You wouldn't be the first couple to specify a consulate in a different country than the country of citizenship of the beneficiary.

On the petition, there should be a spot to specify which consulate you want them to send the petition to when they are through with it (Like question 22 on the I-130). If your wife has an unexpired visa which you think will allow her to stay in Canada legally until the CR1 is through, then you can choose a Canadian consulate.

There are others who have done similar, user MARM comes to mind, her fiance is Pakistani, but a student in the UK, so they are going through London. That's for K1 though. You should double check to make sure it works for CR1 as well.

K3 is a NON-immigrant visa with a path to AOS for people married to US citizens. Upon entry, you will still have to file for AOS. Currently, there are no advantages to the K3, but it was created to decrease the time spent apart when it took a long time for CR-1/IR-1 visas to be processed, and is now obsolete (or so I read).

IR-1 visas are "Immediate Relative" visas, available for couples who have been married for more than 2 years. If you have not been married for at least 2 years, you can get a CR-1 "Conditional Resident" visa, which is the same, except you have to file to remove conditions when you have been married for 2 years. The advantages over a K3 visa are that you do not have to adjust status, you enter the country as a US resident and do not have to apply to adjust status.

Well you have 2 choices, go ahead and send them a complete (4) pages of the G-325A form for petitioner and beneficiary with copy of NOA 1 and explanation letter. or wait to see if you get a RFE. I did something simular, I did not enclose my Registured copy of marriage license, when I found this out, I sent them my registured copy of marriage cert . with NOA 1 and explanation letter, and I did not get RFE on this, but on another matter. I THINK they matched it up to my petition, and why my RFE did not pertain to my mistake at time of originally sending them my petition.
Its worth a shot, all you lose is the price of postage, and may save you a RFE. Calling them will not help.

Is your #1 priority to return to your SO as soon as possible, or to begin working in the States as soon as possible? It's hard to tell from your post.

Do NOT go for the K3 visa, it's pretty much obsolete.

If your #1 priority is to be back in the US and with your SO as soon as possible, and you can afford the significantly higher fees, and to have one of you out of work for months, do K1.

If your #1 priority is to start working in the US as soon as possible, and you are worried about your financial needs, and can't afford to be out of work, marry and apply for CR-1.

At this time, on average, the K1 will get you here faster by about a month and a half, but then it could be up to 3 months before you can start working (assuming little to no time spent getting married and filing AOS). With CR-1 you get a green card right away, and can then start working.


Also, the K1 is significantly more expensive. Compare the costs (visa AND AOS) as an input to your decision.

If you're living in Gibraltar why not do DCF from Spain? You don't have to go through the embassy of anyone's home country. The embassy in the country where you have residence should work. I'm basing this on a couple of K1s I know who are Indian and Pakistani citizens in the UK and go through the London Embassy (because that's the country they reside in).

I'm not sure what the rules are about residency - if it's that you must be eligible for residency longer than 6 months or actually have been residing there for 6 months. The DCF forum might be more appropriate for that sort of question.

1. Yes, you can order them now. Unless you are going to file an amended return, they will not change.

2. Transcripts are free, so why not get all three years and send them along? Unless you feel as though they will be detrimental to your case - ie: you were a student in 2008, and had zero income, but you became full time employed and more than meet the requirements in 2009.

3. In your case, yes, past years are helpful, as they show historical earning power. Add to that proof of current income exceeding that in 2009 with some pay stubs and an employer letter. Do the math for them (ie: $2k every 2 weeks = $2k*26 = $52,000/year) Put a cover letter on there to explain the circumstances to be safe.

Your mother fills out an 864A. You fill out the 864 (regardless of income - even $0/year).

Follow the instructions on your 864, it will tell you where to add her numbers and how to do all the math to come up with the final household size and household income.


Ownership of the house does not factor into the 864/864A issue, only when income is insufficient and assets (such as a house worth more than the mortgage against it) come into play.

Some states will issue licenses good for 1 year based on the pending AOS. You don't mention the state, and since the states make their requirements for DL issuance, this is crucial to answering the question specifically.

I think it would be worth poking around the DMV (or MVD) website for their state and seeing what comes up. They may have to do a little (or a lot) of digging to try to find the information they need. I did it once for Texas, it was about 4 or 5 different links buried from the front page. They COULD call or go and stand in front of a person, but they may get conflicting information. But if they showed up with a print out of the regulations, that may be helpful.

