my interview is on jan 27th and i plan on leaving on the 7th of feb, will i have any problems getting my visa fast enough from montreal? from what i see it only takes a day or 2 to get it. also, im going to be driving across to buffalo and flying from there, is there anything i should know about the border crossing? im not taking any electronics or household goods, just books and personal items, will i have any problems with these? are there forms or anything i should have together in advance? and will the people driving me have any problems? and how long does it usually take to get accross the border when you drive? i would have to give enough time for all this in order to make my flight in time, also, is there a limit on how much money i can take across with me? i planned on taking my money out of my bank account here and carrying it accross with me

No limit on the money you can take with you.

You shouldn't have a problem getting the visa within 10 days, haven't heard of many where it has taken that long. A few people have managed to pick up their visa lately in Montreal - you can ask the CO after your interview about that.

No problem taking your personal items.

If you are taking more than 2 or three boxes - number the boxes and have an itemized list. Box 1, books and CD's - Box 2 - clothing.

How long it takes to get across the border depends on how busy the border is when you get there and how experienced the border person is who gets stuck processing your visa laughing.gif - figure at least an hour, which border crossing will you be using?

i will be sure and number and list everything thank you for that, i wont be able to pick it up in montreal so im hoping this mailing thing they do is fast too smile.gif im not sure of the border, i guess i would cross at niagra falls to get to buffalo? is that right? its been a long time since ive been down that way but i think thtas right,

Hi There,

I asked the same question, and the lovely Kathryn answered, I cut and paste what she said:

"Just to clarify - if you are a K-1, then you write 'Yes" under alien authorized to work on the SSN form. The classification IS work authorized, however, work is only permitted if you ALSO have physical proof from USCIS such as the stamp or the EAD. It means you are allowed to apply for proof of work eligibility. If you write "No", your SSN will be denied as it is available for work authorized individuals only. Make sure you get it as soon as you can after you arrive - the longer you wait the more hassles you encounter and time runs out 2 weeks before your I-94 date."

I did what she said and it was all good!

my poe didn't give me the stamp though, is that going to be a problem? i just dont know what all i need to have i have my birth certificate my passport with I-94 and visa in it and my marriage lisence but is that enough? do i HAVE to have that stamp?

I didn't get a stamp either.... I just showed the lady at the SSN office my passport with K-1/I-94 inside, she didn't ask to see anything else even though I brought my marriage cert with me....

ok thank you, ive checked able to work and hope everything goes smooth smile.gif

The only thing they absolutely require, per the instructions, is a tax return (or transcript) from the most recent year. Sometimes, though, people will get RFEs for different things that will help them prove they have enough resources to qualify (usually the pay stubs, which you have already said you have). What we did was send a copy of the employer letter my boss wrote for me when we interviewed for the K1 (to show that this is a permanent position), 6 months of pay stubs, and my 2007 tax return. This was enough. If you have an employer letter, it will show them that your husband's job is a secure permanent position. I'd definitely send the copies of the paystubs since you already have them.

One other thing---in case you don't know this yet---if you send a copy of his return, you must also send copies of his W2, any schedules and 1099s that show the income reported. I realize you are young and may not have much of that, but he could have a 1099 from the bank just showing a small amount of interest on a savings account. If so, send a copy. If you order a tax transcript from the IRS (which is free, but I do not know how long it takes to receive), you do not have to send that.

thank you very much, i would think he does have all that, hes not quite as young as me tongue.gif we should be able to scrape all that up and we dont need a NEW letter from the employer they accepted the old one from the interview?

Per instructions on the I-864:

"You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years."

He needs to put his individual income on part 25 - then he will send his W2's - or whatever slips he has - to support those numbers.

Yes married within 90 days, but it is often posted on here you should file AOS before your I-94 expires because you are technically out of status. Not to mention, if there is an emergency you cannot go home, etc.

not so much worried about going home for any reason, im just worried about being denied, is there any reason i would have problems with my aos if i wait past the date my I94 expires?

Probably no. But filing asap will also (in addition to not being out of status and unable to travel) give you the opportunity to file for EAD at the same time. If, as I understand, money is tight... this maybe a reason good enough to file right now...

ya it is tight, to the point that we dont have the money to file right now, thats why i wanted to make sure we would be ok filing later. thank you

They separate the three files when it gets there, so I would include a copy of each to each form you are filling out.

where did you find what needs to be included with each form, im still having problems finding it, im going by your cover letter here but i want to be sure not to miss anything important, also, is it 1010 or 1012? i though 1012 but just checking

$1010

If you go to USCIS.gov and look at the forms, each form has a set of instructions. I went by that, along with reading the guides here on VJ to double check everything

thanks jilla, your alot of help, looks like you did your homework tongue.gif whats this though A copy of a Federal Government-issued identity document which includes my Visa issued by a foreign consulate is that just another copy of my visa page in my passport?
