Hello All,
I have a CrAzY...Question?? Has anyone tried cutting out the barcode off the actual AOS packet and pasting it onto the completed AOS form (printed from website) and mailing it back?? Is that a good idea??? I keep telling myself to be patient and understanding due to the sloooooowww process.. I have all my documents for the AOS packet but awaiting NOA2 results to mail everything out.... I'm going crazzzzzzzzzzy....waiting :whistle:

Hello All, I gathered all my AOS documents already.. Justing twinkling my fingers for the GREEN LIGHT for NOA2.. :whistle:

I went to the IRS Building (Jan. 2012) and I requested for my Federal Transcripts (past 2 yrs) I was so excited, ahead of the game and rounding up what i needed. I noticed they gave me W2's Transcripts when I heading out the door. The processing line was long and it was closing (security at door) so I couldn't go back into the building.. Bummer!! Does it matter if the IRS Transcripts are for Federal or W2s when sending out with AOS packet???

hi my friends , i am really pissed off and i need your help , my lowyer send me email and send they refuse my marriage contract and clerence police record and my birth certificate because they are not original , how that can be ? the original are in arabic launguage , the copie i send them translated by sworen translater and stpbed by the goverment , before i send them i want to the amrican embassy at tunis and they said they paper are ok and they will accept them there at the NVC

that's true... i sent in my originals arabic and translated marriage certificate, but made 2 copies of the front and back before i mailed my packet. you can always get another copy and you will get them all back. sorry to hear about your frustration.. I would be very upset if your lawyer didnt know #######..

My RFE was for Bona Fide Marital Relationship... I have pretty much everything covered.. My chats, e-mails before our marriage. Ongoing chats, e-mails, packages sent from my husband, and international unlimited textn mobile bill. Wedding Celebration cd, pictures, wedding announcement to family and friends, stamped passport pages, itinerary confirmation of my flights. My husband's sending me copies of letters i mailed to him, receipts from the wedding, my birthday gift and my anniversary gifts.

Please let me know, if I'm missing anything...

You have to get through CA USCIS before you can get to NVC. It is also not necessarily true that the NVC will be the office asking for ongoing relationship evidence. NVC is more responsible for financial verification, security checks, and scheduling the actual interview with the foreign embassy/consulate. In some cases, this information can be requested by USCIS or even by the consulate/embassy at the actual interview.

In any event, there is little that you can do until you find out exactly what the RFE was for. As the previous poster explained, you need to know what information they want from you. It is possible they are not interested in information to validate the relationship, but that the application was incomplete or incorrect.

The RFE that you received - was it in the mail or are you speaking of getting an email notification? Either call to ask them what it was or wait for their official letter stating what they need from you.

I would put all of your additional evidence that you've gathered since you sent your application in together in a 'packet'. It may come in handy to have your spouse take this to the interview, in the event the interviewer wants to see more evidence or the course of your relationship since filing the petition.

Submitted a written statement of how we met, 8 wedding pictures, Bona Fide Marriage stated on our Marriage Certificate/Translated and 2 Affidavits.. USCIS process sux!!! Reason I asked is cause I got back from Colombia and put together the package in one day, didn't really include many pics (just like 14 total, some before and after wedding, a couple from the wedding, our first FaceBook picture with tons of "likes" and comments, and 2 honeymoon pics. Most of the before and after pics are with my and her family. That along with 2 affidavits, one from my mom and another from my MIL.

Just hoping I don't get an RFE cause we use mainly FaceTime, textfree, Tango and iMessage which don't really have logs i can print. And it would really suck to add more time to the already expected delays coming up.

What is needed or likely to be asked for during the petition approval process, depends on the country and circumstances, but it is a best practice to at least address that last item on the list of "in addition to the required...". Usually, some photos together and passport stamps showing time spent together in person will be enough. From the more high fraud countries, extra evidence is s very good idea.

Very understandable. Thanks for the reply.. I guess I shouldn't beat myself up... I kept thinking maybe I should have included this or all those in the I-130 Packet.. It was driving me crazy. Thanks!

In my case, I originally sent them all the documents and pictures, but when they sent me RFE, they requested phone bills, photos b4 and after marriage, passport copies for both of us, affidavits from her and my relatives, letters and post cards, wedding ring reciepts, credit card charges and etc.....i sent them over 7 pounds of documents

Those are the exact same items my husband and i FedEx with our RFE.. :yes:

Primary evidence - Copy of marriage certificate
Secondary evidence - Bottom of the page to see the detailed list
g. Copy of divorce decree of petitioner and/or beneficiary, if applicable

Time from receiving RFE to NOA2 is not relevant. How long from when USCIS received your response to RFE to NOA2 is relevant.

