I called the NVC the good news they got the petition just today and the bad news it may take up to 20 business days to get it into their system and the customer agent told me to call after a week. Anyways it moves one step further.

I have been also waiting for the petition to be at the NVC since June 18. We are on the same side of the page. I think it is too early to judge the day, we got the whole day until midnight to get good news. Don’t give up, since it was a weekend for the last couple of days, NVC was not working and I hope very soon they will get it in their system.

I just got off the phone with the NVC and there is no sign yet of my case! This is really hard for me cause I the beneficiary... am doing pretty much all the work and "running around" for this because my partner is currently on deployment.

Unless the official you are dealing with is a family member, or you plan on accidentally dropping four or five thousand pesos on the ground, ANY day dealing with the bureaucracy in the Philippines is a "get up early and spend all day" event!

Like in many places in Southeast Asia, corruption is endemic to nearly every facet of the process -- to the point of being natural. Our guy twiddled his paperwork, and spoke of not having enough money for lunch. Magically, when lunch came we leapt to the front of the other eight-hundred people sweltering in the hot lobby below. Until then, there was a "problem" with our documents. And this was with me strategically hiding myself elsewhere to avoid the $$$ popping up in his eyes; it was enough that my wife was simply going abroad.

In a way, you can't blame them. They're under-paid, dissatisfied, and often living in squalor.

We would call and consider that bribery, whereas for them it is simply how the process works. Much like our own government contracting, where backs are scratched and pockets are lined all of the time. The entire war in Afghanistan and Iraq has flourished in this way.

So, yes, get there before the sun is up, and fight the disorderly lines. I think you can infer a great deal about a country by simply watching how people form in a line -- or don't.


I know what you mean... I'm a Euroasian... i look more Euro than Asian... but i was there early... taft seems like a no nonsense system...thus i highly recommend it!

TAFT is an area, near a big uni here in MNL.
She'll find it easy if she's not from MNL and takes an early morning cab to NBI Ermita.

as you know this process can be tedious when running around...but the sacrifice is so worth it.

I went to the NBI in TAFT.

make the effort to get there by 3:30-4am! and you'll be done by 9am!

same day service!


IF you have a very common name. it takes 10 working days.
that's better than some branches.

30 working days!
-the cloying part is they only tell you that they take a "decade" once you are done!

hi yall... about to send the I-129F packet. Every time I check and re check i think of new questions, i stress a little bit more.. so I just want to ask about the packet to those who know-

1- with the I-129F packet and sending the "evidence of having met/ relationship"- I have photocopies of some pictures of me and my fiance - some pictures of just us together (wearing different things, different locations.) I also have pictures of us with his family in Mexico.. (some pictures of us with sisters, nieces, dad.. etc). The question is *should the pictures be in color?? * and do i have to have a description of the photo??-where it was taken, year, who is in the photo??-
2- how necessary is extra evidence and such.. i have some emails from my fiance to my parents :) discussing our relationship etc.. also phone bills and records, and some letters that i have sent him and him to me..

This topic made me think of another question.

If a K1 visa is denied, what other options are there?.... Would it be to marry while using the VWP and then for the foreign spouse to return to their home country and the US citizen apply for a CR1 visa?


Well Sunshine, there is a pretty heated discussion going on another forum today. Apparently a man from Egypt was denied because his American fiancee was to much older than him. Everyone is saying for her to travel to Egypt or for them to both go to another country, get married, live together for some time, and then file a CR1. Hope this helps. I was looking for a spot on this site to just simply find some statistics on denials vs. approvals. Apparently there isn't much out there.

Yes, I know that two years does not equal 25 years. I was speaking figuratively in the sense that many relationships are silent or based on very little communication. Someone can be married 25 years and not have a clue who they are married to. That was the point. As far as evidence goes, you can print out the "relationship" between you and another user. What this does is show only the wall posts, mutual friends, mutual likes, etc. between the two of you without all the others mixed in. I also took screen prints of all the calls between us on Skype. If necessary, I could also print out all the IM's between us on Skype, but that gets a little personal.

