Hello,

It has taken 16days for the DS3032 and AOS Bill to be generated and sent via email !!!!!! (Doesn't seem that long but if you compare to others who have been through recenlty, its approximately 10days overdue.) It also took a phone call every day, twice a day to the NVC. Each time I got a different response from the operator.

But its here and we have already paid the AOS Bill - now just waiting for the Status to change to PAID!!!!

Yippee...it looks like it is finally moving along!!!!!

hi jamster0105. the vaccinations are required for the immigrant visa. for the nonimmigrant visa (k3) u don't have to take any vaccinations but u will have to when u get to the US. i have lots of pointers! but first off, do you have a passport already? if not, do u have two valid government issued photo IDS? if you do have 2 gov't IDs (these are ones that qualify: driver's license, voters registration ID, SSS ID, GSIS ID. postal ID and TIN ID are not accepted), then u can apply through an agency (i think the number is 713 000) and spare yourself of the headache of having to line up at the DFA at around 1 am (DFA only accepts 500 applicants a day. people line up as early as 11 pm). if you don't have at least two gov't issued IDs prepare the following: baptismal certificate (you can get that in the cuhrch where you were born), Nbi clearance, students permit to drive (u can get this in one day, no driving test required), certificate of attendance from the commission on filipino overseas for spouses of foreign nationals (this is required), transcript of records (college or high school) or high school/college year book.

if u have an email add, i can send u the outline i got (if u plan to pursue the IR1 visa) in order to reduce the processing time at NVC (which can take up to 3 months.. u can cut it down to 4 weeks).

Once you file the I-130 and I-129F, it helps to provide as many documents as possible. aside frmo correspondence, provide notarized affidavits from other people attesting to the authenticity of your relationship. =)

My husband is going to start this soon too so we decided that we will ask some questions from you just to clear up some confusions on our part here. I'm from the Phils and I don't have any recall of any vaccination taken, just wanna ask like how much is it for me to get those. Is there something I need to do before my physical examination? we understand how the IR 130 works but we're a bit confuse on what comes after that. Can you give us some pointers? Are you familiar with the I- 485 form? Is this we need to submit with the I-130 or this is done after I arrive in the US ...smile.gif hopefully.
Any advise from you, like the steps you went through from the start of your application will be greatly appreciated.

I don't know of any form to check on the first one. In about a week, you should know if they have accepted it or not.


Well, we are both new to this VJ site. We may have lot's of questions, since our situation is rather unique, so please bear with us! We are both living and working in Bangkok, although the spouse is from the Philippines. We came here so that we can have the chance to live together before this painful ordeal....We both decided we will file for the IR and K-3 at the end of august, as this will give us some time to get documents together and for us to get back to our home countries. So, here are some of our questions:

1) Does the US citizen need a police clearance from Bangkok? If so, would it be wise to get it from here, or to wait until we both get back to our countries? Or maybe a police clearance is not required from the US Citizen? Same question for the Filipina spouse? Will they want a police clearance after departing Thailand?

2) We worry about the AOS. The husband has not worked in the US since december and will have to immediately begin work upon arrival (won't be a problem). Will this delay things? Will the NVC make us get a co-sponser? These things are really bothering us and we hope someone can give us some answers in regards to the AOS and our situation. We obviously have not earned American income since at least december and we read that American $$$ must be the source of income on the AOS. We don't want to file DCF since we'd have to stay in Bangkok until at least december (our Immigrant visa's didn't "technically" begin until early june here in Bangkok). We just want to get the ball rolling ASAP. We hope someone can help us through the start of our journey. Thanks all! innocent.gif

I have one suggestion...hyphenate your surnames for sure.  I did not and I am *constantly* trying to explain that the "middle name" is not a middle name but is the first name of my surname.  No one seems to know how to file it or which to look me up under and 50% of the time it is wrong.  Legal papers inevitably have to be done again for the same reason...constant confusion.  My maiden name doesn't even sound like it could be a middle name.  Go figure.

Otherwise I'm with hikergirl.  It was easy changing the name starting with a new passport when I visited back in Canada after marriage with new identification etc from USA.

I only had to update my tetanus and my records were old Canadian ones too...some of the vaccinations are just not age appropriate for us.  While they may list them on the form, they don't say they are all necessary.

Like a lot of snowbirds I had a second home in the warm south and commuted back and forth so often that I didn't have any idea of all the dates, other than the fact I knew it was never over a few months total a year.  It wasn't an issue and wasn't even asked about at the interview.

