also, you stated once she comes to america, they would marry and she would work asap.   that won't be able to happen because after marriage you need $1,070.00 to file for her AOS (adjustment of status) which includes her application for the green card, ability to travel outside the US and the ability to work, until you have this approval she won't be able to work.

 

I don't mean to rain on any parade, just wanted to give as much facts as i'm aware of since i brought my husband last November, we married in December 2012, i filed for AOS in April or May of 2013 and he got his work papers and ability to travel around the beginning of July 2013.    still waiting for green card.

for Adjustment money he has been saving for it for that purpose. Yes he is aware of the expenses e.g. medical visa fee and plane ticket. He's got money for that. He just need to know whether to go ahead set the interview now or wait after filing 2013 tax?

Hi there! I would like to give an unsolicited advice...since the K1 is approved, just go on and have the interview, and if it didn't work, he could go to the PI and marry the fiance...I know someone who had an interview at USEM last January 2013, and the guy here in the US is receiving SSDI, she was denied due to the reason that the petitioner is receiving money from the government and he's not capable of supporting the beneficiary...but as what others say, it always a case to case with regards to using a co-sponsor, just try every possible way...and always have plan A and B...goodluck to your friends!

I poked around my old email records.  My memory was incorrect.  I did an i-134 on my own for the K1, for AOS an 1-864 for me and an i-864a for my parents.

Are you sure of this assertion?  I brought my then-fiancee over using a joint sponsor on a K1 in 2005.  There was no issue at all.  Has something changed since then? 

 

So what did you do? You filled form I-864 and 864a for the joint sponsor then?

Well, he does not really need tax transcript for the interview, he only need recent pay stub or something that could proof his income right now/recent 3 months.
You don't want to be waiting to schedule interview next year like other VJ-er suggest the poverty line will go up just like every other year

 

So you mean to say, go ahead and have that interview going this year and go with current income?

Hi, I did a search and couldn't find an answer to this in the guides or searching the forum.

 

My fiance is Malaysian Chinese and we are currently living together in Australia, going for the K-1 route.

 

Question 16 asks if native alphabet uses other than Roman letters, to write the name and address abroad in the native language.

 

Should he write his name in Chinese?

 

Also, he tells me Malaysians typically use Roman letters for addresses, and Australia sure as heck doesn't, so I'm not sure what to put - does he need to translate it into Chinese?  Otherwise can we just live the whole question blank and put "None".

 

The thing is that I did have him write his name in Chinese characters on the G-325A.

I know you have to be married within 90 days of the beneficiary's arrival in the US.  I don't know whether that means you have to be legally married in the state where you live.  I would think you can find free legal aid from any number of organizations but given the newness of it all if this isn't covered by regulation or statute (or precedent, which is unlikely) your best bet is to file and see what they say.

The info we've received so far is that we can live in any State we choose (although doing so in one with same sex marriage will be much easier for benefits), and same sex couples just need to do the actual marriage in one of the States that have it.  It will create an interesting legal conundrum when it comes to State income tax and other things!

 

Immigration Equality is a helpful website for any same sex couples who need some info or a referral.

Hi - we are in the same situation, although both of us currently live in Australia.  I am the USC and here on a 457 work visa, and my fiance is Malaysian-born but now on a NZ passport.

 

It'll be interesting to see how things are handled at the Consulate in Sydney, but the Ozzies are known for being quite friendly and laid-back (unless you're talking sports, haha!).

 

Thanks to this website, we've done quite a bit of researching and preparation, so are almost ready to send in our 30mm high stack of papers for the I-129f.

Hi, we are in a similar situation as we're both living and working in Oz - basically from what I've read on this site is that the Consulates in NZ and Australia are pretty understanding.

 

If your USC fiance has a US driver's license that is still valid, plus some sort of US address to use as an initial base (a relative or a good friend), that is helpful.

 

Ideally your USC fiance would have some sort of job offer, otherwise the self-employed typically show 3 last tax returns.  Alternately if he has enough assets, that also can work.

 

In our situation, I still have an AZ driver's license and am using my nephew's address in AZ (with his permission, haha), plus I still have bank accounts in the US that go to his address.  Anything like that helps as well.

Question. What are you doing for the medical section on the DSL-1076 form? It says to tick to show you've included the originals but the doctors in Sydney send the results straight to the embassy. That part confuses me a little bit.

 

Since you're doing the medical in Sydney, I'm not sure - either write that on the checklist or maybe include in a cover letter, as they'll know about that.  We're in Victoria so the doctor in Melbourne will either mail or let us pick up the packet from his office, and we can send that in with everything else.  I think I read on here that you can arrange interview on a Tuesday morning and go do the medical that afternoon?  If that is the case, then they'd wait a week to get your results and issue the visa then.

