Police Clearance in the Philippines is only good for 60 days. NBI clearance is good for 1 year. not sure if there is any exception in expiry if requested from abroad. but better ask the Philippine embassy in Japan.

Ya, since that casefile is headed to Guangzhou, you need to front-load it.

However, I suggest you pare back the 800 pages of chat to around 200, or 1/4 of what you've accumulated, highlighting major things and events with a yellow highlighter.

this is a very good advice. Posted Image someone questioned our front-loading as a waste of paper and causing lots of dead trees and that we include lots of non-sense papers. what's funny is that they actually petitioned someone from my country and they were saying it is easier in our country. lol. since it was easy for them before... but like wat me and my fiance said, what one's experience does not always applies to others. we believe that the consul would take a look at our papers first and decide before the interview. we only send in 27 pages of chat logs but over all our I129F was 380+ pages.now doing our chat logs, and would probably print more pages. Well I just scrolled up randomly it has an option to show messages from 1 month 3, 6 etc and picked up random conversation and print screen. Sometimes when we video chat I make print screen too. Then copy paste in paint (I use windows) and save and ready. I think it's kind of nice so they can see it's not fake or something.


oh ok. when i did that before, it just pissed me off because it keeps on moving the messages while at the same time talking to my fiance. so instead of giving myself a hard time, i just searched online if there are any softwares i can download to extract the log calls. then i found skype log view.it only took me few mins to get the logs.

I guess it only depends on someone if they have the intention to fake it or not.lol.

I wouldn't print the skypes logs but instead I would print screen so they know it's real. We send skype logs, just copy pasted them on word and then I thought about it and I could have send the print screens hm..


how did you extract the skype logs? did you scroll back from the start? skype log view was very easy for us since we can view it in HTML then copy and paste in ms word. then can also delete other callers (like for example my cousin also calls me, i deleted that log with her name since i just want to highlight with my fiance's call). we have many calls done in 1 year, so print screen would not be ideal for us and i would need to keep on scrolling back lol. it would take me months to scroll back. and difficult while talking to my fiance since we talk everyday. I would say, it depends on the petitioner/beneficiary,If the country has high fraud cases,etc.. if the consulate prefers front loading etc... we had send in as much evidence we have instead of having it sit on the table. and will bring in more for the interview (chat logs,call logs, remittances, etc - the latest evidence after sending the I-129F to prove that we still have ongoing and bonafide relationship). some had questioned about front loading our I-129F, that it was just a waste of paper,money,etc bec ours was 380+ pages... and that these are useless and wouldn't be looked up, etc.. Only few understands front-loading (i guess). have read threads about front-loading.... in the end it really depends on the petitioner/beneficiary if they want to front-load or take chances. in our case, we don't want to take chances. but we made sure that we followed the guidelines and send in additional documents that we think would support our petition. and also some would say it was easy for them when they were in the process BUT what one's experience does not always applies to everyone. And also it will be a different consulate, different officer, different adjucator,etc... so don't take any chances.uscis might not look at all the papers u send but the consul might look at it and make decision even before u go for the interview.. so don't take any chances... i end up telling people to not mind our i129f if they think it is wrong. LOL.

We only attached maybe 6 or 7 emails (covered 2 pages only) and focused mostly on boarding passes, passport stamps, hotel receipts, and photos in different locations. So I wouldnt worry so much about the Skype logs!
Then again we could receive an RFE

You may search Skype historian in Google and download it. and you can start extracting chat logs. you can choose the dates you just want to be extracted or you can have all extracted since 2011 and save in a folder by month, day and username. you also have the option to save it in .txt file which is notepad then copy paste in word. (since the date and time stamps are in descending order, I highlight it all and change the font size to 1 then arranged in ascending order by clicking that A-Z icon in MS word then change the font size to my preferred size then select the conversation i just want to print). I don't know if any one here knows an application that you can use aside from skype historian. but for some they just print screen some of their skype conversation

- I first used skype historian for the chat logs and skype log view for extracting skype log calls. the skype historian takes a lot of work for me since the date and time for chat logs where in descending order so i rearrange them in MS word after copy pasting from notepad.

i have itineraries, pictures, receipts but only CASH ones, will this be okay?, boarding passes, passport stamps , luggage tags as well and security stickers on my passport!
- I think that will be ok as for some does not really look at remittances but might be looked at the interview (really depends which consulate or who will do the interview) but what is important is that you met each other in person in the past 2 years.

Your profile says you’re in New Mexico.

Before having her fly to Mexico, take a weekend daytrip to someplace like Nogales. It’s right on the Arizona/Mexico border. If they say no, you only out a long drive.

I don’t know, there could even be closer border towns to where you are. After you get back let us know.