My wife finally received her international passport today from Ukraine. We have been waiting for 7 months for it. I have a few questions. 1.I have all the documents signed by her and for my stepdaughter and ready to send to the NVS. But since I have collected and translated marriage certificate, birth certificate, photos for visa, I have had to return my daughters original birth certificate to her. So now i just have a notarized copy of it that was done in America by a notary. It says in the instructions to send original and copy of it to the NVS. My question is can we just bring the original to the interview at the US Embassy in Kiev? I would send in the copy of I to NVS. 2. Can i send in copies of the police certificates to the NVS and bring the originals to the Embassy at the time of interview? 3. If i need to get the originals to send to the NVS does anyone know of a good way to send them from Ukraine to USA? 4. The DS-230 was signed by her on April 30th of 2009 will this be a problem when submitting it to the NVS? Thanks in advance for all your help and suggestions.

Wow. I just got the news today (on a Sunday) that our I-130 for my spouse was approved. I can't believe it. No RFE or nothing. I'm speechless. I'm so excited and as everyone else says, thank you VJ. I do have one question however. I filed a 129-F for the K3 as well, but they were both marked as being approved. This just means that the K3 will basically be canceled and I will have to move ahead with the IR-1, correct? Yeah, my baby's comin' home.

I thought I have to state my adjusted gross income (line 37 not the total income on line 22). Am I right? (It's a big different between these two. My total income is about $30K, but my adjusted gross income is $22K. I'm sort of $1K for 125% poverty (family of 3)). NVC will look at the total income or the adjusted gross income? I'm confusing. :)

Look on the instructions. It says if you filed a 1040EZ, they look at ADJUSTED gross income. If you file any other type of 1040, they look at TOTAL income.

On part 3, it asks you to list dependents who you are sponsoring. But my question is since he is a US citizen, I would not list him actually on this form. I would just put a 1 in PART 5 where it asks for number of dependents. Is this right? Thank you guys!

re: POE - look - the VISA has the city printed in it, at the bottom - so IF she updates the address at the INTERVIEW, the visa will be printed (later) with the city in it.

anywhere/anywhen - someone asks for current address - she gives it to them, noting the prior address in the paperwork.

my apologies if i seem snarky or mean, but since you've already got 'interview date set' - yer options are fairly limited.

The do-all, be-all, 'we won the game' is when the green card shows up at YOUR CURRENT ADDRESS, right? Only SHE can make that happen, at Visa Interview with Visa , and POE with CBP officer.

Thank you once again so much. And it didn't even cross my mind that you were being snarky or mean at all. I super appreciate it. I really appreciate the fast responses guys. I have one more question. The problem is that I just started medical school and I will not be able to attend the interview (as I originally planned) as the schedule is so rigorous, and I have a scheduled anatomy exam that day. So, I'm worried because when they ask her where I live, her answer will not match the paperwork on any of the forms. However, my plan is to go down there to bring her back because she would have no idea how to navigate through an airport, let alone find a connection. So, will they ask us at the border why our final destination is not my old state where I used to live? Which brings me to one more question, should she just say my old city in which I live (if they ask her where I live, which I can almost guarantee they will) to avoid any problems. I just hate lying though. It always comes back to bite ya. This should hopefully answer all my questions.

OK, I found the site https://egov.uscis.g...i/go?action=coa that allows you to change your address, but I am confused because I'm not exactly sure if my case is still 'pending' with the USCIS. It was obviously already approved with them and went through the whole NVC process, but now is sitting at the embassy. When I go through the steps, and try clicking "no" to not having a pending application, it basically says that it is for someone who has previously submitted the I-864 for someone who has become a legal permanent resident and immigrated, which she has not done yet. When I click on "yes" I have a pending application, I don't think it applies to me either because I don't any longer have any pending petitions with them. I'm confused. I hope someone helps with this.

There may be someone more qualified to answer this than me, but here is what I think she will need to do.  From the IRS standpoint she needs to ammend her 2012 return and file as married filing jointly or more than likely she will want to file married, filing separately as her husband is not living here.  It is not a big deal.  If she has anyone do her taxes she can just have them ammed the 2012 return when she files her 2013 return.  I don't think this will really affect her I-130, but from a tax standpoint, the sooner she fixes the better.  She shouldn't have any trouble with the I130 as long as she has proof of the marriage regardless of what the taxes say.

I am still pretty new to this process so I'm hoping someone with more experience will also write you.  But from my understanding it is not really good to travel after you have interviewed as it could prolong your AP.  If your residence is in Denmark that is really where you should interview.  If you interview in Pakistan then go to Denmark and your AP goes longer than a year you will need to re-do your medical in Pakistan.  I am guessing you will also need to get a new police report from Denmark as you had traveled there after AP starts.

If you're going to be living in Denmark I would try to interview there if possible.  I have heard the AP process can really drag out if you leave the country after the interview.  I believe you would need to submit the transfer request with Denmark and then if they agree to take the case they will request everything from Islamabad.  We just got our case transferred from UK to Islamabad.  It look a few months without knowing if it was going to go through, but eventually did.  We never heard anything from either party until one day CEAC finally updated our case status online to the same case number we had always had, but now with ISL at the end.