While they are looking around on that website, they should also keep eyes open for how long the foreigner can drive on their license from home. In some states it's up to a year, so maybe that will work?

Jim, Now that your petition is approved, you'll have to go through some more processing. Very soon the ball will be back in your court on this immigration journey you are taking. If you are interested in speed towards the end of the process, the very best thing you can do is to educate yourself about the next steps of the process in order to most speedily go through the remaining steps towards visa issuance and moving to the US.


If you don't take the time now to get prepared, you could be responsible for many delays.

Have you checked out the guide for the IR-1/CR-1 visa? You can read up about it here. I think (not as familiar with this process) that you are getting into the NVC phase, and soon you'll be needing to submit more forms and documentation, which you could start filling out and gathering now.

It looks to me that the DR on average takes a bit over 6 months to get to interview on immigrant visas like the one for which you have petitioned for your wife to be able to apply. Remember that this is an average number, and if you are diligent and on the ball, you can make it so that you minimize that processing time by responding speedily and correctly to any requests from NVC/consulate. I wish you all the best, but I think it would be better to adjust expectations and hope for their arrival around Christmas rather than August to avoid disappointment.

It feels bad now, but it is not a trauma which will affect the rest of your life. It is merely a passing phase. I totally get where you are coming from regarding being apart for so long just after you get married. We didn't want that either, so that's why we went with the K-1. But, you cannot enter the US on a non-immigrant or tourist visa (except a K visa) with the intent to stay and adjust status without committing visa fraud and misrepresenting yourself. These are serious charges, and since you are planning for this wedding, and I'm sure you'll be bringing quite a few belongings with you too, it's quite obvious what your intent was.

Why not get the fiancee visa (K-1)? We had a perfectly wonderful wedding with all the vendors and flowers and all the family and friends we wanted there. Having the K-1 visa doesn't preclude you from doing just that. Once the visa is issued, you have 6 months before you must enter the US using that visa, and then once you enter, 90 days to marry, so that's roughly 9 months at the maximum between having the visa and needing to be married, so it's more than enough time to plan and sort out a beautiful event.

London accepts cosponsors. If your parents are willing and qualify, you don't need to have a job at all. You can have zero income and the cosponsor can carry all of it (you would still need to file as primary sponsor despite no income). Just some observations about the CR-1/K1 process.
The visa process can be seen as sort of a trial by fire.

Consider this.
If you are impatient… you should reconsider.
If you are easily upset or angered… you should reconsider.
If you have money problems… you should reconsider.
If you have difficulties understanding legal documents… you should reconsider.

Be aware of this.
Expect the process to take a long time.
Expect to be tested mentally and emotionally.
Expect to pay repeated fees, travel expenses, as well as being able to support both yourself and the beneficiary for a long time even after they are here.
Expect to be judged and scrutinized based on how you look on paper and in person.

The view of USCIS and the embassy.
You are guilty of visa fraud. You must now PROVE that you are not guilty and your relationship is real. If it’s real then you will wait as long as USCIS deems reasonable.
You are guilty, belligerence or arrogance will not be tolerated, and your feelings are a moot subject and do not matter.
You are responsible for ALL financial matters related to yourself and your beneficiary from now until the end of time. Your ability to support your family WITHOUT the assistance of the beneficiary MUST be proven. You will not be allowed create a potential burden for taxpayers by bringing a person into the county.
Your age even at 18 will be viewed with suspicion. Your financial ability will be viewed with suspicion. The validity of your relationship will be viewed with suspicion. Your maturity will be viewed with suspicion.

After all that… The entire process can come down to the OPINION of one person, who you may or may not be allowed to speak with for only a few minutes. Without the time or ability to plead your case.
This is not a light decision. It will affect the rest of your life. It is expensive, time consuming, and painful. It is intended to be difficult. We choose this path because we have no other choice. We choose this trial of fire rather than losing a part of our soul. Even a man who displays absolute bravado will quietly admit that asking him to live without his wife/spouse/fiancée/asawa is like asking him to live without air.

these visas are almost obsolete and many instances of delays actually being caused by pursuing them

I also have read that you do not really need to use the I-129F. Anyone have gone through this please help.

