Is it a problem when you have met your fiancee twice in another country which is not your nationality.As for me i have seen my fiancee twice in the UK took pics with friends and family but she has never been to Nigeria.We schedule our interview in Lagos,i hope we will not be query for the fact she has never been to nigeria.

The more face time the better the petition. They will look at contact with your family. Scammers are less apt to take the photos with family. Usually if the USC has not visitied Nigeria that is another red flag

What if your family are based outside and not in Nigeria?But to me i feel the most important thing is just for the two of you to have met and For your USC to provide affidavit of support,employment and bank notice.Like how many pictures will be appropriate to take along for the interview?

Greetings, This is my first positing.. Im so glad that I found this question because this was a fear of mine as well. My Finace'(e) is Nigerian and he is 8 years younger than I. We have meet twice and our engaged at this point. When
I applied for my Visa to enter Nigeria, little did I know at that time my visas was going to be denied based on this age issue. I guess it was thought to be one of the "notorious Nigerian scams". The amazing thing was the Emabassy "Lost" could not find my passport and info. I drove down to DC, Washington to handle this. As a result of being there in person I was able to talk to the agent, and tell her our story. My passport was found 1 hour before closing and I was approved for a six month visas. God is awesome. I'm glad to hear the other posting of age differences not being an issue. I am gaining so much hope.

Nigeria is a country where is it rare that the couple doens't have at least one red flag. The more flags you pile up the more they will look at your relationship. The typical flags there are
Female USC older than Nigerian spouse/fiancee double this if the USC is past child bearing age
Couple is of different race
Couple has different religion
Couple has vastly different educational background
Couple has been togther less than 30 days in real life
Couple has not been with Nigerian family ( parents / children )
Female has prior marriage
Female has children

The closer you get to being a 9 the more troubles you can expect. Being a 1 or a 2 probably isn't a big thing with the exception of the time together.

What of if the meeting point of you and your usc finacee is not your country but somewhere else?i am a nigerian but i have meet twice with my fiancee in the UK but not Nigeria.Her initial visit was a week while the last one was 2 weeks.

After the 5 months of waiting and a congressman's help, USCIS issued us an RFE on 3rd, February, 2012 (Our NOA1 date is 26th, August 2011). This procedure has been so tedious, frustrating for us but we waited patiently for 7 days and still my fiance didn't receive the hardcopy letter. We are getting terribly worried and sick from this. Is it normal to take this long to get a letter from them? Whenever we see people whose filing dates are after us getting approved so fast compared to us, it pains us greatly. Should we call them and ask to resend us the letter? Please help us.

Patience is the key in this process.Hope you know the reason for the RFE,try gather documents to back up any reason for having a RFE.We also filled in August 5th but got approval on the 12 of January this year.if you can reply your RFE on time.you will get approved under 2 week.and after approval other stages are smooth.

I believe that the OP said his papers expired in November meaning they are already expired....I f I were you I would wait for the outcome to see if he is granted the extension if he is then go through Londond to process your paperwork...if it is not extended then he will have to return to Naija to finish the process and make sure he doesnt over stay in London.....Good luck :thumbs:

Pat what happens if he didn't get the visa extension and does his overstay in another country affects his fiancée visa?i believe the situation where you overstay count against you is when you do it in U.S and not other country.

i think on da safe bet, to avoid delays at that stage of ur petition, u should do interview at Lagos.. i think interview is usually where the beneficiary is a permanent resident. if he's needing visa's to hang around, ur streching it and wat ur not sayin is da concern if he leaves UK he mite not be able to return.. well, dats ur call.. but petition transfers from one consulate to anoda adds almost two mnths.

i have seen people with transfer cases but not all is additional 2 months

Sorry Chi,it is one of those things in life.It's just unfortunate that he fell into the hands of the wrong interviewer.From my own opinion i would advice you to file a new petition ASAP.A fresh K1/CR1 depending on the one your mind leads you to.Waiting on the respond of the recent denial is just a waste of time,i may sound so discouraging but that's just the truth.Seeing him again in a couple of months for interview in Lagos by same petitioner is more than enough to convince them that you guys are in for real.Don't waste time trying to wait,make your plans now.I live in Tempe AZ,feel free to contact me whenever you want.I am a beneficiary of a K1 petition.