 

***I'm not sure if the Pakistani is male or female.  If you're a woman then you may just want to interview in Pakistan and stay there until you are approved since AP doesn't usually take that long for women.  If you are male I would at least consider what I wrote above. :)

I would just send in what they are requesting.  Whether they request a copy of 2013 taxes for the interview I would bring a copy along anyways or if you file a tax extension bring a copy of that.  It'll save you having to mail it in after the interview and prolonging the process and at worst they won't ask for it and you brought it along for no reason.

He can go anytime as long as he has the appointment letter from the Embassy.  I believe the exam is only good for a year and since he will probably be in AP for a decent amount of time he will want to go close to the interview time as possible, but leave enough time in case they need to do extra testing.  We just got our appointment letter this past weekend to interview in 2 weeks so I'm hoping that's enough time to get the medical done.

I agree with mpwhitebird.  They can ask you anything.  My fiance and I went over all the questions we saw asked on visa journey, but in the end the officer only asked a few general questions like how we met, but then literally grilled my fiance about my religion and a name change I had when I was a teenager which he was not prepared for.  My fiance answered all the questions honestly, had good eye contact with the officer, and when he didn't know an answer he just said 'I don't know'.   In the end my fiance had his visa issued only 3 days after the interview.  Quite honestly I kind of feel like preparing for the interview is not that good of a thing.  It's better to go in, be natural, answer the questions as shortly and accurately as possible and be willing to say "I don't know" if you don't know the answer.  Good luck!

My fiance is from Pakistan, another high fraud country.  We are 17 years apart in age.  He had his interview less than a month ago and had his visa issued 3 days later.  He was never asked about our age difference.  Age should not matter if your relationship is real and you are truthful at the interview about everything.  Of course nothing in this process is for certain, just wanted to let you know there are others out here with large age gaps that are getting approved....even in high fraud countries.  Good luck!

This link will show you all the approved locations in Pakistan.  One piece of advice is to make sure you either have all your immunizations before you go to the appointment or make sure the location has all the immunizations you need.  My husband went to Wilcare in Lahore and they were missing 2 of the shots he needed and it ended up being a big hassle.  Good luck with your journey!

My husband and I had questions about that also when we did the I-130 petition, so I emailed the embassy and they told me the shenasnemah is needed in place of the birth certificate. From my understand, copies of your birth certificate are hard to get in Iran. But when in doubt email the US embassy, at first they will probably just send you the same information about the shenasnemah the trailmix posted (that's exactly what they sent me), but you can ask them specifically what they will accept and let them know what you have. Hope this help :)

My husband and I had the interview this past Friday at the embassy in Seoul. At first my husband went up and answered all of his questions with no problem than they called me over and started asking me questions. The one that puzzled me is when they started asking why I was in Cyprus (I went to study at a college), they seemed a little too interested in this. They asked how long, what did I study, what medium. Then told me that they needed a paper saying I will have a job lined up when I return to the US (I'm currently working in Seoul). They even said it is to make sure I won't stay in Korea, go to Australia or Cyprus...sort of half joking. But I took it as, are they thinking our marriage is a fraud? ( which is pretty much their job)

Also, can we still be denied at this point? I'm pretty sure it is possible, but I just want to hear others opinions.

I was also told that I could only have one joint sponsor. I was confused by this because I knew that I would not meet the requirements because my current income is in Korea not the US. So were they wrong in telling me I could only have one joint sponsor? The woman told me this before even looking at my paperwork and the interviewer seemed a bit confused when I told him that I was only allowed one joint sponsor.

They also told us that he would be put on AP, he is from Iran. I know it's a long shot but can I ask for a possible expedite? because we cannot afford to live in two separate countries ( I have to leave Korea in October). I could renew my contract(only 1 year renewals) with my school but I would lose money if I cancel early and we are trying to save as much as we can.

The interview went over well, but I still have my doubts because we have been together for a short time (8 months). I know how skeptical immigration can be. The guy who interviewed us seemed nice and I didn't feel like he was trying to trap us with questions. But I'm not sure why my traveling prior to my marriage would have anything to do with my husband. Has anyone else had this happen?

Or am I over thinking the whole thing? Also has anyone else had experiences with going through the embassy in Seoul, ROK?

Thank you! I have read this thread numerous times and waver between feeling relieved and then fearful again when someone posts something negative (for example the post about Nigeria having policies against visiting during the process). When I saw that, also coming from Africa, I was nervous again.

