Thank you for your response. I already have received my NOA-2, and my case is at the National Visa Center now. I have heard lawyers don't take cases this far along. I'm not worried at all about anything but the i-134. All of my family has been to Mexico, and have been close since the beginning so I have a lot of evidence. . I will start looking for a cosponsor now. I will start researching the taxes thing, because I am clueless on that. But I will make sure I file this years taxes before I go to Juarez.

File taxes this year even if your income is low. You can file no matter what your income is.

The first thing I would try to do if I were you is to find another job fast.  You will need one that pays 19,300 a year in order to ask as a sponsor.  That isn't too hard to find if you are in Phoenix.  If that doesn't work look into finding a joint sponsor.  Just make sure the consulate you are using allows one.

I noticed the instructions on the consulate site are from 2012 and outdated too. The DS-160 replaces all those other DS forms it lists.
 

 

Oh my God!  Did I read the instructions wrong?  I guess this is good news except I poured so much attention into completely the DS-260.  Live and learn.

Did the instructions from your consulate tell you to fill out the DS-260 for a K-1? For a K-1, you need the DS-160. The consulates are not supposed to accept the DS-260 for a K-1 any longer.

This is not accurate information.  You can marry in any of the 15 states or Washington, DC and then return to another non same sex marriage state.  Immigration will recognize this.

Your YTD salary is just your annual salary.  How much money do you make in one year?  They are looking for your CURRENT salary.  If you make $50K a year, then your employer should state that.  Simple.

It is odd but they are asking me both for my salary and also my YTD salary.  The two things don't appear to be the same.  Hence the confusion.

An agency may not make it faster. A lawyer may not make it faster.  What makes it faster is:  USCIS, NVC, and the Consulate (manila is like the wind) and of course the couple and their history and their accuracy in paperwork.  Honesty and integrity also play a role.  Read every form. Check every box necessary.  Re-read, re-check. Have a someone look over the shoulder.  Include things that are NOT required (but not too many just enough to eliminate doubt).  Pics are important but boardign passes and itineries are more important.  Read the forums for the extras.  And there are extras. US consulate in Manila handed us a paper in the building that says "OH make sure you have this, this, and this."  A couple of those "This" items were not listed as required.....until you walk through the door.  We had them anyway thanks to the inordinate amount of reading and reading and checking and double  checking.  IF your petitioner CANNOT do the reading and re-reading and checking and double checking that is necessary, then an agency, lawyer, friend, may very well make it faster.

So I'm gathering my Facebook, Skype & phone history for my fiancé. Has anyone been questioned the authenticity of the print outs? I mean it seems like you copy the history and paste it on a word doc? So with some effort and time (which many people seem to have waiting on this whole K1 process) one can just "create" some history on a word doc. Or are people getting "authentic" history?

Just do the best you can.  You are only trying to establish that you indeed communicate with one another and how you do that.  We only mentioned that we called and texted but never were asked to produce such records.  We sent about 50 full pages of the thousands and thousands of pages that we downloaded from Skype to MS Word. anyone that could have produced that on the fly deserves the visa anyway. We included a few days for each two or three months.   I wish i could tell you that they won't care about them, but they read the pages...yes...they read the pages.  Consular Officer "Why does he say you're Grumpy?"    WTH? It was a hidden tidbit of discussion that somehow was overlooked during the preparation.   LOL

We included the statement from the bank for the deposits, but I included many things that were not necessarily required.  Why would I do that?  Eliminate doubt and increase the opportunity for approval.  I also included pay stubs and W2 forms but did not include tax returns. If i had the copies I would have carried them with me.  I believe that everywhere you go and every person you speak with will have different interpretation of this.  Encourage you to compile more than you think is required and have as backup, or, not.  It is going to be easy interview and status changed to ISSUED within a month's time.  peace.

we included hotel receipts from the places that visited. That, accompanied by a couple pictures AND organized with boarding passes and passport stamps were intended to demonstrate that we were in fact in the same country at the same time, and eventhough the hotel receipt only had my name on it, the evidence suggested that the story was true.  A lot of people here are right, include anything you can that you think will be important.

We have decided to just go ahead and get whatever immunizations that are required for him to come. Can someone tell me exactly what he will need. I have looked at all the shots required for his age but then I read that only MMR, Varicella and Tdap are required so I am confused. Thank you in advance for your help!