Hello and welcome back!

I would say the number one reason is lack of evidence even though many claim they had plenty but the officer refuses to look at them. The officer may have also felt that the relationship was not genuine. Provide enough evidence of an ongoing relationship and remain confident. While we waited on our NOA2 we practiced interview questions, not like everyday since we still had a ways to go. And we gathered other necessary papers we needed for our interview.

I'm sure more are denied than we hear about. But like you mentioned most of them are approved (on VJ).

Thank you for the advice! I figure after countless hours on Skype for over two years now, we probably know each other better than most 25 year marriages :).

Well, I apologize for using such an abrasive topic title :wacko: .
The reason for this post is to see if there is a spot on this site that discusses individuals that have been denied a K1. I am not a pessimist in any way, I just want to hear of any possible hurdles that I can better prepare for in the five month wait we have before that NOA2 comes about. I see so many wonderful stories of "Appoved" on here and that makes me jump for joy. So my question is: how rare is it that someone is actually denied and what could possibly cause it?

Don't worry USCIS does not even reissue NOA1...I never received mine either (NOA1 4.7) and when I called (twice) they said they don't reissue. The actual hardcopy is useless but for some reason I feel more secure having that than just having a case number sent by email/text (call me old-fashioned).



I agree. I received the email and text message, but it wasn't until I received the hard copy that I saw they had Aley's country of birth as Venezuela instead of Bolivia. Could this have caused a problem in the future? I don't know, but I am not taking any chances. I can't stand to be away from her any longer than is necessary. So my suggestion is to take 10-15 minutes out of your day and call USCIS to verify everything.

Regarding the background check:

I sort of thought of it like getting a mortgage. Do you need to submit your credit report with the paperwork? No, they'll look at it themselves. BUT, if you order your own credit report first, you might have an opportunity to see/address/correct any information in there which you feel may not be completely accurate.

All that said, I didn't do a background check on myself, and....I didn't get my credit report on my own before applying for a mortgage either, just pointing toward commonly given and widely accepted as a good proactive step in a somewhat analogous process.

Looks like you've already done a lot of research into what he should bring etc.

I think especially over the holidays there are a lot of people visiting (return ticket dates reflect this!) so I'd expect it to be quite easy.

When Nik visited me, he was taken into secondary inspection - If you're expecting this, at least it won't be a shock. He found that the receipt notice for the petition was actually quite useful. It shows that you're already invested in immigrating legally instead of trying to get around it. Just a copy will be fine, - don't trust the original to the mail!

the lady i talked to from customs and border control said that since we will have noa2 by then that the k1 petition will show up when they scan his passport, but they've misinformed me on so much other stuff, i'm sure they were just lying to try and prove their point.


NichNick reported that when she asked the CBP officer if they could see anything like that on their computer at the immigration checkpoint, they said they couldn't. CBP looks at things they are concerned about - entries, overstays, etc. They don't have (or didn't a couple years ago) access to USCIS activity.

So, two things to consider here. Source reliability: USCIS minimum wage phone answer-er telling you what CBP can see or CBP officer who knows what he can see every day?

Also, and this is a bit far-fetched, but maybe the CBP officer doesn't want to reveal what he does/doesn't know. However, if the petitions ARE visible, then people have still gotten in while they are going on, so isn't it a moot point??

Another really useful thing will be a vacation request form from his work. A lot of places you have to fill out something that your boss signs anyway with the planned dates. Or he could ask his manager to just sign off on one he prints out himself. Include the dates he will be off of work and the manager's contact info.

Wow I am so sorry you are getting so much misinformation from "official" sources.

1. He can absolutely visit you when the petition is in process. Nik did this. No issues whatsoever, and they even asked us about his trip at the green card interview! Now, there may be some other factors which would prevent his visiting on VWP - for example, if he had a criminal history. Did this come up in the conversation at all? Or was the ONLY reason that he had a petition in progress? Nik was honest in his CBP interactions (though they did take him into secondary inspection) he said he had a fiance, and he showed them the receipt notice from our K-1, and it was actually the filing of the petition that prompted them to stamp him into the country, so it's really the proof that he'll return to the UK which matters.