 

However, I must say that we actually did apply for a B2 visitor's visa about 2 weeks prior to sending in the I-130 - we timed it this way on purpose to ensure a visitor's visa and he did get one, it is in his passport right now. The CO interviewing him did ask if he intended on ever immigrating to the states, to which my husband replied no (despite my telling him to say "possibly in the future") but that can be argued that we changed our minds after the fact, correct? Or will this "misinformation" ever be held against him? Do you know? I am nervous about that. Do they keep visitor visa interview records? Regardless, Namibia will not be the one processing our immigrant visa since there is no USCIS presence here.

 

However, with a B2 visa in hand as well as strong ties to Namibia, on top of the fact that I also reside here with him and will supply him with a letter from my employer as well stating my leave dates as well as our lease agreement and bank statements, on top of the fact that it is the holidays, I am confident that he will be allowed entry but will let everyone know once we know for certain December 14.

Hi AmandaLane102, I have a South African passport although I am being processes from New Zealand, so don't know how similar a situation that makes it haha. But I got through fine in September past and am at the NVC stage. I took proof of employment etc but they never asked for it. I already had a visiter visa though long before even thinking of immigration and had been before. So hopefully all good and you guys sound very prepared.

I thought I would share my experiences so far and write about my upcoming travel plans.

 

First off - I have a South African passport but am a New Zealand resident.

 

I met my USC partner back in 2011 in NZ. We decided to go to the US in 2013 so I was able to apply and get my US tourist visa end 2012. As we had no intent back then to immigrate, purely a holiday to the US as I had never been, had no problems at POE in LAX.

 

Long story short, I loved my trip to the US and my partner had been wanting to return for the longest time. So we got married in 2013 after DOMA was repealed and initiated the green card process expecting 5 months as we had no idea back then about how long it would take. Eventually got NOA1 then NOA2 in end May 2014. We thought we were close to getting it now as we were at NVC stage, so he left to return to the US in June'14 to reestablish domicile and get a job. WRONG again on processing time, lol!

 

So in August'14 we decided for me to do a last minute trip to visit him as our 1 year anniversary was coming up.

 

I was nervous as we were in the NVC stage, AOS fee paid and waiting for IV fee to be billed. I did as recommended on all that I had read on VJ- got a letter from work stating I only had specified leave and was expected back, printed proof of funds. Printed NOA2 letter. Well after 12 hour flight (LAX POE) I was tired, had to wait more than an hour to get to the front of the queue and my nerves were acting up. Well to my relief was the easiest ever - customs official asked:

- Intention (A: vacation and visit family)

- How long (A: just under three weeks, said return date)

- When last was I in the USA (A: feb 2013)

 

When I was having my photo taken or face scanned whatever, the officer told me to relax and not be so nervous!

 

That was it. I can't remember if he asked to see my return ticket or if I volunteered but the rest of the documents were definitely not looked at.

 

Plus adding to my stress was that I had paid for an extra bag inbound but not outbound and I brought all my original docs for the IV stage - I would have had a hard time if I had of gone to stage 2 interview I think. We also went on a cruise for our anniversary as we did not honeymoon and I had no problems reentering the US in Miami.

 

But I am now worried again as last week we decided that the distance thing is not working at all for us, especially with no firm end date in sight to work towards and so we are in the beginning stages of me planning another trip - this time to wait it out there with him till interview time. So I will need to quit my job and I already don't rent with a lease agreement. I will have a return flexi-fare though. The only real ties I will have is that I have paid all the fees to immigrate legally and definitely intend to go back to NZ to complete the process and have the interview.

 

I think that only factor we are now weighing up is that are we fully prepared to lose the expensive airfare if I am turned back. I know that we are close to the end but as a couple we used to spend 99% of our non-work time together so it feels worth the risk as we could be apart for at least till sometime in December earliest. I don't want to miss thanksgiving, his birthday and potentially Christmas and new year. Sigh. I at least have a place to stay if I am turned around. And by what I have read here it seems the odds are more in favour of getting through than being turned back (held to the whims of a custom official's mood!!)

 

I still have some time to think about this before making a decision! Like I say, we are well aware of the risks but just wanted to share our story.

Hello,

    I have just moved back from France in order to re-estabilish domicile and have a U.S. based job to establish income and

domicile as a sponsor for my French family. I am renting an apartment now, and have just started a new job. It pays very well (>100k/yr).

I am a natural born US citizen, and my question is this:

 

    How long do I need to be working at my new job in order to satisfy the I-864 employment/income requirements?

I have filed my last three years' US Tax returns, and a letter from my employer verifying my salary, and a recent pay stub. In verifying employment, I would like clarification on a few points: 1. You've found a really great resource in this site, but this is very much a Do It Yourself oriented place, and even if someone were to have the answers to your questions (like "what do I need to bring with me to marry in Morocco?") you should verify them on a reliable source. Perhaps there is a government site from Morocco which can help, or your fiance over there can inquire at the local registry office? I think you'll also find the Middle East and North Africa forum a great asset.