I can't thank you all enough for the extremely useful information, especially from San Diego, as I was in El Paso a couple months ago and asked some of the locals there about crossing into Juarez. I agree as this might be a valid option. And from belinda - I have not submitted my application because I was told there was a hold. Perhaps I should give this a try and see if I squeak by. I have also talked to a lawyer who said I can obtain a clearance letter that shows I am current with my payments. Any validity to this?

To clear up all the Neighsayers concern about my finances, I currently make $79,000 annually, have no children living at home, own my home and car, and have a credit score of 785. I really didn't feel like sharing so many personal details of my life, and asked to refrain from bashing about child support arrears, but I guess that was too much to hope for.

The child support arrears started at $52,000 when this woman I slept with twice in high school figured out in the late 80s that she can milk two states for a total of $1000 per month. When the child turned 10, she moved to a third state, and by this time accumulated 4 more children, all from different fathers. When she moved to the third state, the entire child support enforcement file from state number one moved with her, then later from state number two, which basically doubled the amount I owed. From the time I found out about the child, I paid support. As I said before, the child is now 26 and has a family of his own, and does not communicate with his mother. She is alcohol and drug addicted, morbidly obese, and may not live long due to poor lifestyle and recently diagnosed type 2 diabetes. I won't even go into the bitter dispute with the biological mother I had when I approached her on settling, who told me I will pay every month and will never release me from the debt. She is a crooked woman who exploits flaws in the system.

So now that I have shared all the dirt on this situation, I ask once again to please refrain from continuing to discuss and make suggestion to pay off arrears, and stay focused to the the question at hand: how best to meet, and is there any truth to one lawyer's claim, and I quote "As long as you have evidence such as emails, letters etc. This is a fiance visa so therefore no physical contact is needed. That is why they also give you 90 days once she is here for you to marry her to be sure that this is what you want."



Yes, usually you can get a summary of the status of your support case. This should include all payments made and portions applied to arrears.

My guess is that having already paid $32,000 in arrears could go a long way in your favor. If it’s just you, her and her child, and you make $79,000 and owe $20,000 in arrears mathematically it could work. It’s a coin toss depending how they will view it.

Are you sure the state has it reported against your passport? I know in my case I later saw the arrears was reported on my credit report and had a negative effect on my score. If your score is 785 it seems unlikely that it’s actually been reported.

Also, if your credit score is 785, and income is $79,000, you’re probably better off getting a loan and paying it off outright. The interest on the loan will probably be less than the interest the state puts on the arrears.

I know in Arizona its 10% APR compounded.

Also you might check with the state and see if they have a debt compromise program, most states do. Considering your financial situation they may be willing to work with you.

I don’t know ####### about going to Mexico, never been there. But the arrears I know.

That would apply to persons who are not citizens and are attempting to become citizens or immigrate to the US. From my personal experience the issue of my arrears was never mentioned, questioned, asked to explain, it was a non-issue. At the time of my filing of the petition I was under felony indictment for flagrant non-support. Yep, I left the country with my little blue passport, flew to Sweden, met my fiance, and returned and no one was any the wiser.

I know that in October I had to pay $15,000, even while I was still current on all deducted payments and had made every clearing house payment for over 2 years. I didn’t have any kind of indictment. My ability to renew my passport was revoked. And I was told in no uncertain terms that the arrears would be a big problem.

That’s why I recently got my hands on a copy of the PDF of the USCIS field manual. It covers many immigration topics and in several places talks about arrears. Including Nonimmigrants Intending to Adjust Status (K and V Classifications).

Just because 1 person gets lucky don’t mean it’s a good idea to ignore the rules.

Child support arrears has nothing to do with the ability to file for family immigration. I successfully did it while I was allegedly more than $5,000 in arrears. No questions were every asked at any point in time about child support. No credit report is run, nothing. The only issue is where they can meet.
Being lazy and not wanting to read, have you already applied for and been denied a passport? Just because they say you have a block does not mean they have actually filed the paperwork to block you.



I just resolved the same sort of issue. I KNOW they know about arrears without needing to run a report because I didn’t know about the arrears until the Department of State told me.
The state and support clearing house report an arrears to HHS who reports it to the department of state. The department of state oversees U.S. Embassies.
USCIS is where the final passport restriction occurs.
This is a quote from an internal USCIS guide.
(A) Policy Regarding Support .


You should also review Interpretations 316.1(f)(5) for a discussion of good moral character and the effect of support payments on a finding of good moral character. This discussion includes support of spouse and children; effect of unemployment or financial inability; attempts to comply with court ordered support.