2. Simply being denied entry does not necessarily mean that his K-1 will have any trouble. If the CBP officer finds that he is inadmissible because immigrant intent is suspected, the legal terms are that he "withdraws" his attempt to enter the US. They deny entry "without prejudice". Yes, it will go on his record, and will have to be counted as a denial of entry, but that sort of thing is easily solved with a visa. Because now he is allowed to enter with immigrant intent. Problem solved. If he is denied entry because he LIES to them and they find out about it, then it is misrepresentation, and that can have an effect on the K-1.

Keo's right. Don't let your concerns about getting together your 1000's of pages of chat get in the way of fully documenting the clearly REQUIRED evidences.


Now, Keo and I went through a relatively easy consulate. It's low fraud, and based on the stories of the members here, at the end of the journey we are for the most part still together or the relationships died naturally - not because the beneficiary does a runner once the GC arrives, so we deserve that good rep. The point of all that is that your interview experience and what you need to show is HIGHLY dependent on your consulate, and you need to seek out advice which is specific to that. A good resource for that is in the links at the top of the page on the second lighter blue bar (stretch your screen sideways if you need to, the text wraps funny) There's one called Reviews: Embassy. Look up your embassy and read about what other VJ members have experienced. Are there a lot of denials for lack of evidence? Or do a lot sound like Keo's experience? Find the success stories and the failures and learn from them.

Given the above, and that I didn't go through your consulate, consider the following thoughts along with your findings in the reviews: If a bonafide relationship entails frequent communication - I really don't think they care WHAT you talk about, just that you can talk, and do talk to each other - then what you need is to show summaries of your communication. So, call logs which would show dates and durations. They can be from the phone, or from Skype, etc. Or emails. Just show your inbox/folder with all of your emails. You're a real couple, so you probably have about 1 (or maybe more?) per day. Everyone likes getting snail mail, so even though it's not the most efficient, you've probably at least sent birthday cards or something, yes? Include those. Finally, I'd like to say something about including your chats and emails. A K-1 is for UNMARRIED people. If you think it is cute to call each other husband and wife in anticipation of your vows, this has been used against people in the past, and here all they were trying to do was bombard the embassy with paper to prove their relationship, and they ended up shooting themselves in the foot. There are other ways that chats can be harmful. What if you have forgotten some detail which was mentioned in those chats, and they quiz you on it and you get it wrong...etc. So many things, I could probably spend all day. Pick a couple safe ones to demonstrate you share a common language, and leave the rest out is my opinion.

Money orders are proof of a financial transaction. Transactions should NOT be confused with romantic relationships.

In fact, the exchanging of money is what happens in fraud cases. Do you want your evidence of relationship to have anything in common with a fraudulent case? I don't mean that any exchange of money has to immediately mean fraud is occurring, but it is at best open to speculation.

Focus on the less ambiguous relationship evidence like frequent/long duration communication & correspondence, things that you have in common and planning for the future.

I agree with everything Marlea has said, and will add some of my own experiences and the resources I used to make my plans and decisions. I'm not sure if you've found it, but I think just for some clarity, you should review the K1 flowchart. The major milestones in the process are the petition phase, visa phase, entrance & marriage, Adjustment of Status (AOS or Green Card filing), Removal of Conditions and Citizenship (optional). So, if you are curious about timelines, then you have definitely come to the right site, because we collect data from all of our users in order to estimate time frames. Plus, you can watch other people's cases that are about the same as yours. So, some links:

As you explore around those links, you can get to the raw data tables and do your own sort of investigations in excel. The problem with the average numbers in there is that it's not a very steep slope in terms of the timing when I plotted it out. The standard deviation is quite large. Keep an eye on your filing group thread. When others start getting their petition approvals, yours is probably on it's way as well!

