^^Yes - technically we are supposed to get it transcribed by a Civil Surgeon to form I-693 - but many Canadians get away with just sending the sheet they gave us at the medical.

ok good to know, thank yhou for the list, guess i got lazy thinking all i needed was all these forms.

one more quick question, i noticed your cover letter has some things listed twice such as marriage certificat and copy of passport? do you HAVE to put more then one copy of each or can i just assume that they will copy it if they need another copy of it

I wouldn't assume anything when it comes to this stuff, LOL they won't copy it for you. May as well make a few extra copies to be on the safe side, since you're making copies anyway

ok thank you, i just wasn't sure what i needed to go with each form

Has she said what her residency status is?

I'm confused about what a pregnancy outside of marriage has to do with USCIS and her citizenship application.

Somone help me!!!!!!

Hasn't said from what I can see. But I think to answer her question for everyone, I don't believe your pregnancy has anything to do with immigration in any way, they really aren't looking at that, especially if your husband is not going to divorce you for it or anything like that.

hmm well thats a mess, but, how are you applying for citizenship, have you gone through any other immigration process? if so, why would you not finish the process? unless your wanting to move back to wherever you came from?

US Citizenship General DiscussionN-400 Interview

Hello everyone,
I applied for my citizenship at the end of november 2011 here in Nashville TN.
I filled it through my lawyer and he filled out all the information for me.
Right before christmas i got a receipt notice and a few days later my fingerprint notice.
I went for my fingerprint appointment on january 18th and three days later got my interview/test letter. also they sent a yellow letter to my lawyer.
Here's my Story:
I got my Green Card based on marriage, we lived together for almost 5 years and then, due to my crazy work schedule and lots of traveling , we went apart. but never got divorced.
I applied for my citizenship based on being a permanent resident for over 5 years.
I enlisted in the Army National Guard and was in the delayed entry program. After going to drills for 5 months, I got put on anxiety medication and got discharged with an Y "uncaregorized discharge" for medical reasons. however i never even went to basic training. They never gave me a DD-214 but i have a package explaining my discharge they which they sent me.
___________

Now here's my problem:
On January 10th I moved to a diferent location. Knowing that I had 10 days to update my address, I didn't do it right away.
but on January 13th an officer who identified himself as beinf from USCIS knocked at my old address and spoke with the new tenants. The new tenants said that he asked about me. they replied: He moved! Officer asked, to where? They replied: Downtown nashville. They also said that the officer asked questions like: How long have you known him, how long has he lived here and took notes of it.

As soon as this happened, the tenants called me and I went straight to my lawyer. He thinks i may be under investigation!
Others, told me that sometimes this is precedure! A friend of mine said they also went to her house in PA about a month after she applied for her citizzenship.
My lawyer sent an email to the USCIS office in Memphis and nobody responded.
I went to my firngerprint apointment, nobody said anything. a few days later got my Interview letter...
...NOW I am freaking out about the interview!!!
what could it happen? Has Anyone here ever heard of any case like this?
Do you all think if anything could have gone wrong, They would have came looking for me by now? I updated my address the day that this all happened, and when i went to my firngerptrint appointment , it was already showing in the system.

I can't sleep over this, and the closer i get to my interview date, the more nervous and anxious I get.
Thank you all so much!

I haven't been through this process yet or anything, and someone correct me if im wrong, but i think i read in other forums that it is standard procedure to have completely random home visits from IO when your trying to become a citizen, not everyone gets them but its pretty normal.

I am Canadian and my fiance is the USC, when i met my fiance he was still married but had been seperated for 4 years and they just stayed married cause their insurance was cheaper that way and when we met and decided to meet was when they started looking into the divorce. Their divorce did not go through until April 24th 2008, and we filed our I-129f in may, is this going to look bad on us, or cause any problems with paper work or the interview? i just want to be ready for whatever comes up.

I am not sure if it is all 3 years or if just the last year is now sufficient. The easiest thing he can do is to order the actual tax transcripts from the IRS for the relevant years - that way he doesn't have to include all of the extra attachments like W-2s (equivalent of T-4s). They are available for free and he can order them online. No, a letter won't be sufficient - it actually has to be a copy of the tax return or the transcripts.