Haha I'm waiting for mine to arrive in Singapore so I know just how you feel! DHL says my file is at the Hong Kong processing base now...fingers crossed it arrives in a day or so.

  

We seem to be on the exact same dates for NVC receiving and sending out our packets!  DHL says ours landed in Sydney and was released by Customs today, so we are hoping it gets delivered Friday or Monday.  Then it's on to the medical exam on the 30th and hoping to send Packet 3 in by 8 November!

 

I hope things go quickly for you too - are you all ready with your Packet 3 paperwork?

I've just gotten off the phone with one of consular officers and he's not positive that I could use the ESTA if I were already issued the K1 in my passport. However, he did say that they would be able to delay the interview until February as long as the consulate receives a notarized affidavit from both of us stating that we still intend to marry. It's either this, or just wing it- enter the US on the K1, marry in a few days, file the AOS/EAD/AP and hope it arrives before Feb. I honestly don't feel too good about postponing my interview date since you can only do it once.

 

The CO on the phone says that the visa is issued within 5 business days. We were thinking of me flying out in mid-November, though I'd like to push it sooner to early Nov since even a few days make a difference for the AP. I personally would like more time to plan the marriage ceremony and to combat jet lag.

Hi again everyone,

 

My fiancé says if he has to come back to Singapore alone, then he would only stay here for two weeks. And we both want to celebrate Thanksgiving in the US with his family (Nov 28 if I'm not wrong), so I don't think I would be able to stay put in Singapore for a few months. If not for the fact that we are able to travel and spend time together for months at a stretch, we wouldn't be where we are :(

 

Now I'm actually wondering another option- delaying my interview altogether until February. We actually received the NOA2 way back in May/June but Packet 3 arrived on the very day I left Singapore to the US (timing is everything!). So I wasn't able to pay the fee in Singapore and get a much earlier interview date.

 

Has anyone had any experience in delaying the K1 interview further so that you can still come in on the ESTA? (seems more straightforward since there isn't a risk of a K1 entry- I would never want to find myself out of status!)

Hi everyone,

 

My fiancé and I have been dividing our time between Singapore (business trips for him, college for me) and the US (where he lives and where I visit in between semesters). This year, I graduated in June and we spent the summer together in the US. Now that we are both back in Singapore, I sent off the required materials last week, and received my appointment letter a few days later- Oct 23 for my K1 visa interview. My fiancé leaves Singapore on Oct 31, and is looking to come back in early Feb 2014 for an important conference. My issue is that I might not be able to join him in Singapore if my AP doesn't come through before then (considering that we're looking at early Nov for me to get the K1 in hand). 

 

I still have a valid ESTA and think it may be a better option for me to not use the K1 yet so I could still leave with my fiancé in early Feb. He is planning to return from Singapore to the US in late March. As such, I would then likely use my K1 to enter the US in late March as well, although I'm not sure what other implications would entail (expired medical etc.). I would really appreciate some good advice on this matter. If anyone has faced similar issues, please share as well! :)

To add to the other comments, I would suggest being very detailed in your answer to Question 34.a. in the I-129F form. You'd have to state the dates you first met (if not roughly), how you met (in class, on campus etc.), how often you saw each other or if you have been living together, the places you've visited together and how you have been keeping in touch. If the both of you have taken classes together, get at least, unofficial copies of your individual transcripts to show that.

Yup! Just contact NVC as soon as possible. I think that's what my fiance did when he moved to another place. Don't worry! Most of the important documents will be sent to the petitioner (you). The only one I got was a letter from the consulate here telling me that they have received our case and that we can schedule our interview.

I'm just sitting here wondering, while pulling out the last hairs on my already old and balding head. What are the chances me (Petitioner) and my Fiancee Gina can get "head of the line privileges" due to our ages and "impeccable" backgrounds (ha-ha-ha)?? We are both soon to be "senior citizens" in our 50's, and thus "time running out on us" in life, unlike you young 20 year old petitioners. biggrin.png I turned 54 and Gina will enter her 5th decade of living next month in June (sorry Honey for revealing your age!). I am a retired police officer, US Navy veteran, never been married before, no criminal record, no financial/credit problems, no children problems , squeaky clean (and pure as the driven snow!)....ha-ha! Gina also "clean" - no criminal records, no credit/financial problems, good work history, widowed, and wants to marry this old 'lifelong bachelor." Why cant we move to the head of the line for processing from CSC on our petition request?? I need some information.

I am hoping to start getting the I-129F form together this week.

I am presently in Laos and will not be back to the USA until September.

I was hoping to send the application this week but wonder about how I will be notified that it was accepted.

Is it possible to request all notifications be done by email?

The main issue I have is that here in Laos they do not have mail service with home delivery.  So I would not be able to receive anything here.

There is no one at my USA address at the present and will not until September.