Anyway, we didn't (or probably more correctly, *I* didn't) let any of that stop me from planning a wedding. When we filed it was an average of 8 months start to finish, and I picked a date roughly 10 months out and started planning a wedding for that weekend at about the same time in our process as you are in yours now. You'll see a lot of advice on here warning you not to plan anything without having the visa in hand, but we are all adults, so it's up to you to assess your risk and more importantly your priorities, and make decisions based on your own financial ability to absorb any lost deposits or to write into any vendor contracts the ability to move the date as the visa processing changes.

So, before I get any farther, let me tell you what our priorities were when we were making wedding and flight decisions:
1. We wanted only one wedding/marriage ceremony. The legal part and the floofy dress part had to occur at the same time. We wanted all of our family there.
2. We wanted to make sure that Nik's risk was minimized in terms of health care etc. This requires legal marriage soon after entry - it's difficult to find decent health insurance options, but Nik would be retroactively covered from the date of our marriage.
3. We wanted to get Nik working in the US/Nik wanted to work as long as possible in the UK.
4. We wanted to be together ASAP.
5. We wanted to minimize our costs/financial risk.

Unfortunately, as you can imagine, #1 and #2 actually somewhat conflict with #4! Maybe your priorities are in a different order than ours were. If so, perhaps a different plan of attack is appropriate. So what happened was that we had the visa 4 months before our wedding, and 3.5 months before Nik actually entered the country! As I said, I started planning before the petition (first phase) was even approved! I set a mental milestone (for the contracts and the invites) of 60 days. If we didn't have the visa or we didn't think we'd get it in time, that's when I was going to make the decision to go forward or push it out. Luckily, we had the visa well before that. It's useful to have that 6 months validity on the visa, because then the beneficiary can wrap up their affairs with a firm date in mind rather than trying to handle it all at the last minute, or with an unknown date.

Besides, there are a lot of things that you can do to plan the wedding without having to worry about the date. You can pick your dress, and select flowers and colors, work with your attendants, and at least tour locations and interview caterers. You can pick out the paper for your invitations and select the wording with everything except the date, think of a guest list and start gathering their addresses. There are tons of things that can be done before you have to sign on the dotted line!

It's actually 3x for the I-134, and 3x for spouses on the I-864, so each time, it will be 3x.

It IS indeed 5x if you're sponsoring someone who you aren't related to.

Yeah, the discussion did go off on a bit of a tangent, didn't it.

Anyway, there will be two times during the K-1 & AOS process where you will be asked about your income. The first is at the K-1 embassy interview where you have to fill out the I-134 for sponsorship.

For sponsorship there are two possible components. There is income and Assets.

At both stages you'll need to state your income and then provide proof of that number. An expected way to do this is with a TAX TRANSCRIPT from the previous year which you can have mailed or faxed to you for free from the IRS. Just google "Tax transcript IRS" and you'll find the 1800 number. This is the only part which is "required" However, in uncertain economic times, the consulates frequently have been exercising their discretion and asking for more evidence. There are other ways to prove your income. They are mostly interested in the "current" income, so if you just got a new job and are earning more, you can provide an employer letter (This includes your name, the company's name, your salary or hourly rate and weekly hours, if you are temp or permanent, when you were hired & the name and title of the person writing the letter dated and on company letterhead), or paystubs. If this second list shows you in a more favorable light than your latest tax returns, definitely include it!

For assets, you need to show that you have assets which make up at LEAST 3x your income shortfall. These need to be assets which you can liquidate (sell) relatively quickly and don't harm you to do so. So, think stocks rather than your old record collection. The way you figure out what you need is by looking at the requirement (for calculation, let's say it's 19k for round numbers) and what you make (Let's say for example, 17k). For this example, you have 2k shortage in INCOME, so you need to prove that you have 3 x 2k = 6k in assets. At LEAST that much. You may want to even show that you have ~10k just to be safe. Or, boost your income.

A cosponsor is someone who can step in and support the immigrant with the same requirements as if they were adding the immigrant to their own household. They need to meet the same requirements as above for income and/or asset proofs and levels depending on their own household size.