Actually, according to the Act of 1952 and the reform act of 1965. It is a RIGHT to bring in your fiance, spouse, and children to the USA to live with you. The condition is, the person is not involved in, has in the past, or is now actively pursuing subversive activities against the US government or other like aligned governments with the USA. Any person who has come to the US and is considered "subversive" can be deported. However, the INA, USCIS, and DHS have been allowed to determine the "allowable" time frame for processing. The ACT of 1952 which is the basis for the USCIS today placed a priority on family first. Since then the 1% of all applications has been attacked, reformed, and slammed upon. there have been amendments, marriage broker revisions, checks mandated, etc. Many things to make the finace, and spousal visa more thorough. Due to these reforms, the original inceptions has been "muddied" and lost. I am hoping my senator will take this up. my senator has already promised an inquiry to the Service Center. but also the Secretary for DHS is from my State. So i have a senator who has sponsored many, many reform bills for immigration reform, plus the Secretary of DHS is from my state. If someone does not hear my cry and those of you who I have heard on here. it is not for lack of trying. I have not only asked my senator for assistance in my case, but assistance from the senate in ALL k1/k3 visa cases at the Service Centers. If a bill can be introduced to mandate immediate family first with application processed in 4 weeks with a maximum 8 weeks or less. the problem the Service centers do not realize is I am from Arizona, Secretary of DHS was the governor of Arizona. the senator doing the inquiry is one of the foremost leaders in the senate for immigration reform plus the senate minority whip from my state. I also worked in DC for many government Bureaus. I was not the person the Service Center wanted to ignore or do a "silent" refusal to expedite on. I am the one who no matter how beat up I am, I will continue until there is reform now. If they had approved my expedite request, I would have gone away silently. The longer I wait, the more I learn. In government, an educated voter who knows and works within the system is what they fear the most.

send in the information you have. See if you can order his school transcript if posible. State the reason why you may not be able to provide the answer in the required RFE. If you have any details, information, which can also show he is in the hospital this will help as well. State, if needed, when available, you will get his transcripts to prove it. Also, if you plan to learn his native language, state so, and where you plan to go to school to learn.

unless you are doing a K-3, I-130, CR-1/IR-1. It is the I-134. The I-184 is due on the I-1465 Adjustment of Status. The I-134 is just simple verification. Thee I-184 is more stringent and invasive.

As for fees, check the local embassy. there is the interview fee, the visa delivery fee, and the medical fee which are standard. there may also be other fees as well. Also check to see if there are any regulations by the local government for leaving. You could always get zapped with unexpected taxes for someone immigrating.

If you signed up for email and text on your application, you should get email and text through the website. All the "touches" mean is your application was moved from pile "a" to pile "b". It does not mean any processing has taken place, but may have.

you will probably get questions omitting the information. why was she there so long, what was she doing? etc, etc, why was it left out? how did she work on a tourist visa? where was the visa issued from? did she overstay the visa? If she was not supposed to be working on a tourist visa, why was she? you will get questions, just answer them. It is hard to say what the best answer is. either way you will end up with questions. The biggest question to answer was this a US Visa or not? Also why was the work done? when asked directly, you will have to answer honestly at the embassy interview. then there will be the questions on why not in the G-325a work history. the bigger concern is looking at a persons history in the fiance process.

hehe, welcome to the philippines. What a fun time. Yes, just bring the G-325a, and DS-130 to the interview. They may do further processing or the counselor may just makes notes on it, and go on. this is nothing unusual in the philippines. It happens many, many more times then you think. All I can say is be prepared at the interview. Also, ask her the questions the interviewer will ask. Get her ready. Go through a mock 10 minute interview a couple of times. And always remember, be prepared to be shocked during the process if you are with her. Filipinos/Filipinas are brought up with a strict moral code. So what may be said in private, may not always be said in public. Hope things go well for you. Do not worry, the issue you are facing is normal.

RFE, RFE, RFE... The people at USCIS handle hundreds of applications a day. if something is not done right, not "fitting" to the rest of the group they work on, or just "hits" a flag, they issue an RFE. It can be for something you already filed, or something you missed, could be for age, location, religion, language, work, proof, or it could be someone filed a motion against you. (people can file a motion saying you are not fit, too old, not eligible, not financially stable, sham relationship, etc. to which when they process your application, the adjudicator has to be able to answer in your application or RFE for the answer.)