A finding of good moral character is precluded where there is a willful failure or refusal to provide support unless extenuating circumstances exist (see 8 CFR 316.10(b)(3)(i) ). Unemployment and financial inability should be taken into account when examining the applicant on this issue. In considering such factors, you should also take into account the cause of the unemployment and financial inability to support dependents. For instance, if an applicant was unemployed because of incarceration, then the reason for incarceration must be determined as it may affect the applicant’s ability to establish good moral character.


Another factor to consider would be whether the applicant had the opportunity to support the children. Example: the spouse had custody of the children. He or she took the children to a new residence, prevented the applicant from learning of the children’s whereabouts, and made no provision for receiving support payments through a third party or financial institution. Depending upon the circumstances in this last example, it would be important to know why the spouse prevented contact between the applicant an d the children. You would need to consider if the applicant had in any way threatened the spouse or children, or defied a custody order. You would have to ask enough questions about the circumstances, on a case-by-case basis, to determine if the conduct of the applicant met the standards for a finding of good moral character.


If the documentation indicates that the applicant is in arrears for court-ordered child support, you will need to find out how long the applicant has failed to provide support and why. If the circumstances surrounding the applicant’s failure to provide support have already been reviewed by the court, and the court still continues to order payment, the application should be denied for lack of good moral character. If the applicant tells you that he or she cannot provide support and provides an explanation an d documentation to support that explanation, you will have to determine whether the applicant willfully refused or failed to support the dependents. An applicant who is unable to provide documents that establish that he or she did not willfully fail or refuse to support his or her child (children) has failed to establish good moral character. See 8 CFR 316.10(b)(3)(i) .

I crossed the border ABSOLUTELY LEGALLY. Anyone can cross US Border on Naturalization Certificate or with Birth Certificate. You need passport ONLY to travel abroad, not to cross the border back into US. In fact, permanent residents don't even take passport with them raveling to Mexico, only GC! This is the law that you can cross the Border with PROOF of your legal presence. It can be multiple documents mentioned above. US Passport is only one of the proofs.
They will meet in Mexico and can file for K1, this is what I am recommending. He travels on his proof of citizenship (whatever it is), she travels on Mexican visa to Mexico, they meet, file or K1.. What else??

The OP wants to find a way to sneak around his passport restriction that he has because of the support arrears.
Even if he can go to Mexico legally. The intent is still to try and sneak around the restriction.
Everything I have read says you need a passport or passport card, but I’m not even making that point.

I did contact them, and it was they who told me that I will not be removed from the list until the arrears were below $2500. I will look more into this and post my findings to this thread. I am sure there are others in this dilemma.

I will also have her try again to apply for a B2 visa. Any suggestions on what are considered strong ties? She has a 7 year old daughter, and has worked for 5 years at the same job. I am afraid I am really new to all this, so I do not know what they consider to be good evidence against immigrant intent, or how to prove strong ties to your home country.

Even if you meet. You still cannot obtain a K-1/K-3 visa with $20,000 in arrears. Even if you manage get away with fraudulently getting married here on a tourist visa. You cannot sponsor her for a GC or AOS with $20,000 in arrears.

While documents are not routinely checked along the land border, Mexican authorities at immigration checkpoints approximately 20 to 30 kilometers from the border with the U.S. will often conduct vehicle and document inspections and will require valid travel documents and an entry permit or Forma Migratoria Multiple (FMM). All U.S. citizens entering by land and traveling farther than 20 kilometers into Mexico should stop at an immigration checkpoint to obtain an FMM, even if not explicitly directed to do so by Mexican officials. Beyond the 20-30 kilometer border zone, all non-Mexican citizens must have valid immigration documents (FMM, FM2, FM3 or FME) regardless of the original place of entry. Failure to present an FMM when checking in for an international flight departing Mexico can result in delays or missed flights as airlines may insist that a valid FMM be obtained from Mexican immigration authorities (Instituto Nacional de Migración, INM) before issuing a boarding pass.

This is why they offer the passport card anymore. Mexico, Canada, and the Caribbean all accept that card or book. But All require it now.

Typically the state will not release the passport unless the full amount is paid. They can make exceptions and will do so if you can prove that travel is required, such as travel is required by an employer or employment will be terminated. But they will still usually expect a lump sum payment of the majority of the arrears.

The child is 26 now, and as I said, there is no current support order. I have paid my support obligation since I found out. It is obvious that paying off the arrears and obtaining my passport is the logical route, however, as I do not have the $20k to do this, I am here asking for suggestions where the both of us can meet in lieu of my missing passport.



The support order is typically considered currently active until all arrears are paid in full. Additionally there is typically interest on arrears.


It is many times also necessary to file in court that the order has been fulfilled.

My girlfriend lives in Russia, and we were planning for her to visit me, but her tourist visa was denied (214b). We would like to start petition for K1, but understand that you must meet in person. Does anyone have suggestions as to where we can meet? I have thought of Juarez, Mexico, but as unsafe as Mexico is currently, I would love to hear other suggestions.