So, you asked about how does a lay off affect all of that. Well, if you have assets, it doesn't really affect things, but you need a lot of assets. ;) As I mentioned above, really the tax transcripts are all that's required. You could try to skate by on your previously shown income. Other people on here have also lost their jobs at various points in the process. Most that I have seen have either delayed their process until they got a new job, or they found a cosponsor. There are lots of little ways that you can delay the process. After the petition is approved, you can delay the visa application. Many consulates have a standard policy that they will wait for sometimes a whole year for the beneficiary to apply for the visa. You can keep in contact with the embassy to make sure the file stays active. That's a lot of time to get a job in time to provide the proofs at the interview. It's a little less favorable to do the same thing at AOS, but you have 6 months to use the visa after it's issued, and for many reasons (not just immigration - EAD included!-, but health insurance etc.) you might find it favorable to marry and get the AOS sent off ASAP after arrival. So if you loose your job after the visa is issued there is some padding on that side as well.

I read on VJ where one couple was at least hassled (or were they denied? I can't remember) because the person was trying to come in on a K-1 visa and the CBP officer thought they were married! So, don't: 1. Get married before entry 2. Refer to "my wife/husband" 3. Wear a wedding ring....etc.

Well, age difference and how concerned they are depends not only on the consulate doing the interviewing, but also the nationalities of the people involved. What I mean is that if it's a UK citizen (born & raised, from a western family etc) then experience shows, (as directly above) no problem. But, if the beneficiary is from a high fraud country and in the UK on a visa or from a culture where this is out of the norm, then this could lead to some questions. It's not a deal breaker, but could be trouble, the OP has to understand the potential red flag and then assess if it applies to their situation, then prepare accordingly. It is not strictly correct to say "Oh, UK, no problem" that statement assumes some background on the part of the beneficiary/petitioner which may not be true.

Regarding the timeline of the divorce and the petition - At the time of FILING the petition, both parties must be free to marry. Others have gotten caught up by divorces not being finalized at the time of filing (they hoped it would be cleared up in time for the interview) and there were issues, so safest bet would be to understand the waiting period (if any), when it starts, when it ends, and then file after that time.

Thanks for all these posts.

We cannot wait long to decide because some guests went ahead and booked flights and the need time to rearrange and we will need to pay their fees. So, I think we will have to postpone very soon. When to is the question?


I'm sorry, can you explain a little further why you think there is urgency to them cancelling or rescheduling their tickets? Does some window close for when the fees are lower? If they cancel 6 months before is it free or something? Most airlines that I've looked at have a 24 (or perhaps 48?) hour window where you can cancel free of charge. If that's the case, then they should perhaps do that. Otherwise, I can't see how cancelling or rescheduling in December is any different to their pocketbooks than cancelling in March or April, or even May. And...don't let your other friends and family schedule plane tickets. We were very clear in our communications about the uncertainty of the timing to our family members, and they all waited until our say-so to buy their airline tickets.

I stand by what I said earlier: Cancel now and loose your money for SURE, or cancel later and MAYBE loose your money.

What to do?

We applied for our K1 in September. We have a wedding planned on May 1st. We are waiting for NOA2 having received NOA1 on 13th September. Radio silence since.

Will May 1st happen or do we need to cancel?

I'd look pretty closely on the agreements you've signed with any vendors. This far out, you can probably cancel or even better, CHANGE the date with minimal cost to you. Most of our contracts had 60 day clauses (That means you could wait until March to see how you are, if yours are similar) in them which allowed us to get out or change before we were really locked down. Usually, if there was a change in the date, they would not even charge us more. I certainly don't think it's time to cancel now....Wow, that's shooting from the hip advice!! If there is no "out" clause in those agreements, why bother cancelling?? Loose the money now for sure or MAYBE loose the money later.

I assume that you'll still want the same venue and caterer that you've already picked out, it's not like you need to completely cancel. Check with all of them where you already have money down and ask them when their change date deadline is, and see if any will work with you, then determine when you'll need to reassess.

Crossing my fingers that you'll have your petition approval soon!!!!