We're going through this right now too.  If you go towards the bottom of this link there is a table that will show which shots are needed for your fiance's age group.  What you have listed sounds right.  If he hasn't had his medical yet, try to get all the shots done at the time of the exam....it is much easier. If he isn't able to get it done at the time of the exam then check the prices, it may be better to get them done in the US as you'll have to pay to go to a civil surgeon in the US no matter what to at least have the vaccination records translated onto the I-693 that you will have to submit with AOS.  Your fiance can come into the country without having the vaccinations, but will be required to have them to adjust status.  FYI...they only require the 1st round of shots to be able to file for adjustment of status so if he knows he has received all the shots when he was younger there will be no need to do all rounds required for the Tdap and Varicella.

Hi,  My husband mailed in his AOS paperwork July 1, got his biometrics appointment the end of July and received his EAD/AP card on Sep 12.  I think 2-3 months is normal.  The green card interview time can really vary depending on where you will be interviewing.  We are Phoenix and our case is ready for interview, but we are sitting in a queue waiting to get an interview date because there are so many people here trying to adjust status so it really just depends on your local immigration office.  Good luck with everything!

Hi, 

 

My husband (fiance at the time) had a similar situation.  You are a Pakistani so your time frame will not be the same as if you were a UK citizen.  You may have a long wait for your visa...long after your visa extension in the UK, if you get one.  We had considered interviewing in the UK, but his student visa was expiring soon and he would have become out of status and not able to interview.  We filed the I-129F while my husband was still in the UK, but put on our paperwork that we wanted to interview in Paksitan as he would be back there by the time of the interview. They sent it to the UK anyways and we had to get it transferred to Islamabad which took a couple of extra months.  Once back in Pakistan things went really smoothly.  My husband was there less than 2 months before he got his visa and a couple of weeks of that time was waiting for the police report from the UK.  I think two of the things that helped him get his visa quickly was the fact that had been in the UK with no police record, he left willingly, and that he went back to Pakistan to interview.  If he had interviewed in the UK it may have looked like he was doing anything to keep from going back to Pakistan.  Of course we don't have any actual proof that going back helped him, but my gut feeling is that it did help.

 

Whichever way you decide I wish you the best with your K-1 journey!

From my understanding he can either sponsor himself or his fiancee or anyone in the US that he knows can sponsor him.  He may get denied, but he needs that denial if they are going to try and prove medical hardship for the reason they can't meet.

If she is the US citizen and the doctor will write a letter explaining why she cannot travel you may be able to get a waiver.  Your friend would probably also have to show proof that he cannot travel to the US to meet her. (iex. denied tourist visa).  I'm sure there are others on this site that can give much better info than I, but I do know firsthand of a friend of a family member of mine that was able to get a waiver because of a situation similar to this.

since you were in the military in 2013,
you are evaluated for that income at the poverty level, not at 125 percent of the poverty level.

So, take your final LES statement, look at the biggest number there, and tell us if it's OVER the poverty level or no.


 

I would say that this year I definitely made over the poverty level.  But my problem is that when I fill out the I-134 it asks who my current employer is.  I don't even have a current employer right now.  If I give them my last LES statement will they overlook the fact that I am separated from the military and currently unemployed?

Regarding the co-sponsorship, it has always been a 50-50 chance of them accepting it or not. However in our case, they accepted my MIL to be the co-sponsor and they approved us, yet we were worried that they wouldn't accept it as well. You could always try and have a co-sponsor that is a family member, just bring all the supporting documents. It's still a chance though.

 

Maybe some of the other member could give you their two cents regarding the I-134 concern. 

 

Thank you for your reply.  It does make me feel a little better that they accepted your co-sponsor.  What is a MIL though?

My fiance's interview is scheduled for November 21.  I just recently separated from the military less than a month ago and right now I am in between jobs.  I am planning to go to school starting in January and during that time I will be working a part time job.  While I'm going to school I will also be collecting BAH (housing allowance) from the Post 9/11 G.I. Bill.  I'm really worried because our interview couldn't be at a worse time.  We can't wait any longer for the interview because the petition expires November 23.  My dad said he will be a joint sponsor but I heard that the Philippines does not accept joint sponsors for I-134.  What will happen if they deny her at the interview?  Will they give us another chance?  It really sucks because we have already been apart for more than 2 years.  If I fill out the I-134 I don't even know what to put for my employer because I don't have an employer right now.  But if I show them my last 12 bank statements it shows steady income from the military.  Has anyone ever heard of the consular in the Philippines accepting a joint sponsor for K-1 applicants?