When you receive your package from the Consulate they will include the I-134 form and instructions that should have everything you need. You can, however, find the I-134 form online and check over the instructions yourself to see what is required. Here is a link to the form: http://www.uscis.gov.../form/I-134.pdf . I know I wanted to have as much prepared before hand as well. Good luck.

I have looked at the I-134 and from what i read i didn't see anything about tax forms at all, the other question i had about this is, at least one of the years my fiance was in school and not working so what happened was his wife at the time claimed him as a dependent, not that he was really but that waas just the best way for them, does that matter? i mean now he is making enough to support me and thats all that matters right?

It does say on the instructions to the I-134 that you require a letter from his/her employer, and if self employed a copy of the LAST income tax return filed so I only got Glen's last W-2 and also his employer letter, I think that's fine... well I HOPE it is, since my interview is in 2 days tongue_ss.gif

ok so i should be good with a statement from the bank, letter from employer and last years income tax statement, i dont even have an approved i129 lol im just on question overload

Oh yes, that should be fine. I know how you feel, when I started this whole process I went crazy with questions, luckily all the wonderful helpful friends on VJ helped me get through the process!!

You will need to bring the tax information and the pay stuff info. The purpose is to ensure that he has sufficient income to ensure you won't become a burden upon the US social systems (such as they are whistling.gif ). While the tax income is going to show joint income with his wife, the letter from his employer and his current paystubs will show his income only. I believe you will also need a letter from his bank verifying his account information.

thank you kathryn thats what i needed to know, do you know if its 3 years of tax info i need to take? and i dont know what they have have down there but is it just like a letter from each year with the info or do i have to get ALL the tax papers lol thats alot to mail, and thank you i will remember the bank letter too

I believe the correct process for you, seeing as you are already in the US and married, would be to apply for AOS right away, this would be the I-485 form and you can find all the related forms here http://www.visajourn...p;page=examples

this will get you a work permit and eventually your green card, im sure others will add more for you, but that gives you some place to start welcome to vj biggrin.gif

Ok, so i have a couple questions about the I-134 i guess.

My fiance is starting a new job next week, which is really good, but he really wants to go to school in november, he got approved for a respatory therapy program and now is having a really hard time deciding between starting this new job or staying with his job he has now and going to school in november which is what he really wants to do, its a hard decision, and i told him that if he went to school i'm not sure how good our chances are that we can prove he can support me, we dont have anyone to co sponsor and im just afraid that if i tell him to go to school (cause i want him to be able to do that) that we will get declined and i wont be able to get my visa.

anybody have any suggestions or know how it works if someone is in school how they can prove support? I just dont want to hold him back from doing that, but at the same time right now we just need to do whats best for the visa. sad.gif

Under those circumstances you would committing visa fraud. Knowingly entering the US on one visa status (visitor - even if it is as a Canadian who doesn't have a paper visa) with the intent of using that status to create circumstances that make you eligible to apply for a spousal based adjustment of status is not looked upon kindly at all. You are allowed to enter the US as a visitor. You are allowed to get married as a visitor. You are not allowed to enter with the intent of getting married and staying as a visitor. If your intent is to marry - and you have already stated your intent with the K-1 - then they would think you have got married to evade the immigration process, which in fact you have. If your AOS is denied on the grounds of adjustment from a visitor visa, there is no right of appeal. You have to leave the country, plus having an immigration fraud charge against you may make you inadmissible to the US for life. I am not sure if that is a waiverable offense or not, but believe that it is not. Yes, the wait is long and can be difficult but it is infinitely better than being charged with immigration fraud - that wait is forever.

You can certainly 'visit' for up to 6 months while you wait for your K-1 to be processed, but you would not be allowed to work and you would have to return to Canada making sure not to accrue any out of status time in the US. The second part of the K-1 needs to be done in Canada regardless. Your concern then would be ensuring you have sufficient evidence of ties to Canada so that the US border authorities would not think you an immigration risk and deny you entry for your visit.