I  really don't have another address to use in the States either..

Anyone have a tip what to do?

The secret would be to do it all by email.  is it possible?

My question regards my ability to be a sponsor.  I think I do but I did wanted to throw it off the forum and see if they agree.

 

I have not really lived in the USA for a long time but do own a co-op which is worth  about 20,000 there.

I also have a pension which totals 9,192 a year.

My cash assets total $59,918.

 

I haven't filed a tax form in over three years because my income wasn't enough.

So, with this amount would I be able to sponsor my  partner?

I ask because Laos does not have home mail delivery.

I received this from the USA embassy in Laos on July 15th.

 

We are aware of the Supreme Court ruling and are working closely with other agencies to determine next steps. As of yet, we have not received any guidance so we are currently not accepting applications for same-sex couples.  We understand how important this decision is for many LGBT families and will post updated guidance soon. 

 

I haven't heard anything recently so I am not aware if they have started processing petitions or not.

I suspect with the delays in processing filing now would be a good idea anyway.

I am a little confused.  

I will be doing an affiliated of support(I-134 for my fiance and will be using both assets and a pension I have.

My pension is around $9,000. a year.  I will have  a shortage of about 10 grand in regards to the poverty rate of 125%.

Do I need to have assets of 3 times or 5 times the shortage?  

I have done a search and it seems people are saying both.  Anyone know which is it?

I am presently in SE Asia and want to mail my initial paperwork.  I will be here until Sept 10th and presently having my mail forwarded to a friend's house until I get back to the USA.

Does anyone know if the envelope which contains the NOA1 will be forwarded to my friend's house or would it be returned to the government office?

There is a chance I will be back before the NOA1 is even sent out but I do want to get this process started as well as get as much of the paperwork done while I am in Laos.

I am not sure if this will help but I am having the same problem in Laos.  Laos doesn't have home delivery of mail and there are few addresses.

I contacted the Lao embassy by email and was informed that all contact here in Laos will be done via telephone and that my partner will be called into the USA embassy to pick up the paperwork.

I suggest you email the consulate in Guate City  to see how they are handling this.

Hello everyone! :D

I am new to this site, and i was just looking around trying to find out information. As i read this post, I was kind of relieved i am not the only who received a notice the alien registration number had changed! I send the I-129F on Jan 26th, they received it in Dallas on Jan 28th. I received the NOA1 feb 6th and when i went to check online, it said the case was in "initial review" but it also said that on the 4th of Feb, the alien registration number had changed. I got worried something was wrong. I called USCIS, and the first person i talked to, i couldnt even understand him. Pretty much, i got no answers! I called again later on today and spoke with a different lady and i didnt get a straight answer. She pretty much said something about I dont need a registration number for now, that number is assigned when my fiance receives his visa. And that i could just use the receipt number to check my case online or on the phone. So i am still confused. I read somewhere else on a post, it meant the case will be approved soon and to expect the NOA2 anytime. does anybody know about this, if this is true?? I wish that was true!!! but based on the processing time for the california processing center, they are working on cases from July 2012. -__-

What do you mean by you did not put your Fiance's address. You had to. In the I-129F there is a section where it clearly asks for your fiance address in Mexico. I assume this is the address CDJ uses to send Packet 3... It they send some sort of notification too both addresses that would be a relief.


Nope we didnt put his adress, its a small town in mexico, they dont have street names. We put the city where he was born, and where he has been living the past 5 years but no actual adress, we put my adress instead so that I can receive it. I went to an office that does all this immigration stuff, and thats what the lady told me to put.

Hi there, can I get confirmation from you fellow members as to where Packet 3 is sent to? I am under the impression it gets sent to the beneficiary in the foreign country where the Consulate has the paperwork. I called the consulate and they stated that the packet was sent on the 17th of June. I then asked to what address it was sent and the rep. told me it was sent to my address (petitioner) here in the states. He did sound like he was doubtful though... Now why would packet 3 be sent to me when my fiancee is the one that will be needing that?
 
Anyhow, for those that have received Packet 3 already, where was it sent? In my case it has been 2 weeks and have not received nothing at either address. :(

I was told my letter/packet 3 was sent to me on June 17th also!!! Until now i havent received anything :/ i think its supposed to go to the beneficiary. But we put on there just my adress so that I can receive everything here in the US.

They didnt care what amount of cash I had - they said if I did not get a job - they would mark me public charge and they were not lying. One month after the interview we received a paper from the embassy stating we were public charge. They did not remove this decision until after they received three months of paystubs . They would not consider my bank account , my student income, my home , or my child support !

wow!  That is ridiculous for a 3 month visa.  The fact that there's enough money to qualify for the 864 should be more than enough.  Thanks for the info.  I guess I'll get a job and forget about spending some time with my fiancé.