Please refrain from bashing about child support obligations, there is no current support order, and only arrears where the biological mother bilked two states for welfare for 10 years before I even knew I had a child - long story.

I have been in a similar situation in the past and learned a lot about this topic. I recently had to clear up a arrears I didn’t even legitimately owe.

First my story.

When my ex and I were getting a divorce we had agreed to a alimony and child support amount above the state calculation. I was attempting to be generous. Even without an order for support or a decree I started to pay that amount directly to her in cash. I had signed receipts from her for each payment.

When the decree was issued and order of support established the state initially had assed be as being 6 months in arrears. I was easily able to prove the error and my ex even asserted that fact. Because my ex helped me clear up the support issue I felt I could trust her.

I paid off the alimony about a year before it was needed. The state once again showed it in arrears and I proved it was an error and my ex helped prove it.

My ex’s BF has probably about 6 months total combined employment over the past 4 years. My ex would frequently ask for help and I would pay her cash and she at the time would agree to apply it to the support. I was mostly self-employed so salary deductions were not typical for me. About 1 out of 3 times I would just pay her directly.

This past summer my ex wanted an increase in child support and the state reviewed the support and denied increasing the amount.

After the review I needed to renew my passport and could not because I owed arrears. The state showed I owed $15,000 in arrears and interest. I tried to prove it in error once again but this time my ex stayed silent and refused to tell the state the truth.

When it was all said and done I ended up having to pay the amount and learned NEVER to trust her with payments or ever give her extra again.

Here is what I learned in the process. There is some variation from state to state but overall here are the basics.

1. If you give money without going through the court or state it can be considered a gift. Even if the amounts are exactly the same and you have signed receipts to the contrary. If your ex does not also provide proof the money was toward support payments you can be looking at an expensive and time consuming court battle. (I considered fighting in court but to retain a lawyer would have been around $5000 and could take a year to fight. Even if I would have fought I would have really gained nothing and just as easily been still ordered to pay the arrears.)

2. Once the amount is over $2500 the state may suspend your passport.

3. When paying off the arrears the state is not obligated to remove the limitation on your passport until the full amount is paid. Not $2500, but $0.

4. In some cases you can negotiate a lump sum agreement with the custodial parent and they can waive the arrears if done with the approval of the state. If the custodial parent received assistance from the state, the state can choose to not allow that amount to be waived or deduct the amount to be reimbursed to the state.

5. If you file for a K-1 or K-3 visa and owe more than $2500 in arrears it can be outright denied.

6. If you file for a K-1 or K-3 visa and owe arrears, the total amount of arrears can be deducted from your estimated income used to prove you can support the beneficiary. For example, if your income is $40,000 and you have $2,000 in arrears, the adjusted amount can be $38,000.

7. Your children are considered part of the family household size even if you do not use them as a tax exemption or dependent on your taxes. For example if you have 4 children your household size would be 6. Your 4 children, your spouse/fiancé(e), and yourself.

8. Your income typically must exceed the HHS poverty levels at 125%. Sometimes the 100% level is used for K-1, but often the 125% standard is used because AOS is assumed. For example, consider the above $40,000 income adjusted to $38,000 because of arrears. Also consider if you have 4 children, making a total of 6 people in the household. If you live in the continental U.S., the 2012 income requirement at 125% for a family size of 6 is $38,712. In this example you would not meet the requirements.

9. A co-sponsor may be used in applying for a visa however embassies in some countries opt to ignore co-sponsorship as a rule.

10. A co-sponsor is usually only accepted when the petitioner’s income is close to the required amount.

The process is not cheap. Travel costs, application fees, the cost to obtain documentation, medical exam fees, visa fees, AOS fees, etc.

The basic moral to the story is you need to get your house in order before applying for a visa.

i think if he is in military u can request for expedite.but that would make ur application processed faster then..possible 3-4months and u r done

my contract will just be 1 year.

humm that sounds a bit longer. you might receive your NOA2 before 1 year.. some got NOA2s in like almost 5months or 6 months and 9months the longest.. or 1 year for those who have a problem with their case.. then once you have NOA2, your approved I129F is good for 4months. in those 4 months you should be able to have medical and interview done.. then if you have visa on hand.. it is valid up to 6months.. some got 3months for some reasons but normally it is up to 6months..then you should be in the US already.. then have 90days to get married in the US.

 

i think the perfect timing should also be considered here.

i know your fiance can still petition you if you are working outside PI. like other filipinas who were working in other countries say in middle east.. but their case were forwarded to Manila embassy.but for some, they requested to have the case forwarded to the nearest Philippine consulate in their place and had interview there.. but ofcourse there are paper works you need to get done in Philippines
