They didnt care what amount of cash I had - they said if I did not get a job - they would mark me public charge and they were not lying. One month after the interview we received a paper from the embassy stating we were public charge. They did not remove this decision until after they received three months of paystubs . They would not consider my bank account , my student income, my home , or my child support !

wow!  That is ridiculous for a 3 month visa.  The fact that there's enough money to qualify for the 864 should be more than enough.  Thanks for the info.  I guess I'll get a job and forget about spending some time with my fiancé.

I had a similar situation. I was not working because I was attending school ,however, I had enough assets to sponsor my fiance including my bank account and home which I own free and clear. The embassy in Islamabad would not accept this at all. They point blank told my fiance in the interview that if I did not get a job they would mark us as public charge. I tried to fight it using my congresssman but nothing helped .  Finally I found a job (under 100% of the poverty line) yet they accepted it and said that we now meet financial requirements . The only thing which satisfied them was 3 months of paystubs .

Thanks for the response although it's not what I wanted to hear. :(  Do you mind me asking what % of cash you had in the bank?  I was hoping since I had enough cash to cover the requirement for the I-864 it would also be enough for the I-134.  I have heard many say they won't use the house as it would put you in a hardship if you sold it even though that is not necessarily true and with the market in my area it would be very easy to sell it in a few months.

Hi,

 

We are new to this site and have a question regarding the I-134.  I just lost my job of 13 years so currently have no income other than $840/month in unemployment.  My question is do I have to be working to sponsor my fiancé or is $70k in the bank and a house with equity of approximately $180k enough to sponsor?  If I cannot find a job soon I would like to spend a few months with my fiancé before going back to work if possible.  I have heard that the Consulate in Islamabad, Pakistan will not accept the house as equity.  Does anyone know if I am showing enough to not need a job right away? I will definitely be working by the time the I-864 so I am not worried about that part, just the I-134.

We received our NOA1 for a K-1 in August and were getting really excited the people filing around the same time as us were receiving their NOA2. Just got an email update today that we're being sent an RFE sad.png I was extremely disappointed! I'm not sure exactly what it's for yet, but it seems that most people receive them for lack of evidence on having personally met in the last 2 years. I sent boarding passes and pictures. I thought there was no way we would get an RFE because of the circumstances under which we met....

We were both employed on the same cruise ship for a year. We were in the same place everyday for a year! How can you need an RFE?! You don't get more proof than that!

Is it possible they're sending us an RFE for something else??

We received an RFE in September from the CA service center.  The RFE happened on Thu and I received the hard copy in the mail that Sat.  I had a complete copy of what we sent in and couldn't find anything wrong with it.  Turns out they couldn't understand my name change so I sent in the additional document they requested that Monday.  We just received our approval exactly 1 month after sending in the requested document back to them.  It's stressful waiting for the RFE to arrive, but just give it a few days.  It could be something as simple as them misplacing a document you already sent in and you'll just need to resend.

As long as his 2012 income tax shows that he meets the minimum financial requirements, I would apply now.

 

I visited the US every month during our process, and was never questioned.  Just make sure you bring solid proof that you will not stay in the US.

 

By the time you get to the interview phase, he should be more stable in his job as well.

 So how to do we get an inextensa?  Are there instructions somewhere? The embassy website doesn't give instructions; the website only says we need it.  We had our visa interview Thursday. (I am going to post a review of it)  They told us everything was approved but that we need to get an original birth certificate.  My girlfriend is from the Dominican Republic.  She had a Dominican lawyer help us out.  We paid him twice now and both times he has given us the abstract birth certificate and says we don't need anything else.  Arrrgghhh. Frustrating.  No visa yet.

My problem was because the registration process was interrupted after selecting a courier, and for the life in me I could not find a way to get back to that page. In the end I had to just register a new account with a new email address, then I was able to continue from the courier selection including paying the fee and printing off the page. I don't like that site of theirs. :\

My fiance and I are about to schedule her interview.  The problem is that I just separated from the military and now I am in between jobs.  I am going to be starting school in January majoring in Engineering.  The reason why I got out is because I will make about the same as I did in the military by going to school and working part time because of the GI Bill.  I've been out of the military for only 2 weeks now and my fiance wants to put on the DS-160 that my occupation is military even though I am out.  I told her that's a bad idea because obviously that's lying and if we got caught then she would definitely get denied.  I told her to put my occupation as student and I will get my dad to be a co-sponsor for the I-134.  Anybody else think that's my best option or do I have a better one?  Any advice would be greatly appreciated.