Hello. I am posting my first question on VJ today.

 

I am married to USC.  After marriage, I left US for 3 weeks to visit my family and friends, then when I tried to go back to US, I was refused to enter.

(Lack of knowledge, I wish I knew and read VJ back then!)

I was told to come back with immigrant visa, so we started the process for CR-1.

 

My passport got a stamp and it says : REFUSED IN ACCORDANCE WITH INA SEC 217

?

Below it says : 212(a)(7)(A)(i)(I)

 

Now I am worried if refusal at entry would have any impact on petitioned CR-1.

I was reading some article and it says I also need to file a waiver (I-121).

 

"An alien who is inadmissible under section 212(a)(9)(A) or © of the Immigration and Nationality Act (INA) files Form I-212 to obtain "consent to reapply for admission" that is required before the alien can lawfully return to the United States. "Consent to reapply" is also called "permission to reapply."

Sorry to hear you got checklisted. Yes, it's basically mean "start over." They'll gonna say wait another 20 business days before it get reviewed again. But with the new forms, NVC is kinda quick in reviewing them. I got checklisted 2x on my AOS. My bad! You need to wait for their email. You need to redo your 9-page AOS. Don't leave any blanks this time. You won't get a copy of your original AOS. Did you not save a soft copy of it? Regarding Part 6 13 a.1 double check coz what they want is the adjusted gross income and not the total annual income. I hope you get the checklist email asap. Good luck.

I got checklisted yesterday via email from NVC about my 864ez. I am confused on what to put on Part 5, no. 19 on most recent income tax return. Am I supposed to use the Line 37 on 1040(Adjusted Gross Income) or Line 22 as total income. I am so worried, cuz I just sent out the new form today and realized that some people said to use Line 22.

 

Which one is correct?

I'm getting pretty fed up with this whole process, and was wondering if anyone had an idea what USCIS's reaction would be if my USC husband and I got divorced (we're both currently living abroad) and then got (re-)engaged and filed an I129F for me, seeing as those are being processed much faster. Obviously it'd be money down the drain for the I130 we currently have in the system, but I kinda like the idea of beating them at their own game...

 

Why dont you just filed 129 while waiting for 130? You dont have to pay extra for 129, it ill just expedite your 130. Try that no harm in trying!

IR-1 / CR-1 Spouse Visa Process & Procedureswill foodstamps can affect on the petition process?

I filed form I-130 last month for my husband and stepdaughter in the philippines and im currently receiving Medi-Cal and foodstamp, will it affect the process because im receiving all these?

And to other people going through the interview stage. USEM is NOT requiring doc verification anymore. They told my wife to stop buy and pick up a refund.

If you don't mind me asking, how did you go about getting the pregnancy waiver? My wife is pregnant as well and we might be cutting it close when the time finally does come for her peition to get approved. Also, did you say no more delbros verification? Any help on the USEM would be great!

The average I-130 approval time fro CSC is around 4 months but lately lot of VJ filers got approved within 2 months. That's a good news.
Hope everyone gets approved soon.

I dont wanna jinx it but I have been noticing the approval of people closely and I have seen people getting approved who applied around early July and on Aug 13th there was one approval of someone who sent I130 on July 18th!!!

Although recently USCIS have routed some petitions from VSC to CSC at the beginning of August and I dont know how much would that affect for CSC filers now. I just cant wait to get approved.

I had some comfussion on this part here. I filed my taxes for 2008 through H & R block online and it WOULD NOT let me file as married without a SS number for my wife. I went ahead and read the footnotes and it told me I would have to file single since she does not have an SS number. I hope this will not cause for any delays when I submite the I-864 AOS form.

Others on here say I don't have to submit my 2008 taxes if I am sending in my AOS before April (I can submit 2007)......I am a little confused here...I hope someone can give me insight so that I do not have any delays....thank you blink.gif unsure.gif

It has taken 16days for the DS3032 and AOS Bill to be generated and sent via email !!!!!! (Doesn't seem that long but if you compare to others who have been through recenlty, its approximately 10days overdue.) It also took a phone call every day, twice a day to the NVC. Each time I got a different response from the operator.

But its here and we have already paid the AOS Bill - now just waiting for the Status to change to PAID!!!!

Yippee...it looks like it is finally moving along!!!!!