Our case was one of the ones that was overlooked. All the petitioners that filed after us were getting Approved. A good handful of Petitioners that called USCIS due to over 6 months of unprocessed status were hit with RFE as well..

RFE sent out (split topic)

RFE sent out on August 14, 2012 and received on August 16, 2012.
Although we sent wedding pictures, photocopies of passport pages, affidavits by witnesses and friends who were present at the wedding, CSC-USCIS requires more proof of a bonafide marriage/relationship.
We are planning to send:
Chat logs
Emails
More photos
More affidavits
Passport page with entry / exit stamps
Phone call records
Copy of house lease agreement (if the landlord would agree to put my husband's name on it but he says SSN is required to do it so probably not).
Questions:
Any expert opinion on what else to send?
Do I need to send original RFE letter with the evidence or should I keep the original and send a copy of RFE letter with evidence?
Since I had filed two petitions (I-130 for CR-1 and I-129F for K3), I have received same RFE for both the petitions. Should I send same set of evidence x 2 separately for both petitions or would only one set of evidence be sufficient? (They are going to administratively close K3 anyway but still I would appreciate advice from some experienced person maybe Darnell, Saylin or Pushbrk?).
To which address should I send the evidence? To lockbox again where I sent the petitions or directly to California Service Center address?

See if you can add your spouse to the Electricity Bill, it'll have your Apartment Address with his name added. They didnt require SSN, make sure his name is visible on the Payment Notice when you receive mail. I wasnt able to add my husband to my Lease Agreement due to SSN too, but the Apartment Office/Manager is able to submit a written Letter for you to submit to USCIS. I submitted more wedding pix with family and friends.

I've received a reply from tycoon....This was too much of evidence.
I just submit marriage certificate, birth certificate and my wife passport copy.

DS3032 problem!!

Correct. As soon as you can check the box in the online payment portal, you can pay the fee. You do not need to wait for any invoice.

I have a question? I just got off the phone with NVC Rep... let her know my AOS is still showing as IN PROCESS and I paid Monday. She said it takes 3-5 business days and I can submit my AOS Packet today, attaching the Payment Receipt although its show IN PROCESS along with my Cover Sheet (which has generated).

Im a bit confused... Then my husband's been sending the DS 3032 as email template but has been receiving the auto-reply from NVC..

We both received (PAOSF I-130 FOR NEOPOST DS-1200) and (ACL FOR NEOPOST DS-1200) from NVC....stating "The immigrant visa petition recently filed on your behalf is now eligible for further processing at the National Visa Center (NVC)." which confirms his Mailing Address and DS 3032 form attached.

Expedite Approved

Hello All,
I have a few questions... Our case was Approved for Expedite. NVC confirmed our AOS I-864 Packet was good (2 thumbs up) last week after being reviewed. NVC had mailed our I-864 to Tunisia including our Expedite Paperwork. I called NVC today, to confirm they've received our IV Packet. Female Customer Service stated NVC will be mailing me back the IV Packet. Then it's my responsibility to mail it to my husband in Tunisia. I spoke to Male Customer Service, he advised they will mail my IV Packet to Tunisia.. Confused?? Will US Embassy be sending my husband the Interview Letter along with Packet 3 for medical exam?? Female CS advised, my husband will be taking his IV Packet to US Embassy during his Interview..

I'm so confused. Please help... :help:

My USC partner has still an oregon drivers license, im not sure if its still valid of expired well, It doesnt matter as long as he has DL, does it? and our problem is if its ok to use his parents house address ? and do we need a proof of his car in the US? he's car is with his parents though, do we need that? to prove to the consulate about it? and one more thing sir, if you dont mind it, , if we are going to send our application through one of the lockboxes address online by DHL or any courier?

Sure, you're welcome! It would be good for your partner to have a current USA DL, but I don't think it's absolutely necessary. They understand that some USCs stay overseas to be with their partners and need some time to relocate back home. It's more important to have some sort of place to live (yes, using the parents house is fine, they also understand people may need to stay with family for a while), as well as some sort of job lined up. Your partner will need to show enough income and recent income tax forms/transcripts to prove he has ability to support. Be sure to read through the K-1 guides on this website, just look for the "Guides" in the blue menu bar near the top of this page. As for car, again, it's not necessary, but if he can get a copy of the registration that is current and has his name, it certainly helps. He will need to submit paperwork with yours to the Consulate, again available on the guides here.