The visa fee is for each person no matter the age, so yes $240 x 3.  Each visa applicant no matter their age also needs a separate Affidavit of Support but the supporting documents can be shared. Also each applicant no matter their age, need to have each required visa interview forms filled out. Each applicant no matter their age needs a medical exam and everyone over 16 needs police clearance reports.  Now I do know some consulates and embassies can vary, so I recommend emailing them to confirm this.  But this is my understanding. I have researched for my fiance and his daughter. 

 

Thanks for the info, have your fiance already scheduled his interview? Have he scheduled different times for him and his daughter of just one date/time for the two of them?

My fiancee will go for her K-1 interview with her two girls 6 and 17.

I wonder if ONE package with all the forms will be enough for the three of them or if each one will have to have her own package with copies of all documents.

Also I wonder if my fiancee will have to pay one $240 fee that would cover her and the girls, or if each one of them will have to pay their own fee; thus, $720 altogether for the three.

 

Please advise!

It's the second one. From the date of the issuance of the visa, you have 6 months to enter.

If you enter the day after it's issued, you have 90 days from entry to the US to marry (about 3 months after issuance).

If you enter the day before it expires (6 months later), you have 90 days from entry to the US to marry (up to 9 months after issuance).

If you enter on any day in between, you have 90 days from entry to the US to marry.

As you can see, the expiration of the visa only has to do with the entry to the US. Once entered, a different clock (the I-94 expiration date) starts, and it is always 90 days. I can see how it can be confusing, especially if the correct vocabulary isn't used.

Hello everyone! I've got another question and I hope you can help me with this.


Question is regarding I129F Part A-Question # 10: My Citizenship was acquired through:


-Birth in the US
-Naturalization
-Parents



My Fiance (USC) was born in 1968 at Japan when his parents were serving in the US Military. I asked my fiance why he checked "Birth in the US" and he told me that he got a birth certificate from the US state department and that he is one of the few people with a Federal recognized birth certificate. His birth is seen as a US birth and also at that time Okinawa, Japan was a US territory. I asked him if it is ok that he checked "Birth in the US" and he said it is fine. His parents are USC too. My fiance has a birth cert no., date and placed issued. Born in a US territory at that time, born in the US military hospital or US embassy is also same as being born in the US?


I am confused and I don't know if what we did is right. any opinions? :)
Anyone who are expert or has same situation? :)

I heard that if you put "Travel to USA/VISA application" NBI will ask you to come back after 2 weeks and that you would need to put your US address in the application.

The prescreener in Manila will ask for some initial evidence, like pictures, and letters, and such. That will have to fit through a 6" hole in the security glass. So, make sure that she can break it all down if need be. The prescreener won't ask for it all, just a half dozen or so of each item. Your fiancee can take the rest of her evidence with her when she is interviewed by the Consular Officer.



That good to know. The Binders are 3” but I had assumed the interview would be conducted in a room with a desk.

I need to figure out some sort of quick release for the tabs.

I forget whether it was on the embassy site, or in one of the USCIS guidelines, but in one of the FAQ's, the question was asked, "How many pieces of each kind of evidence listed was sufficient?" The answer was, "Up to six pieces of the most relevant evidence among the types listed for each category would be sufficient." That stuck with me.

Remember, the person reviewing your file has to complete so many files per day, and if your best evidence is buried among the clutter, that vital piece of evidence may get overlooked. You can say you tabbed and organized everything, and highlighted it with paste-it notes, however, the first thing that happens, other than look for the check when they open your envelope, is take the whole filing apart, remove all the staples, tabs, and paste it notes, and scan every piece of paper, front and back. So, that pretty, nicely organized file, is now reassembled, top punched, secured with an acco fastener, and dumped in a box, to be forwarded to the local office, or service center for archiving, in case an interview is required. For the rest of the processing, an electronic copy of the file will be used.



When I say very organized I mean it.

For example each area of evidence, forms, or documentation is placed in a separate section divided by a colored card with the topic clearly printed on its face and a corresponding printed tab located on the bottom of the separator card.

When I say printed I mean it is professionally printed not simply hand written.

Things like the payment, passport photos, etc., are placed inside full page size, clear plastic, sealed, document envelope sheets.

The entire packet then was assembled with an ACCO clip at the top.

