careful, pay the toll, don't try anything fancy, and pick your fights wisely.

If you are leaving tomorrow, I wouldn't try to correct it. If you are doing like we did, and it will be a few months before you plan to leave for the US, I'd have it corrected. If USCIS can be picky about all the i's being dotted and all the t's being crossed, then I think we should expect that they will make sure what they issue to us has all the i's dotted, t's crossed and o's included!! Also, the visa issuing agency is not the same as the Green Card issuing agency. If it were me, I'd feel better if everything matched up.

The drunk driving charge abroad is not an issue in obtaining the green card. It's an issue in obtaining the visa. If there's going to be a stumbling block, this will be it. Generally this is considered a crime of moral turpitude and can be grounds for denying the visa. You'll want to check into this quite thoroughly.

I think you are missing his point. The reluctance comes from the fact that she is giving up a lot of things and a good life to move to a place where she's NEVER BEEN. You didn't have such a complication, as Canadians can freely visit. She sounds like a pretty smart girl, and I can completely understand the desire to have more data before making such a huge decision and sacrifice. Nik and I would have been able to decide to get married without the three months he was able to spend here. I don't think it has anything at all to do with the relationship itself, other than that the distance has put a strain on them. I found your comment rude and uncalled for.

I agree with both of you Push and Johnny. Regardless of the likelihood of actual departure under deportation orders, I think just the legal problems of getting to that point (or avoiding it) are traumatic enough.

The point that I was making was more along the lines that the way you stay out of trouble is to file for AOS, because if you don't and get caught, your "due date" has arrived!! If in fact you were able to just cruise along in your life without ever adjusting, then these guys would just have to show a marriage certificate and go on their merry way. Can you show where this is written?

From my understanding of the law, deportation or removal from the US is based entirely on immigration status, not martial status.

Being married does not change the immigration status, only the AOS (by virtue of being married to an USC, in this case) would.

If you get an IJ having a bad day if they find you out of status, your going to have a bad day.


Since a spouse of a US citizen is eligible for immediate adjustment of status (Excepting, of course, EWI), they usually would immediately apply for adjustment rather than be deported. It's happened twice that I know of to VJ members - one from a visitor visa here, and one where I cannot find the thread - but he was travelling to renew his passport and got caught. He had come on a K-1, married on time, but was out of status without having filed AOS. Again, there, they were required to file AOS immediately to avoid further trouble.

So yes, marital status can affect the part of deportation where they put you on a one way trip home, but it is no protection to significant legal hassles leading up to that.