Ahh, didn't realize that. It doesn't matter who fills it out, but you, the beneficiary, must be the one who submits the form, just to be on the safe side. 

 

Just call the NVC when it's early in the morning for them (so that the lines are open) and all you do is provide your Receipt Number which is on your NOA2 and they will let you know if they have received your packet and they will give you a case number if they have(which I have not had to use yet as the DS-160 didn't ask for it.)

You will only be doing the DS-160 (it has replaced the DS-156 and DS-230 entirely) and it is online and your fiance must be the one who submits it, as they can track the electronic signature of where it was submitted from. After you submit it an interview date should be able to be set depending on how your consulate does things.

 

In Poland you still need to pay the Visa fee and it has to be done through their banking system and in their currency (pretty silly in my opinion. Why can't we just use a damn credit card online?) and then the interview date may be set. We were lucky to be able to set a date very early, as can be seen in my timeline below.

 

 

Tell your lawyer to get up to date with what's going on. Not really sure why you would want a lawyer in the first place. Unless you have a special situation, the K1 Visa process is rather simple (though time consuming) as long as you spend spending enough time on the internet doing research and reading through the instruction forms thoroughly when filling them out.

On February last year, I applied for a K1 for my fiancée and her two daughters (7 and 18). The visas were approved and past December, she came to the U.S. with her two daughters but due to family reasons, she had to return to her country (Colombia); thus, we could not complete the process of marrying; however, we are still engaged and wanted to move forward to marry and live together.

 

We are in doubt of what steps to take to make things right. The first option we thought of was that I would go back to Colombia, get married, and thereafter, begin the process of her I-130 as spouse. However, this path would preclude us from including her older daughter in the application because she is now 18 and she would not qualify to be in my original petition.

 

The second option is to file again for a K1 visa so she could, for the second time, come back to the U.S. so we can get married and proceed with the adjustment of status after the ceremony. This approach would allow us to include her oldest daughter, as she would still over 18 but less than 21.

 

Nonetheless, our concern is that a second K1 could be denied due to the IMBRA statements detailed in page two of the K1 application instructions. BTW, we do not meet neither entered into an engagement agreement through any matchmaking services.

All petitions are mailed to the Dallas lockbox intake facility. That is not a service center. It is NOT the Texas Service Center. From the Dallas lockbox facility, all cases are sent to either the Texas or California Service Centers for processing. Those are the only two service centers currently processing I-129F petitions.

 

Your case was not transferred. Being sorted out and sent to the appropriate service center for processing from the Dallas intake facility is not a transfer.

This is Maria. I am kind a new here in VJ. I read and learned alot in this website. Here is my situation.

My Fiance lives in Arnold Maryland, USA. We've met 2 years ago in US and got engaged December of last year (2013). He filed the first part of K-1 Visa which is the I-129F last March 20, 2014. He sent it to Dallas,TX Office. We waited for few weeks and he did't received any notification or something up until this day May 16, 2014. He called USCIS several times, and they kept saying that the can see the name of my fiance in there system. I understand that as long as they received the I-129F they will notify/inform us, right? He (my fiance) constantly check his email and mail box everyday but seems like up to this day he didnt received anything.

I finally got the urged to send this because We really badly need your assistance. I am worried now. Next week it will be 2 months already that we havent heard anything yet. I know that most of you knows the process better.

We would really appreciate your assistance. I hope to hear from you soon guys.

have you sent your package with a certified mail, meaning you may get a tracking number so you know where it is and when it is delivered. If not, the only way to know if they recieved it is the money : did they take the money from your fiancé's account?

 

when all above is checked, just know that TX is the only place to apply for the K1 , so it happens they transfer files to other service centers such as Los angeles or in Vermont !

texas is known to be very slow.

 

for ex : we sent package on April 29th, recieved May 1st, transfered and proceeded by CA on May 5, NOA recieved on 9th in my fiancé's mail box, and decision approved (NOA2) May 14th !

so only 14 days!

 

keep hope and courage, check what 's above and if the money is not taken consider you might apply again

well we will do our plan B, which is getting married in the US, both civilian and Christian wedding, and then if needed to visit his sister in Mexico just ask for the authorization from the USCIS !

 

we applied in May 1st and i'm already notified for my interview so, i will arrive in the US mid August , i won't take the risk to spoil our fast process !

 

i think i can wait for 6 other month or more to get the green card and then be allowed to travel !!