Finally, you can send the application (I assume you mean the original I-129f) to the lockbox any way you like!

Coz we have the same situation, My boyfriend and I have been together for 2 years now and we are working legally in the same country which is Thailand, Coz we want to stay together in one place and we dont wanna be separated anymore. So we decided to work in thailand and I have a philippine passport. I just want some help how to get started on K1 visa if its possible to send my USC boyfriend our K1 visa though we are in thailand? Hi - if you're asking whether it's possible for you and your partner to be in Thailand and apply for the K-1 visa, then yes! The USC can be either in the USA or overseas with their partner. If your partner is overseas, though, then he will need to submit some additional info later on to the Consulate, to satisfy them that he is setting up a home (what they call "domicile") in America. For example, I submitted an offer of employment from the USA, a lease agreement for a rental condo in the USA, as well as quotes from a relocation company to ship goods to the USA. It also helps if the USC has a US drivers license still.

getting very disappointed at the uscis. Received my NAO2 on 8/22/13 and still the NVC hasnt received my packet. They say it can take up to 8 weeks but according to VJ timelines vermont and texas are receiving theirs within 10-14 days. ugh come on California....mail my stuff to the NVC already!! Starting to wonder if they are slow becuase of the same sex filing or are they just that slow. I just want my case number so that my mind will be at ease that we as a community finally do get a chance to be with our loved ones on American soil.

Yeah, it was great to get a quick NOA2, but looks like now it's just backed up at the next step.

I've been reading on here that everyone is experiencing the delay, so I doubt it's specific to same sex couples. We are just a tiny part of millions of petitions in a very very busy system. :-)

Hi guys, I'm so happy and excited to hear about your status. I'm from Brazil and my partner from Utah, state that does not approve gay marriage. Do you think it will be a issue for us to get the K-1 visa? Have you guys hired an attorney or did by yourselves?
I have another doubt about this: Brazil approves gay marriage so I was thinking to get marriage here with him then he takes all the docs to prove our relationship and try to apply to CR1 visa. Do you think it is harder than K-1?

Hello, we decided to just research carefully and try it ourselves, and we don't have any complicating factors, so time will tell.

Just as Gegel mentioned, doesn't matter where you live for immigration purposes, just where you get married. We likely will be in AZ for at least a year, but will move if they shoot down marriage rights again next year.

Sometimes I wonder about the wisdom in returning to the US, when there is so much division and hatred. I'm the USC in our relationship, and have been with my fiance for just over 8 years now. We met online and I flew to Malaysia to meet him in 2005. I was living in NZ at the time, and he picked up and joined me soon. As NZ has been way more progressive in immigration law, I was able to sponsor him for a work visa, and then permanent residency there. We stayed long enough for him to become a NZ citizen, and he just recently made the decision to renounce his Malaysian citizenship, since they don't allow dual citizenship.

Currently we are living and working in Australia, but I'm on a temporary work visa, so we've both decided to go for it and have applied for the K-1 as well - our NOA1 is 7/11, so we're waiting like everyone else to see what happens - maybe even sometime in late October!

It will be interesting to share stories and see how things go - I suspect it will be business as usual, but sometimes I can't help but wonder, "what if we get an adjudicator at USCIS who's really opposed to same-sex couples? Will he/she slow things down or RFE us to death as a form of protest?" Only time will tell!

I have sent my NOIR response

I sent my response to the USCIS on Jan.27th I received an email stating that they received it yesterday and that I should hear something in 60 days. Does it really take that long? Or are they just giving themselves a timeframe? Has anybody ever went through a rebutal and actually knows? I sent all what I could find to prove a bonafide marriage. The letter also says that they know it can be difficult to prove relationships when the spouse lives overseas so i am hoping they will keep that in mind when making there decision. BUt the burden of proof is on me.

i know is not easy passing through this alone but be strong and do what they want you to do and leave the rest to God.what has you spouse done on this issue?hope he/she has been calling on your behalf to see the end of this case.But it's surprising to hear that even married once that filed for k3 visa are also denied.If not for the high fraud country that our dear country was classified with,getting a visa to reunite with your fiancee and your spouse shouldn't have been a nightmare to Nigerians.Other countries of the world are finding it easier when they filed but when it gets to Nigerians they even asked for requirements that are not needed all in the sake of acquiring the visa to join our loved one