It could be they just want to issue an RFE for a check on the application. An audit of the process. These people handle application from an "in basket" to an "out basket". If someone is approving a lot of applications without and RFE, it may send up "red flags" to supervisors the person is not checking applications thoroughly. Or a supervisor, may ask the adjudicator to get a form not in the packet, just to verify the adjudicator is checking the packets.

per the conversation which is sticky to this room, RFE's go to the top of the line. No waiting in line. The application with an RFE gets checked and either a further RFE, or approved asap. With a 5% denial rate (probably THE lowest in the visa applications centers), there is always a lot of focus on the fiance/spousal visa process.

All we do is make sure we answer so we can get on with the rest of the process. there are still more hurdles where denial CAN happen. this is just the first major hurdle.

st. lukes is first come first served. No waiting or scheduling. The hard part is the embassy interview, and scheduling it. From what I hear you do not get much time online. But you cannot schedule until paid. the nice part is you can pay through bancnet or send money to your fiance via xoom, and she can pay right at the bank when she picks it up. Also, do not forget the CFO guidance session. Without it she cannot leave the Philippines. The embassy does not tell you this part. wish you the best....

The NVC is operated by a private contractor with more than 400 employees. The Department of State has five supervisory employees who work there. The FBI has one employee assigned to the NVC.

Expedite files consist of the following types of filings:

* I-129F – Fiancé
* I-129 – K1 and K3 LIFE Act
* I-730 – Asylee/Refugee
* I-600/A – Orphan

These files and processed and transferred to overseas consular posts within one week of initial receipt. The only exception is in cases where a security advisory opinion is required. In such cases, the NVC will forward the case together with the security advisory opinion when it is received.

Yes, I know I am pounding on doors. And getting beaten up for it. Being told to take the dejection of it. Jstu wait your turn like everyone else. I go through the process of things. I try the doors and windows. rattle bars, and shake locks, Since my last post, one of my senators has taken my case on. there is going to be a senate inquiry. Now the bell has been rung. I may not get any action from my case, but I am not going to stop just because my case is approved or unapproved. I have done much, much research. the K-1 visa came from the McCarran–Walter Act. one of the 3 types: 1. immigrants with special skills or relatives of U.S. citizens who were exempt from quotas and who were to be admitted without restrictions;
the other two were quotas, and refugees. there have been amendments and changes to protect issues and problems. however, the spirit still continues but the process has become muddied. time for a "miracle maid"

Yes, they are the happiest people I have met. I think people need to understand it is NOT the starving I am worried about. It is the rebel activity in the area. the southern islands are a huge hotbed of issues. there are many rebel factions down there with ties to terrorist groups the US is fighting in other parts of the world. It is not an area to tread lightly or just dismiss things. The area is under a "state of emergency" by the Philippine government. $0 reporters killed in 2009, teachers taken ostage, chinese business attempted to be abducted, NPR personnel shot in Butuan, Bus bombing west of cagayan de oro, and the list goes on... They are poor, extrememly poor. the poverty level there is bad. when cassava is considered a meal 3 times a day when there is no fish to catch. and most meals are tamban and rice 3 times a day. or just rice and vegetables. There is one well next to an abandoned fish pond. (who knows how clean the water is) electric is intermittent, goes off all of the time. and catching fish is sometimes a joy, most of the time they don't even get a full box. Think of 500php as something of a joy to get. many times there is not even that much for 7 people for a week or longer. Tis family is so poor, they have never ever bought a 50kg sack of rice. Many times they buy rice and food on credit, get a few good cataches and pay off the credit, then go back in debt again. For all I know he may be in deep debt.

went to phoenix office... thye ad no information to give me, just in processing. told me to file a service request.... AHAHA.... called to file a service request.... not out of the timeline.... is there a way to request a review... no. who decides the expedite? the ADJUDICATOR DECIDES in reviewing the case. THERE is NO DENIAL issued, the case follows NORMAL processing. If there is NO DENIAL issued, the supervisor or director DOES NOT review the denaial... it just goes quietly on by.... And no matter how hard you beat down the door, you cannot get through to anyone for a review of the ajudicator's decision NOT to expedite your request. So if you filed an expedite and hear nothing, it is the "silent" way of keeping things in process.... it keeps work out of hte supervisor's hands having to review the rejects.....


In a way I feel so beaten.... each day I keep on hoping, and hoping this wlll be the day.... but I am realizing that the day will not be for another 90 days.....and ten there is the process after that which takes another 90 days, and the process of waiting for hte visa.... guess I am just having a very, very, very blue monday after being over at her relatives house seeing everyone who is from her village but not her... meeting friends of her dad, people who knew her...