Then the entire application placed within a black canvas federal document envelope, with “I-129F original submission” and the full name of both myself as petitioner and Ann as beneficiary printed on both the front and back of the envelope. The envelope is closed with a zipper making document removal easy while providing protection of the contents.
(This is the same type of envelope we use at work when presenting legislators with proposed bills and amendments)

It is our understanding the packet will be disassembled and reorganized into their own binders used by USCIS. Sections viewed as not directly relevant to this phase of the I-129F will be forwarded on to the embassy for possible use in the interview process upon approval.

We are fully aware that once disassembled and placed into the USCIS binders that things like the tabs, document envelopes, and the canvas document envelope will be discarded. These are only present to make it extremely easy to manage the packet.

Yes, it was more expense that I am sure many will find unneeded, I think we spent about $150 on assembling the packet.

The intent was/is to provide more than enough information, preventing any possible RFE while making it easy to disassemble and reassemble in the proper manner. Additionally we are attempting to front load some information for use in the later in the interview process.

This method was agreed and suggested by three separate immigration attorneys. Yes, it’s probably killing a fly with a hammer.

:thumbs: i am a big advocate of this for domestic deliveries. and if you want overnight, just use USPS express (not more than $30) and next delivery is guaranteed if mailed b4 5pm.



USPS and most any domestic couriers are relatively equally reliable. You can find people who hate and swear by each of them. However there are advantages and disadvantage for each.

USPS tracking and notification is my biggest dislike. FedEx and UPS offer per scan tracking and notifications so you can see each step the delivery makes within the FedEx or UPS system. USPS tracking is usually more of a delivery confirmation.

I like being able to see where my package is along its route. Is it important? Perhaps not in the grand scheme of things. But I like the ability to be a little OCD and check it repeatedly and receive notices of any change in its status. FedEx and UPS also allow me to have delivery before 10:30am.

I personally have both a UPS and FedEx account so I also have the advantage of convenient billing and discounts in some situations.

Internationally depends a lot on WHERE, and if shipping to or from. If shipping from Manila to US I prefer FedEx, some of the malls have places you can ship FedEx. But using your US FedEx account to send from the Philippines to the US is problematic at best. UPS shipping locations are nearly non-existent and the UPS website has locations no longer offering UPS. However, shipping to Manila from the US I prefer UPS they even have some UPS direct deliveries. Don't expect scan level tracking beyond Manila or Cebu, sometimes Davao.

There is a high instance of "loss" on most others. I have not tried DHL but have heard it's good.

Within the Philippines LBC is probably the best.

Manila forwarder is also good for very large cargo and boxes.

Well the good news is they were very lucky on there flight last week. The flight they were on blew an engine 2 1/2 hours out from Tokyo at 36000 feet and tilted to one side and did a rapid decent of 20000 feet before they regained control. The Wife to be said when she saw 2 flight crew members do the sign of cross the only thing she thought about was her daughters that were on the flight with her. She said the pilot announced they had a major malfunction and would try and make it back to Tokyo. She said the whole time going back to Tokyo the plane made horrible noises and vibrations and would occasional dip quickly.
For me I was watching the flight app when the flight dropped of the app I got concerned. Of course Delta would not give me any info except they were safe and it would be a few hours before they would get on there way.
To make matters even worst on the second attempt leaving Tokyo they had to abort the takeoff to another malfunction and had to wait 9 hours for a third aircraft.
After speaking to her, you realize how close I was to losing them all. I am very thankful they made it here.
Right now it has made her and the kids adjustment here very difficult. Not only did they almost crash they came from a very large city in the Philippines to a very small town in my state. It took me a day to calm her down and have promised her after we get her ten year green card I will change jobs and move to a place she will like. Right now I make real good money at my job to support all five of them and I have explained to her that right now we need my income so we can adjust there status.
I know I have to be very patient and understanding and do everything I can do to make there transition as easy as possible.
On a positive note at the POE in New York they did not send her to secondary screening they did everything out at the customs window. They did not ask her any questions and just told her she had to get married before July 1st.
Today, I got an email from Delta Airlines asking us if we would do a survey in regards to the malfunction and the handling of them when they returned to Tokyo. Go figure…….
Well, I am grateful they made it and I know I have a very long road ahead. I did tell her if she really felt she wanted to return that she could but I asked her to stick it out for at least a year but I would be more than happy to move after we adjusted there status.

Police Clearance in the Philippines is only good for 60 days. NBI clearance is good for 1 year. not sure if there is any exception in expiry if requested from abroad. but better ask the Philippine embassy in Japan.
